In an attempt to reestablish the original grades of the
property located at 79 Almeda Street , Salem, MA, we have
exhausted all of our funds and available resources . We wish
to reach a compromise on the existing grades , with proper
stabilization of the yard .
We will ensure proper measures to prevent any further
dumping or filling on the above listed property. We
apologize for the improper maintenance of the property and
any inconvenience it may have caused the commission.
We also wish to address the inadequate drainage of
Almeda Street . The rain drains over our property and into
t,Iie wetlands causing fill to be washed out .
We would appreciate your understanding in our dilemma.

As you know, the Conservation Commission granted an extension to you to complete restoration
work to the wetlands behind your house at 79 Almeda Street,with a deadline of June 30, 1997.
The Commission has requested the City of Salem Clerk of the Works to inspect the property and
report back to the Commission. The inspection will take place on or about July 1, 1997. Please
contact me if you are interested in attending this inspection.
The Conservation Commission has placed your property on its July 10, 1997, 7:OOpm meeting to
discuss the enforcement order and possible action against you as the owners of 79 Almeada

RE: Enforcement Order-violations at 79 Almeda Street
Dear Mr. and Mrs. Ryan:
Thank you Frederick Ryan along with Mr. Orlando for attending the Conservation Commissions April
10, 1997 meeting to discuss and explain the illegal filling of wetlands that has taken place on your
property. As you know and at your request,the Commission voted to extend the Enforcement Order
completion date from April 1, 1997 to June 30, 1997 to allow you sufficient time to complete the ordered
work.
As discussed,you have approval from the Conservation Commission to perform the ordered restoration
and that no heavy equipment shall be allowed in the remaining undisturbed wetlands. At your request I
am enclosing another copy of the existing Enforcement Order dated January 23, 1997. The original
Order was delivered by the Salem Police Department and received by Alicia J Ryan on 2/7/97.
As you know,the Order still stands and you are required to restore your property to the conditions shown
on the March 25, 1991 Notice of Intent plan and you are still subject to the conditions stated in said
Enforcement Order.
As stated, please notify the Commission one week prior to commencement of work to allow for
inspection by Clerk of Works.

Dear Mr. Orlando:
The Metropolitan Boston/Northeast Regional Office of the
Department of Environmental Protection intervened on the above-
referenced project in a letter dated May 2 , 1991. The Department
hereby withdraws its appeal of the project. This withdrawal hereby
abrogates any further action by the Department in this matter and
the associated appeal .
The Department ' s withdrawal of this appeal establishes the
Order of Conditions issued by the Salem . Conservation Commission,
issued April 23 , 1991, as the Final Order of Conditions regulating
activities on the project site.

Notice of Appeal
Dear Mr. Orlando:
Under the provisions of the Wetlands Protection Act,
Massachusetts General Laws, Chapter 131, Section 40, and upon its
own initiative, the Metropolitan Boston/Northeast Regional Office
of the Department of Evnironmental Protection hereby appeals the
above-referenced project filing. This intervention is being made
in accordance with 310 CMR 10. 57 (7) (c) as is evidenced by the date
of issuance of the Order of Conditions, defined by the date of the
postmark (being April 23, 1991) . The Department shall assume
jurisdiction over the -above-referenced project and will make a
determination as to whether those areas on which the proposed work
is to be done are significant to the statutory interests identified
in the Act.
The Department is of the opinion that the project proposal and
the Order of Conditions do not contribute to the protection of the
interests identified in the Act, and that the Order of Conditions
is inconsistent with the Wetlands Protection Act Regulations, 310
CMR 10. 00 . The Department' s specific concerns regarding the
proposed project and the Order of Conditions include the following:
1. The Department has not received the revised plans which are
referenced in the Order of Conditions.
The Department hereby requires the submittal of all plans and
documentation which were revised after the Notice of Intent was
filed. This information shall be received by this office no later
than ten (10) days after your receipt of this letter. Upon review
of the revised plans, the Department may schedule a site visit and
prepare for issuance of a Superseding Order of Conditions.
.In the event that the Department determines that the project
as originally proposed protects the interests of the Act and
complies with its regulations, the Department reserves the right
to withdraw its appeal and return jurisdiction to the Salem
Conservation Commission.

Therefore, the hereby finds that the following conditions are
necessary, in accordance with the Performance Standards set forth in the regulations, to protect those Inter-
ests checked above. The orders that all work shall be performed
in accordance with said conditions and with the Notice of Intent referenced above. To the extent that the fol-
lowing conditions modify or differ from the plans, specifications or other proposals submitted with the Notice
of Intent. the conditions shall control.
General Conditions
1 . Failure to comply with all conditions stated herein,and with all related statutes and other regulatory meas-
ures.shall be deemed cause to revoke or modify this Order.
2. This Order does not grant any property rights or any exclusive privileges; it does not authorize any injury
to private property or invasion of private rights.
3. This Order does not relieve the permittee or any other person of the necessity of complying with all
other applicable federal, state or local statutes, ordinances,by-laws or regulations.
4. The work authorized hereunder shall be completed within three years from the date of this Order unless
either of the following apply:
(a) the work is a maintenance dredging project as provided for in the Act:or
(b) the time for completion has been extended to a specified date more than three years, but less than
five years,from the date of issuance and both that date and the special circumstances warranting
the extended time period are set forth in this Order.
5. This Order may be extended by the issuing authority for one or more periods of up to three years each
upon application to the issuing authority at least 30 days prior to the expiration date of the Order.
6. Any fill used in connection with this project shall be clean fill,containing no trash, refuse, rubbish or de-
bris, including but not limited to lumber, bricks, plaster,wire,lath,paper, cardboard, pipe, tires, ashes.
refrigerators, motor vehicles or parts of any of the foregoing.
7. No work shall be undertaken until all administrative appeal periods from this Order have elapsed or, if
such an appeal has been filed, until all proceedings before the Department have been completed.
6. No work shall be undertaken until the Final Order has been recorded in the Registry of Deeds or the land
Court for the district in which the land is located,within the chain of title of the affected property. In the
case of recorded land,the Final Order shall also be noted in the Registry's Grantor Index under the name
of the owner of the land upon which the proposed work is to be done. In the case of registered land. the
Final Order shall also be noted on the Land Court Certificate of Title of the owner of the land upon which
the proposed work is to be done.The recording information shall be submitted to the
on the form at the end of this Order prior to commencement of the work.
9. A sign shall be displayed at the site not less than two square feet or more than three square feet in size

On behalf of the current owners of the property at 79 Almeda Street, Frederick and Alicia Ryan,
Hancock Environmental Consultants has revised the permit site plan originally dated 25 March
1991 to show existing conditions as of our site review of 22 December, 1997. Nine (9) prints of
that plan are enclosed and attached hereto by reference.
I am advised by Mr. Ryan that he erected a ten foot length of fence and placed slope plantings in
response to the Commission's Enforcement Order issued 25 September, 1997. The fence and
plantings were observed in place during my site visit, but appear to have had little effect upon
overland runoff from Almeda Street. Evidence of ongoing erosion of the Ryan's property by
unconfined street drainage was observed in the form of a two to three foot wide swale
approximately fifteen feet south of the Ryan dwelling. This feature extends from the change in
grade near the left front corner of the Ryan dwelling to the retaining wall behind the swimming
pool. A silt fan approximately eight (8) feet wide and thirty (30) feet long has formed in uplands
and wetlands adjacent and parallel to the retaining wall. This pattern of erosion and sedimentation
is likely to continue, as none of the measures undertaken by the Ryans appear to have any
significant effect either on the stability of the slope or on the source of the runoff.
The attached plans and this letter are intended to fulfill the terms set forth in items 1. and 2. set
forth in the Enforcement Order. You have advised me that a copy of the plan and this letter will
be routed to the City Engineer for his review and comment. Mr. Ryan will attend the meeting
scheduled for 8 January 1998.
With regard to item 4., 1 must advise you that the plan provided is not recordable, because it has
not been endorsed pursuant to provisions of Massachusetts General Laws, Chapter 81. It could
be reduced or reproduced in detail as an attachment to an instrument such as a Modified Order of
Conditions, but would require extensive redrafting in order to be recorded. Time constraints
simply did not permit that work to be done.

Dear Mr. and Mrs. Ryan:
Thank you Frederick Ryan along with Mr. Orlando for attending the Conservation Commissions April
10, 1997 meeting to discuss and explain the illegal filling of wetlands that has taken place on your
property. As you know and at your request, the Commission voted to extend the Enforcement Order
completion date from April 1, 1997 to June 30, 1997 to allow you sufficient time to complete the ordered
work.
As discussed, you have approval from the Conservation Commission to perform the ordered restoration
and that no heavy equipment shall be allowed in the remaining undisturbed wetlands. At your request I
am enclosing another copy of the existing Enforcement Order dated January 23, 1997. The original
Order was delivered by the Salem Police Department and received by Alicia J Ryan on 2/7/97.
As you know, the Order still stands and you are required to restore your property to the conditions shown
on the March 25, 1991 Notice of Intent plan and you are still subject to the conditions stated in said
Enforcement Order.

2. Cease and desist all dumping and secure area from future dumping.
3. All fill shall be removed off sight.
4. All work to be fully completed by April 1, 1997.
5. Salem Conservation Commission shall be notified one week prior to commencement
of work to allow for inspection by Clerk of Works.
Failure to comply with this Order may constitute grounds for legal action,
Massachusetts General Laws Chapter 131, section 40 provides:
Whoever violates any provision of this section shall be punished
by a fine of not more than twenty-five thousand dollars or by
imprisonment for not more than two years or both, Each day or
portion thereof of continuing violation shall constitute a separate
offense.
