MAIL NO: 945068 & 945069 City Hall, Salem, MA 01970 RE: NOTICE OF INTENT AND PLANS DATED: DATE 'OF RECEIPT BY DATE OF PUBLIC HEARING: 9/3/75 CONSERVATION COMMISSION: 8/21/75 Pursuant to the authority of G.L. c. 131 s. 4O, the Salem Conservation Commission has considered your notice of intent and plans submitted therewith, and has determined that the area on which the proposed work is to be done is significant to one or more of the interests described in the said act. The Salem Conservation Commission hereby orders that the following conditions are necessary and all work must be performed in strict conformance therewith : CONDITIONS 1. Failure to comply with all conditions stated herein, and with all related statutes and other regulatory measures, shall be deemed cause to revoke or modify this order. 2. This order does not grant any property rights or any exclusive privileges; it does not authorize any injury to private property or invasion of private rights. 3. This order does not relieve the permittee or any other person of the necessity of complying with all other applicable federal, state, or local statutes, ordinances, by-laws and/or regulations. 4. The work authorized hereunder shall be completed within one (1) year from the date of this order. The order may be extended by the issuing authority for one or more additional one-year periods upon application to the said issuing authority at least thirty days prior to the expiration date of the order or its extension. 5. Any fill used in connection with this project shall be clean fill, containing no trash, refuse, rubbish or debris, including, without limiting the genera.lity .of the foregoing, lumber, bricks, plaster, wire, lath, paper, cardboard, pipe, . tires, ashes, refrigerators, motor vehicles or parts of any of the foregoing. 6. No work may be commenced until all appeal periods have elapsed from the order of the Conservation Commission or from a final order by the Department of Natural Resources has elapsed. No work shall be undertaken until the final Order, with respect to the proposed project, has been recorded in the Registry of Deeds for the .district in which the land is located. Upon completion of the work described herein, the applicant shall forthwith request, in writing, that a Certificate of Compliance be issued stating that the work has been satisfactorily completed. 9. A sign shall be displayed at the site not less than two square feet or more than threesquare feet bearing the words, "Massachusetts Department of Natural Resources, File Number 64-6 " 10. Where the Department of Natural Resources is requested to make a determination and to issue a superseding order, the Conservation Commission shall be a party to all agency proceedings and hearings before the Department of Natural Resources. 11 . The work shall conform to the following described plans and additional. conditions : See attached sheets 2-A and 2-B Page 27A ----- File :No. 64-6 The wetlands considered in this order of conditions are located in the following locations referenced to the drawings of the City of Salem, Massachusetts Sewerage Improvements, Phase I - Contract B, date July, 1975 filed with the Salem Conservation Commission: Drawing No. 18, Sta. 0+00 to Sta. 7+00 " 19, Sta. i8+00 to Sta. 19+33 20, Sta. 0+00 to Sta. 4+60 Sta. 26+oo to Sta. 36+oo 23, Sta. 36+oo to sta. 46+oo 10, Sta. 23+00 to Sta. 25+00 " 11 , Sta. 25+00 to Sta. 36+81 " 24, sta. 0+00 to Sta. 2+00 GENERAL CONDITIONS All excavations in wetlands shall have the sod and at least the top one foot of soil removed and stockpiled so as not to block the flow of water. Upon installation of the pipe the backfill shall be completed by placing the stockpiled soil and sod on top of the backfill so as to be eventually at the elevation of the surrounding ground. Any sheeting remaining in the excavation shall be cut below the ground surface. . No materials or equipment shall be strewn on the wetlands during construction and all materials and equipment shall be removed immediately upon completion of the work. There shall be no decrease in the water storage capacity of any wetland. Excess excavation material shall not be disposed of on wetlands. All equipment shall be brought into the location of the work by using the same path so as to keep damage to the wetlands to a minimum. Any excavation within 100 feet from a wetland shall be made by removing and. stockpiling the sod and at least the top'one foot of soil so as not to block stream flow. Backfilling over the installed pipe shall be completed by re- placing the stockpiled soil and sod or by seeding. Flow and drainage channels and culverts shall be maintained during the construction of crossing sewer pipes. Following construction the drainage channel cross-section shall be at least returned to the profile existing prior to construction. SPECIFIC CONDITIONS Rosi A- Pond (Map 18, Sta. 0+00 to Sta. 7+00) The concern for loss of storage capacity in this marsh is based. on the fact that the marsh is a prime storage area in the South River Flood Control Project. It is stated on page 25 of the report on Flood Control Project for South Hiver by Camp, Dresser and McKee, Consulting Engineers, Boston, Massachusetts, for the Commonwealth of Massachusetts, Department of Public Works, Division of Waterways, that "We cannot overemphasize the point that it is imperative that no further encroachment be permitted on existing swamp storage". The berm • Page 27B ----- File No. 64-6 over the sewer pipe in Rosies Pond shall not be constructed unless com- pensatory flood water storage is made available in the marsh prior to construction or concurrent with construction of the berm. South River Conduit (New Derby Street Installation of the sewer pipe through the South River conduit is most unsatisfactory for flow in the conduit as the design forms a sediment trap and a location for potential clogging. A regular maintenance and monitoring program shall be enforced to keep the section clean. A report on the condition and maintenance work shall be submitted to the Conservation Commission each spring and fall. CONDITIONS CONTINUED PAGE 3 FILE. Fletcher, City Engineer City Hall Salem, .Ma . 01970 Reference: Sewerage Improvements Phase I - Progress Report Dear Mr, Fletcher: The following is an explanation of our current status of Salem's Phase 1 Sewerage ri£_] Improvements program. While significant progress has been made since our meeting of July 23, 1975 in regards to the various federal, state, and local agency require- ments to complete the design, there are continuing delays in some areas. Hopefully, this letter will satisfactorily delineate the items considered to present problems and aid in developing a methodology by which Salem and CE Maguire may effectively overcome these hurdles. 1) Division of Waterways - Four permits are required by Waterways for this project. The applications were submitted on September 9, 1975. In addition, an Environmental Assessment Form was submitted on the same date for the entire project. A public hearing must be held prior to approval of t the permit applications and should be routine. However, Mr. Mario Cinci, j Chief of Permits and Licensing, was unable to place us on the October 15 !'! docket and was unable to state when the hearing might occur. j 2) Conservation Commission - The Notice of Intent and Environmental Data 1 Form were submitted on August 21, 1975; the hearing held on September 3, and Order of Conditions issued on September 10. Due to the adverse ruling on the issue of fill at Rosie's Pond, actual construction may be delayed in this area. The options for dealing 'with this problem are: buying land on the shoreline and performing the dredging which requires another Commission hearing or amending the Order of Conditions through the Commission. In either case, CE Maguire recommends that the contractor not be made a party j to the action, and that the City Engineer's office satisfactorily resolve the j problem prior to,awarding the contract, j j i i i 1 _- Mr, Anthony V. Fletcher, City Engineer Salem, Ma. October 3, 1975 CEM #2273. 10 Page 2 3) Army Corps of Engineers - The Corps ruled in early July that one permit would be required. This application was submitted on July 22, 1975. In late July Federal legislation increased the jurisdiction of the Corps to include wetlands adjacent to affected waterways. CE Maguire was made aware of this situation September 29, 1975, and is presently modifying the application. Resubmittal will be before October 8. The Corps then requsres a 30-day comment period. If no adverse comments are received the permit is approved. A hearing may be required if the Corps receives a sufficient number of negative assessments, This will not delay State and Federal review, but the project cannot be advertised until it is resolved. 4) B&M Railroad - Due to delays in obtaining insurance required by the B&M, the boring contractor was unable to complete the required borings and probes at the site of the railroad crossing until September 15, 1975. Final design was submitted to the B&M on September 25. There may be a long delay in approval of this design since the B&M is currently conducting a rather extensive property evaluation at present due to the December 31 MBTA acquisition of these tracks. The approval must come through Mr. H. B. Berkshire in Billerica. 5) Metropolitan Area Planning Council - A copy of the Notification of Intent was submitted on July 22 and a favorable reply received August 22. However, a review of the final application is required. This should not delay the project. Mr. Greg Senko, as the MAPC representative, should be able to assist in this aspect. 6) Office of State Planning and Management - The Notification of Intent was submitted to the OSPM on July 22. A favorable reply along with the A-95 identifier was received on September 9. No further action is required in this area. 7) Salem State Legislation - In speaking to Dean Marrs of Salem State,and Mr. Joseph Glynn of the Bureau of Building Construction, it appears as though State participation will be through complete reimbursement beyond the Federal Grant of 75 percent for this project directly to the City for all construction and design fees. CE Maguire has prepared the specifications as though there will be participation through a Federal Grant. The contract should be between either the BBC or the College Trustees and the City with reimbursement to CE Maguire by the City. This matter must be resolved by the City prior to advertisement. We will of course continue to assist the City in this matter in any way possible. Mr: Anthony.V. Fletcher, City Engineer Salem, Mo. October 3, 1975 CEM #2273. 10 Page 3 8) Plans and Specifications - Both these areas have been deloyed.by the constraints imposed by all of the above items, i .e., requirements of the various licensing and legislative procedures. Neither of these can be submitted for final State approval until such time as all permits and licenses have been obtained and.the legislative word change passed. A further constraint is the necessity of incorporating the As-Built information being de:veldped by the Engineer's Office on the South River Flood Control Project. The Plans and Specifications are scheduled for a CE Maguire interoffice final review the week of October 8 through October 15. 9) Division of Water Pollution Control and Environmental Protection Agency. a) Infiltration/Inflow Study - This item must include substantiation of the Cost Effectiveness of the construction of the project versus the decrease in Operation and Maintenance of the treatment works afforded by the project. Due to the poor condition of the sewers in many locations, a realistic determination of the amounts of inflow and excessive infiltration has been very difficult to obtain. However, with the support of the T.V. Survey, CE Maguire has been able to develop a report which will f� satisfy the requirements of EPA. This report will be submitted October 17, 1975. b) Industrial Cost Recovery - This is being prepared by the South Essex Sewerage District in connection with funding for the interceptor and treatment works. The only restriction on this item is that it must be approved prior to the final grant installment. t j I c) User Charges and Sewer Ordinance - The City must adopt these prior to the final grant installment. d) Facilities Plan (201 Study) - Except for items 2) through c), the "Sewerage and.Drainage Facilities" reports of 1969 and 1974 satisfy the I 201 Study requirements. j e) Step 3 Grant Aoplication - This will be submitted as a Step 1, 2, and 3 i Application and will include the Negative Environmental Assessment.. This cannot be completed until the Plans and Specifications are in their final form since an intricate portion of the Application involves +he final Engineer's Estimate. As I am sure you are aware, CE Maguire is pursuing all these matters diligently. It is also clear that many of these work tasks were unforeseen at the time of the signing of the contract for this work. i Due to subsequent reevaluation of the methods of funding by the State and Federal governments, misunderstanding between the City and the SESD over the question of Infiltration/Inflow, buiit-in procedural delays in the licensing and permits processes ! } on the private, local, State, and Federal levels, some of which were unanticipated, f as well as the complexity of renovating a highly deteriorated sewerage and sub-system, '{ the project has suffered an unavoidable time delay. Again, let me assure you that this project has a top priority and is progressing as t rapidly as all the aforementioned constraints will allow. CE Maguire anticipates, assuming all the required hearings, reviews, and legislative actions proceed on schedule, that the final step prior to advertisement, the submittal of the Grant Application, will occur about November 15, 1975. Actual advertisement should then take place prior to the first of the year. Salem Sewer Crossing, I submit the following statement. A portion of the Marsh used in the proposed sewer crossing belongs to Salem State College. It appears from the drawing that a minimal amount of impact will result from this proposed crossing. However, It should be noted that the entire Forest River Marsh area, from the tidal gates to Thompson meadows, is used by the College as an on-going environment study area. Moreover, the area actually owned by the College serves as a Salem State College Nature Center which we hope to develop. as funds become available. Because of the proximity of the entire Marsh to the College, student projects can be much more efficiently run than if the study area involved: a lengthy travel time. Our study program has been developing and Improving over the years to the present where we consider the Marsh to be an extremely unique and valuable teaching resource. We, therefore, watch with great interest and considerable skepticism any plans to develop adjacent properties or to make any further in roads to the Marsh. The proposed sewer crossinfj could have an adverse affect on our program particularly if those in charge were negligent with the spoil wherein it were left to wash into the estuary or allowed to: rest on the surface of the Marsh. The condition of the estuary in the immediate area of the proposed crossing is not particularly esthetic, what with foul water, odoriferous muds, and abandoned shopping carts. This very fact may induce a casual approach to the project by workers who may feel that any change Is an improvement. It may very well be an improvement, but theline is narrow and the Marsh is fragile. - s We do not seek an environmental impact statement, but av:is4 to declare that the entire Forest River Marsh area represents a valuable teaching resource that will not stand a great deal of unplanned alteration.
