One Salem Green Salem MA 01970 RE: Bulkhead and pier repairs at Dion's Boat Yard, Glendale St. Dear Mr. Powers: At a regularly scheduled meeting of the Planning Board, March 23, 1978, it was determined that the reconstruction work at Dion's Boat Yard, due to damage o.ccuring in the Feb.0 th storm, does not constitute substantial improvement: and that the reconstruction work that will take place is not . in violationof the Wetlands and Flood Hazard District Ordinance and does not require filing;for a ;permit provided that only reconstruction and repair of previously eicisting,.'structures will take place and that there will be no further:'e4cpansion. of facilities or additional filling of wetlands. This Determination'. 'io b'ised `on the following information: 1. Explanation--of reeonstructio-n work to take place for the storage shed bulkhead and.'pier preserite'&by .the Planning Board Aide. That a Determination of Non—Applicability has been issued by the Conservation Commission (site visit 3/12/78) because there will be no additional filling of wetlands and only reconstruction of structures previously in existence before the Feb. 7th storm will take place. Sincerely, 9f Walter Power III MM/sm Chairman " Conservation Commission Salem. Massachusetts 01970 March 13, 1978 ON SITE INSPECTION REPORT MR. LEO DION"S BOAT YARD GLENDALE STREET, SALEM MA As a result of an on site inspection taken on March 12, 1978 by several members of the Salem ConCom the following observations were made: a. Floor of boathouse and riprap to the side of the boathouse located on the northeast section of the property needs replacing. (note #1 on accompanying sketch) b. Pier, pilings and dolphins located on the northeast section of the property needs replacing. (note #2 on • attached sketch) c. Bulkhead located on the southeast section of the property needs replacing. (note #3 on attached sketch) The proposed action was decided upon: a. An ' Emergency Order' cannot be issued at this time because Mr. Dion will have to have to have more than 50% replacement which was not previously liscensed under MGL #91 . b. At the next Conservation Commission meeting, scheduled at 8:00 P.M. on March 21 , 1978) , a "Determination of applicability" of Chapter 131 , Section #40 will be made. It is anticipated that a decision of non-applicability will be made relevant to the work proposed for the floor of .the boathouse, riprap, pier, pilings and dolphins since the replacement of existing structures only is is planned. c. ' A Notice of Intent will be required for proposed work on bulkhead since Mr. Dion indicated that the new bulkhead will be constructed in a different place from the existing one. • it -2- At the Conservation Commission meeting of March 21 , 1978, Mr. Dion • stated that the bulkhead .(#3 on the sketch) will be repaired by placing a new bulkhead in front of the damaged one and that no filling will be done. For this reason, the repair of the bulkhead will not require a Notice of Intent since the replacement of existing structure, only, is planned Members present at the March 12, 1978 inspection were Commissioners: Bradford C. EXECUTIVE OFFICE Transportation DEPARTMENT Public Works DIVISION Waterways OTHER 144-09" PROJECT IDENTIFICATION DION'S YACHT YARD-SALEM HARBOR 73W-1480 PREDICTED"DATES:Date of License COMPLETION Within 5 years PROJECTED COST + :I. Background Information 1. Give, a brief description of the proposed projects, and describe how your agency is involved in the project. All work in tidewater requires a license from this Division under the provisions of Chapter 91. The petitioner proposes to maintain a travel lift, finger pier, steel bulkhead and to dredge in Salem Harbor. A small pier would extend out from existing bulkhead some 45' having a width of 5' , to be used as a travel lift. A steel bulkhead, retaining fill, will be placed along and parallel to a pier constructed under DPW license No. 1560. Proposed dredging is to be performed in an area 285' long and 55.5' wide to an elevation of 8' below mean low water and adjacent to the existing pier. . 2.-- Describe the geographical area or areas which will be affected- by the project, including distinguishing natural and man-made characteristics, j• and a brief description of the present use of the area,or areas. The proposed work is located in a cove off Salem Harbor which has been used by this boat yard for a good many years for storage and boat repair. . ' The abutting shore and adjacent area consists of single and multi-residences, and some industrial facilities. . There is a beach area used for swimming, but it appears to be on the petitioner's flats. To the best of -our knowledge there are no distinguishing natural and/or man-made characteristice in the area. 2.
