Tobin 265 Essex Street, Suite 204 Salem, MA 01970 Scott and Patricia Hanford 43 Valley Street Salem, MA 01970 Re: Certificate of Compliance—DEP#64-222—43 and 45 Valley Street, Salem,MA Dear Attorney Tobin and Mr. and Mrs. Hanford: Enclosed, please find the Partial Certificate of Compliance for the above referenced project. During the Conservation Commission's regularly scheduled meeting held March 27, 2008 the Commission determined that although the majority of the project approved under Order of Conditions 64-222 has been completed there are a few items that need to be addressed. The first is debris located within the 100 foot buffer zone of a boarding vegetated wetland in the backyard of 45 Valley Street (See attached photos). This material needs to be removed and properly disposed of off site. Second, the Commission does not have record of a permit issued for the construction of the in ground swimming pool that appears to be located within the 100 foot buffer zone at 43 Valley Street (See attached photos). The Hanfords have been working with the Conservation Commission and Agent. We will continue to review the project and determine the next steps and if an after-the-fact Request for Determination of Applicability needs to be filed with the Conservation Commission. The Conservation Commission will handle this issue going forward,working with the Hanfords directly. Upon Completion of the requests to remove the debris from the 100 foot buffet zone at 45 Valley Street please submit a second request to the Conservation Commission for a Certificate of Compliance. The Conservation Agent will then complete a site visit and evaluate if a full Certificate of Compliance is warranted. In the event this land or any part thereof changes ownership before or during construction, the current owner shall notify the new owner, by registered mail, of this Order prior to the transfer of ownership and shall forward proof of this notification to the Commission. 5. Prior to commencement of construction activity, a haybale barrier shall be placed downgradient of construction to prevent siltation of the adjacent wetland. Haybales shall be anchored with stakes and entrenched 4 to 6 inches in depth. Trench material shall be deposited on the upgradient side of the haybale barrier. Haybales shall be inspected daily; those showing signs of deterioration shall be replaced immediately. The haybale barrier shall remain in proper functioning condition until all disturbed areas have been stabilized. 6. Erosion and sedimentation control measures deemed necessary as suggested by DEP in their memo dated 1/3/94 for file #64- 222 shall be instituted by the applicant. Any siltation caused onto any wetland or waterway area shall be promptly reported to the Commission. 7 . Equipment servicing and overnight equipment storage must be conducted outside the buffer zone. Equipment must be maintained to prevent leakage or discharge of pollutants. 8 . * No spill or discharge of petroleum products or other pollutants will occur within 100 feet of any wetland resource area. 9 . * Use or storage or rock salt (sodium chloride) or other toxic de-icing chemicals is prohibited within 100 feet of the resource area. Any arrangement for snow removal shall stipulate the ban. 10. Notice shall be given this Commission no more than 2 weeks nor less than 2 days prior to the commencement of construction activities. This report accompanies a Notice of Intent filed with the Salem Conservation Commission. The project includes installation of a drainage pipe with a headwall and ' energy dissipator to carry stormwater from Valley Street to the wetlands in the rear of the property. Construction of the two homes will require placement of fill within the Buffer ' Zone of Bordering Vegetated Wetlands. One of the proposed homes will also be within the Buffer Zone. No impacts to any Resource Areas are proposed. Gulf of Maine Research Center Inc. (GMRC) serves as environmental consultants ' for the project and evaluated the Site in reference to the Massachusetts Wetlands Protection Act (MGL c.131 s.40; "the Act") and its implementing Regulations (310 CMR t10.00; "the Regulations"). Eastern Land Survey Associates Inc. surveyed the property and prepared the enclosed Site Plan. ' 2.0 SITE DESCRIPTION ' The Site consists of 65,648 square feet of vacant land located on Valley Street in Salem(Figure 1). The property is currently assessed as a single lot (Figure 2), but the ' applicant intends to seek the approval of the Salem Planning Board for division of the ; single lot into two lots. The proposed division of the property into lots 77A1 (31,375 sf) ' and 77A2 (34,273 sf) is shown on the enclosed Site Plan (Site Development Plan of Land; Eastern Land Survey Associates;22 October 1993; note that the property is identified as ' Lot 77 on the plan, but the City Assessor's records assign Lot#90 to the property). The applicant is seeking the approval of the Salem Conservation Commission for the project ' prior to official division of the lot. The proposed lot division creates two separate lots that each meet the lot size, setback and frontage requirements of the Salem Zoning Bylaw. Thus, the division of the lot is likely to be approved by the Salem Planning ' Board. The property is located in a residential area of Salem. The abutting properties to ' the north and west contain single-family homes, and the property to the south is vacant. The rear portion of the Site and the abutting property to the east (owned by the City of ' Salem) consist of a large Bordering Vegetated Wetland. There are currently no structures located on the property. ' Valley Street Weiland Report;Page 1 of 8 GULF OF MAINE RESEARCH CENTER INC. ' 2.1 Drainage and Topography ' There is a 2500 drainage easement in the southeastern corner of the Site. The catch basins on Valley Street discharge through a 24" concrete pipe and headwall into a ' drainage swale on the property. This drainage Swale carries stormwater from the Valley Street catch basins to the east. Stormwater eventually discharges to the wetlands in the rear of the property. The western portion of the property is approximately 7 feet in elevation below the grade of Valley Street and the abutting residential properties. Topography slopes from an elevation of 86 feet at the toe of the slope up to Valley Street to 68 feet at the edge of the Bordering Vegetated Wetland. The abutting properties to the north and south are at the ' approximate elevation of Valley Street. Thus, the Site is bordered on three sides (north, south and west) by steep slopes up to the adjacent properties. Based on the steepness of these slopes and the surrounding topography, it appears that the abutting properties have been filled to facilitate construction of residences. ' 2.2 Additional Information Sources ' Soils in the western portion of the property are classified by the U.S. Soil Conservation Service as Chatfield-Hollis Rock outcrop complex (CrD) and those in the ' eastern portion of the property are classified as Freetown muck (Fm) (Figure 3). These soil types are consistent with the presence of sloping rocky uplands in the western portion and Bordering Vegetated Wetlands in the eastern portions of the property. The U.S. Fish and Wildlife Service National Wetland Inventory Map for Salem ' indicates the presence of a Palustrine Shrub/Scrub wetland in the eastern portion of the property (Figure 4). No other wetlands are indicated on or near the property by this map. This classification is consistent with the observations of Gulf of Maine Research Center scientists concerning Site wetlands. The Wetland and Flood Hazard District Maps of the City of Salem (1977 version) ' indicate the presence of a "shrub bog" in the rear portion of the Site. The boundary of the shrub bog shown corresponds with the tree line shown on the Assessor's Map (Figure 2). ' No other wetlands at the Site are indicated on these maps. ' 3.0 VEGETATION COMMUNITY COMPOSITION ' The majority of the Site is forested, and the dominant overstory species are common buckthorn (Rhamnus cathartica), black cherry (Prunus serotina) and tree of ' heaven (Ailanthus altissima). Much of the property contains a very dense canopy of buckthorn. In these areas, there is little to no herbaceous or shrub layer vegetation. ' Invasive species such as common reed(Phragmites australis), blackberry (Rubus allegheniensis) and Japanese knotweed(Polygonum cuspidawn) can be found on the t steep slopes at the property boundaries. Other species such as grey birch (Betula populifolia) and quaking aspen (Populus tremuloides) are common on the edges of the property. ' The border of the wetland in the rear of the property contains a dense shrub layer, with the dominant species being northern arrowwood (Viburnum recognitum), sweet ' pepperbush (Clethra alnifolia) and oblong-leaf serviceberry (Amelanchier canadensis). Red maple (Acer rubrum) trees become common in the overstory near the edge of the ' wetland. Herbaceous species such as sensitive fern (Onoclea sensibilis) and cinnamon fern (Osmunda cinnamomea) can be found scattered among the shrubs. A complete ' listing of plant species identified on the property is given in Appendix B. 4.0 RESOURCE AREA IDENTIFICATION 1 According to the Regulations, any activity proposed or undertaken within an Area ' Subject to Protection Under the Act (hereinafter 'Resource Area") which will remove, fill, dredge or alter that area is subject to regulation under the Act and requires the filing ' of a Notice of Intent.- 'Additionally, the Regulations Provide for a 100-foot Buffer Zone upgradient of certain Resource Areas. Activities within the Buffer Zone also require the ' filing of a Notice of Intent. The following Resource Areas on the Site were identified by GMRC in reference to the Act and Regulations: ' 4.1 Bordering Vegetated Wetland (310 CMR 10.55) ' Bordering Vegetated Wetlands are defined as "freshwater wetlands which border on creeks, rivers, streams,ponds and lakes. The types of freshwater wetlands are wet meadows, marshes, swamps and bogs. They are areas where the topography is low and flat, and where the soils are annually saturated." The boundary of a Bordering Vegetated ' Valley Street Wetland Report;Page 3 of 8 1 GULF OF MAINE RESEARCH CENTER INC. Wetland is defined as "the line within which 50 percent or more of the vegetational ' community consists of the wetland plant species identified in the Act." Bordering Vegetated Wetlands are considered significant to the following interests: ' • Public and private water supply; • Ground water supply; ' • Flood control; • Storm damage prevention; ' • Prevention of pollution; • Protection of fisheries; and, • Protection of wildlife habitat. ' The Performance Standards for projects in Bordering Vegetated Wetlands state the following conditions will apply to such activities: ' • The proposed work shall not destroy or otherwise impair any portion of the Bordering Vegetated Wetland; ' • The loss of up to 5000 square feet of Bordering Vegetated Wetland may be permitted by the issuing authority,provided that acceptable replication is ' provided; • The loss of up to 500 square feet of Bordering Vegetated Wetland may be allowed when the wetland is a finger-like extension into an upland and the ' loss is unavoidable; and, • No project may be allowed that will have any adverse impact on specified habitat sites of rare vertebrate or invertebrate species. ' The only portion of the property that contains greater than 50% wetland vegetation is the wetland on the eastern third of the lot. This boundary of this area was ' delineated by Gulf of Maine Research Center using the 50% wetland vegetation criteria established in the Regulations. The locations of wetland boundary flags are shown on the enclosed Site Plan. No other areas containing greater than 50% wetland vegetation were ' identified. . , e` ' 4.2 Buffer Zone (310 CMR 10.04) ' The Buffer Zone is defined as "that area of land extending one hundred (100) feet horizontally outward from the boundary of any area specified in 310 CMR 10.02(1)(a)." Unlike Resource Areas, there are no Performance Standards for projects in Buffer Zones. However,the Regulations require the filing of a Notice of Intent for any project in a Buffer Zone which may impact a Resource Area. ' 4.3 Other Resource Areas ' Four additional inland Resource Areas are identified in the Regulations but are not found at the Site. Bordering Land Subject to Flooding (310 CMR 10.57(2)a) is defined as ' "an area of low, flat topography adjacent to and inundated by flood waters rising from creeks, rivers, streams,ponds or lakes." The boundary of Bordering Land Subject to Flooding is defined as the maximum lateral extent of flood water which will theoretically ' result from the statistical 100-year frequency storm. No such areas of low, flat topography adjacent to water bodies were identified by Gulf of Maine Research Center at ' the Site. The Federal Emergency Management Agency's (FEMA)Flood Insurance Rate Map for Salem (Figure 5) does not show any areas of flooding associated with the 100- ' year storm at the Site. Therefore, this Resource Area does not exist on the property. The Resource Area Isolated Land Subject to Flooding (310 CMR 10.57(2)b) is ' defined as "an isolated depression or closed basin without an inlet or outlet...which at least once a year confines standing water to a volume of at least 0.25 acre-feet and to an average depth of at least six inches." The boundary of this Resource Area is the ' perimeter of the largest observed or recorded volume of water confined in the area. No isolated depressions that would meet these criteria were identified on the property by Gulf ' of Maine Research Center. Land Under Water Bodies and Waterways (310 CMR 10.56) is defined as "the ' land beneath any creek,river, stream pond or lake." A stream(310 CMR 10.04) is defined as "... a body of running water...which moves in a definite channel in the ground t due to a hydraulic gradient, and which flows within, into or out of an Area Subject to Protection Under the Act." The Regulations further state that "...a body of running water which does not flow throughout the year(i.e. which is intermittent) is a stream except for that portion upgradient of all bogs, swamps, wet meadows and marshes." The stormwater drainage Swale in the southern portion of the property does not meet the regulatory definition of a stream because it is intermittent and there are no upstream wetlands. Therefore, the Resource Area Land Under Water Bodies and Waterways does not exist ' within the drainage swale. The Resource Area Inland Bank is defined as "the portion of the land surface ' which normally abuts and confines a water body. If occurs between a water body and a ' Valley Street Wetland Report;Page 5 of 8 GULF OF MAINE RESEARCH CENTER INC. vegetated bordering wetland and adjacent flood plain, or, in the absence of these, it occurs between a water body and an upland." The upper boundary of this Resource Area is ' defined as the first observable break in slope or the mean annual flood level , whichever is lower. The lower boundary of the Resource Area is the mean annual low flow level. Because the stormwater drainage swale does not meet the regulatory definition of a stream, the Resource Area Inland Bank does not occur along the edges of the Swale. ' 5.0 ENDANGERED SPECIES ' The Regulations (310 CMR 1059) state that "If a project is within estimated habitat which is indicated on the most recent Estimated Habitat Map of State-Listed Rare Wetlands Wildlife published by the Natural Heritage and Endangered Species Program (hereinafter "the Program"), a fully completed copy of the Notice of Intent...shall be sent ' to the Program." According to the 1993 Estimated Habitat Map for the Site (Salem quadrangle), no estimated habitat of rare wetlands wildlife exists at the Site. Therefore, ' submission of the Notice of Intent to the Program is not required for this project. 6.0 PROPOSED ACTIVITIES The applicant proposes construction of two single-family homes with associated ' driveways and utilities. The homes will be set back 30 feet from Valley Street and their footprints will be approximately 30'x50'. Decks of approximate dimensions 12.5'x50' will ' be constructed on the rear of the homes. The driveways will extend from the homes to the edge of Valley Street. Water and sewer service will be provided from existing ' municipal lines in Valley Street. Home construction on the property will require placement of fill in the Buffer ' Zone of the Site's Bordering Vegetated Wetland. Fill placement will bring the grade of the Site to match that of Valley Street and the abutting properties, and will allow each home to have a relatively flat back yard approximately 40'xl00' in dimension. The ' northern and eastern edges of the filled area will consist of a 2:1 (H:V) slope . The dimensions of the filled area and slope have been designed so that no filling within the tBordering Vegetated Wetland will be required. At the closest point (on Lot 77A1), the toe of the fill slope will be 20 feet away from the edge of the wetland. No vegetation will ' be removed between the toe of the slope and the edge of the wetland. The existing 24-inch storm drain will be extended by the addition of 130 feet of ' subsurface drain pipe. The extended drain will outlet through a concrete headwall with a ' Valley Street WedandRepon;Page 6 of 8 GULF OF MAINE RESEARCH CENTER INC. ' stone energy dissipator at the toe of the proposed rear slope. The headwall will be constructed at the same elevation as the existing drainage swale, and the pipe will be directly connected to the existing pipe leading from Valley Street. Thus, there will be no net change in gradient with the installation of the stormwater pipe, and no increase in tvelocity of stormwater flow. The energy dissipator will serve to reduce the flow rate of stormwater, aiding in the reduction of erosion. The headwall will be located approximately 80 feet from the edge of the Bordering Vegetated Wetland. The area of the Buffer Zone between the proposed headwall and the edge of the wetland is relatively ' flat (slope approximately 20:1). Therefore, this area will further aid in reducing the velocity of stormwater, which will cause any sediment carried in the stormwater to settle in the upland area. Sediment loads of the storrwater are expected to be minimal because tthe source of the stormwater is a paved area (Valley Street). ' 7.0 IMPACT AVOIDANCE AND MITIGATING MEASURES The proposed construction on the property has been designed to minimize impacts on the Bordering Vegetated Wetland. Fill placement is proposed to allow the homes to ' have moderately sized back yards while keeping the toe of the fill slope a reasonable distance from the wetland boundary. The proposed stormwater conveyance system will direct water flow in the same direction that it currently travels. The combination of the ' energy dissipator and the 80 foot wide flat area between the dissipator and the wetland will reduce runoff velocity and sediment loads. No net change in discharge rate to the ' wetland is expected as a result of the project. The applicant proposes to install a row of staked hay bales between the toe of the proposed slope and the edge of the Bordering Vegetated Wetland. The hay bale barrier will control sedimentation of the wetlands and will delineate a no-work zone, beyond ' which no heavy equipment will be allowed. The barrier will be inspected on a regular basis and repaired as necessary. Maintenance of the barrier will continue until all surface soil has been stabilized. ' Soil stabilization on the�2:1 slope will be accomplished by seeding the area with a fast-growing grass mixture and applying a layer of straw or bark mulch. The lawn area ' will be similarly stabilized using grass species appropriate for frequent mowing. Trees and/or shrubs will be planted in the back yards on both lots near the edge of the 2:1 slope, ' although the species composition of these plantings is yet to be determined. These plantings will aid in permanent stabilization of the slope and prevent erosion during ' severe storm events. ' Valley Street Wetland Report;Page 7 of 8 GULF OF MAINE RESEARCH CENTER INC. ' 8.0 CONCLUSIONS The proposed project will require the placement of fill in the Buffer Zone of a Bordering Vegetated Wetland and the construction of a subsurface stormwater ' conveyance pipe with an associated headwall and energy dissipator. The installation of this system is not expected to change the quantity, quality or velocity of stormwater flow. ' No work in any protected Resource Area is proposed. A staked hay bale barrier will be installed and maintained downgradient of the work area to minimize sedimentation of the wetlands.
