The Salem Conservation Commission has reviewed the above-ref erenced Notice of
Intent and plans and has held a public hearing on the project Based on the information available to the
Commission at this time,the Commission has determined that

General Conditions
1. Failure to comply with all conditions stated herein,and with all related statutes and other.reguWzry meas-
ures,shall be deemed cause to revoke or modify this Order.
2. This Order does not grant any property rights or any exclusive privileges;it does not authorize arty injury
to private property or invasion of private rights.
3. This Order does not relieve the permittee or any other person of the necessity of complying withal
other applicable federal,state or local statutes,ordinances,by-laws or regulations.
4. The work authorized hereunder shall be completed within three years from the date of this Order unless
either of the following apply
(a) the work is a maintenance dredging project as provided for in the Act;or
(b) the time for completion has been extended to a specified date more than three years,but less than
five years,from the data of issuance and both that date and the special circumstances warranting
the extended time period are set forth in this Order.
5. This Order may be extended by the issuing authority for one or more periods of up to three years each
upon application to the issuing authority at least 30 days prior to the expiration date of the Order.
S. Any fill used in connection with this project shall be dean fill,containing no hash,refuse,rubbish or de-
bris,including but not limited to lumber,bricks,piaster,wire,lath,paper,cardboard,Pipe,tires.ashes,
refrigerators, motor vehicles or parts of any of the foregoing.
7. No work shall be undertaken until all administrative appeal periods from this Order have elapsed or,if
such an appeal has been filed, until all proceedings before the Department have been completed
8. No work shall be undertaken until the Final Order has been recorded in the Registry of Deeds or the land
Court for the district in which the land is located,within the chain of title of the affected property.In the
case of recorded land, the Final Order shall also be noted in the Registry's Grantor Index under the name
of the owner of the Land upon which the proposed work is to be done.In the case of registered land,the
Final Order shall also be noted on the Land Court Certificate of Title of the owner of the land upon which
the proposed work is to be done.The recording information shall be submitted to the
on the form at the end of this Order prior to commencement of the work.
9. A sign shall be displayed at the site not less than two square feet or more than three square feet in size
bearing the words,"Massachusetts Department of Environmental Quality Engineering,

10.Where the Department of Environmental Quality Engineering is requested to make a determination and
to issue a Superseding Order, the Conservation Commission shall be a party to all agency proceedings
and hearings before the Department.

Certificate of Compliance be issued stating that the work has been satisfactorily completed.

of debris, cradina and the placement of approximately one
inch of gravel on the site has not chana_ed its flood storage

NARRATIVE
TEMPORARY PARKING LOT, RELOCATED SALEM COMMUTER RAIL STATION
LOCATION
The project is located north of downtown Salem between Bridge Street
(Rt. 107) and the North River , adjacent and northeast of North Street
(Rt. 114) . See Map 1 showing general location on U.S.G.S. base and
Map 2 showing specific location on the "FIRM" map.
PART II: SITE DESCRIPTION
Natural Features
Figure 2 shows resource areas within which work is proposed.
o Buffer zone. A portion of the work is located within 100 feet of
the south bank of the North River.
o Land subject to flooding. The project is located within Zone A
(area of 100-year flood) as defined by the National Flood
Insurance Program of the Federal Emergency Management Agency (see
Map 2) .
o Bank. The project is located near the south bank of the North
River separated from the waters edge by a seawall and Boston and
Maine railroad tracks.
Manmade Features
Map 2 shows existing railroad tracks at the site owned by the Boston
and Maine Railroad. The Massachusetts Bay Transportation Authority
uses the eastern segment of the "Y" portion for commuter rail service.

PART III : WORK DESCRIPTION
A layer of gravel approximately one inch thick has been placed on a
site northeast of North and Bridge Streets to serve as a temporary
parking lot for the relocated commuter rail station serving Salem.
The lot will accommodate up to 400 cars. The action is considered
temporary while the Beverly-Sa10m Bridge is reconstructed. The bridge
was damaged by a fire on November 16, 1964. Long range plans call' for
a permanent parking lot and Salem commuter rail station to be
constructed at this site.
The gravel- layer is not expected to change existing drainage patterns
or the flood storage capacity of the site.

SUBJECT: MBTA Emergency Construction of the Commuter
Rail Station At Salem, Massachusetts
As you are aware, the MBTA's Salem/Beverly Drawbridge over the Danvers
River was destroyed by fire on November 16, 1984. This fire damaged trestle
has seriously disrupted commuter rail service on the Eastern Route Main Line,
inconveniencing approximately 5,000 passengers daily.
In view of the foregoing, the Authority, as an emergency measure, has
constructed a temporary commuter rail stop at the North Street location and
has graded the area to accommodate a 300-400 car parking area. Whereas the
above-mentioned location is potentially in or near a wetlands area, the
Authority is aware of its obligation to Salem and its Conservation Commission
to file a Notice of Intent.
However, due to the critical nature of this situation, the MBTA acted
on the side of expediency and has made these temporary improvements prior to
filing the appropriate forms.
Therefore, as per our telephone conversation of November 21 , 1984, the
Authority will be forwarding a completed Notice of Intent, along with the
necessary filing fee and accompanying plans to your Commission forthwith.
We are also prepared to attend your December 13 , 1984 meeting to further
provide any information you may need to issue an Order of Conditions.
