All work shall conform to the above-reference Notice of Intent, site work and supporting documents and those final specifications which shall be filed with the Commission prior to construction. Any change made or intended to be made to the approved plans shall require the filing of a new Notice of Intent. 2 . Members and agents of the Commission shall have the right to enter and inspect the premises at all reasonable times to evaluate compliance with the conditions in this Order . The Commission may require the applicant to submit additional date or information necessary for the Commission to conduct that evaluation. 3 . Upon completion of the project, the applicant shall submit . with the request for a Certification of Compliance, an affidavit, prepared by a professional engineer of land surveyor registered in the Commonwealth of Massachusetts, stating that the site has been developed in accordance with the requirements of this Order of Conditions, the referenced site plan and supporting documents. 4 . This Order shall apply to every successor in control or successor in interest of the property described in the Notice of Intent and accompanying plans or part thereof. In the event this land or any part thereof changes ownership before or during construction, the current owner shall notify the new owner, by registered mail , of this Order prior to the transfer of ownership and shall forward proof of this notification to the Commission. 5 . Prior to commencement of construction activity, a haybale barrier shall be placed downgradient of construction to prevent siltation of the adjacent wetland. Haybales shall be properly anchored with stakes . Haybales shall be inspected daily; those showing signs of deterioration shall be replaced immediately. The haybale barrier shall remain in proper functioning condition until all disturbed areas have been stabilized. 6 . Equipment servicing and overnight equipment storage must be conducted outside the buffer zone. Equipment must be maintained to prevent leakage or discharge of pollutants . 7 . All concrete trucks shall be cleaned outside the buffer zone. Specifically, no trucks shall be cleaned at or near catch basins on the site. B . *No spill or discharge of petroleum products or other pollutants will occur within 100 feet of any wetland resource area. 9 . *Use or storage of rock salt (sodium chloride) or other toxic de-icing chemicals is prohibited within 100 feet of the resource area. Any arrangement for snow removal shall stipulate the ban. 10 . Notice shall be given to this Commission no more than 2 weeks nor less than 2 days prior to the commencement of construction activities . Said notice shall include, in writing, the name( s) , address (es ) , and business and home telephone numbers of the project supervisor ( s) responsible for insuring that operations are conducted in compliance with the Order . 11 . *Fertilizers used for landscaping and lawn care shall contain a low nitrogen content and be used in moderation. The property owner proposes ' removal of some contaminated soil,paving of a portion of the site and construction of appropriate drainage control structures. Also proposed are additions to two Site buildings and construction of secondary containment structures for exposed pipes and oil storage ' tanks. Portions of the site in which paving is proposed are within the 100-foot Buffer Zone of a Coastal Bank and the Resource Area Land Subject to Coastal Storm Flowage. ' Activities in these portions of the Site require the filing of a Notice of Intent with the Massachusetts Department of Environmental Protection (DEP) and the Salem ' Conservation Commission,pursuant to the Massachusetts Wetlands Protection Act (M.GL. c.131 s.40; hereinafter "the Act") and Regulations (310 CMR 10.00; hereinafter ' "the Regulations"). Gulf of Maine Research Center Inc. (GMRC) serves as environmental consultants to the Salem Oil and Grease Company and evaluated the presence of protectable ' Resource Areas on the Site. Patrowicz Land Development Engineering (PLDE)prepared plans,drainage calculations and drainage recommendations and serves as Project ' Engineer. WEB Engineering Associates provided the design and dimensions of proposed spill control structures. Paving of portions of the Site is proposed as part of a Remedial Response Action in accordance with the Massachusetts Contingency Plan (M.GL. c21E;hereinafter ' "Chapter 21E"). The Remedial Response Action is designed to eliminate potential long- term worker health risks associated with Site soil contaminants that were identified during several previous GMRC investigations of the site. Because only limited ' groundwater contamination was discovered, the soil contaminants present at the Site are thought to be relatively immobile. Construction of secondary containment and spill ' control measures is proposed to satisfy the facility's requirement for a Spill Prevention, Control and Countermeasure (SPCC)Plan. Two of the proposed building additions will ' be used to house water quality and air quality control equipment. The project is proposed to bring the facility into compliance with the ' Massachusetts Contingency Plan and the requirements for an SPCC Plan. The project has been designed in accordance with the Performance Standards for the Site's Wetland ' Resource Areas, and will not result in a negative impact to any Resource Area. ' Salem Oil and Grease Notice of Intent;Page 1 of 11 ' GULF OF MAINE RESEARCH CENTER INC. ' 2.0 SITE DESCRIPTION ' The subject property is located at 60 Grove Street in Salem, Massachusetts and is occupied by the Salem Oil and Grease Company. Four buildings are located on the ' property, and contain manufacturing, storage and office space for Salem Oil and Grease. The North River Canal, a tributary of the North River,bisects the property, and is channelized on the eastern half of the property. Railroad tracks of the Boston and Maine ' Railroad run through and along the border of the property from east to west,crossing the canal the northern portion of the property. Three of the site buildings are located south of the canal and one is located north of the canal. The majority of the remaining open space on the subject property has been ' cleared. Vegetated portions of the property include the western end, the southern border, and the area between the railroad tracks and the canal in the northwestern comer of the ' property. The area north of the Office Building, through which the railroad tracks pass, also contains a mixture of upland grasses and herbaceous plants. Paved portions of the property include the parking area between the Office Building and Grove Street, and the ' majority of the loading area between the Former Sulfonation Building and Grove Street. The area between the Sulfonation Building and the Cooperage Room is also paved. The ' area between the Finishing Building and the Pretreatment Facility is paved, although the surface is deteriorating. No portion of the Site west of the Finishing Building is currently paved, although a dense crushed stone layer is present in the truck turn-around area immediately west of the Finishing Building. 3.0 PROJECT HISTORY The site has been in industrial use since the late 1800's, with former property uses including a leather tannery. Gulf of Maine Research Center has completed a Phase I ' Preliminary Site Assessment,Phase II Comprehensive Site Investigation and Phase III Report on Remedial Action Alternatives for the Site in accordance with Chapter 21E. ' The property has been designated a Confirmed Disposal Site (Site#3-2131) and has been granted a Waiver of Approvals by the Bureau of Waste Site Cleanup of the Massachusetts ' Department of Environmental Protection. Under a Waiver of Approvals, the responsible party (Salem Oil and Grease) accepts the responsibility for implementing a permanent ' solution to the presence of site contaminants within five years. ' Salem Oil and Grease Notice of Intent;Page 2 of 11 tGULF OF MAINE RESEARCH CENTER INC. The GMRC Phase II Comprehensive Site Investigation included a characterization of the potential risk to worker health resulting from site soil contaminants. The risk assessment used the most conservative assumptions of risk and revealed that ' contaminants in soil at three portions of the industrial site presented a potential unacceptable health risk to site workers. These areas are described briefly below: ' 3.1 Former Tannery Area ' The Former Tannery Area is located in the western portion of the site, to the west of the existing Building 59. This area was the location of a leather tannery, which was ' present on the Site until the late 1800's. The only portions of the former structure which remain are the brick chimney, a buried degreasing chamber, and a concrete and brick ' slab. Contaminants found in this area are believed to have resulted from its historic use as a tannery. Because the tannery no longer exists, the source of site contaminants is no longer present. 3.2 Former Sulfonation Building Loading Area 1 This loading area is located east of the Former Sulfonation Building and ' Cooperage Room. The area has been historically used as a loading dock, and soil contaminants are believed to have originated from spills and leaks of fuel and raw ' materials from trucks using the loading docks. The majority of this area is currently paved, with the exception of a roughly triangular portion bounded by the eastern edge of ' the building and the southern edge of the North River Canal. This area will continue to be used by Salem Oil and Grease as a truck loading and unloading area. ' 3.3 Office Building Loading Area ' This loading area is located north of the Office Building and south of the Boston and Maine Railroad tracks. The area contains soil contaminants that are believed to have ' originated from the loading and unloading of raw materials and finished goods from railroad cars. This loading area is no longer used for the transfer of materials, and the use ' of the side spur railroad tracks has been discontinued. Thus, the source of soil contaminants in this area has been removed. ' Salem Oil and Grease Notice of Intent;Page 3 of 11 ' GULF OF MAINE RESEARCH CENTER INC. 3.4 Regulatory Requirements ' To comply with the requirements of Chapter 21E, the property owner has selected a remedial response alternative that will eliminate the worker exposure pathway to contaminated soil in the three areas discussed above. The selected alternative will also ' include institutional controls on future land use, and will thus serve as a permanent solution to Site soil contamination in accordance with Chapter 21E. The proposed project has also been designed to satisfy the requirements of the ' U.S. Environmental Protection Agency (USEPA) for a Spill Prevention, Control and Countermeasure Plan (SPCC Plan). Under the authority of the Federal Water Pollution ' Control Act,USEPA requires the preparation of an SPCC for facilities which could reasonably be expected to cause substantial harm to the environment by a discharge of oil ' into navigable waters. One requirement of an SPCC Plan is secondary containment for oil tanks and pipes to prevent such discharges in the event of a leak. ' 4.0 RESOURCE AREA IDENTIFICATION AND PERFORMANCE STANDARDS According to the Regulations, any activity proposed or undertaken within an Area ' Subject to Protection Under the Act (hereinafter 'Resource Area") which will remove, fill, dredge or alter that area is subject to regulation under the Act and requires the filing ' of a Notice of Intent. Additionally, the Regulations Provide for a 100-foot Buffer Zone upgradient of certain Resource Areas. Activities within the Buffer Zone also require the ' filing of a Notice of Intent. The following Resource Areas on the Site were identified by GMRC in reference to the Act and Regulations: ' 4.1 Land Subject to Coastal Storm Flowage (310 CMR 10.04) ' Land Subject to Coastal Storm Flowage is defined as 'land subject to any inundation caused by coastal storms up to and including that caused by the 100-year storm, surge of record or storm of record, whichever is greater." According to the Federal Emergency Management Agency Flood Insurance Rate Maps for Salem (August 1985; ' Figure 3), the 100-year coastal storm causes inundation up to an elevation of 10 feet NGVD (National Geodetic Vertical Datum). 1 ' Salem Oil and Grease Notice of Intent;Page 4 of 11 1 tGULF OF MAINE RESEARCH CENTER INC. Unlike the other Coastal Wetland Resource Areas,Land Subject to Coastal Storm ' Flowage is not bordered by a 100-foot Buffer Zone. The Regulations do not contain Performance Standards for projects in this Resource Area. ' This Resource Area is present on the Salem Oil and Grease property on both sides of the North River Canal at elevations up to 10 feet NGVD (See enclosed plan for ' Resource Area boundaries). 4.2 Land Under Water Bodies and Waterways (310 CMR 10.56) Land Under Water Bodies is defined as "the land beneath any creek,river, stream, ' pond or lake." The boundary of this Resource Area is the mean annual low water mark. The Resource Area is considered significant to the following interests: t • Public and private water supply; • Ground water supply; ' • Flood control; • Storm damage prevention; • Prevention of pollution; ' • Protection of fisheries; and, • Protection of wildlife habitat. ' The Performance Standards for work within Land Under Water Bodies and Waterways stipulate that the proposed work shall not impair. ' • The water carrying capacity of the defined channel, which is provided by said land in conjunction with the banks; ' • Ground and surface water quality; • The capacity of said land to provide breeding habitat,escape cover and food for fisheries; and, ' • The capacity of said land to provide important wildlife habitat functions. This Resource Area is present adjacent to the Salem Oil and Grease property ' within the North River Canal, and is bordered by the Resource Area Coastal Bank (see Section 4.3). ' 4.3 Coastal Bank (310 CMR 10.30) A Coastal Bank is defined as "the seaward face or side of any elevated landform, ' other than a coastal dune,which lies at the landward edge of a coastal beach, land subject to tidal action,or other wetland." ' Salem Oil and Grease Notice of Intent Page 5 of 11 1 ' GULF OF MAINE RESEARCH CENTER INC. Banks are considered significant to flood control and storm damage prevention. ' Coastal Banks in general are found in two forms: 1) stable banks which act as a buffer to wave action; and, 2)eroding banks which provide sediment to beaches,dunes and barrier ' beaches. The Performance Standards for projects within 100 feet of this Resource Area ' stipulate that proposed work shall not have an adverse effect due to wave action on the movement of sediment from the Coastal Bank to Coastal Beaches or Land Subject to Tidal Action. ' This Resource Area is present on the Salem Oil and Grease property at the edges of the North River Canal. The Resource Area is defined by stone walls containing the tcanal in the eastern portion of the site. The Bank is comprised of exposed soil west of the bridge where the railroad tracks cross the canal. ' 4.4 Land Subject to Tidal Action (310 CMR 10.04) ' Land Subject to Tidal Action is defined as "land subject to the periodic rise and fall of a coastal water body,including spring tides." This Resource Area is not bordered ' by a 100-foot Buffer Zone, and the Regulations do not contain Performance Standards for projects in or adjacent to this Resource Area. Land Subject to Tidal Action is located ' within the Banks of the North River Canal. No work is proposed within this Resource Area. ' 4.5 Buffer Zone (310 CMR 10.04) tThe Buffer Zone is defined as "that area of land extending one hundred(100) feet horizontally outward from the boundary of any area specified in 310 CMR 10.02(1)(a)." ' The only Resource Area at the Salem Oil and Grease Company which is bordered by a 100-foot Buffer Zone is Coastal Bank. Unlike Resource Areas,there are no Performance tStandards for projects in Buffer Zones. However, the Regulations require the filing of a Notice of Intent for any project in a Buffer Zone which may impact a Resource Area. The Buffer Zone at the Salem Oil and Grease property extends 100 feet landward from the upper edge of the North River Canal(Coastal Bank). Most of the activity ' proposed in this Notice of Intent will take place in the Buffer Zone. ' Salem Oil and Grease Notice of Intent;Page 6 of 11 1 GULF OF MAINE RESEARCH CENTER INC. t4.6 Other Resource Areas ' The Resource Area Bordering Vegetated Wetland,which may be associated with vegetated Coastal Banks, was not identified at the Site. GMRC scientists thoroughly ' inspected the vegetative community along the banks of the North River Canal, and did not identify any area in which the plant community was comprised of greater then 50% ' wetland plant species (see Appendix B for plant species list). The Resource Area Salt Marsh also may be associated with areas that receive regular tidal inundation. The ' GMRC Site inspection did not reveal the presence of any areas of salt marsh vegetation on the Salem Oil and Grease property. A National Wetland Inventory Map (U.S.Fish' t and Wildlife Service, 1977) for the Site indicates the presence of a riverine, lower perennial,open water wetland(designated R2OW; Figure 2). This wetland type is typically non-vegetated, which is consistent with the GMRC field observations. The City ' of Salem Wetland Maps do not indicate the presence of vegetated wetlands at the Site. ' 4.7 Summary There are four Resource Areas present at or adjacent to the Salem Oil and Grease property which are protected under the Massachusetts Wetlands Protection Act and ' Regulations. In addition, the Resource Area Coastal Bank is bordered by a 100-foot Buffer Zone. Therefore, all activities within these Resource Areas or the Buffer Zone require the filing of a Notice of Intent. t5.0 ENDANGERED SPECIES The Regulations (310 CMR 1059) state that "If a project is within estimated habitat which is indicated on the most recent Estimated Habitat Map of State-Listed Rare ' Wetlands Wildlife published by the Natural Heritage and Endangered Species Program (hereinafter"the Program"), a fully completed copy of the Notice of Intent...shall be sent ' to the Program." According to the 1993 Estimated Habitat Map for the Site (Salem quadrangle), no estimated habitat of raze wetlands wildlife exists at the Salem Oil and ' Grease property. Therefore, submission of the Notice of Intent to the Program is not required for this project. ' Salem Oil and Grease Notice of Intent;Page 7 of 11 GULF OF MAINE RESEARCH CENTER INC. ' 6.0 PROPOSEDACTVaTIES ' The applicant proposes to complete a soil remediation and spill control project at the Salem Oil and Grease property: _The purpose of the project is to bring the Site into ' compliance with Chapter 21E and the SPCC Regulations. The project will entail removal of surficial contaminated soil from a portion of the Site and paving of several portions of ' the Site. The specifics of the proposed project are outlined below: ' 6.1 Soil Removal The applicant proposes to excavate approximately 66 cubic yards of surficial ' contaminated soil from the former degreasing chamber located in the Former Tannery Area(See enclosed plan). The approximate depth of excavation will be 6 feet. After ' excavation of contaminated soil, the area will be backfilled with clean fill and graded. Excavated soil will be transported from the site by a licensed transporter and ' disposed in a hazardous waste landfill. Prior to transportation from the Site,the disposal firm will require analytical testing of excavated soil. Thus, soil will be stockpiled on site ' for approximately three weeks while testing is completed. The soil will be placed on 6- mil polyethylene sheeting, and each pile will be covered with a secured layer of sheeting and surrounded with a staked hay bale barrier to prevent sedimentation into the canal. The stockpiles will be located in the open area south of the Former Tannery Area, outside of the Buffer Zone. The former degreasing chamber is not located in the Buffer Zone of the Coastal Bank or the Resource Area Land Subject to Coastal Storm Flowage. The soil stockpiles twill not be located in the Buffer Zone or in any Resource Area. ' 6.2 Paving The applicant proposes paving of the following areas: 1) The Office Building Loading Area(6462 square feet); ' 2) The Former Tannery Area(31,745 square feet); 3) The Truck Turn-around Area(17,652 square feet); and, ' 4) Portions of the Former Sulfonation Building Loading Area(3570 square feet). ' Salem Oil and Grease Notice of Intent Page 8 of 11 1 GULF OF MAINE RESEARCH CENTER INC. 1 The surface in all of the above areas currently consists of relatively impervious ' densely packed gravel (Lyn-Pac), with the exception of a portion of the Former Tannery Area Portions of this area are vegetated with upland grasses and herbs, and a large concrete and brick slab.is also present. The paving of these areas will not result in a ' substantial change in the amount of impervious area on the Site. The majority of these areas is currently covered with a relatively impervious surface. Runoff from the portions ' of the Former Tannery Area that are currently vegetated will be directed toward the North River Canal. A strip of wooded land exists between the Former Tannery Area and the ' North River Canal. This area will act as a filter for any surface runoff that could enter the Canal, and will allow infiltration of this surface water. tThe applicant proposes to resurface the following areas: 1) The Office Building Parking Area (7320 aquare feet); and, 2) The Finishing Building Loading Area, including the access road leading to Grove Street (18,751 square feet). ' The above areas are currently paved, although the surface of the pavement is ' deteriorating. The activities in these areas will not result in a change in the amount of impervious area on the property (See Engineer's Report in Appendix Q. The project as a ' whole will not result in an increase of surface water discharge to the North River Canal. Also proposed is the installation of spill control structures in the loading areas ' adjacent to the Former Sulfonation Building. The spill control measures will consist of concrete pads equipped with catch basins to collect spilled materials or divert rainwater as ' necessary. Construction will include grading necessary to ensure that spilled materials in the loading areas are not discharged to the canal. ' The Pipe Transfer Area on the south side of the Finishing Building is currently equipped with spill control structures. To the extent possible, the existing concrete pad ' and catch basin will be retained during construction. Surrounding grades will be created to maintain current drainage patterns in this area. Following completion of the project, all materials loading and unloading areas will be equipped with appropriate spill control ' structures to ensure that no released materials enter the North River Canal. Two five-foot wide grassed filter strips are proposes along the southern edges of ' the North River Canal. One filter strip will be located adjacent to the Former Sulfonation Building Loading Area and one will be located between the Finishing Building and ' Building 59. The purpose of these filter strips is to prevent any direct discharges of ' Salem Oil and Grease Notice of Intent;Page 9 of 11 GULF OF MAINE RESEARCH CENTER INC. 1 surface runoff into the North River Canal. The filter strips will allow surface water to ' infiltrate instead of running into the Canal. Because the areas in which products and materials are transferred will be equipped with catch basins, spills will not be directed into the filter strips. ' All of the above described structures are located in the Buffer Zone of a Coastal Bank and the Resource Area Land Subject to Coastal Storm Flowage. ' 6.3 Materials Handling Modifications The applicant proposes upgrades to several materials management structures at ' the facility. These alterations are proposed to provide secondary containment for storage and transfer structures, and to improve materials management practices at the facility. The proposed upgrades include construction of a covered above-ground pipeway for ' several steam and product pipes that run between the Finishing Building and Building 59. The pipeway has been designed to prevent a release of oil.in the event of a break in one of ' the product pipes. The applicant also proposes relocation of a subsurface lift station adjacent to Building 59. t A 5000-gallon underground fuel oil storage tank adjacent to Building 59 will be removed, as will an above-ground skid-mounted tank adjacent to the Finishing Building. ' The tanks will be replaced with new tanks located between Building 59 and the Finishing Building. The new tanks will be mounted above ground on a concrete pad, with a concrete berm that provides secondary containment for the tanks. This berm will provide a sufficient storage area to prevent spills from the tanks from reaching the canal. The applicant also proposes to install a new waste manifold system above the ' floor grade inside the Finishing Building. The manifold will replace existing metal pipes below the floor grade. The manifold will collect wash water and process water from the ' product storage areas in the Finishing Building. The collected waste water will drain to the existing lift station, from which it will be pumped to the on-site wastewater treatment ' facility. The manifolds will be constructed of Schedule 80 PVC pipe and will be equipped with catch basins and secondary containment structures. The existing waste water collection pipes beneath the building's floor will be abandoned. This improvement in waste water handling will reduce the likelihood of an inadvertent discharge of wash water or process water to the North River Canal. All of the above described structures are located in the Buffer Zone of a Coastal Bank and the Resource Area Land Subject to Coastal Storm Flowage. ' Salem Oil and Grease Notice of Intent;Page 10 of 11 GULF OF MAINE RESEARCH CENTER INC. 6.4 Building Additions ' The applicant proposes additions to the Pre-Treatment Facility and Building 59. The additions will be used to house additional air and water treatment equipment. The ' addition to the Pre-Treatment Facility will also house the spill control tank discussed in Section 6.2. The addition to the Pre-Treatment Facility is not located within the Buffer ' Zone or any Resource Area. The addition to Building 59 is located in the Buffer Zone of a Coastal Bank, and the Resource Area Land Subject to Coastal Storm Flowage. An addition to the Finishing Building is also proposed. This addition will consist of warehouse and product storage space. The purpose for this addition is to eliminate product storage in the Office Building and the Barrel Storage Building on the north side of the canal. This modification of product storage practices will eliminate the current practice of product transfer across the North River Canal, through the existing covered walkways. Following completion of the addition to the Finishing Building, all product storage would be on the south side of the canal, and the covered walkways would be used ' only for pedestrian traffic. The product storage areas within the addition to the Finishing Building will be equipped with appropriate spill control measures to provide secondary ' containment for spills and prevent releases into the canal. In conjunction with the addition to the Finishing Building, the Loading Dock on ' the south side of the building will be relocated. The ramp will be removed and a new loading area will be constructed on the western face of the existing Finishing Building, immediately south of the new addition. This modification will improve emergency ' vehicle access to the western portions of the site during truck loading and unloading operations. Under the current Site layout, trucks using the Finishing Building Loading ' Dock must park perpendicular to the Finishing Building, restricting vehicular access to the western portion of the Site. The proposed loading area alignment will allow trucks to park parallel to the building, maintaining open access to the western portion of the Site. 7.0 RESOURCE AREA PROTECTION ' The Site's Resource Areas will be protected throughout the completion of the ' proposed project. During excavation of contaminated soil, a hay bale siltation barrier will be installed downgradient of all areas of disturbed soil. A similar barrier will also be installed downgradient of the subsurface drainage system during its construction. No stockpiles of excavated soil will be stored in the Buffer Zone or any Resource Area. No activity is proposed within the Resource Areas Coastal Bank or Land Under Water ' Salem Oil and Grease Notice of Intent:Page I I of 11 GULF OF MAINE RESEARCH CENTER INC. ' Bodies and Waterways. The proposed project will not result in a negative impact to any ' of the Site's Resource Areas. The result of the proposed project will be an overall improvement in environmental conditions at the Site. Stormwater drainage and spill control will be ' improved by the addition of concrete pads and catch basins in materials loading and unloading areas. Paving of areas of contaminated soil will prevent worker exposure to ' contaminants and will mobilization of contaminants. The replacement of the underground and the skid-mounted storage tanks will reduce the likelihood of a release of ' oil impacting the Site's Resource Areas. t8.0 CONCLUSIONS The purpose of the proposed project is to eliminate the pathway for worker ' exposure to contaminated soil at the Site and improve Site spill control measures. These activities are proposed to bring the Site into compliance with the SPCC Regulations and ' the Massachusetts Contingency Plan, which requires that a permanent solution be implemented on confirmed disposal sites at which a potential worker health risk has been identified. The applicant has considered several alternatives to the proposed method of ' eliminating the potential worker health risk. These included complete excavation of all contaminated soil and biological/chemical treatment of excavated soil. In consideration of the cost and effectiveness of soil remediation, the proposed plan of action is the ' preferred alternative. In reference to minimizing impacts on protected Resource Areas, the proposed alternative is preferable to the remaining options. Complete excavation of ' contaminated soil would create the potential for sedimentation into the North River Canal, and could compromise the integrity of the canal banks. ' The recommended alternative has an added advantage over the complete excavation of contaminated soil from the perspective of protection of Resource Areas. ' The installation of a graded asphalt barrier and a subsurface storm water conveyance system will contribute to water quality in the North River Canal by directing future leaks or spills away from the canal and into a collection tank. Thus the project will result in an ' improvement to the Site by reducing worker health risk and improving spill control measures.
