The Salem Conservation Commission hereby orders that the following conditions are necessary and all work must be performed in strict conformance therewith: CONDITIONS 1. Failure to comply with all conditions stated herein, and with all related statutes and other regulatory measures, shall be deemed cause to revoke or modify this order. 2. This order does not grant any property rights or any exclusive privileges; it does not authorize any injury to private property or invasion of private rights. 3. This order does not relieve the permittee or 'any other person of the necessity of complying with all -other applicable federal, state, or local statutes, ordinances-, by-laws and/or regulations. 4. The work authorized 'hereunder shall be completed within one (1) year from the date of this order. The order may be extended .by the issuing authority for one or more additional one-year periods upon application to the said issuing authority at least thirty days prior to the expiration date of the order or its extension. 5. Any fill used in connection with this project shall be clean fill, containing no trash, refuse, rubbish or debris, including, without limiting the generality of the foregoing, lumber, bricks, plaster, wire, lath, paper, cardboard, pipe, tires, ashes, refrigerators, motor vehicles or parts .of any of the foregoing. 6. No work may be commenced until all appeal •periods have elapsed from the order of the Conservation Commission or from a final order by the Department of Natural Resources has elapsed. None of the material listed in section 5 shall be used in the fill. The fill shall be contained by a graded rubble mound dike, with a base width of approximately 30 feet, of sufficient strength to Withstand wave action. The dike construction and the filling operation at both 9 and 10 White Street shall be done under the supervision of a civil engineer registered in Massachusetts. The rip rap slope on the east of . the proposed project at 9 white Street shall be disturbed only to a distance of 130 feet+ in a southerly direction from the existing bulkhead. Removal or storage of material or filling shall be limited on the 9 White Street property to within 250 feet+ in an easterly direction from the existing stone pier at 10 White Street. All dredging shall be done between October 1st and May 1st. The Commission strongly recommends that all dredged material be used as fill. Any excess dredged material shall. be drained prior to removal from- the site. The Commission shall be notified of. .the disposal area at least 7 days in advance of removal. All fuel, storage tanks are to be located inland on the site J near to the end of White Street. A sufficient quantity of oil absorbent material shall be kept on site during the operation of the marina for use in the event of an accidental spill of petro-chemicals. Although work was instituted under this permit it was not completed before the permit expired. Inadver- dently, Doctors Tassinari and Burba did not ask for an extension of the permit . It is, therefore, now requested that this extension be granted in order that the bulkhead and other work may be completed at the Miller Wharf Marina. King Governor, Commonwealth of Massachusetts State House Boston, Massachusetts Dear Governor King, On Saturday August 11, 1979 I was informed of the passage of House Bill No. 6718 "An Act Authorizing and directing the City of Salem to regulate the use of the tidal gates located at the headwaters of Forest River in said City. " This legislation exempts the operation of the tidal gates at the mouth of the Forest River from all "general or special laws". The source of my information was the Salem Evening News. As Chairman of the Salem Conservation Commission, I am urging you not to sign this bill into law. The Forest River joins waters from Salem Harbor to form an extensive tidal estuary consisting of several miles of river frontage and tidal wetlands. Estuaries such as these are unique ecologicA 1 systems of great importance to wildlife, storm damage control and for the production of nutrients essential to a prosperous commercial and recreational fighing industry. The Wetlands Protection Act of the Commonwealth of Mass. , administered by the Conservation Commission locally and the Department of Environmental Quality Engineering at the !state level is designed to protect these important and fragile wetland areas. There is currently an Order of Conditions issued by the Conservation Commission that requires these tidal gates be left open to allow for the natural flow of water upon which the health of the Forest River estuary depends. This has been appealed by a homeowners group in the area and is under review by your Department of Environmental Quality Engineers. The findings of the Conservation Commission are based on information submitted to the Commission on both sides of the issue and testimony given at a public hearing as required by the Wetlands Protection Act. Our decision to require the opening of the gates is based on this information and our interpretation of the state law which �,.e felt clearly prohibited the interference with tidal action. -2- This legislation would remove the operation of the gates from the jurisdiction of the Wetlands Protection Act and- the well established legal and administrative process designed to serve the public's interest in protecting significant wetland areas such as the Forest River estuary from destruction and abuse. land along the Forest River has recently been acquired by the City of Salem to form the Forest River Conservation Area- the first of its kind in the City. State "Self Help" funds and federal land. and Water Conservation funds were used to make this acquisition possible. This project received the highest rating by the State Department of Conservation Services, which administers these funds, because of the uniqueness of this pristine land in an urban environment. The Conservation Commission currently has 24 high school students employed in the Forest River Conservation Area as part of the Youth Conservation Corps program administered by the State. They are developing .a trail system so the public can more easily use and enjoy this beautiful area of the City. Marblehead owns,..lands along the Forest River estuary also, and this is administered by its Conservation Commission for aisimilar purpose. This legislation, if passed, would not allow the Conservation Commission in either Salem or Marblehead to protect the health and well being of this conservation area it has long sought to protect for public benefit. During the review of the operation of the tide gates under the , Wetlands Protection Act it was well established by testimony of both the City Health Department and the Salem Department of Public : Works that raw sewage was surcharging into the Forest River estuary as a result of an antiquated sewage system. The Board of Health in 1974 ordered the tide gates left open for this reason and the Director of Public Works recommended the same action be ordered by the Commission at its August 1978 public hearing. Both agencies feared that the impounding of water by closing the gates would poten- tially -raise oten-tially raise the pollution resulting from the sewage surcharge to levels that could threaten the health of those coming in contact with the hater. Leaving the gates open and allowing a daily natural flushing of the estuary reduces this hazard. If this legislation is signed into law by you, the protection afforded the public by laws and ordinances pertaining to health and pollution would no longer be available. Perhaps the most disturbing aspect of this legislation is the way it was passed and the constituency which supports it. First of all, there were no public hearings on the bill. Extraordinary measures were taken to prevent the process of passage from seeing-Ahe light of public scrutinyo As Chairman of the Conservation! Commission, the City agency appointed by the Mayor and City Council to protect the communityts natural resources, I was informed after the -fact -3- by the local paper. Neither Representative Alexander or Senator King were informed of the issues in this matter as Representative Ruane maneuvered this through the legislature. Although this bill received City Council approval several months ago, no debate or input was allowed by the Conservation Commission or other interested parties and no notification of the vote was given the Commission prior to Council action. Finally, the legislation supports the interest of a special group known as the Harborview Park Associates, who have exclusive use of a small strip of beach along the tidal estuary. They are the sole constituency which is served by this legislation so that impounded water will provide a more comfortable swimming area at their, private beach. The one public beach on the Forest River, Pickman Park is currently closed because of high turbidity and pollution problems and the Conservation Commission is working with the local citizens to attempt to clean this beach. The citizen's group involved, the Pickman Park Association, has not been advocating the removal of these tide gates from the overview of all general or special laws. Clearly, this is the worse kind of legislation that works to the benefit of a few, albeit vocal, individuals of the expense of the public at large who is protected and served by the laws and ordinances this legislation overides. It is a fact that all groups like the Conservation Commission, which are mandated to regulate community activity, must make decisions that will be opposed by some. In this case we have acted in the public' s benefit and upheld the law. This legislation undermines the efforts of a volunteer, hard working Commission acting in a responsible manner. It is legislation which undermines the public's already eroding confidence in government. For these reasons the Salem Conservation Commission urges that you take action to prevent this bill from passing into law. As the Fire Prevention Officer for the City of Salem Fire Department, I hereby concur that the following inspections were made of tank installations as follows: On April 14, 1978, an on site inspection was made with Contractor Paul Caron, of Norshoco, for a change of location for installation of three 49000 gallon flammable liquid storage tanks. The location was to be changed to the approximate center of the filled in area, which consisted of heavy rock and stones. This area was more condu- sive to placement of the storage tanks then under the main drive area. As a result I approved the change of location and the method for installation was discussed. On May 1, 1978, the reinforced concrete pad was poured in the approved area, and I observed the depth of concrete to be at least eight (8) inches, with wire mesh and reinforcing rods in place. On May 2, 1978, the three 41000 gallon tanks were set in place. I observed the tanks being strapped into place, per provisions of Fire Prevention Regulations. An approved gravel and sand fill was used to separate and cover the installation to the top of the tanks. On May 24, 1978, an inspection of the piping and swing joints was made and permission granted to cover the tanks. On June 12, 19789 I observed the pouring of the eight inch concrete pad on the top of the tanks at grade level. This was concrete, re- inforced with wire mesh I am in receipt of an as built copy of a plan for Miller Wharf Marina, prepared by F.E. Tassinari, 156 Lafayette Street, Salem, Massachusetts 01970 has requested a permit under Section 10 of the River and Harbor Act of 1899 to: Install and maintain two floating tire breakwaters at the outer end of the marina in Salem Harbor at Salem, Massachusetts as shown on the attached plan. One breakwater will be approximately 21' wide by 300 linear feet long and is to be installed approximately 580' from the end of the existing stone pier. The other breakwater, approximately 60' long, is to be placed at the southeast corner of the marina. The breakwaters will be anchored with 1/2 inch chain secured to 250 lb concrete blocks._ These anchors will be placed every 50 feet on the wave side and every 100 feet on the lee side. The other marina facilities shown on the plan were authorized by a Department of the Army permit issued on 17 February 1977. In order to properly evaluate the proposal, we are seeking public comment. Anyone wishing to comment is encouraged to do so. Comments should be submitted to us in writing by 11 July 1977. The applicant is required to obtain all necessary local and State authorizations. The applicant has obtained Approval from the Salem Harbormaster. License No. 250/Salem Yacht Basin/pg. 2 A riprap stone dike may be constructed and maintained in said harbor, extending between two existing seawalls, having a length of approximately 130 feet, with a top elevation of 13 feet above mean low water datum, and a face slope of 1.5 feet horizontal to 1 foot vertical. The area enclosed by said stone dike and existing seawalls may be filled and maintained with clean suitable fill to an elevation of 13 feet above the mean low water datum. Gas and diesel fuel lines may be placed and maintained extending in a southerly direction through said fill area. A 24 inch reinforced concrete drain pipe may be placed and maintained extending through said fill area, having an outfall invert elevation of approximately 7.0 feet mean low water datum. A pile held gas and service dock with necessary appurtenance thereto, may be placed and maintained in said harbor, having a length of approximately 85 feet and reached by a 4 by 25 foot ramp from the top of said. riprap. Two travel lift piers consisting of timber piles and steel wide flange beams may be constructed and maintained extending into said harbor each having a length of approximately 80 feet from the top of said riprap slope, with widths of 3 feet and having a space between piers of approximately 18 feet. Deck planks may be placed and maintained on top of said travel lift piers, extending waterward a distance of approximately 35 feet from the top of said riprap, to form a dock like structure. A floating type marina installation held in place by piles, reached by a 4 by 25 foot ramp from the top of said riprap fill area, consisting of main floats and finger floats, may be placed and maintained extending into said harbor a distance of approximately 560 feet from said fill area. , The plan of said work, numbered --------- 2 5 0 ----------- is on file in the i office of said Department, and duplicate of said plan accompanies this License, and is to be referred to as a part hereof. Dredged material, if suitable, may be used as fill in designated area and surplus dredged material shall be disposed of in the area of Massachusetts Bay designated "Foul Area, Explosives", as shown on U.S.C. & G. S. Chart No. 1207, and located approximately at longitude 700-34.5'W and latitude 42025.5'N, or at an approved on-shore disposal area above the mean high water line. All work authorized hereby shall be in the location shown and in accordance with the details shown on license plan no. 250. Acceptance of this license by the licensee, either by filing this license in the appropriate Registry of Deeds as required by law or construction of the facility in part or in total for which this license is issued, shall be prima facie evidence that the licensee accepts the condition impozed by the Division of Environmental Health and the Division of Water Pol'.ution Control as stated in letters to the licensee from the aforementioned agencies , copies of which are on file in the Department of Environmental Quality Engineering and are hereby made a part of this license. Should any pollution condition arise as determined by the Division of Environmental Health and/or the Division of Water Pollution Control through or because of the operation of the facility constructed under this license, the Division of Environ- mental Health and/or the Division of Water Pollution Control shall direct that the condition be corrected. Noncompliance on the part of the licensee with the directive of the Division of Environmental Health and/or the Division of Water Pollution Control shall be cause for the Department of Environmental Quality Engineering to revoke the license for the facility upon recommendation by either agency that such action is justified. This license is granted upon the further express condition that the authorization contained herein may be modified or may be revoked in whole or in part in the event of the licensee, its successors and assigns, failing to comply with said authorization or any provisions of the license or failing to maintain all authorized structures and installations in good condition, to the satisfaction of the Department of Environmental Quality Engineering or its successors. This condition permitting modification or revocation of the license shall also apply in the event of the failure of the licensee, its successors and assigns, to secure approval under all other applicable laws, ordinances or regulations or failure to adhere to the conditions of such approvals upon receipt of such failure provided by an agency having jurisdiction. Revocation or modification of this license as provided herein shall be without liability to the Commonwealth or claim for compensation by the licensee, its successors and assigns. This license is granted upon the further express condition that the licensee, its successors and assigns , shall upon request in writing by the Department of Environmental Quality Engineering or its successors, change the location of said pipe lower it to such depth, or raise it to such height, as said Department may prescribe or remove it entirely from said waters, and said licensee, by accepting this license shall be deemed to consent and agree to the condition herein set forth, and in case of any. refusal or neglect on the part of the licensee, its successors and assigns, to comply with this condition, then this license shall be wholly void and the Commonwealth, by its proper officers, may proceed to remove or to cause the removal of said pipe at the expense of said licensee, its successors and assigns, as an unauthorized and unlawful structure in said waters. In order to create a usable marina approximately 22,500 C.Y. of material will be dredged with the spoils being used as fill material behind a stone dike to be constructed in conjunction with the dredging. Excess dredge material not used for fill will be deposited at sea, at a foul dumping area designated by the Corps of Engineers. Approx. 2,570 running feet of main dock and finger floats held by timber piles will ' be constructed to berth 110 boats. Two timber pile piers each approximately 80' x 3' will be constructed to accommodate a travel lift haul out facility. - Water to the site will be provided by the public water supply system and sewage from the site will be deposited in the City of Salem, Sewerage System. In accordane with the provisions of Section 401 of the Federal Water Pol- lution Control Act Amendments of 1972 (Public Law 92-500)9 this Division hereby issues the following :dater Quality Certification relative to this project: 1. The dredging portion of the project could result in a violation of water quality standards adopted by this Division. Therefore, reasonable care and diligence shall be taken by the contractor to. assure that the proposed activity will be conducted in a manner which will not cause or result in a violation on said standards. 2. November 7, 1978 SPECIAL PERMIT WETLANDS AND FLOOD HAZARD DISTRICT ROBERTO G. TASSINARI AND STANLEY BURBA 10 1411ITE STREET SALEM,MASSACHUSETTS On Thursday, October 19, 1978, the Planning. Board of the City of Salem, held a public hearing regarding the application, received, August 31, 1978, of Roberto G. Tassinari and Stanley Burba, for a Special Permit under Section P Wetlands and Flood Hazard Districts, of the Salem Zoning Ordinance, with respect to paving work and the construction of an utility shed (pump house) on the property located at 10 White St. , Salem, Massachusetts. At a regularly scheduled meeting of the Planning Board on October 19, 1978 .the Board voted nine in favor, none opposed, toApprovethe application as complying with the requirements for the issuance of the permit with the following conditions: 1. The paving work shall be done in accordance with .the site plan prepared by Essex Survey dated May 18, .1977, revised August 22, 1978, prepared for Roberto G. Tassinari, entitled "Plan of Land In Salem", 2. The utility shed (pump house) be constructed according to drawings pre- pared by Thomas Meller, entitled "Miller Wharf Marina Utility Building Foundation", dated August 18, 1978. I hereby certify that a copy of this decision has been filed with the City-Clerk, and a copy is on file with the Planning.Board. This special permit shall not take effect until a copy of the decision bearing the certification of the City Clerk that twenty days have elapsed : and no appeal has been filed or that if such appeal has been filed, and it has been dismissed or denied, is recorded in the Essex County Registry of Deeds and is indexed in the grantor index under the name of the owner of record or is recorded and noted on the owner's certificate of title. The fee for recording or registering shall be paid by the owner or applicant. Tassinari and Burba: This is to inform you that at the meeting of September 19, 1978 the Salem Conservation Commission voted six in favor, none opposed that the work being done at 10 White St. , Salem, MA which deviates from the Order of Conditions issued to Dr. Roberto Tassinari, 156 Lafayette St. , Salem, MA on January 15, 1976 (DEQE File 1164-7) is not significant to the purposes of the Wetlands Protection Act. The Commission is also granting an one year extension to complete the work covered in the Order of Conditions issued January 15, 1976. This extension will end on Septem- ber 19, 1979.
