has requested a permit under:
(X ) Section 10 of the River and Harbor Act of 1899.
(X ) Section 404 of the Clean Water Act.
( ) Section 103 of .the Marine Protection, Research and
Sanctuaries Actof 1972.
to: Place approximately 855 cubic yards of fill below mean high water
in conjunction with the replacement of a damaged timber bulkhead with
steel sheet piling and construction of a concrete retaining wall in
Salem Harbor at Salem, Massachusetts as shown in the attached plans.
The steel sheet piling will be driven approximately 30' seaward of the
existing bulkhead. This will be done at the request of the Salem
Engineering Department as vibrations from pile driving could cause
damage to an existing 24' sewer line and an existing building. The
area behind the piling will be backfilled with granular material.
Work will also include the replacement of a marine railway with a
pile and timber pier and floats. This system will extend 150' seaward
of the proposed bulkhead.
In order to properly evaluate the proposal, we are seeking public
comment. Anyone wishing to comment is encouraged to do so. Comments
should be submitted to us in writing by 14 September 1981. If you

The evaluation of the impact of the activity on the public interest will
-elan Include application of the guidelines promulgated by the Administrator,
U.S. Environmental Protection Agency, under authority of: Section 404(b)
of the Clean Water Act., and/or Section 102(a) of the Marine Protections
Research and Sanctuaries Act of 1972 as amended.
Based on experience with similar activities performed in the past, the Division
Engineer has made a preliminary determination that an Environmental Impact
Statement is not required under provisions of the National Environmental
Policy Act of 1969. -
Eased on his initial review, the Division Engineer has determined chat little -
likelihood exists for the proposed work to impinge upon properties listed in
or eligible for listing in the National Register of Historic Places and no
further consideration of the requirements of the Preservation of Historical
and Archeological Data Act of 1974 is necessary. This determination is based _
on one or more of the following:
a. The permit area has been extensively modified by previous work.
b. The permit area has been recently created.,
c. The proposed activity is of limitednature-and scope.
d. Review of the latest published version of the National Register shows
that no presence of registered properties or properties listed as being
eligible for inclusion therein are in the permit area or general vicinity.
Presently unknown archeological, scientific, pre-historic or historical
data may be lost or destroyed by work to be accompits had under the requested
permit.
The Division.Engineer-has also consulted- the latest published version
of threatened or endangeredspecies and made a-preliminary determination
that the proposed activity will not affect those listed or their critical
habitat.
Evaluation of the proposed actvity will include conformance with appropriate
State or local floodplain protection standards; consideration of alternative
-sites and methods of accomplishments and weighing of the positive and negative,
concentrated and dispersed, and short-and long-term impacts upon floodplain. -
The initial determinations made herein will be reviewed in light of facts
submitted in response to this notice.
The following authorizations have been applied for or have been or will be
obtained: ' -
(X) Permit, License, or Assent from State.
(X) Permit from Local Wetlands Agency or Conservation Commission.
(X) Water Quality Certificate in Accordance with Section 401 of the
Clean Water Act. -
Massachusetts CZM consistency statement
The States of Maine, Massachusetts and Rhode Island have approved Coastal
Zone Management Programs. Where applicable, the applicant has stated that.
the proposed activity complies with and will he conducted in a manner that
is consistent with this approved Coastal Zone ttanegement Program. Issuance
of a State permit from the appropriate State agency will indicate concurrence
with this Statement of Consistency.
All comments will be considered a matter of public record. Copies of letters
of objection will be forwarded to the applicant who will normally be requested
to contact objectors directly in an effort to reach an understanding. -

On Thursday, July 1_ , 1981 , the Planning Board of the City of Salem held a public
hearing regarding tta application of Frederick J. Atkins Trust for a Special Permit
under Section P, W_tlands and Flood Hazard Districts , of the Salem Zoning Ordinance,
with respect to the zonstruction of steel sheet piling, concrete retaining wall, and a
timber pier, and to he addition of solid till at 23 Glendale Avenue, Salem, Massach-
usetts.
At a regularly scheduled meeting of the Planning Board on July 16 , 1981, the Board
voted, by a vote of six in favor, none opposed, to approve the application as complying
with the requiremems for the issuance of the permit with the following conditions:
1. That all work shall be done in accordance with the plan entitled "Site Detail Plan
in Salem,. Mass. for Frederick J. Atkins Trust" prepared by T & M Engineering
Associates , 36 Orchard Circle, Swampscott.
9 . The issuance of this permit is contingent on the approval of the Conservation
Commission and incorporates their Order of Conditions .
3. This order does not grant any property rights or any exclusive privileges; it does
not authorize any injury to private/public property or any invasion of public/
private rights.
I hereby certify that a copy of this decision has been tiled with the City Clerk, and
a copy is on file wish the Planning Board.
This Special Permit shall not take effect until a copy of the decision bearing the
certification of the amity Clerk that twenty days have elapsed and no appeal has been
filed or that it such appeal has been filed, and it has been dismissed or denied, is
recorded In the Essex County Registry of Deeds and is indexed in the grantor index
under the name of t-e owner of record or is recorded and noted on the owner's
certificate of title. The fee for recording or registering shall be paid by the owner
or applicant.

2. This order does not grant any property rights or any exclu-
sive privileges; it does not authorize any injury to private
property or invasion of private rights.
3. This order does not relieve the permittee or any other per-
son of the necessity of complying with all other applicable
federal, state or local statutes; ordinances, by-laws and/
or regulations.
4. The work authorized hereunder shall be completed within one
(1) year from the date of this order unless it is for a
maintenance dredging project subject to Section 5(9) . The
order may be extended by the issuing authority for one or
more additional one-year periods upon application to the
said issuing authority at least thirty (30) days prior to
the expiration date of the order or its extension.

5. Any fill used in connection with this project shall be clean
fill, containing no trash, refuse, rubbish or debris, includ-
ing, without limiting the generality of the foregoing, lumber,
bricks, plaster, wire, lath, paper, cardboard, pipe, tires,
ashes, refrigerators, motor vehicles or parts of any of the
foregoing.
6. No work may be commenced untill all appeal periods have,.-
elapsed from the order of the=Conservation Commission or.-from
a final order by the Department of Environmental Quality
Engineering.
7. No work shall be undertaken until the final order, with
respect to the proposed project, has been recorded in the
Registry of Deeds for the district in which the land is
located within the chain of title of the affected property.
The Document number indicating such recording shall be sub-
mitred on the form at the end of this order to the issuer
of this order prior to commencement of work.
8. A sign shall be displayed at the site not less than two
square feet or more than three square feet bearing the
words, "Massachusetts Department of Environmental Quality
Engineering, Number 64-80
9. Where the Department of Environmental Quality Engineering
is requested to make a deter-urination and to issue a super-
seding order, the Conservation Commission shall be a party
to all agency proceedings and hearings before the Depart-
ment.

10. Upon completion of the work described herein, the applicant
shall forthwith request, in writing, that a Certificate of
Compliance be issued stating that the work has been satin
. factorily completed.
11. The work shall conform to the following described plans and

The Conservation -Commission has determined that the projected
work is . significant to storm damage prevention and issues the .
following order of conditions :
1. Except as modified by this .order of conditions , all work
shall be done in conformance with the following plans :
a. Site Detail Plan in Salem,, Mass . for Frederick J.
Atkins Trust, 22 Willow Ave. , Salem, MA. , T & M Associates.

2. The retaining wall and the sheet piling bulkhead shall
have weep holes at four foot , centers near the base of the
structures .
3. No material or equipment shall remain seaward of the
bulkhead or the retaining wall following construction.
4. All fill shall be granular as noted in submitted plans ,
5. Plans. shall be amended to define the elevation datum;
this shall be done prior to the start of construction and a
copy shall be sent to the Commission and to the Department, of

federal, state or local statutes; ordinances, by-laws and/
or regulations.
4. The work authorized hereunder shall be completed within one
(1) year from the date of this order unless it is for a
maintenance dredging project subject to Section 5(9) . The
order may be extended by the issuing authority for one or
more additional one-year periods upon application to the
said issuing authority at least thirty (30) days prior to
the expiration date of the order or its extension.
5. Any fill used in connection with this project shall be clean -
fill, containing no trash, refuse, rubbish or debris, includ-
ing, without limiting the generality of the foregoing, lumber,
bricks, plaster, wire, lath, paper, cardboard, pipe, tires,
ashes, refrigerators, motor vehicles or parts of any of the
foregoing.
6. No work may be commenced untill all appeal periods have C
elapsed from the order of the=Conservation Commission or from
a final order by the Department of Environmental Quality
Engineering.
7. No work shall be undertaken until the final order, with
respect to the proposed project, has been recorded in the
Registry of Deeds for the district in which the land is
located within the chain of title of the affected property.
The Document number indicating such recording shall be sub-
mitted on the form at the end of this order to the issuer
of this order prior to commencement of work.
8. A sign shall be displayed at the site not less than two
square feet or more than three square feet bearing the
words, "Massachusetts Deartment of Environmental Quality
Engineering, Number 64- Q'S,
9. Where the Department of Environmental Quality Engineering
is requested to make a determination and to issue a super-
seding order, the Conservation Com-fission shall be a party
to all agency proceedings and hearings before the Depart-
ment.

10. Upon completion of the work described herein, the applicant
shall forthwith request, in writing, that a Certificate of
Compliance be issued stating that the work has been satis—
factorily completed.

The Conservation Commission has determined that the projected
work is significant to storm damage prevention and issues the ,
following order of conditions :

2. The retaining wall and the sheet piling bulkhead shall
have weep holes at four foot centers near the base of the
structures .

bulkhead or the retaining wall following construction.
4. .All fill shall be granular as noted in submitted plans .
5. Flans. shall be amended to define the elevation datum;
this shall be done prior to the start of construction and a
copy shall be sent to the Commission and 'to thQ� Depart inent of

On Thursday, July 16, 1981, the Planning Board of the City of Salem held a public
hearing regarding the application of Frederick J. Atkins Trust for a Special Permit
under Section P, Wetlands and Flood Hazard Districts , of the Salem Zoning Ordinance,
with respect to the construction of steel sheet piling, concrete retaining wall, and a
timber pier, and to the addition of solid till at 23 Glendale Avenue, Salem, Massach-
usetts.
At a regularly scheduled meeting of the Planning Board on July 16 , 1981, the Board
voted, by a vote of six in favor, none opposed, to approve the application as complying
with the requirements for the issuance of the permit with the following conditions:
1. That all work shall be done in accordance with the plan entitted "Site Detail Plan
in Salem,. Mass. for Frederick J. Atkins Trust" prepared by T & M Engineering
Associates , 36 Orchard Circle, Swampscott.
�. The issuance of this permit is contingent on the approval of the Conservation
Commission and incorporates their Order of Conditions.
3. This order does not grant any property rights or any exclusive privileges; it does
not authorize any injury to private/public property or any invasion of public/
private rights .
I hereby certify that a copy of this decision has been tiled with the City Clerk, and
a copy is on file with the Planning Board.
This Special Permit shall not take effect until a copy of the decision bearing the
certification of the City Clerk that twenty days have elapsed and no appeal has been
filed or that if such appeal has been filed, and it has been dismissed or denied, is
recorded in the Essex County Registry of Deeds and is indexed in the grantor index
under the name of the owner of record or is recorded and noted on the owner's
certificate of title. The fee for recording or registering shall be paid by the owner
or applicant.

Place approximately 855 cubic yards of fill below mean high water in
conjunction with the replacement of a damaged timber bulkhead with steel
sheet piling and construction of a concrete retaining wall in Salem Harbor
at Salem, Massachusetts as shown in the attached plans. The steel sheet
piling will be driven approximately 30' seaward of the existing bulkhead.
This will be done at the request of the Salem Engineering Department as
vibrations from pile driving could cause damage to an existing 24, sewer
line and an existing building. The area behind the piling will be backfilled
with granular material. Work will also include the replacement of a marine
railway with a pile and timber pier and floats. This system will extend
150' seaward of the proposed bulkhead.

Dear Mayor Levesque,
I would like to indicate to you the City of Salem' s strong
support for the referenced project.
Dion' s Yacht Yard is a family owned business which has been
operated successfully in Salem since 1914 . Both in the past and
at the present time the yard has been an important asset to the
commercial and recreational marine community. In view of the
increasing interest in boating activity and in particular the
City of Salem' s substantial efforts at revitalization of its
waterfront, we feel that Dion' s fills an important need to the
community.
Our examination of the plans of proposed work and the Salem
Harbormaster' s on site inspection, leads us to the conclusion
that the work is vital to the maintenance of the facility which
was severely damaged in the blizzard of 1978 and subsequent storms.
The proposed work will have no adverse impact on the adjacent
area and in fact will add additional protection to an adjacent
beach and seawall.

Chapter 131, Section 40, at the request of Fred Atkins, 23 Glendale
Street, Salem, Ma. The purpose of the hearing is to explore the effects
of replacing timber sheet piling with steel piling to place solid fill and
to construct timber pier in place of existing marina railway. The hearing

At .the Conservation Commission meeting of December 10, 1982
the Commission voted to approve a revised plan for work in a Flood
Hazard area at Dion's Boatyard, Glendale Street in Salem. This
work was originally covered under an Order of Conditions (File 1664-78)
issued by the Commission July 31, 1981. The only change in the
revised plans concerned the amount of fill being used for the
- project. The revised plan calls for the fill line to be brought back.

Dear Mr. Bewick:
I am in receipt of your determination pertaining to this project and am pleased
that your determination does not require an Environmental Impact Report.
I am very displeased however at the actions taken by the representatives of Coastal
Zone Management. The concerns, to minimize adverse effects on marine fisheries caused
by: (a) Alterations in water circulation. . . . . (b) Changes in water quality. . . . . (c) Marine
flats. . . . .are not valid. There is absolutely no established fact that a "marine fishery"
exists here. The area has long been the location for this and other boat yards, and
several natural street drains enter into the area. The yard is also the site of the South
Salem sewer trunk line, and in fact, a section, on piles, traverses the west anchorage.
CZM does not take into consideration the exposure of this site, and the potential wave
damage by a Northeast or Northwest storm, to the land area, buildings and docks. Any
such damage exposes the trunk line, which runs under the building and a portion of the
dock, to complete disaster. Rupture of this trunk will absolutely do extensive damage
to the marine environment. One only has to review the damage incurred during the winter
of 1978, in which wave action removed huge amounts of earth 30'-40' behind sea walls, in
like locations in Salem Harbor.
As City Engineer, I requested the Salem Conservation Commission to approve the design
for its support of our main.

I feel CZM is entering the design business without addressing our concerns and ,
their negative impact on approval of this project should be removed in the best interests
of the City and the owner. Delay of this project further increases our exposure to damage
and I ask you take immediate action. `

Although no impact report has been required, the proponent should be

or modification to narrower fill area appear necessary before CZM can

MCZM began a federal consistency review of the Corps of Engineers permits
required for this fill proposal on August 24, 1981 after receiving a
consistency certification from the applicant. Since the proposal calls for
filling in some 4500 square feet of intertidal habitat and displacing, 800 to
1000 cubic yards of the foreshore, we feel that a careful examination of
alternatives to the proposal is called for. Regulatory incentive to examine
such alternatives is found in the Coastal Wetlands regulatory standard for
coastal beaches and tidal flats calling for use of the best available measures
to "mininize adverse effects on marine fisheries caused by: (a) alterations in
water circulation. . . (b) changes in water quality. . ." (Section 27(6) . We
believe that tidal flats, such as those at the site, are significant to marine
fisheries in that they provide habitat for a wide variety of organisms that are
important in the marine food chain. Similar incentive to a search for alternatives
is found in Sections 23 (4) (d) and 23 (2) of the Waterways Regulations which
describe the criteria for tidal flats and the procedure to follow when an applicant
for a Waterways license already has received an unappealed Wetlands Order of
Conditions.
We feel that the phrase "minimize adverse effect" should be interpreted to
allow for stabilization of the existing eroding bank and protection of the
existing building by using the best available engineering measures that will also
act to minimize the area of fill required.
After considerable thought and discussion we have developed two alternative
proposals that more nearly satisfy the minimize adverse effect standard:
1) Minimize the horizontal distance between the proposed and existing
bulkheads by placing the timber tie-back pile as close to the existing
old bulkhead as possible and using the shortest possible tie rod to
connect the pile to the new bulkhead.
2) Use rock rip-rap placed against the existing bulkhead being careful
to install appropriate filter layers between the rip-rap and the old
bulkhead.
