Massachusetts Historic Commission The request for project change is under review by MHC. 7 . Salem Conservation Commission NOI/Order of Conditions PROPOSED MODIFICATION TO PROJECT The National Park Service proposes a revision to a portion of an existing permitted project . The revision effects the Derby Wharf retention structure . The revision allows significant historic and archeological areas to remain undisturbed; under the existing plan, the archeological features will be destroyed and the historic granite wall will be altered. In brief , the revision involves changing the steel sheetpile retaining structure to a precast concrete/steel H-pile structure; adding drilled tiebacks to restrain the structure; and moving the structure outboard by approximately twenty eight inches . The dredging plan does not change . The attached sketches show the revised arrangement . PROPOSED REVISION The National Park Service proposes utilizing an anchored soldier pile wall with precast concrete lagging in lieu of the cellular sheet pile wall on Derby Wharf between Sta. 19+45 and Sta . 22+05 . 96 to act as the retention structure for that portion of Derby Wharf which will be dredged to EL . -13 .01 . Specifically, we propose utilizing HP14 X 117 soldier piles installed on 6 ' centers . The piles will be installed to EL . -34 . 0 in grouted rock sockets . Lagging between the H-piles will consist of precast concrete panels measuring 25 ' high X 5 ' 8" wide X 10 1/2" thick . The panels will be installed between the flanges of adjoining soldier piles . Pressure grouted ground anchors will be installed and attached to the soldier piles at El . -1 . 5 . After dredging operations are completed, a fiberglass form will be placed over the outside flange of the soldier piles , connected to the adjoining lagging panels , and filled with concrete from 2 ' feet below the mudline to the top of the concrete panels . SUMMARY OF DIFFERENCES EXISTING DESIGN The existing design requires that a cofferdam be installed which will allow access to the portion of the stone wall which is to be dismantled and reconstructed. After installation of the cofferdam, approximately 7 , 500 c . y . of material is to be excavated from behind the wall . The wall is then to be carefully surveyed and dismantled. The underlying wall foundation is then removed, after which a series of eight interconnected sheetpile cells are to be driven measuring approximately 25 ' in diameter. A concrete foundation beam is placed on top of the completed cells and the stone wall reassembled to match the lines and grades of the initial survey. The cofferdam is then removed, and the harbor is dredged to EL . -13.0' . REVISED DESIGN Soldier piles will be installed on 6 ' centers along the face of the existing stone wall . These piles will be installed in 30" diameter cased holes which will be drilled down to the bedrock. The holes will be drilled to a tip elevation of -34 .0 . After the piles have been lowered into the cased hole and grouted into bedrock , the casings will be filled with clean sand and removed. A continuous series of 24" diameter cased holes will be drilled to bedrock between the grouted soldier piles . The casings will be filled with sand and withdrawn after the native material is removed down to bedrock. The removed native material will be disposed of at an approved upland disposal site. The purpose of the sand filled shafts is to remove obstructions from the path of the concrete lagging panels . Once the piles have been grouted precisely and the sand filled shafts have been installed between piles , precast concrete panels measuring 25 ' high X 5 ' 8" wide X 10 1/2" thick will be installed in the slot created by the flanges of adjoining H-piles . Several 1 . 5" diameter PVC pipes will be pre-cast into the center of the panels running top to bottom. The open ended pipes will be manifolded to a jet pump during installation and the panels jetted through the sand into position with their tips at El . -24 .0 ' . Next , the anchor attachment device is connected to the top of the piles . The grouted anchor tendons will then be drilled, installed and tensioned. The harbor will then be dredged to E1 . -13 .0 ' in accordance with existing permits . After dredging, the exposed flanges of the H-piles will be encased in concrete to prevent corrosion . Fiberglass forms will be set to 2 ' below the mudline and extend up to the top of the panels . These will attach to the panels on either side of the soldier pile by means of precast inserts in the panels . Concrete will then be tremied into the forms starting at the bottom. This will displace the column of water in the form and insure the soundness of the concrete . The fiberglass forms will be left in place. A concrete seal pour will be placed in the space between the existing wall and the back side of the new concrete panels to a depth of approximately two feet . Small granite stone matching the existing wall will be placed at elevation 0 .0 ' on the ledge created by the top of the new concrete lagging panels (See Detail A on the attached sketch) . DREDGED MATERIAL There is no change in the disposition of the dredged material . There is no change to the dredging plan. y ' ENVIRONMENTAL SAFEGUARDS The top three feet of sediment to be dredged is classified as contaminated, with upland disposal specified in the permits . Special care will be employed to ensure that the contaminated dredge material is kept segregated from the uncontaminated material . A strip of contaminated material immediately adjacent to the existing wall ( 3 feet deep by 10 feet wide) will be dredged prior to the drilling of the rock sockets . This dredged material will be handled and disposed of in strict accordance with the permits . The dredged space will be immediately filled with clean sand to prevent tidal washout of the existing material under the granite wall . The added sand is ultimately removed during the final harbor dredging operation. The siltation curtain will be in place throughout the construction as specified in the permits . The Water Quality Monitoring does not change. The seasonal dredging restrictions established in the permits do not change. 1. According to the project engineer, it is conceivable that the region of seawall is in a failure mode because of increased loading of the seawall from above. Therefore, fill will be removed from this region in an effort to avoid further seawall destabilization: this work must occur prior to frozen winter conditions. Once all local, state, and federal permits are obtained, the remaining site work,including demolition and reconstruction of the sixty-four(64) foot section of ailing wall, will occur. No emergency work is proposed in the site's protectable coastal wetlands and an erosion control barrier will surround the seaward side of this upland region and will remain in place until all buffer zone soils are fully vegetatively stabilized. Pickering Wharf Seawall Repair: page i 1 GULF OF MAINE RESEARCH CENTER INC. 1.0 Introduction This report provides information regarding proposed construction activities in and adjacent to protectable Coastal Wetland Resource Areas on a parcel of property in Salem, ' Massachusetts, located at Pickering Wharf(Figure 1). Proposed activities involve the repair,restoration, and maintenance of an existing granite and concrete seawall located on ' the South River, a channelized tidal estuary. The Gulf of Maine Research Center,Inc. (GMRC), of Salem, Massachusetts, identified the boundaries of all Coastal Resource Areas on the property (hereinafter referred to as the "Site') and served as environmental consultants for the project. Raymond C. ' Pressey, Inc., Registered Professional Engineers and Land Surveyors, of Lynn, Massachusetts conducted the Site survey and serve as the project engineer. The proposed ' Site layout and design protects the Coastal Resource Areas according to the Massachusetts Wetlands Protection Act(M.G.L. C. 131 S. 40) (hereinafter the "Act"), the Massachusetts ' Wetlands Protection Act Regulations (310 CMR 10.00) (hereinafter the 'Regulations"), and the City of Salem Ordinance Pertaining to General Wetlands (hereinafter the "local Ordinance"). This report describes the existing,protectable Coastal Resource Areas on the ' Site, and discusses measures to protect the interests identified in the Act, Regulations, and local Ordinance. ' The most recent GMRC visit to this Site was conducted in November, 1990. 1 2.0 Site Description ' The approximately four and fifty-five one hundredths (4.55)acre Site is composed of one (1) lot, located to the south of Derby Street,in Salem, Massachusetts. The Site is ' located to the north of the South River,a channelized tidal estuary. Commercial,retail,and residential condominium units currently occupy the Site. ' The perimeter of Pickering Wharf is surrounded by a granite and concrete block ' seawall. Much of the existing seawall structure consists of concrete blocks atop a poured concrete pad,although portions of the wall are composed of granite stone ,which at times has been heightened by the addition of concrete blocks. According to the report of Childs Engineering Corporation(1987),a number of regions of the existing seawall have settled and bulged. Portions of this deteriorated seawall have already collapsed, and a number of 1 ' Salem,Massachusetts. ' 2.1 Soils and Topography The following information regarding the properties and identification of soil types is based upon material published by the United States Soil Conservation Service (1984). Soils at the Site are in the Urban Land unit. This unit consists of nearly level to moderately steep areas where the soils have been altered or obscured by urban works and structures. ' 2.2 Biota ' The tidal channel of the South River supports minimal biota, and is grossly polluted (Jerome et al., 1967). No recent evidence exists that the South River supports important -' oceanic resources, commercially viable shellfish,or anadramous fish runs. The upper reaches of the South River have been filled for decades and drainage has been reduced to culverts. Because of the urbanized environment of the region,little wildlife habitat occurs at the Site, and the Site is utilized by few, if any, wildlife species. ' A number of finfish occur in Salem Harbor and may.occasionally venture into the South River channel. According to the study of Jerome et al. (1967), fifteen (15) species ' of finfish were taken during sampling of six (6) shore sampling stations. Fish such as the mummichog(Fundulus heteroclitus), fourspine stickleback (Apeltes quadracus),Atlantic silversides(Menidia menidia),and Atlantic tomcod(Microgadus tomcod)were the most ' common species in the vicinity of Salem Harbor. ' The existing deteriorated seawall, the new portion of the seawall adjacent to the Chase House Restaurant, and the proposed restored seawall will all provide adequate habitat for pollution-tolerant marine brown algae such as rockweed (Fucus sp.) and Ascophyllum(Ascophyllum sp.). In addition,it is conceivable that blue mussels (Mytilus ' e&dis) and rock barnacles (Balanus balanoides)will colonize the sea wall, and that occasional lobster(Homarus americanus) and rock crabs(Cancer irroratus) will forage at ' the base of the seawall. ' Salem, Massachusetts.Pickering Wharf Seawall Repair. page 2 of 8 1 GULF OF FMNE RESEARCH CENTER INC. 3.0 Seawall History ' According to the 1987 engineering investigation of the structural integrity of the Pickering Wharf seawall(Childs Engineering Corporation, 1987),the original footprint of the wall can be traced back to 1874. This nineteenth century wall was placed directly on the underlying soils,with no pile foundation. In 1978,the Pickering Wharf Real Estate ' Development Group(PWREDG)constructed much of the existing concrete block seawall at the Site. ' On July 14, 1988, the PWREDG was in the process of developing engineering plans and a work protocol for the repair of the Pickering Wharf seawall, when a portion of the seawall located at the western portion of the Site, to the west of the Chase House Restaurant,failed. Due to the emergency nature of the situation, both the City of Salem Conservation Commission and Planning Board allowed immediate repair work. An "after- the-fact" Notice of Intent for demolition and reconstruction of this portion of the seawall was filed by GMRC on April 21, 1989, and an Order of Conditions permitting seawall ' demolition and repair was issued by the Salem Conservation Commission in May of 1989 (File No. 64-179). ' 3.1 Environmental Permit History and Requirements ' In addition to an Order of Conditions from the Salem Conservation Commission, and a Special Wetlands Permit from the Salem Planning Board,a number of state and federal environmental permitting requirements must be fulfilled prior to the commencement of repair of the Pickering Wharf seawall. Some pre-existing licenses permit the repair of the existing seawall, while other permits will still need to be obtained. t On April 4, 1978,the Massachusetts Department of Environmental Engineering (DEQE,currently the Department of Environmental Protection,DEP)issued a license permitting the owners of Pickering Wharf"to construct,repair,rebuild, and maintain a ' relieving wall,retaining wall, and bulkhead..." (License No. 165290, see Appendix A). ' According to Ms. Karen Kochenbach,of the New England Division of the United States Army Corps of Engineers Regulatory Division (personal communication,November ' 1, 1990), the repair and maintenance of the Pickering Wharf seawall is eligible for Nationwide Permit#3 (33 CFR 3305,a,3)which permits the "repair, rehabilitation, of replacement of any previously authorized,currently serviceable structure or fill, or of any currently serviceable structure of fill constructed prior to the requirement for authorization, ' Salem, Massachusetts. ' provided such repair,rehabilitation,or replacement does not result in a deviation from the ' plans of the original structure or fill,and further provided that the structure or fill has not been put to uses differing from uses specified for it in any permit authorizing its original ' construction. Minor deviations due to changes in materials or construction techniques and which are necessary to make repair,rehabilitation,or replacement are permitted. Maintenance dredging and beach restoration are not authorized by this nationwide permit." In addition,the repair of the Pickering Wharf seawall may require a Federal ' Consistency Review for the Massachusetts Department of Coastal Zone Management,and a Water Quality Certification from the DER Division of Water Pollution Control. 1 ' 4.0 Proposed Activities The applicant, North Shore Marine, Inc., of Salem, Massachusetts, seeks approval to repair and maintain the seawall located at Pickering Wharf. An approximately sixty-four ' (64) foot long section of the seawall --which is currently in a failing mode-- will be demolished and replaced. Proposed construction activities at this portion of the seawall ' will consist of temporary placement of steel sheet piling to minimize erosion and siltation; removal of existing granite blocks,sidewalk, and debris from the failing seawall; and, ' reconstruction of the granite seawall atop a poured tremie concrete footing. Filter fiber will line the inside of the wall, and the region behind the new seawall will be backfilled with ' crushed stone. Reconstruction of this failing portion of the Site's seawall will result in the temporary removal of three (3) wooden floats and a wooden pier. These structures will be replaced following construction activities. The remainder of the proposed seawall maintenance activities include driving steel sheeting around the regions of seawall to be repaired;repairing the concrete footing of the seawall;re-chinking the existing seawall; and,conducting high pressure water blasting of ' all areas of the seawall to be restored. No dredging or displacement of marine sediments is proposed,and no filling of coastal wetlands will result from the proposed activities. The use of angular stone and the project design will ensure that adequate "weep holes" exist between newly placed rocks in the seawall to ensure that groundwater will pass through the seawall into the South River,thus avoiding destabilization from behind the restored ' seawall. Lastly,the applicant proposes to remove approximately four hundred (400)cubic ' yards of upland fill from upgradient of the sixty-four(64) foot section of the wall to be replaced. It is conceivable that this region of seawall is currently in a failure mode due to ' increased loading of the seawall from above. Therefore,fill will be removed from this region in an effort to avoid future seawall destabilization. The area from which fill has been removed will be re-graded,loamed,and seeded. An erosion control barrier will ' surround the seaward side of this upland region and will remain in place until all soils are fully vegetatively stabilized. t ' 5.0 Resource Area Identification Any activity proposed or undertaken within an area subject to protection under the ' Act which will remove,fill,dredge,or alter that area subject to protection under the Act requires the filing of a Notice of Intent(310 CMR 10.02). The state Regulations (310 CMR 10.02 2.b.)also provide a 100 foot Buffer Zone outside of the Site's Coastal ' Resource Areas. Any activity in this Buffer Zone must not destroy or otherwise impair a protected Coastal Resource Area. ' In addition, the Regulations also state that no project shall have an adverse effect on ' rare vertebrate or invertebrate species that occur within resource areas. The Regulations (310 CMR 10.04, 10.59)define a rare species as any vertebrate or invertebrate officially ' listed as endangered, threatened,or of Special Concern by the Massachusetts Division of Fisheries and Wildlife under 321 CMR 8. According to the Regulations, the Site contains the following protectable Coastal Wetland Resource Areas: ' 5.1 Coastal Bank ' Coastal Bank is defined in the Regulations (310 CMR 10.30) as "the seaward face or side of any elevated landform, other than a coastal dune, which lies at the landward edge ' of a coastal beach, land subject to tidal action, or other wetland". Coastal Bank is considered significant to storm damage prevention and flood control. Coastal banks may ' supply sediments to coastal beaches,coastal dunes, and barrier beaches. Pickering Wharf Seawall Repair, page 5 of 8 1 GULF OF MAINE RESEARCH CENTER INC. 1 5.2 Land Under the Ocean tLand Under the Ocean (310 CMR 10.25) is defined as 'land extending from the mean low water line seaward to the boundary of the municipality's jurisdiction and includes ' land under estuaries". Land Under the Ocean is frequently significant to the protection of marine fisheries and shellfish (when they are present). Nearshore areas of Land Under the ' Ocean are likely to be significant to storm damage prevention,flood control,and protection of wildlife habitat. 5.3 Land Subject to Coastal Storm Flowage Land Subject to Coastal Storm Flowage(310 CMR 10.04) is defined as "land ' subject to any inundation caused by coastal storms up to and including that caused by the 100-year storm,surge of record or storm of record, whichever is greater" This Wetland ' Resource Area does not have an one hundred(100) foot Buffer Zone subject to protection under the Act. ' According to the Federal Emergency Management Agency Flood Insurance Rate Map for the City of Salem (1985), the Site is within Zone A4 (elevation 11), an area within ' the one hundred(100)year coastal floodplain. tUnlike other resource areas subject to protection under the Wetlands Protection Act, Land Subject to Coastal Storm Flowage does not have a Preamble, Definitions,or ' Performance Standards regulating its use. The Regulations for Coastal Wetlands (310 CMR 10.24, 1.) state that "if the issuing authority determines that a resource area is significant to an interest of the Act for which no presumption is stated in the Preamble to tthe applicable section,the issuing authority shall impose such conditions as are necessary to contribute to the protection of such interest". 1 ' 6.0 Impacts and Mitigation The project has been designed to minimize impacts to the protectable Coastal Resource Areas at the Site. All performance standards outlined in the Regulations have been,and will be, strictly adhered to. No work will be conducted directly within Land Under the Ocean, therefore no measures are required to mitigate direct impact to this coastal resource area. Work within ' the Coastal Bank and the Buffer Zone will be conducted so as to minimize erosion and ' Salem, Massachusetts.Pickering Wharf Seawall Repair. page 6 of 8 1 GULF OF MAINE RESEARCH CENTER INC. ' wetland siltation. Installation of a haybale erosion control barrier around all excavated ' upland regions will minimize Coastal Wetland Resource Area siltation,and installation of sheet piling--driven to refusal--will minimize erosion from the restoration of the seawall. ' Following construction activities, this sheet piling will be cut off approximately one foot above the Land Under the Ocean to minimize future destabilization of the seawall footing from boating and/or dredging operations. 1 When necessary,work will be conducted from a floating barge located in the South ' River channel. The project will be implemented using the best available commercial construction methods. ' Because the seawall at the Site does not supply sediments to coastal beaches, ' coastal dunes,or barrier beaches, and because the restored Pickering Wharf seawall will continue to be significant to storm damage prevention and flood control,all performance standards for Coastal Bank have been met. 6.1 Rare and Endangered Species ' According to the most recent edition of the "Atlas of Estimated Habitats of State- listed Rare Wetlands Wildlife" (1990), the Site does not provide rare and endangered ' species habitat recognized by the Massachusetts Division of Fisheries and Wildlife, Natural Heritage and Endangered Species Program. Therefore, no measures are necessary in order ' to protect rare and endangered species at this Site. ' 7.0 Summary The applicant,North Shore Marine, Inc., proposes to repair an existing concrete and granite seawall located at Pickering Wharf, in Salem, Massachusetts. The existing seawall is in poor to moderate condition,with the exception of a region located to the west ' of the Chase House Restaurant,which was replaced in 1989. The applicant seeks approval to:drive steel sheeting around the regions of seawall to be repaired; repair the concrete ' footing of the seawall; re-chink the existing seawall;conduct high pressure water blasting of all areas of the seawall to be restored;demolish and reconstruct a sixty-four(64)foot ' granite region of seawall located in the eastern portion of the site; and,remove approximately four hundred(400)cubic yards of upland fill from the buffer zone upgradient of the seawall. No dredging or displacement of marine sediments is proposed , ' and no filling of coastal wetlands will result from the proposed activities. When new facilities are constructed or business operations are modified, compliance with federal, state and local laws requires the submission of technical information to appropriate regulatory agencies. ' Projects which have recently been undertaken by the Gulf of Maine Research Center, Inc. , inclhde: ' * Conducting numerous MGL c.21E site assessments (over 600 in 1988) for the presence of oil or hazardous materials. As necessary, GMRC has coordinated and supervised remedial ' action programs on contaminated properties,. including underground tank removal, groundwater recovery system installation and contaminated soil removal. ' * Analyzing technical reports and records of Acid Rain Damage in Massachusetts for New England Electric, Boston Edison, Commonwealth Electric, Northeast Utilities and Eastern Utilities Associates. In -addition, the staff of the Gulf of Maine Research Center, Inc. , has experience in siting numerous land based . and offshore energy facilities including: * Obtaining U.S. Environmental Protection Agency (Region 2 ) N.P.D.E.S. permit to allow ocean disposal of drilling mud and cuttings in the Mid'Atlantic and .therefore enabled offshore oil and gas exploration to proceed. - ' * Preparing permit strategy, documents and environmental reports and designing, subcontracting and supervising studies of land, water, and air environment for EG&G New ' England Energy Park 10,000 ton/day coal gasification plant proposed for Fall River, MA. ' * Preparing permit strategy and documents for proposed New England Electric - EG&G co-generation plant to generate process steam and electricity at Millers Falls, MA. * Directing application for waiver of stack tests at-NASA Hazardous Waste Rocket Fuel Incinerator at Kennedy Space Center. Gulf of Maine Research Center has also arranged and conducted a series of U.S. Industrial Pollution Control Tours for selected ' international environmental officials. This work is being undertaken for the World Environment Center and U.S. Department of State (Agency for International Development) . The Center has ' arranged the itinerary and conducted a tour for the Environmental Protection Minister of Tunisia, who visited industrial facilities in Massachusetts, Pennsylvania, New York, Texas and Florida. Similar visits are planned for other senior international environmental ' officials. + 1 GULF OF MAINE RESEARCH CENLER INC. 1 ' page 3 ' The activities in which GMRC engages are multi-disciplinary, and they involve interacting with facility managers, attorneys, ' engineers, geologists, geohydrologists, chemists, biologists, economists and planners. GMRC often works with solid and liquid waste disposal alternatives, treatability of wastes, surface and ' ground water contamination, and the impacts of hazardous materials and chemicals on the environment and on public health and safety. The Center evaluates ocean outfalls and impacts to other water uses,— ' defines wetland boundaries, defines compensation for wetland utilization, evaluates feasibility of dredging and disposal of dredge spoils, and prepares Environmental Impact Statements, Environmental Impact Reports and applications for environmental ' permits and approvals. Dr. Hugh F. Mulligan, the Director of the Gulf of Maine Research Center, Inc. , consults with other individuals or firms, as necessary, to carry out the Center' s environmental programs. Prior to establishing this company, Dr: Mulligan worked for ten years with t engineering and environmental consulting firms and spent fifteen years in academic research, teaching and public service. Dr. Mulligan has authored more than 50 scientific publications ton Limnology, Aquatic Botany, Phytoplankton, and Oceanography and has presented papers at national and international symposia. He was awarded an NSF Fellowship at Cornell in 1961, was awarded a ' Fulbright Fellowship to develop a Center of Excellence in Oceanography at the University of Karachi in Pakistan in 1975-76, and in 197.5 was selected by the U.S. and Rumanian Academies of ' Sciences for a ten-month Exchange Research Fellowship to study the Danube Delta of the Black Sea. He has worked closely with scientists from the Agency for International Development, world Bank, The United Nations Food and Agricultural Organization, United ' Nations Development Program, and other international agencies. Dr. Mulligan has had considerable experience in working on projects that were quite controversial and often precedent setting. His role has been to design and receive industry and regulatory approval for special studies which satisfied the letter of the ' regulatory requirements and which were technically sound and cost effective. Regulations and consistency ' with Coastal Zone Management Regulations for companies exploring for oil and gas off Mid and North Atlantic coasts. * Obtaining N.P.D.E.S. permits for Hudson River Power Plants ' with Thermal Discharge Demonstration Compliance Studies. * Designing and conducting complex studies on the Phytoplankton Productivity of Georges Bank for the U.S. ' Bureau of Land Management which were essential to permit oil and gas exploration: * Designing an Ocean Dumping Compliance Program for the Government of Australia. * Evaluating dredging and ocean disposal of dredged materials for the U.S.Army Corps of Engineers at Roosevelt Roads Naval Base, Puerto Rico.
