Therefore, the Conservation Commission hereby finds that the following conditions are
necessary, in accoraance with the Performance Standards set forth In the regulations, to protect those Inter.
ests checked above. The Commission orders that all work shall be performed
in accoraance with said conditions and with the Notice of Intent referenced above. To the extent that the fol-
lowing conditions modify or differ from the plans, specifications or other proposals submitted with the Notice
of Intent. the conditions shall control.
General Conditions
1. Failure to comply with all conditions stated herein,and with all related statutes and other regulatory meas-
ures, shall be deemed cause to revoke or modify this Order.
2. This Order does not grant any property rights or any exclusive privileges;it does not authorize any injury
to private property or invasion of private rights.
3. This Order does not relieve the permittee or any other person of the necessity of complying with all
other applicable federal, state or local statutes. ordinances,by-laws or regulations.
4. The work authorized hereunder shall be completed within three years from the date of this Order unless
either of the following apply:
(a) the work is a maintenance dredging project as Provided for in the Act;or
(b) the time for completion has been extended to a specified date more than three years, but less than
five years, from the date of issuance and both that date and the special circumstances warranting
the extended time period are set forth in this Order.
5. This Order may be extended by the issuing authority for one or more periods of up to three years each
upon application to the issuing authority at least 30 days prior to the expiration date of the Order.
6. Any fill used in connection with this project shall be clean fill,containing no trash,refuse,rubbish or de-
bns,including but not limited to lumber, bricks,plaster,wire,lath,paper,cardboard, pipe, tires,ashes,
refrigerators,motor vehicles or parts of any of the foregoing.
7. No work shall be undertaken until all administrative appeal periods from this Order have elapsed or,if
such an appeal has been filed,until all proceedings before the Department have been completed.
8. No work shall be undertaken until the Final Order has been recorded in the Registry of Deeds or the Land
Court for the district in which the land is located,within the chain of title of the effected property.In the
case of recorded land, the Final Order shall also be noted in the Registry's Grantor Index under the name
of the owner of the land upon which the proposed work is to be done.In the case of registered land. the
Final Order shall also be noted on the Land Court Certificate of Title of the owner of the land upon which
the proposed work is to be done.The recording information shall be submitted to the Commission
on the form at the end of this Order prior to commencement of the work.
9. A sign shall be displayed at the site not less than two square feet or more than three square feet in size
bearing the words."Massachusetts Department of Environmental Protection,

10, Where the Department of Environmental Protection is requested to make a determination and to issue
a Superseding Order.the Conservation Commission shall be a party to all agency proceedings and
hearings before the Department.

the matter of the rail improvements presently taking place between Salem
and Lynn. A Commission member, who is also a commuter, has noted that
there are cut—up ties in several areas along the track and debris being
stored within the wetland area. The Commission feels this is a
violation of the Order of Conditions issued in February of this year.

SECTION 02100
SITE PREPARATION
PART 1 - GENERAL
1 . 01 DESCRIPTION
A. This Section specifies cutting and chipping of right-
of-way brush and right-of-way cleanup in accordance
with Standard Specifications Section 02100 - SITE
PREPARATION except as modified herin.
B. The limits of the right-of-way cleanup and brush cut-
ting shall be as follows :
1 . Eastern Route MP 16 .4t to MP 28 .Ot
2 . Gloucester Branch MP 18 .8t to MP 35 .5t
1 . 03 JOBSITE CONDITIONS
A. Dispose of cut brush by chipping and distributing on
the right-of-way within the Authority' s property
limits .
D. All site preparation work must be executed in confor-
mance with any Order of Conditions established by local
communities within the project area.
PART 2 - PRODUCTS
(NOT USED)
PART 3 - EXECUTION
3 . 01 GENERAL
A. The work to be performed shall consist of furnishing
all labor, equipment and supplies for clearing, brush
cutting, removal of trees, and removal of all rubbish,
trash and debris on the right of way, including scrap
ties .
B. The public access to the right-of-way is restricted
throughout the limits . of the project. The Contractor
shall familiarize himself with the work area including
the restrictions imposed by limited access to the site.
C . If the Contractor elects to arrange for access through
private properties abutting the right-of-way all agree-
ments are the sole responsibility of the Contractor and
shall not be an inconvenience or cost to the Authority.

r SITE PREPARATION
D. No off-track equipment will be allowed to operate
within 8 ' -6" of the centerline of track due to possible
damage to the track structure.
3 . 02 CLEARING AND BRUSH CUTTING
A. Clear trees and brush from the centerline of track for
a distance of thirty (30) feet from the centerline,
except as follows :
1 . When the Authority' s property line is less than
thirty (30 ) feet from the centerline of track the
clearing and brush cutting shall be limited to
that vegetation within the Authority' s property.
2 . When the Authority' s signal and communication pole
line is located more than thirty (30 ) from the
centerline of track the clearning and brush cut-
ting shall extend to a distance of ten (10 ) feet
beyond the pole.
3 . All ornamental shrubbery and trees, within the
limits of the brush cutting envelope as described
above, shall remain unless otherwise directed by
the Engineer.
B. The designated limits as described above are shown on
Fig. 02100-1 .
C . Trees and vegetation beyond the desig&ated limits shall
remain as a screen between the abutting properties and
the Authority' s property.
D. Standing trees and brush within the designated limits
shall be cut flush to the ground with a two (2 ) inch
tolerance permitted.
E. Prior to all clearing and brush cutting operations, the
Contractor shall walk the entire project with the
Engineer and other appropriate authorities to identify
trees, shrubs or other vegetation which shall be desig-
nated to remain.
3 .03 RIGHT-OF-WAY CLEANUP
A. All items of debris and rubbish including but not
limited to automobile tires, scrap lumber, loose
boulders, etc. shall be removed from the Authority' s
property.
B. The right-of-way cleanup shall include removal of all
existing scrap cross ties along the right-of-way and
shall also include removal of all scrap cross tie
material generated by tie installation work during the

duration of the contract, within the project limits .
The anticipated cross renewal operations will generate
scrap cross tie materials approximately as follows :

3 . 04 REMOVAL
A. All trees and brush materials to be cleared shall
become the property of the Contractor, and the satis-
factory disposal of the wood in such trees and brush
materials shall become his responsibility.
B. The Contractor may dispose of cut material by pro-
cessing into wood mulch and distributing the mulch
uniformly throughout the cleared areas and away from
the tracks, ditches and drainage structures . Dutch Elm
diseased wood shall not be mulched but shall be dis-
posed of in a manner approved by the Engineer.
C. Chipping operations shall be conducted in areas
approved by the Engineer.
D. All items of debris and rubbish, including trees and
cuttings not used for mulching, shall be disposed of
immediately after cutting or collection. Rubbish and
debris accumulated and stockpiled for loading shall be
removed and transported to the Contractor' s off-site
disposal areas prior to the close of work each day.
E. The burning of trees, brush, debris, etc. will not be
permitted.
PART 4 - MEASUREMENT AND PAYMENT
4. 01 MEASUREMENT
A. Site preparation will be measured by the lump sum, as
indicated in the Schedule of Bid Prices .
4. 02 PAYMENT
A. Site preparation will be paid for at the Contract lump
sum price which price shall include full compensation
for furnishing all labor, tools and equipment necessary
to complete the work described herein fully and satis-
factorily.

Re: Reconstruction of Salem-Beverly Railroad Trestles
Order of Conditions
Dear Ms. Yale:
In accordance with Item 6 of the Order of Conditions issued January 25, 1985 for the
reconstruction of the Salem-Beverly Railroad Trestles, we are transmitting the enclosed
progress prints showing the proposed Salem abutment and embankment structure.
The abutment footing is at elevation +5.0, above mean high water. Stone rip-rap will be
placed in front of the abutment within the approximate limits of the existing rip-rap. The
abutment will be supported on prestressed concrete piles.
Since the elevation of the tracks at the Salem abutment will be approximately 292 feet higher
than the existing profile, a reinforced concrete structure will be built to contain the additional
ballast. This structure will accommodate the higher profile without requiring any increase in
the width of the existing embankment. Some of the existing rip-rap will be removed during
construction and then replaced against the embankment structure.

The railbed is located:in the 100-year flood area, according_
to the Flood Insurance Rate Map; effective 3/15/77. A
portion of the railbed, mainly on the causeway approach to
the Beverly Drawbridae, is in the 500-year flood area. No
additional displacement of flood storage capacity is ex-
pected due to the maintenance/replacement nature of the
proposed projects.

The railbed is within 100 feet of the North and Danvers
Rivers. Impact on the rivers is expected to be
nea_liaible and insianificant because all the work is to
be done on top of the embankment, except the rip rap
repairs. The raisins of the embankment was addressed
in the Notice of Intent submitted by the NBTA for the
reconstruction of the Beverly Draw, dated 12/21/84.
