The Planning Board shall not take final action on such application until it has received a report thereon from the Inspector of Buildings, City Engineer, Board of Health and Conservation Commission or until thirty-five (35) days have elapsed after dis- tribution of such application without a submission of a report. The Planning Board Shall hold a Public Hearing on said application as soon as possible after receiving the above reports, in accordance with Chapter 40A of the Massachusetts General Laws. The Planning Board ' shall notify the applicant in writing of its decision on the special permit. The decision shall document the proposed development or use and the grounds for granting or refusing the special permit. C Re: Replacement of Retaining Wall Dear Mr. Antonelli: The purpose of this letter is to describe the conditions that presently exist and the need for replacing the re- taining wall at the rear of lot #342 per the Assessors ' map #32 . Enclosed, for your convenience, is a copy of the Assessors' map #32 , showing lot #342, as well as a list of abutters to lot #342, a drawing showing the proposed construction (side view) - Exhibit A, and a drawing showing the top and side view of the existing structures along with a side view of the proposed retaining wall - Exhibit B. In 1971, the lower boards of the retaining wall of lot #342 were still attached to the columns and for the most part, the land was intact, except at the wall itself. The 1972 storm did quite a bit of damage to this area. The remains of the retaining wall were destroyed and since then, only the pilings remain. Between 1972 and 1975, nothing much happened except that erosion took place at a relatively slow rate. In 1976, 1977 and 1978 , erosion accelerated as shown on the top view of Exhibit B. Over 12 feet of land has eroded within a two year period. Because of this erosion, three serious con- ditions are occurring. The purpose :of the retaining wall is to eliminate these problems, which are as follows: J I Mr. Joe Antonelli 10 April 1978 Page 2. 1) The field stone wall, along the water side of lot #310, has been undermined and has dropped approximately 6 inches to 1 foot at the area formerly joined by the previous retaining wall. 2) The root systems of the trees at the rear of the wooded lot #342 , have been uncovered and are exposed. These trees will surely die this year unless the problem is corrected quickly. 3) The land of lot #343 is being undermined now that lot #342 is being seriously eroded (see the top view - Exhibit A) . All abutters, per the attached list, have been notified in writing that I am requesting authorization to replace the prior retaining wall with a field stone wall due to erosion problems. Also, a copy of this letter and associated exhibits are being sent to the Dept. of Environmental Quality Engineering. Please contact me should you have any information concerning the above, the attached, or if you require more information.
