The MEPA review identified three principal issues: the proposed alteration of salt march; timing of the project in relation to repair and replacement of city sewers; and testing and disposal of dredged material. I. SALT MARSH The proposed dredge area is fringed on both sides by salt marsh. At the con- sultation session the Salem Conservation Commission proposed transplanting of the salt marsh to a location downstream of the swim area. However, replacement of salt marsh can only ba authorized by a variance to the Coastal Wetlands Regulations. Should the Conservation Commission decide to pursue this course of action, preparation of an EIR would be reuired, prior to the granting of a variance, to set forth the "e need and justification for the proposed alteration. If, on the other hand, the salt marsh is clearly delineated as part of the Order of Conditions and carefully avoided during dredging and construction, the project may proceed without preparation of an EIR. It is our understanding that this course is currently planned, and that is the basis of this decision. FORM B Page 2 V w/comments #4606 Pickman Pk. II. TIMING IN RELATION TO SEWER PROEJCTS Repairs to the Moffat Road sewer, accomplished in fall of 1981, resulted in significant lowering of coliform levels in the Forest River. This reduction has been demonstrated by a sampling program performed by the Salem Board of Health. Repair of the Loring Avenue trunk sewer is scheduled for June 1983. In a discussion concern- ing the timing of the two projects at the consultation session, the proponent and Mr. Anthony Fletcher, the City Engineer, agreed on the following construction sequence. 1. Dredging of the swim area and construction of the retaining wall will precede sewer construction. 2. Sewer excavation and repair will take place in June 1983. 3. Clean sand will be placed in the swim area after completion of sewer construction. It is desirable for repair of the Loring Avenue intercepter to precede refurbish- ment of the swim area in order to minimize degradation of water quality. III. TESTING AND DISPOSITION OF DREDGED MATERIAL Sediment sampling results provided in the ENF indicate high levels of oil and grease at both sampling locations (1,275 mg/Kg and 6,820 mg/Kg) . PCBs are frequently associated with such levels of oil and grease. Based on the sampling results and on discussions with the DEQE Northeast Regional Office and the Division of Water Pollution Control, I request the proponent to run an analysis for PCBs prior to com- mencing the project. The sample for the PCB analysis should be taken in the area of the worst-case oil and grease sample and run for the entire 6-inch dredging depth. Based upon results of the PCB analysis, a suitable site for disposal of dredge spoils should be identified. In addition, the proponent should specify the location and method for dewatering. The dewatering method should provide for diversion of the dewatering effluent away from salt marsh areas. The above issues and others identified in the appended comments from W. Sterling Wall and Sabin M. Lord, Jr. , DEQE Northeast Regional Office, must be addressed in the Order of Conditions in a manner satisfactoryr to the DEOE. February 23, 1983 DATE � S S. Bos/NERD DEOE SUBJECT: Pickman Park Swim Area Restoration - ENF DATE: January 6, 1982 The Wetlands Division of the Met.-Boston/Northeast Regional Office of the Department of Environmental Quality Engineering has been requested to review the ENF for the above-referenced project for adverse effects to coastal resource areas and the public interests protected by the Wetlands Protection Act. The site is subject to the jurisdiction of the Act as Tidal River, Coastal Bank, Saltmarsh and Coastal Beach. The work is regulatable activity and includes 1. dredging 800 cy. , an average of .5 feet of material from the river bed; 2. disposal of dredge material; and 3. filling with an average of .5 feet of clean sand on the river bottom. The swim area is presently not used because of sewer system exfiltration that pollutes the water with fecal coliform concentrations in excess of water quality standards for recreatioo�l use. The upgrading of this area is desireable, but should not be completed before phase 5 of the Loring Avenue Interceptor in Salem is completed. This work should be done by the Fall of 1984 and will prevent exfiltration to the swim area and allow for its unrestricted use. The dredge project should be rescheduled to allow for this change in completion date. The Solid Waste Section of the DEQE NERO has reviewed this proposal for its dredge materials disposal options. It is the opinion of this office that the fine grained (silts and clays) dredge materials should be disposed of at the Peabody landfill as proposed. These materials should be disposed of as daily fill in the landfill, definitely not as intermediate or daily cover. Any sand from the beach area may be retained on-site. Additionally, there are problems with saltmarsh vegetation that has grown up along the banks while the area has been in use as a swim area. The Act is specific about impacts to saltmarsh and prohibits destruction of or diminishment of marsh bioproductivity when the saltmarsh is significant to the interests of the Act. Therefore, the applicant musCidentify where there is saltmarsh as defined by the Act within the dredge footprint and because it is significant to the Act, should not be dredged. _ RE: Memo - Pickman Park Restoration -ENF Page 2 - - - - There is also concern fot existing significant saltmarsh upstream and downstream of the site. The project locus is adjacent to residential area and within a park where both active and passive recreational pursuits are available. The purpose of this project is to provide a swimming and bathing area. As delineated on the project specifications and pointed out at the scoping session, there is saltmarsh fringing both sides of the river bed. As discussed at the scoping session, the Salem Conservation Commission would prefer transplanting the saltmarsh downriver. Their reason is based on potential foot traffic in and around the saltmarsh which could lead to the destruction of the marsh. A decision to transplant can only be reached after the wetlands variance procedure. This process is a time consuming one. The decision to allow the saltmarsh move would result in valuing the public benefits of swimming and bathing over the benefits of saltmarsh preservation, which we would oppose. For these reasons, CZM feels that the saltmarsh should stay in place and be carefully avoided when dredging the river bed. The saltmarsh can also be avoided by bathers and waders. The use of the park will not be as intensive as public beaches but, will primarily serve the residents of the immediate area. Signs can and should be posted to discourage foot traffic on the marsh portions. In regards to high fecal coliform counts due to exfiltration problems, the public works officials stated the problems were rectified. CZM suggests testing the water quality after the dredging is complete and before the clean sediments are placed on the river bed. The project consists of dredging the Pickman Park swim area and placing clean sand along the bottom of the Forest River; in addition, a concrete retaining wall near the swimming area would be replaced. While the Council agrees that the proposed improvements would bepositive for the park, there are several important items of information which do not appear in the Environmental Notification Form. In Section III C.3, the Form does not describe the project area as being adjacent to or including salt water marshes. The possible disruption or impacts on this marsh should be more fully discussed. In Section III D. 1, it is mentioned that the sludge to be dredged from the river bed has potentially hazardous levels of lead and cadmium. There is no specific information about the handling of this material beyond a statement that it will be "transported to a nearby landfill" . A permit from the local Board of Health may be necessary for permission to-place lead- and cadmium-bearing sludges (these are considered "special wastes") in a town landfill . The specific town being considered should be identified and the permit from the local board of health added to the list of permits in Section I .G. The material attached documenting sludge contamination does not specify the type of testing method used or whether the readings given are dry weight or wet weight, making assessment of the hazard difficult. Methods for safely handling this material may need to be more clearly described. In addition to these concerns , the MAPC representative from Salem has pointed out that there are ongoing sewerage improvements taking place in the town, and steps should be taken to prevent recontami.na"tion of the Pickman Park area and a waste of the proposed improvements. In an effort to maintain improvements to the beach area brought about by the restoration project, the City of Salem proposes to replace a small amount of silted material that has accumulated along the bottom of the swim area with a layer of clean sand. Bos/NERD DEQE � SUBJECT: Pickman Park Swim Area Restoration - ENF DATE: January 6, 1982 The Wetlands Division of the Met.-Boston/Northeast Regional Office of the Department of Environmental Quality Engineering has been requested to review the ENF for the above-referenced project for adverse effects to coastal resource areas and the public interests protected by the Wetlands Protection Act. The site is subject to the jurisdiction of the Act as Tidal River, Coastal Bank, Saltmarsh and Coastal Beach. The work is regulatable activity and includes 1. dredging 800 cy. , an average of .5 feet of material from the river bed; 2. disposal of dredge material; and 3. filling with an average of .5 feet of clean sand on the river bottom. • The swim area is presently not used because of sewer system exfiltration that pollutes the water with fecal coliform concentrations in excess of water quality standards for recreation'sl use. The upgrading of this area is desireable, but should not be completed before phase 5 of the Loring Avenue Interceptor in Salem is completed. This work should be done by the Fall of 1984 and will prevent exfiltration to the swim area and allow for its unrestricted use. The dredge project should be rescheduled to allow for this change in completion date. The Solid Waste Section of the DEQE NERO has reviewed this proposal for its dredge materials disposal options. It is the opinion of this office that the fine grained (silts and clays) dredge materials should be disposed of at the Peabody landfill as proposed. These materials should be disposed of as daily fill in the landfill, definitely not as intermediate or daily cover. Any sand from the beach area may be retained on-site. Additionally, there are problems with saltmarsh vegetation that has grown up along the banks while the area has been in use as a swim area. The Act is specific about impacts to saltmarsh and prohibits destruction of or diminishment of marsh bioproductivity when the saltmarsh is significant to the interests of the Act. Therefore, the applicant must identify where there is saltmarsh as defined by the Act within the dredge footprint and because it is significant to the Act, should not be dredged.
