Findings
The Salem Conservation Commission has reviewed the above-referenced Notice of
Intent and plans and has held a public hearing on the project. Based on the information available to the
Comm; G G;r,n __at this time, the r _ has determined that
the area on which the proposed work is to be done is significant to the following interests in accordance with
the Presumptions of Significance set forth in the regulations for each Area Subject to Protection Under the
Act(check as appropriate):

Therefore, the Commission hereby finds that the following conditions are
necessary, in accordance with the Performance Standards set forth in the regulations,to protect those inter-
ests checked above.The Commission orders that all work shall be periormed
in accordance with said conditions and with the Notice of Intent referenced above.7o the extent that the fol-
lowing conditions modify or differ from the plans,specifications or other proposals submitted with the Notice
of Intent,the conditions shall control'
General Conditions
'1. Failure to comply with all conditions stated herein,and with all related statutes and other regulatory meas•
ures,shall be deemed cause to revoke or modify this Order.
2. This Order does not grant any property rights or any exclusive privileges;it does not authorize any injury
to private property or invasion of private rights.
3. This Order does not relieve the permittee or any other person of the necessity of complying with all
other applicable federal, state or local statutes, ordinances, by-laws or regulations.
4. The work authorized hereunder shall be completed within three years from the date of this Order unless
either of the following apply
(a) the work is a maintenance dredging project asprovided for in the Act;or
(b) the time for completion has been extended to a specified date more than three years, but less than
five years,from the date of issuance and both that date and the special circumstances warranting
the extended time period are set forth in this Order.
S. This Order may be extended by the issuing authority for one or more periods of up to three years each
upon application to the issuing authority at least 30 days prior to the expiration dale of the Order.
5. Any rill used in connection with this project shall be clew fill, containing no trash, refuse, rubbish o: de-
bris, including but not limited to lumber, bricks, plaster,wire,lath, paper, cardboard, pipe, tires, ashes,
refrigerators, motor vehicles or parts of any of the foregoing.
` 7, No work shall be undertaken until all administrative appeal periods from this Order have elapsed or, if

such an appeal has been filed, until all proceedings before the Department have bean completed.
S. No work shall be undertaken until the Final Order has been recorded in the Registry of Deeds or the Land
Court for the district in which the land is located, within the chain of title of the affected property. In the
case of recorded land, the Final Order shall also be noted in the Registry's Grantor Index under the name
of the owner of the land upon which the proposed work is to be done. In the case of registered land, the
Final Order shall also be noted on the land Court Certificate of Title of the owner of the land upon which
the proposed work is to be done.The recording information shall be submitted to the Commission
on the forTn at the end of-this Order prior to commencement of the work.
9. A sign shall be displayed at the site not less than two square feet or more than three square feet in size
bearing the words "Massachusetts Department of Environmental Quality Engineering,

DIVISION 2 - SITE WORK
1 .01 GENERAL REQUIREMENTS
A. Attention is directed to all printed Forms of Contract
and to Division 1 of these Specifications entitled
1°General Requirements", which are hereby made a part
of the Specifications.
B. Equality of Material , Assembly or System, other than
those named or described in this Section will be
determined in accordance with the methods specified in
the in the Contract Forms.
1 .02 DESCRIPTION OF THE WORK
A. The Scope of the work covered by this Division of the
Specifications includes, but is not necessarily
limited to the following :

rigging, appliances, materials, and performing

1 . 03 EXAMINATION OF SITE
A. The Contractor shall visit the Site of the proposed
work and shall fully familiarize himself with the
the conditions under which the work will be
accomplished . Failure to do so shall not .relieve
this Contractor of responsibility for full
completion of the work in accordance with the
Plans and Specifications .
B. The Contractor shall assume the entire cost and
responsibility for changes in the work which may be
occasioned by the approval of materials or.
equipment other than those specified .
1 . 04 CODES , REGULATIONS AND PERMITS
A. All work done under this Division shall conform to
all Federal State and Local Codes and Regulations
governing such work. In cases where there are
descrepancies between these Codes and Regulations
the more stringent shall apply .
B. The Contractor shall give all required notices , file
all required Plans and Applications, secure and pay
for all required Permits and Inspecitions relating
to the work in any manner whatsoever .
1 . 05 PLANS AND SPECIFICATIONS
A. The Plans and Specifications are intended to be
explanatory of each other and any labor or material
called for by either , whether or not by both , or
necessary for the successful operation of any of the
components shall be furnished and installed by the.
Contractor. Should any discrepancy between the
Plans and Specifications or the Contract Documents
and any Code, Regulation, etc . , be determined by the
Contractor , or any other perons , the Contractor
shall bring the same tothe attention of the
Engineer who shall make the necessary adjustments
and all other Documents shall remain in full force
and effect .
1 . 06 MATERIALS AND EQUIPMENT
A. All Materials and Equipment funished under this
Division shall be new and best grade for the service
intended . The manufacturer 's mentioned in the
Contract Documents are intended to indicate the
quality desired. Any substitutions of equipment or
materials , other than those mentioned or
specified, shall be submitted to the Engineer for
approval prior to purchase.
1 . 07 CLEANING
A. All work areas shall be kept free from the
accumulation of waste materials, excess dirt and
debris and dirt from the Site : He shall remove all
tools, equipment, etc., and leave the Site in a
clean and neat appearance .
1 .08 TEST AND INSPECTIONS
A. The Contractor shall , at his own expense , provide. all
materials necessary and perform all required tests of .
materials and system constructed under this Division.
He shall provide certified copies of all tests to the
Engineer .
B. All systems constructed under this Division shall be
inspected in accordance with the appropriate
Code /Regulations and shall be approved , by the
proper Inspectors/ Authorities, prior to being put
into final operation .
1 . 09 GUARENTEE
A. All equipment , labor , materials furnished and work
performed under this Division shall be guaranteed by
,the Contractor , for a period of one ( 1 ) year from
the date of final acceptance against defective
materials and workmanship. Materials, equipment or .
workmanship found defective during the guarantee
period , or. prior thereto, shall be replaced with new
items at the Contractor ' s expense.
SECTION 01560
ENVIRONMENTAL CONTROLS
PART 1 GENERAL
1 .01 General Requirements .
a. Attention is directed to the General Conditions
and Supplemental General Conditions, including
all subdivsion thereof , which are made a part of
this section.
1 . 02 Scope
a. The Contractor shall furnish all labor ,
materials, plant, tools, services and equipment
necessary to completely construct environmental
control facilities as shown on the specified
herein .
1 . 03 Related Work Specified Elsewhere
a. Earthwork - Section 02200
1 . 04 Requirements of Regulatory Agencies
a. All applicable Federal , State and Local rules ,
regulations, laws and ordinances governing the
work to be done under this section shall be
strictly adhered to.
PART 2 MATERIALS
2 .01
a. Mulch materials shall be reasonably clean and free
of noxious weeds and deleterious materials. Mulch
may consist of hay, straw, netting , fiber mats ;
wood cellulose, corn or tobacco stalks, bark , corn
cobs, wood chips , or such other material as may be
acceptable to the Engineer/Architect.
b. Grasses for temporary cover shall be a quick
growing species, including but not necessarily
limited to rye grass, Italian rye grass or cereal
grasses, suitable to the area of application, and
non competitive with grasses to be sown for
permanent cover. Fertilizers and soil conditions
shall be a standard commercial grade, acceptable
to the Engineer/Architect.
PART 3 EXECUTION
3.01 The Contractor shall provide such environmental
control measures as may be specified by the
Engineer / Architect , including temporary and
permanent procedures , and limitation of
excavation in areas subject to erosion.
The Contractor shall comply with the following
measures as to prevent adverse environmental
impacts resulting from the following operations:
(a) Clearing and grubbing . Disturbed areas
shall be seeded as directed by the
Engineer/Architect .
( b) Tree Cutting . Trees within the limit of
work shall be cut only after the
Contractor has secured written permission
of the property owner. Cut or damaged
trees not approved for cutting or outside
of the limit of work shall be replaced
with trees of a similar nature and
maturity at the Contractor ' s expense .
When directed, stumps of approved cut
trees shall be removed and replaced with
seedlings of similar nature, 6 to 12 feet
in height .
(c) Material Storage. Construction materials
shall be stored only at approved
locations. Petroleum products shall be
stored away from wetlands or other
environmentally sensitive areas , in
leakproof containers.
(d) Excavation . Wet fill shall be contained
where dumped . When material is
stockpiled adjacent to areas of
excavation , the side away from advanced
brooks, swamps , canals , etc. shall be
utilized where space is available. Side-
slopes of stockpiled material shall be in
conformance with the natural angle of
repose of the soil . If soil deposition
occurs in brooks or wetlands during
construction , the Contractor shall
promptly remove all such sediment at his
own expense . Excess fill shall only be
disposed of at such locations as are
authorized by the Engineer/Architect .
(e) Water Handling . The Contractor shall
utilize crushed stone or plastic
sluiceways to collect and pool pumped
discharges leading to storm drains
and/or brooks.
( f) Solid Waste . The Contractor shall
provide trash receptacles at the job
site . The Contractor shall perform
such preliminary cleanup operations as
are specified by the Engineer/Architect
as segments of the work are completed .
3. 02 Cleaning Up
a. The cleaning up , picking up and disposal of
refuse, abandoned facilities and surplus
materials shall not be delayed until the end of
the project. The Contractor shall schedule his
work in such a manner as to allow sufficient time
in each work day to accomplish this work. All
work sites shall be kept in as neat and clean a
condition as possible at all times.
3. 03 Dust Control
a. The Contractor shall conduct his operations to
minimize the amount of dust created as a result
of h}s work. He shall broom clean and hose road
surfaces immediately after completing backfilling
and shall water down or apply calcium chloride
(at rate if 1 -1 /12 lbs. per sq . yd.) over trench
surfaces when dust control measure become
necessary .
PART 4 MEASUREMENT AND PAYMENT
4.01 No separate payment shall be made for work done under
this section. Payment therefore shall be deemed to be
included under other bid items in this contract.

SECTION 02200
EARTHWORK
PART 1 . GENERAL
1 .01 General Requirements
a. Attention is directed to the General Conditions
and Supplemental General Conditions, including
all subdivisions thereof , which are made a part
of this section.
1 . 02 Scope
a. The Contractor shall furnish all labor, materials ,
plant, tools, services and equipment necessary to
excavate , trench, backfil1 and compact earth as
shown on the Drawings and as directed by the
Engineer/Architect and as specified herein .

PART 2 EXECUTION
2 .01 Trench Excavation
a. Trenches shall be excavated' so as to permit the
pipe to be laid at such elevations, slopes or
depths of cover as are indicated on the Contract
Drawings, including bedding if applicable except

Engineer/Architect. All loose materials shall be
removed from the trench bottom so as to provide a
uniform undisturbed 'foundation. for the pipe.
Bell holes shall be hand excavated at each joint .
Excavation beyond the trench limits indicated on
"the Contract Drawings shall not be allowed
without the express permission of the
Engineer /Architect . Unauthorized excavations
below the specified depths shall be refilled with
bank run gravel or crushed stone at the expense
of the Contractor.
If material unsuitable as pipe foundation is
encountered, said material shall be excavated to
such depth as may be directed by the
Engineer /Architect and replaced with suitable
backfill . Such work shall be compensated under
the appropriate pay items.
2. 02 Backfilling General
a. In general , or unless other material is indicated
on the Drawings or elsewhere specified , material
used for backfilling trenches shall be suitable
material which was removed in the cause of making
the construction excavations. Backfilling shall
be done as promptly as is consistent with no
injury to the. pipe or structures , but no
backfilling shall be done before the
Engineer/Architect gives permission .
The backfill material shall be free from cinders,
ashes, refuse, boulders, rocks, or stones greater
than 6" in any dimension , unsuitable organic
material or other material which, in the opinion
of the Engineer/Architect, is unsuitable.
Frozen material shall not be placed in the
backfill, nor shall backfill be placed upon
frozen material . Previously frozen material .
shall be removed, or shall be otherwise treated
as required , before new backfill is placed .
2 .03 Excavation Near Existing Structures
a. The Contractor 's attention is directed to the
fact that there are certain water pipes, drains,
sewers and other utilities within the area of the
work to be done. These have been shown on the
Co nt ra ct Drawings , but th a ac cu ra cy o r
completeness of the given information is not
guaranteed .
All existing underground - utilities shall be
located on the ground with pipe locating
equipment or by other approved means. All such
location work shall 'be done ,by the Contractor
in cooperation with the appropriate utility at no
extra cost to the Owner.
As excavation approaches underground structures
or utilities, excavation shall be done by means
of hand tools until the utility is located ,
unless otherwise directed by the
Engineer/Architect at no extra cost to the Owner .
2 .04 Compaction of Utility Trenches
a. Utility trenches shall be compacted by
mechanical compaction in maximum lifts of 12 "
under pay.ed area. Machine compaction may be
utilized in landscape areas .
2 . 06 Rock Excavations
a. The. word "Rock", wherever used as the name of an
excavated material or material to be excavated
shall mean only boulders , and pieces ,of concrete
or masonry exceeding one ( 1 ) cubic yard in
volume, or solid ledge rock which , in the opinion
of the Engineer/Architect, requires for its
removal drilling and blasting, wedging, sledging,
barring or breaking up with power-operated tools.
No soft or disintegrated rock wich can be removed
with a hand pick or power-operated excavator or
shovel , no loose, shaken or previously blasted
rock or broken stone in rock-fills or .elsewhere,
and no rock exterior to the maximum limits of
measurement allowed which may fall into the
excavation will be measured or allowed as rock .
b . No blasting shall be permitted on the site
without the prior written .consent of the ,
Engineer/Architect and the Owner.
C. Rock as defined herein shall not include any
portion of the existing rubble or masonry stone
walls existing within the limits of work.
PART 3 MEASUREMENT AND PAYMENT
3.01 Measurement
a. The quantity of earth excavation to be paid for
under this item shall be the actual number of
cubic yards of earth exvcavatopm amd disposed of
as measured by the engineer.
b . The quantity of rock excavation to be paid for
under this item shall be the actual number of
cubic yards of rock excavation and disposed of
for demolition of any part of existing rubble or
masonry walls shall be paid for under this item.
3 . 02 Payment
a. Payment for items of work under thisitem shall
constitute full compensation for all tools,
labor, equipment , plant , and materials required to
complete the work as indicated on the drawings
and as specified herein .
SECTION 02244
CHAIN LINK FENCING
PART 1 GENERAL
1 .01 General Requirements
a. Attention is directed to the General Conditions
and Supplemental General Condi-tion.s, including
all subdivisions thereof , which are made a part
of this section.
1 . 02 Scope
a. The contractor shall furnish all labor ,
materials, plant, tools, services and equipment
necessary to completely construct slope
protection facilities as shown on the Drawings
and as directed by the Engineer/Architect and as
specified herein .

a. All applicable Federal, State and Local rules,
regulations , laws and ordinances governing the
work to be done under this section shall be
strictly adhered to .
PART 2 MATERIALS
2 .01 Posts
a. Line and corner post shall be zinc-coated steel
pipe having a minimum outside diameter of 2 3/8",
with a weight of 3.65 pounds per lineal foot .
Zinc coating weight shall not be less than 2.0
oz. per square foot of ' metal surface. All posts
shall be fitted with an approved top, designed to
fit securely over the post and carry the top rail
or cable.
2 .02 � Top Rails , Cables and Spring Tension Wire
a. RAIL. top rails shall be tubular pipe 1.66 inch
OD nominal weight 2.27 pounds per lineal foot in
conformance with ASTM-A120, Schedule 40. The
weight of zinc coating shal l be 2. oz . per square
foot of metal surface . Couplings or expansion
sleeves shall be outside sleeve- type and at least
six inches long.
b . Cable. Top tension cable shall be 3/ 8 inch
diameter hot-dip galvanized 7 strand steel cable
conforming to ASTM -A475 , Common Grade .
Galvanizing shall be Class "A" Cable
Attachments. Shoulder eye bolts shall be 5/8
inch diameter and of sufficient length to fasten
to the type of posts used. Turnbuckles shall be
of the shackle end type, 1/2 inch diameter, with
standard takeup of 6 inches and provided with 3/8
inch diameter pins . Thimbles shall be
lightweight wire rope thimbles for use with 3/ 8
inch diameter cable. Anchor shackles shall be
3/ 8 diameter with a minimum distance between
eyes of 11 /16 inch and a pin diameter of 7 /16
inch . Seizing shall be 0.0181 " dia. galvanized
annealed iron wire.
C. Spring Tension Wire. Tension wire shall be coil
spring steel 0.1770" diameter. The base metal
shall have a minimum tensile strength of 80 , 000
lbs. per sq . inch, coated with 1.6 oz. of zinc
per square foot of surface area , or with an
aluminum alloy applied at the rate of 0. 40 oz .
per foot of surface area .
2 . 03 Fence Fabric
a. The fabric shall consist of (0.148 inch) wire .
It shall be woven approximately 2-inch diamond
mesh.
The width of the fabric shall be as specified or
shown on current standard drawings. Chain link
fabric shall be finished at top and bottom as
shown on the standard drawing , with a "twisted
and barbed" selvage. Barbing shall be done by
cutting the wire on the bias.
1. Zinc-coated Steel Fabric. The base metal of
the fabric shall be a good commercial quality of
steel wire coated with prime western spelter or
equal (AASHO-M120) applied at the rate of not
less than 2. 0 oz. per square foot of uncoated
wire surface either before or after weaving .
2. Aluminum-coated Steel Fabric. The base metal
of the Fabric shall be of steel wire having a
minimum tensile strength of 80 , 000 lbs . per in .
coated with aluminum alloy .applied at the rate of
not less than 0.40 oz. per - square foot of

uncoated wire surface .
PART 3 EXECUTION
3 . 01 General
a. All posts shall be set plumb and true to the, line
and grade of the proposed fence in concrete
bases. After the post is set and plumbed the
hole shall be filled with cement grove or 2000
PSI concrete. Forms for placing concrete bases
shall not be required .
b. Top rails shall pass through the ornamental tops
of line posts, forming a continuous brace from
end to end of each stretch of fence. Lengths of
top rail shall be jointed by sleeve type
couplings. Top rails shall be securely fastened
to terminal posts by pressed steel fittings.
On curves with a radius of less than 500 feet the
top rail shall be bent true to the curve.
C. Top Tension Cable. Top tension cable shall pass
through the ornamental top of the line posts.
One continuous length of cable shall be used
between pull posts. The cable shall pass through
the pull post top and down the base of the next
line post where it shall be attached to the base
of line post with a turnbuckle. Sufficient
tension shall be applied to the cable to allow a
maximum sag of 1/4 inch between posts after the
chain link mesh ahs been attached to the cable.
The Contractor shall provide temporary bracing on
intermediate brace posts when applying tension to
one length of cable at a time , to prevent undue
stresses in the intermediate brace post.
After tension has been applied to the cables , a
wire rope clip shall be placed around both cables
one on each side of the intermediate brace posts ,
and the clips securely tightened. Clips shall be
placed as close to the . posts as possible to
minimize the deflection of the post if one of the
cables should be parted .
The cable shall be fastened to the top of the end
intermediate brace post with an eye bolt through
-the post and a turn-buckle connecting the eye
bolt to the cable. The end intermediate post
shall be braced to the bottom of the end post
t with a short length of cable attached. A length
of cable shall connect the end intermediate brace
post and the end post at the top .

Eye bolts shall have a shoulder on the eye end
and shall be provided with a nut and lock washer.
Where the eye bolt is to be installed through a
pipe section, 2 lead washers shall be placed
against the shoulder of the eye, and a lead
washer backed and the nut tightened sufficiently
to seal the hole in the pipe .
All holes drilled in steel post sections shall be
cleaned and painted before the eye bolts are
installed with 2 coats of paint. High Zinc Dust
Content .
The ends of all cables shall be seized with
annealed iron wire passed around the end of cable
and the line cable. The seizing shall be at
least 1 inch in width.
d . Fence Fabric. Chain link fabric . shall be placed
on the face of the post away from the site.
The chain link fabric shall be placed
approximately 2 inches above the ground and on a
straight grade between posts.
The fabric shall be stretched taut and securely
fastened to the posts . Stretching by motor
vehicle will not be permitted. Fastening to end ,
gate, corner, and intermediate brace posts shall
be with stretcher bars and fabric bands spaced at
one foot intervales. The fabric shall be cut and
each span attached independently at all
intermediate brace and corner posts. Fastening
to post, top rail , top tension cable or spring

a. Riprap shall be placed on a prepared earth base ,
shaped to the lines and grades indicated on the
drawings. Stone shall be placed so as to form a
finished surface of uniform appearance. The
interstices between large stones shall be chinked
with smaller stones. Base stones along the
existing wall shall define the toe of the
proposed embankment and shall not be disturbed .

PART 2 MATERIALS
2.01 Loam
a. Loam shall be stripped from the area of excavation and
stockpiled as directed by the Engineer/Architect.
b. Ground Limestone. Ground limestone shall consist of
pulverized limestone obtained by grinding either
calcareous or dolomitic limestone so, that 95 percent of
the material will pass a No. 20 sieve and at least 50
percent will pass a No. 100 sieve. The ground limestone
shall have a neutralizing value satisfactory to the
Engineer/Architect, and shall be only such as will have
been marketed in accordance with those provisions of
General Laws of the Commonwealth of Massachusetts which
relate to commercial fertilizers.

c. Fertilizer. Fertilizer shall be furnished in containers
plainly marked with the chemical analysis of the product
and it shall•have one of the following compositions by
weight:

At least 50 percent by weight of the nitrogen content of
the fertilizer shall be derived from organic materials.
No fertilizer shall be used which has not been marketed
in accordance with the provisions of General Laws of the
Commonwealth of Massachusetts, relating to fertilizers.
d. Seed. Grass seed shall be of the previous year's crop and
in no case shall the weed seed content exceed 2 percent by
weight. The grass seed shall conform to the requirements
of the following tables:

No seed may be sown until the contractor has submitted to
the Engineer/Architect two copies of producer's certificates
of compliance with the specifications for each shipment of
each mixture of seed. These certificates shall include the
guaranteed percentages of purity, weed content and germina-
tion of the seed, and also the net weight and date of
shipment.
PART 3 EXECUTION
3.01 Loaming and Seeding
a. Prior to stripping, the loam shall have demonstrated by
the occurrence upon it of health crops, grass or other
vegetative growth, that it is reasonably well drained and
that it does not contain excessive amounts of either acid
or alkaline elements.

The area upon which the loam is to be placed shall be raked,
harrowed or dragged to form a reasonably smooth surface.
All stones larger than two (2) inches, undesirable growth
over two (2) inches and debris shall be removed from the
area and disposed of by the Contractor outside the
locations.
When directed by the Engineer/Architect, additional suitable
material shall be spread as required to repair gullies or
depressions. The labor, equipment and materials necessary
shall be furnished at the Contractor's expense.
The loam from borrow of the previously stockpiled loam
shall be hauled, deposited and spread to the directed
depth on the areas shown on the plans or designated by the
Engineer/Architect. All grass and weed growth on the
areas designated to be loamed, .shall be cut to a maximum
height of two (2) inches before the loam is placed thereon.
After the loam has been spread, it shall- be carefully pre—
pared by spading or harrowing, and raking with iron rakes.
All large, stiff clods, lumps, large atones, brush, roots,
stumps, litter and other foreign material shall be removed
from the loamed area and disposed -of satisfactorily.
The whole surface shall then be rolled with a hand roller
weighing not more than 100 pounds per foot of width. During
the rolling, all depressions caused by settlement or
rolling Ahall be filled with additional loam, and the
surface shall be regraded and rolled until it presents a
reasonably smooth and even finish and is up to the required
grade.
During hauling operations, the roadway surface shall be kept
clean and loam or other dirt which may be brought upon the
surface shall be removed promptly and thoroughly before it
becomes compacted by traffic. If necessary, the wheels of

The Contractor shall take all reasonable precautions to
avoid injury to existing or planted growth.
The seed shall be sown only between the periods from
April 15 to June 1 and from August 15 to October 15, except
as directed by the Engineer/Architect. The Contractor
shall not proceed with the work of seeding until the
permission of the Engineer/Architect has been obtained.
When the seed bed has been prepared for planting, if the
time is not appropriate for seeding, according to the
requirements as specified, the seeding shall be done at
the next planting season, subject to the approval of the
Engineer/Architect.

Where postponement has been necessary, all weeds and other
growth that may exist in the bed shall be removed to the
satisfaction• of the Engineer/Architect without additional
compensation.
Ground limestone where necessary shall be spread and
thoroughly incorporated in the layer of loam to adjust the
acidity of the loam. The rate of application of the
limestone will vary up to a maximum of one (1) pound per
square yard depending on the results of laboratory test
conducted by the Engineer/Architect.
The ground limestone shall be thoroughly incorporated into
the layer of loam and the upper one (1) inch of the under-
lying subsoil by harrowing and raking so as to provide a
layer of thoroughly mixed material for the seed bed.
After the application of ground limestone on the seed bed,
fertilizer shall be spread on the top layer of loam at the
rate of 0.2 pounds per square yard. The full depth of loam
shall then be spaded or harrowed and graded to the required
cross-section.
After the loamed areas have been prepared and treated as
herein before described, grass seed conforming to the
respective formulas herein before specified shall be
carefully sown thereon at the rate of approximately 3.6
pounds to each 100 square yards. Seedings shall be done
in two directions at right angles to each other,
preferably by means of rotary or other mechanical seeders.
No seeding shall be done during windy weather or when the
ground is frozen, wet or otherwise nontillable.
As soon as the seed is sown, it shall be thoroughly covered
with a thin layer of loam by raking. Finally, the surface
shall be rolled with a hand roller weighing not more than
100 pounds per foot of width.
The seeded areas shall be carefully and suitable sprinkled
with water from time to time as directed.
After the grass has appeared, all areas and parts of areas
which fail to show a uniform strain of grass, for any
reason whatsoever, shall be reseeded and such areas and
parts of areas shall be seeded repeatedly until all areas
are covered with a satisfactory growth of grass.
The Contractor shall maintain all of the seeded areas until
the work has been finally accepted, without compensation in
addition to the amount regularly to be paid under this item
as herein before provided. Maintenance shall include all
mowing, regrading, refertilizing, and reseeding which may
be necessary.

Describe project and give a description of the general project boundaries and the present use of the project

A field inspection of the existing rubble stone wall which supports the
bank at Collin's Cove Playground indicates failure of a 250' section of the wall
by both overturning and displacement of stone blocks. It is the opinion of our
contracted engineers that the most cost effective means of protecting the adjacent
land is considered to be demolition of the existing wall and utilization of the
materials, supplemented by blasting ledge, to construct a riprap slope for a dis-
tance of some 250 feet from the southeast corner of the present wall.
The project is located on.the western bank of Collin's Cove, at the eastern
edge of the Collin's Cove playground. The project requires the regrading of a
3250sf section of the playground to accomodate the new riprap wall. The proposed
slope construction is not considered to appreciably impact use of the playgrounds
active recreation areas.
The present use of the project area, bank stabilization for Collin's Cove
Playground, will not be altered due to this project. The project will result in
the enhanced bank stabilization for Collin's Cove Playground, and the protection
of Collin's Cove from continued siltation from seawall failure.

BETWEEN
THE CITY OF SALEM PLANNING BOARD
MCNEIL & ASSOCIATES
AND RIZZO ASSOCIATES, ' INC.
On July 19, 1979, the Salem Planning Board adopted an amendment to the
Salem Subdivision Regulations in accordance with the Massachusetts
General Laws Chapter 40A. The amendment states that the Planning Board
may require the services of a consultant to serve as a Clerk of the
Works on various development projects to ensure that proper construction
practices have been implemented according to approved subdivision plans
and subdivision regulations,and, in addition, according to any
individual standards or procedures set forth in the approval of the
project by the Planning Board.
In the 'project entitled Collins Cove Condominiums, being developed by s
McNeil & Associates, the Planning Board has determined that such Clerk
of the Works shall carry out the services as indicated in the Amendment
of July 19, 1979. In order to carryout such amendment, the Salem
Planning Board, McNeil & Associates, (hereinafter referred to as the
"developer") , and Rizzo Associates (hereinafter referred to as the
"consultant") , shall comply with the following:
1 . The consultant shall provide all services as defined in the Salem
Subdivision Regulations of the City of Salem, and specifically as
defined by the attached Addendum I. Such addendum adequately defines
the necessary scope of services.
2. The consultant, on an as—needed basis, as defined by the Salem
Planning Board, shall fully monitor and 'supervise the construction of
the project in conformance with the Salem Subdivision Regulations and
the conditions of the Planning Board approvals of the project.
3.. The consultant shall invoice the Salem Planning Board on a timely
basis for the. services provided, in accordance with the terms defined by
Addendum I and II.
4. The Sale m. Planning Board shall review such invoices, approve or
alter them such that they are accurate, and forward them to the
developer for timely and .proper payment.
5. The developer shall make timely and proper payment to the consultant
as requested, with documentation of such payment being supplied to the
Salem Planning Board.
6. The consultant shall make inspections on his own initiative or as
requested by the Salem Planning Board or the developer. Requested
inspections shall be made by the consultant on a timely basis, provided
reasonable notice is given thereof.

3. Review any requests for changes in the field and report same to the
City.
4. Undertake other activities as directed by the City.
Cost
The cost of these services will be on a time and expense basis. Time
. will be billedas actually incurred by the Clerk of the Works . The cost
of such services shall be billed at rates as given in Addendum II.
Rates shall generally range between $35 per hour and $38 per hour
(Project Engineer Rates) . Principal and Project Manager rates may also
be charged, but no more than 10% of the hours charged shall be at those
rates. Out of pocket expenses for items such as travel and telephone
will be billed at cost plus an administrative fee of 15 percent.
A per diem charge of $50 for overnight accomodations for the Clerk will
be incurred as necessary and as agreed upon by the City and the
developer.

individual job.

Dear Mr. Southworth:
This responds to your letter, dated February 4, 1986 wherein you
requested that the Department make a determination whether a Waterways
License is required pursuant to G.L. Chapter 91 for the above-referenced
project. You also provided additional plans and documents for our review.
Upon review of this documentation, the Department has determined the
following:
a) The proposed placement of the riprap shoreline stabilization
material along the existing coastal bank will not require Chapter 91
authorization provide that all work occurs above the mean high water
shoreline as indicated on your design plans.
b) Any change in use or substantial structural alteration of the
existing solid fill wharf and granite block seawall , which were
constructed prior to 1866, will require the issuance of a Waterways License
pursuant to Chapter 91. This also includes any existing structures built
thereon.
c) Historic tidelands at the site consists of a small area of filled
tidelands at the westerly portion of the property as indicated on your
project plans. This former tideland was apparently filled in 1942 pursuant
to a Department of the Army permit, however, review of our licensing
records indicate that this activity was not authorized pursuant to G.L.
Chapter 91. Therefore, you are required to submit a completed Waterways
License Application (enclosed) to receive c. 91 authorization to maintain
the existing fill and state its intended use.
