The Conservation Commission hereby orders that the following conditions are necessary and all work must be performed in strict conformance therewith: CONDITIONS 1. Failure to comply with all conditions stated herein, and with all related statutes and other regulatory measures, shall be deemed cause to revoke or modify this order. 2. This order does not grant any property rights or any exclusive privileges; it does not authorize any injury to private property or invasion of private rights. 3- This order does not relieve the permittee or any other person of the necessity of complying with all other applicable federal, state, or . local statutes, ordinances, by-laws and/or regulations. 4. The work authorized hereunder shall be completed within one (1) year from the date of this order. The order may be extended .by the issuing authority for one or more additional one-year periods upon application to the said issuing authority at least thirty days prior to the expiration date of the order or its extension. 5. Any fill used in connection with this project shall be clean fill, containing no trash, refuse, rubbish or debris, including, without limiting the generality of the foregoing, lumber, bricks, plaster, wire, lath, paper, cardboard, pipe, tires, ashes, refrigerators, motor vehicles or parts of any of the foregoing. 6. No work shall be undertaken until the final Order, with respect to the proposed project, has been recorded in the Registry of Deeds for the district in which the land is located. No fill shall be placed beyond or below the 70 foot contour as shown on the submitted plan; no fill shall be placed on land defined as wetland by the Wetlands Protection Act, Chap. 131, Sect. 40. Carter and Towers Engineering Corp. 6 Fairview Avenue Swampscott, MA 01907 Subject: Notice of Intent of Mr. Gallo under Wetlands Protection Act Dear Mr. Carter: Thank you for your letter dated June 6, 1976. I must confess that the Commission was totally unaware that its actions were a cause of concern to Mr. Gallo and on behalf of the Commission I apologise for any upset caused him. Any discussion about the plan included with the Notice of Intent basically referred to the difficulty of writing an Order of Conditions using that plan, either because the contours were inaccurate or because the interval was too large. These observations resulted from a site inspection. The Conunission, in order to be fair to the applicant, suggested that a conservative Order of Conditions could be written based on the application, or, if more: details were supplied, an Order based on a better knowledge of the edge of the wetlands could be written to the advantage of the applicant. The choice was with Mr. Gallo's son who freely chose the latter alternative. The applicant's son showed willingnes t.o take this course of action and at the suggestion of ,James MacDowell agreed to stake out the boundary of the wetlands' which would be submitted to the ^ommission on a plan. Salem Conservation Commission City Hall Salem, Massachusetts 01970 RE: Lot #78A Valley .Street, Paul J. and Shirley Gallo, Petitioners Dear Mr.,; French: Our representative James MacDowell has informed me of the results of the hearing and Mr. Gallo is very concerned as to the attitude of the Board as to additional time and costs that may be incurred. Possibly with some explanations this situation can be resolved. The following facts I feel are pertinent and should be given careful con- sideration. 1. The Topography for the original ground was obtained from the City of Salem Topographic maps. The reason for this is that the site was altered by filling prior to our survey and we are attempting to reconstruct the original area. The City Maps have proven to be quite accurate horizontally and ver- tically and are used quite frequently by the City and other Engineering firms. The existing surface was plotted by a horizontal and vertical location survey by my survey crew who are well qualified. The reason that the plan does not appear to represent the area is due to the fact that the stock piles were placed after our survey and will be used to bring the lot to the proposed finish grade as shown on our plan. 2. Our plans were kept to the same scale as the City Maps, so as to make it convenient for your Board to overlay or check our work. 3 . According to Mr. Gallo, who works for the City and has lived in this area his entire life, the lot was predominately ledge outcrops which as you know is practically impervious. By filling, grading, loaming and seeding the runoff will be decreased and therefore will be beneficial to the South River project and the conservation preservation of the wetlands.
