THE PURPOSE OF THIS PROJECT IS: To reconstruct Webb Wharf by replacing existing pilings where necessary and decking to provide a tie-up for commercial vessels . DESCRIPTION OF MODIFICATIONS PROPOSED ON THE SITE, INCLUDING GRADING, DREDGING, REMOVAL OF VEGETATION, ETC. The proposed reconstruction of Webb Wharf will consist of the following work: 1. Landscaping of the Wharf Area, including removal of plant growth, etc . in order to facilitate access to the Wharf for vehicles and equipment. 2. Replacement of pilings where necessary, to be driven on line and within the confines of existing pilings of Wharf, with decking consistent with the architectural design dated November 1, 1976, to be submitted to the Salem Conservation Commission. 3. Reconstruction and closing up of that portion of the Wharf which was damaged in the 1972 storm using trap rock and granite. - 1 - A. SOILS 1. United Stated Department of Agriculture Soil Types (show on map) The coarse grained soils unearthed on the Mackey property were predominantly either gravel with some sand or vice-versa with trace quantities of fine sand. No silts or clays were found. Moisture content was typically "moist" averaging 10% to 11% water. Most of the samplings were grayish-brown to black coarse grained soils. All pH values were essentially neutral. See appended Soil Analysis Map for details. ASTM tests #D2488 , D2216 and D2487 are referenced. 2 . Permeability of soil on the side. (Dates of testing) Permeability tests were performed in the laboratory according to ASTM #D-2434 on the six samples collected on November 26, 1976. All permeabilities were representative of sandy loam as referenced in Todd, "The Water Encyclopedia" , Table 4-26 , The Maple Press Company, Copyright 1970. These results are detailed on the appended Soil Analysis Map. 3 . Rate of percolation of water through the soil. (Dates of 9 testing) Perculation tests were run in accordance with The State Sanitary Code, Article XI, regulation 14. Sample sites and their respective perculation rates are listed on the appended Soil Analysis Map. Most of the soil removed during perculation analysis revealed dark, sandy loam with occasional red brick, wood, metal and glass fragments. - 2 - B. SURFACE WATERS 1. Distance of site from nearest surface water (date of measurement) . The Mackey property directly abuts Salem Harbor. There are two tidal pools on the property, one resulting from the severe 1972 storm and referred to herein as The "Lower Tidal Pool" , and an "Upper Tidal Pool" existing as a depression adjacent to the previous pool. About six to eight feet of land mass separates the two pools. At mean low water the upper tidal pool is empty and the lower pool several feet deep. During low tide both are closed to the sea. The upper pool reaches a depth of a couple feet during high tide while the lower pool corresponds with the tide level. The upper pool is actually a depression in the wharf surface. It is affected by the tides only because of its proximity to the lower tidal pool which was formed as the result of erosion. 2 . Sources of runoff water. As tides rise harbor water seeps through the red brick fill and into the tidal pool. Peaking of the tides gradually fills the upper pool, whereas this same pool is empty at low tide. Drainage of the lower pool is through the red brick landfill. During rising tides water appears to seep from the adjacent Power Company Property, but the water is still harbor water. Rain drainage would exist around the periphery of the Mackey property, although erosionary troughs were not evident. 3. Rate of runoff from the site. Tidal drainage of the upper pool is complete within several hours. The lower pool recedes with the tide. No observations were made during rain fall. 4. Destination of runoff water Salem Harbor. 3 - 5 . Chemical additives to runoff water on the site. There is no sign of any precipitous materials, oils, greases , or sludges in any of the surface waters in the area. A gray dust appears only in the lower pool and is accented during low tide. e - 4 _ C. GROUND COVER 1. Extent of existing impervious ground cover on the site. The major portion of the impervious ground cover is concentrated on the land portion of the Mackey property and at the beginning of the wharf area in an area adjacent to the New England Power property which abuts the Mackey property. This area is unaffected by the present proposal . Located in this area are old trucks, iron tanks, concrete and granite slabs and woods. Over the general wharf area there are scatterings of general building debris such as wood, concrete, brick and pipe, but there is not a concentration of impervious ground cover. 2. Extent of proposed impervious ground cover on the site. None proposed. 3. Extent of existing vegetative cover on the site. Except for the excavated areas, twitch and carb grasses cover most of the property. Dispersed throughout the ground cover are patches of dandelion (Toraaxacum officurale) , red clover (Trifolium pratense) , glasswort (Salicornia europea) , and several species of moss. Low lying vegetative cover includes extensive goldenrod (Solidago canadensis) and sparse patches of Tansy (Tanacetum vulgare) , chicory (Cichorium intybus) , purpose vetch (Vicia americana) , Aster, sandbur (Cenchrus tribuloides) , marsh fern (Thelypteris palustris) , and celandine (Chelidonium majus) . 4. Extent of proposed vegetative cover on the site. None proposed. E. GROUND WATER 1. Minimum depth to water table on site (at time of filing) The Mackey property abuts Salem Harbor and is therefore intertidal. At mean high water, ground level is approximately 6 feet above tide level. (Typical Salem Harbor tides run 9 feet according to Nautical Chart 13274 of the National Oceanic and Atmospheric Administration, Edition 8, May 1976. ) At high- tide, the upper tidal pool draws about two feet of water, while the lower pool directly corresponds to tidal fluctuations. 2 . Maximum depth to water table on site (at time of filing) At mean low tide, ground level is approximately 15 feet above sea level. The upper tidal pool is empty and the lower pool several feet deep. Since most of the soil is porous, the water table would closely follow tidal changes . 3. Seasonal maximum ground water elevation. Not applicable. 6 - J. IMPACT OF PROPOSED ACTION APPLIED FOR 1. Effects on plant species (upland and marine) Landscaping of the property will remove most of the existing land cover to enable access to the proposed wharf. Since no reseeding or replanting is anticipated, the proper landfills will be used to minimize erosionary deprevation of the soil. Only non-organic type of heavy fill will be employed for landscaping, while pieces of trap rock and granite will be used to reconstruct the dike damaged in the 1972 storm. Landscaping, fi.11ing., piling, and wharf reconstruction should have little or no effect on the local marine flora. The harbor bottom is depicted on the appended drawing of intertidal environment. 2 . Effects on marine species (shellfish, finfish) Landscaping and reconstructing Webb Wharf will use heavy non-polluting materials that will have little or no effect on the delicate filter feeders of the littoral tidal zone. Landfill abutting the water will use the same types of rocks currently supporting marine life along the periphery of the Mackey property. Wood used in the wharf and piling will not contain any organic coating that could restrict proliferation of fauna. Only the concussion associated with the piling operation, will have any effect on the local marine inhabitants. However, the short term effects are minimal compared to the benefits derived from the incorporation of new piling attachment sites for barnacles, periwinkle, algae, mussels , etc. The observed Intertidal Environment drawing appended illustrates only scattered plant and animal throughout the piling area, so effects of piling would be minimal. Invertebrates effected by concussional distrubances would include the burrowing soft shelled clam and oysters . Crabs, snails and fish would probably move from the area during piling. No operations upon the reconstructed wharf are planned that could cause spillage, runoff, or washing of petrochemicals , oils, greases , or soaps in the abutting waters. There will be no storage of the same materials anywhere on the landfilled property. 3. Effects on drainage and runoff Drainage and runoff of the proposed reconstruction will be no more adverse than the current configuration, with the exception of the use of more stable and suitable landfill in reconstructed and filled areas. Since the intended use of the dock is for securing equipment, no foreign polluting materials will be available for spillage or contamination. - 7 - 4 . Effects on siltation of surface waters The current configuration contributes no silt to the existing waters, and with the use of none silt type fills, siltation will remain non-existent. 5. Effects on groundwater quality No application, the area is intertidal. 6. Effects on surface water quality Any effects on surface water quality will be minor and only in the local area. - 2 - K. ALTERNATIVES TO PROPOSED ACTION 1. Describe alternatives to the requested action 2 . Describe the benefits of the requested action over the alternatives . (Answer to both No. 1 and No. 2 above) The principal alternative to the proposed action would be to continue the status quo and not achieve any development of Webb Wharf. The immediate effect of this, however, would be to encourage erosion and damage to the property which would at minimum increase costs of later development. The proposed action is simple and relatively inexpensive with the limited objective of providing some immediate access to Webb Wharf. There are indications that the long range potential for Webb Wharf is substantial from the standpoint of commercial interests in Salem Harbor. This modest proposal may be a first step in encouraging a revitalization of what was once a-n historically active Harbor. One of the properties is located on Leggs Hill Road and has been used as a dump and for the storage of fill. Since this land represents one of the few attractive open spaces in Salem, the massive amount of litter, including appliances, presents more than a passing eyesore for the people in the area. The other piece of property is located on Blanney Street in Salem., and is waterfront property. Mr. Mackey as well as North Shore Dredging were served a cease and desist on October 27, 1976 for the placing of unauthorized fill in the tidewater and wetlands of Salem Harbor. The ACE issued a cease and desist on November 5, 1976. On January 17, 1977 Mr. Mackey submitted a Notice of Intent under the Wetland Protection Act to the Salem Conservation Commission. Orders of Conditions were issued on .February 14, 1977. No work has been done on the property following the issuance of the Order of Conditions. There are buildings on this property which appear to be in a dangerous state of disrepair and various construction materials have been dumped on the land. At approximately 11:00 a.m. , I observed activity on said site consisting of three individuals moving by means of a truck, approximately three yards of debris,to the end of the land area and dumping said debris directly into the tidal waters of Salem Harbor. I further observed at the same time and place, an approximately fifteen foot wide area that had been scraped clean of vegetation running from North-West to South-East along the length of the pro- perty ending at Salem Harbor, and said area bore evidence by way of tire marks and ruts of frequent use by motor vehicles. On the remainder of that afternoon, I observed a truck filling in the same area which we (myself and Brad Northrup) had previously seen a truck filling. I took pictures of this incident. I saw this on three different occasions that afternoon. The following day, October 26, 1976, I observed four men and an end-loader being moved from the premises at approximately 2:15 p.m. - 2:30 p.m. I then precedeeded to go down and inspect the premises again and noted several changes in the amount of filling i -2- that occurred that day from the previous day. A commission by knowledge gained through interest and experience and through State and Federal funds, can encourage a community to use wisely its natural resources. In some communities this would include the use of forest and agricultural land, but in Salem it is essentially the role of the Commission to 'help the City make decisions on land use planning, zoning changes, proper use of wetlands and development and use of the harbor, as well as to recommend and actively develop conservation areas wherever necessary. As was previously mentioned a commission is also charged with the protection of watershed resources which is accomplished principally by the enforcement of G.L. Ch. 131, Sec. 40, The Wetlands Protection Act. The Act specifies that a conservation commission must regulate all work on wetlands, which includes coastal areas, insofar as that work is significant "to public or private water supply, to the groundwater supply, to flood control, to storm damage preven- tion, to prevention of pollution, to protection of land containing shellfish, or to the protection of fisheries". In order to judge the significance of the work it is necessary that plans and descriptions be sent to the com- mission and that a public hearing be held so that a commission may be informed of concerns relevant to the Act. Only in the case of an emergency does the Act allow a commission to waive the application and hearing procedure "for the protection of 'health or safety of the Commonwealth Following the public hearing a commission must write an order of conditions to' prevent or to limit the impact of work on the wetland. Enforcement of the Wetlands Protection Act is often a problem. For some reason it is frequently difficult to get people to comply, while on the other hand the Zoning Ordinance and the Subdivision Regulations are complied with without question. Reluctance to comply with the Wetlands Protection Act is not just limited to persons ignorant l -2- of the law but, as we have just recently experienced, it is also seen in those whose work should require knowledge of all regulations pertaining to work in wetlands. People intending to work in wetlands rarely consult with the Commission beforehand and our responsibility requires us to stop work and to force compliance. These actions sometimes make us appear to be unsympathetic and to obstruct work which others may judge necessary or profitable. What can be done? If swift enforcement is not imposed, work can often be finished with unnecessary damage or loss of the wetland, aggravating flooding or pollution. The Commission is determined to enforce the Act vigorously and in a community where this has not been done until within the last three years, I can see how this can cause upset. It is, above all, our intention to be fair by requiring all persons to comply strictly with the Act. The objection of Mr. Mackey to the proximity of the proposed channel for the marina to the pier which he wishes to construct is entirely outside the jurisdiction of the Wetlands Protection Act and has no bearing on the need for Mr. Mackey and Mr. Pelletier to comply. Policy 3 - Support attainment of the national water quality goals for all waters of the coastal zone through coordination with existing water quality planning and management agencies . Ensure that all activities endorsed by CZM in its policies are consistent with Federal and State effluent limitations and water quality standards. Approve permits for flood or erosion control projects only when it has been determined that there will be no significant adverse effects on the project site or adjacent or downcoast areas. Policy C - For coastally dependent energy facilities , consider siting in alter- native coastal locations. For non-coastally dependent energy facilities, consider siting in areas outside of the coastal zone. Weigh the environ- mental and safety impacts of locating proposed energy facilities at alternative sites. Policy 9(a) -Accommodate exploration, development and production of offshore oil and gas resources while minimizing impacts on the marine environment , especially on fisheries, water quality and wildlife, and on the recreational values of the coast, and minimizing conflicts with other maritime-dependent uses of coastal waters or lands . Encourage maritime dependent facilities serving supply, support or transfer functions to locate in existing developed ports. Policy 9(b) - Evaluate indigenous or alternative sources of energy (coal , wind , solar and tidal power) and offshore mining to minimize adverse impacts on the marine environment , especially with respect to fisheries , water quality, and wildlife, and on the recreational values of the coast . Policy 10 - All development must conform to existing applicable State and Federal requirements governing subsurface waste discharges, sources of air and water pollution and protection of inland wetlands. NON-REGULATORY POLICIES Policy 14 - Encourage and assist commercial fisheries research and development, restoration and management of fishery resources, development of ex- tensive and intensive aquaculture, and enhancement of anadromous fisheries, initiated at local , State and Federal levels . Betts. also had a tow boat and lighter in the same area. The City of Rockland and the lightship were dis- mantled there and the remains of the hull of the City of Rockland were towed down between the Miseries and burned. Webb Wharf runs parallel to the New England Power Company property which was made land that laid between the Webb Wharf and the Philadelphia and Reading Pier. During the past years, Webb Wharf property has had maintenance at times. A hard fill was put over the sur- face, to within 200 feet of the end. Pilings and heavy timbers are still in evidence at the end of Webb Wharf. JR. 28 January 1977 HARBORMASTER To whom it may concern : Subject : Reconstruction of the former Webb Wharf My first recollection of Webb Wharf was some 55 years ago when a Captain Betts either owned or used the wharf for a marine repair and salvage dock. The old Boston to Bangor vessel "City of Rockland" was. berthed at Webb Wharf and scrapped. Her remains were then beached on Little Misery Island and burned to retrieve the scrap metal. Her remains are still there to this day. On 19 January 1977, at the time of low water, 1700 hours, the writer made an on scene examination of the area where the former Webb Wharf used to stand. The tide level at 1700 hours was minus 1.8 feet. The general shape of the wharf was clearly visible by the. remains of old pilings protruding from the mud. The end of the former wharf extends approximately 185 feet beyond the present land area. There is still visible indications of the former wharf noted by several piles still standing on the right side of the present filled wharf area. The reconstruction of the old Webb Wharf is most essen- tial for a commercial facility. This reconstruction fits in with the revitalization of Salem water front , such as the adjacent wharf where a 120 boat marina is under construction, and the future rebuilding of the former Pickering Wharf, which may be a 90 slip marina. Presently unknown archeological, scientific, pre-historic or historical data may be lost or destroyed by work to be accomplished under the requested permit. The Division Engineer has also consulted the latest published version of threatened or endangered species and made a preliminary determination that the proposed activity will not affect those listed or their critical habitat. ., Evaluation of the proposed actvity will include conformance with appropriate State or local floodplain protection standards; consideration of alternative sites and methods of accomplishment; and weighing of the positive and negative, concentrated and dispersed, and short-and long-term impacts upon floodplain. The initial determinations made herein will be reviewed in light of facts submitted in response to this notice. The following authorizations have been applied for or have been or will be obtained: ( ) Permit, License, or Assent from State. ($) Permit from Local Wetlands Agency or Conservation Commission. ( ) Water Quality Certificate in Accordance with Section 401 of the Clean Water Act. The States of Connecticut, Maine, Massachusetts and Rhode Island have approved Coastal Zone Management Programs.
