Petition of GENIA PATESTIDES requesting a Special Permit under Section 3.3.2 Nonconforming
Uses of the Salem Zoning Ordinance to allow a change from one nonconforming use to another
nonconforming use,at the property located at 107 FEDERAL STREET (112 Zoning District).
On December 18, 2013, the Board of Appeals met to discuss the petitioner's request to withdraw the above
referenced petition without prejudice. The following Board of Appeals members were present: Rebecca
Curran (Chair), Annie Harris (Vice Chair), Richard Dionne, Thomas Watkins, and David Eppley (Alternate).
Board of Appeals members Mike Duffy and James Tsitsinos were absent.
At the request of the Petitioner, the Board of Appeals voted to allow the Petitioner to withdraw the petition

addressed.
Please be advised, my last letter directed you to correct a zoning violation.

fact that its location does not agree with the decision of the Zoning Board. I also directed
you to contact me to discuss this.
At this point, with no response from you, 1 am directing you to relocate the shed to
conform with the drawings that were approved by the 1989 Zoning Board of Appeals
Decision.
The shed needs to be relocated within 30 days upon receipt of this notice. Failure to
comply will result in further enforcement action. Your right to appeal this order is to the
Zoning Board of Appeals.

Dear Owners:
I have received a complaint regarding the placement of the shed in your yard. As you are
aware, in June of 1989, you petitioned the Salem Zoning Board of Appeals to construct a
shed within the 5 foot setback that is required. A recent survey of 102 Federal Street
shows that your shed encroaches upon 102 Federal Street by 2 feet-seven inches.
Normally we would not be involved in a property line issue, but in this case, it appears
the shed was not constructed per the plans that were submitted to the Zoning Board of
Appeals. This violates the terms of the Z.B.A decision.
You are directed to contact this office upon receipt of this letter to discuss this matter.

A hearing on this petition was held June 14, 1989 with the following Board
Members present: James Fleming, Chairman; Messrs. , Bencal, Febonio, Luzinski
and Nutting. Notice of the hearing was sent to abutters and others and notices
of the hearing were properly published in the Salem Evening News in accordance
with Massachusetts General Laws Chapter 40A.
The petitioners, owners of the property, are requesting variances from side and
rear setbacks to allow construction of a shed in this R-2 district.
The Variances which have been requested may be granted upon a finding of the
Board that:
a. special conditions and circumstances exist which especially affect
the land, building or structure involve and which are not generally
affecting other lands, buildings and structures in the same district;
b. literal enforcement of the provisions of Zoning Ordinance would involve
substantial hardship, financial or otherwise, to the petitioner;
c. desirable relief may be granted without substantial detriment to the
public good and without nullifying or stubstantially derogating from the
intent of the district or the purpose of the Ordinance.
The Board of Appeal, after careful consideration of the evidence presented at the
hearing, and after viewing the plans, makes the following findings of fact:
1 . There was no opposition presented to the petitioners plan.
2. To place a shed anywhere on the property would require relief
from the Board of Appeal.
3. The shape of the lot makes this the most feasible location for
for the shed.
On the basis of the above findings of fact, and on the evidence presented, the
Board of Appeal concludes as follows:
1 . Special conditions exist which especially affect the subject property
but not the district generally;
2. Literal enforcement of the provisions of the Ordinance would work a
substantial hardship on the petitioners;
3. The relief requested can be granted without substantial detriment to the
public good and without nullifying or substantially derogating from the
intent of the district or the purpose of the Ordinance.

Therefore, the Zoning Board of Appeal voted unanimously, 5-0, to grant the
Variances requested, subject to the following conditions:
1 . All construction be done as per City and State Building codes and with
a legal building permit.
2. Dimensions be as per the plans submitted.
3. Petitioners obtain a Certificate of Appropriateness from the Historic
Commission, a copy to be provided to the Board of Appeal for the file.
4. Exterior finishes of the proposed shed be in harmony with the existing
building at 104 Federal Street.

We did in fact petition the Salem Zoning Board of Appeals to construct a shed within the 5 foot
setback,and received permission. We also at that time (1989) conferred with the then owner of
the adjacent property at 102 Federal Street,concerning the placement of the shed. We agreed that
placing the shed closer to 102 Federal would allow a better view from the north unit's north
window,and agreed that the shed would be constructed so it could be moved to allow efficient
painting of the north wall. In fact when,102 Federal was recently painted the shed was temporarily
moved for this purpose.
The agreement was documented in writing,and we are researching the matter to find the
documentation of this agreement,and will contact you at a later time with the,details
