RE: NOTICE OF INTENT AND PLANS DATED:4/15/76 DATE OF RECEIPT BY DATE OF PUBLIC HEARING: CONSERVATION COMMISSION:4/16 7 5/5/76 Pursuant to the authority of G.L. c. 131 s.40, the Salem Conservation Commission has considered your notice of intent and plans submitted therewith, and has determined that the area on which the proposed cork is to be done is significant to one or more of the interests described in the said act. The aaiPID ( nncgr<ro+_; r_ _- hereby orders that the following conditions are necessary and all work must be performed in strict conformance therewith: CONDITIONS 1 . Failure to comply with all conditions stated herein, and with all related statutes and other regulatory measures, shall be deemed cause to revoke or. modify this order. 2. This order does not grant any property rights or any exclusive privileges; it does not authorize .any injury, to private property or invasion of private rights. 3. This order does not relieve the permittee or .any other person of the necessity of complying with all other applicable federal, state, or local statutes, ordinances, by-laws and/or regulations. _ 4. The work authorized hereunder shall be completed within one (1) year from the date of this order. The order may be extended by the issuing authority for one or more additional one-year .periods upon application to the said issuing authority at lease thirty days prior to the expiration date of the order or its extension. 5 . 'Any fill used in connection with this project shall be clean fill, containing no trash, refuse, rubbish or debris, including, without limiting the generality of the foregoing, lumber, bricks, plaster, wire, lath., paper, cardboard, pipe, tires, ashes, refrigerators, motor vehicles or parts of any of the foregoing. 6. No work riav be comnen-ced until all appeal periods have elapsed from the order of the Conservation Commission or from a final order by the Department of Natural Resources has elapsed. No work shall be undertaker_ until the final Order, with respect to the proposed project, has been recorded in the Registry of Deeds for the district in which the land is located. Copy to be furnished to issuer of this Order showing book and page. S. Upon completion of the work described herein, the applicant shall, forthwith request, in writing„ that a Certificate of Compliance be issued stating that the work has been satisfactorily completed. 9. A sign shall be displayed at the site not less than two square feet or more than three square feet bearing the words, "Massachusetts Department of Natural Resources, File Number 64-13 10. Where the Department of Natural Resources is requested to make a determination and to issue a superseding order, the Conservation Commission shall be a party to all agency proceedings and hearings before the Department of Natural Resources. 11 . The work shall conform to the following described plans and additional conditions : See attached sheet. 31 - PAGE 2-A ATTACHMENT 11 (a) In conformance with the statement of the applicant at the public hearing there shall be no filling on the water side of lots 6 and 7. 11 (b) Lot 5 shall be filled to conform with the Plan of Land in Salem, Massachusetts , Sheets 1 and 2 , prepared by George Hayes, Land Surveyor, dated May Sth, 1976 which was submitted at the public hearing. The fill shall conform with the requirements of condition 5 and furthermore shall contain no deleterious substances which may pollute by leaching. The riprap shall be the size customarily used in the locality for erosion pre= vention and it shall extend to at least the elevation of the 100 year water elevation, 15. 2 feet mean low water datum. 11 (c) The storm drain on lot 5 shall be relocated and con- structed as shown on Plan of Land in Salem, Massachusetts Sheet 1, prepared by George Hayes, Land Surveyor, dated May 5th, 1976 which was submitted at the public hearing. 11 (d) All debris, branches, tree trunks, and stumps shall be removed from the water side of all lots within one week of the expiration of the 10 day appeal period. Salem Conservation Commission Wetlands Hearing May 5, 1976 Ross Construction /Topsfield Meeting began at 7:40, Commissioners present: Brad Northrop, Paul Willis, Brian French, Don Hunt, Dave Devoe, and Mary Ellen Pelletier. Ross P0kas from Ross Construction Gmpany in Topsfield gave a description of the @cork to be done: On lots 6 and 7 there will be no change in topography. On lot 5 he will be putting back the material ; purpose being when the house goes on top, cellar will be loft. into the ground and he'll round it off so there isn't 10 ft. of concrete showing. Other lots - no problem, its all on top. Paul Willis questioned him on the change of brush pile materials but Mr. Ross said that the fire dept. had asked him to remove some brush because of the hazard involved. Paul Willis also asked if Mr. Pikas knew of any easements or right of ways in this area. The answer was no. Also, was there any water requirements for the house (minimum) question on whether building permits had been issued. Permit #12,VQE streesed that he bought the lots only and they came with building permits. Mr. Ross felt as far as beach fill goes, economically it is not worth his •gVhile to fill a beach the beauty of property is that it overlooks the water. Ralph Hobbs, the harbormaster, spoke to say that the clam beds were viable 6or bait digging (clam worm) . He was concerned about the logs over the bank, they should be removed immediately before Mr. Ross is fined and the next llft. tide would take the logs out to sea. C� Richard Morton asked if the fill from one basement was going to be used in the new building - answer was that it was notAgood clean fill but may be used later for basement. Stockpiled right now. Brian French asked about the rip rap size. Not determined as yet. Mr. Leblanc of 65 Dearborn St. claims that in his deed is a right of way to the beach at Ropes Point. He says he has the rights to use this beach and would this construction and the subdivision plans effect this, The answer was given that the right of way has been moved arbitrarily by prior developers, and may not be our jurisdiction. Note: the city owns one lot as a bond. Aa� s�-Nubs, Vote was taken and a request for removal of the logs was approved unanimously. Following a visit to the site it was clear that you have not submitted sufficient information to enable us to judge i the impact of the r p proposed work on the beach. Please supply the following information: 1 . A site plan with a scale of not less than'Q inch to 100 feet and contours at preferably 2 foot intervals, showing the location of the houses, the top and bottom of the bank, the mean low water line, the mean high water line, 100 year flood elevation line and the extent of filling necessary for site development. Please also show any drainage easements or rights of way which may be on the property. 2. Cross-sections through the houses showing foundations and floor elevations, original ground profiles and filled land profiles in areas which are to be filled. t 3• The elevations of all foundations and floors.
