Tuvell 80 %Warren Street Concord, NH 03301 Dear Ms. Tuvell: In accordance with Chapter II of the State Sanitary Code, 105 CMR 410.000, Minimum Standards of Fitness for Human Habitation, a recent re-inspection was conducted of your property located at 17 Osgood Street, conducted by Jeffrey Barosy, Sanitarian of the Salem Board of Health on January 5, 2026. At that time the following items were still outstanding: Basement: - The basement lights still do not work. - The fourth stair from the bottom of the basement stairway is still cracking and has a nail sticking out of the top surface. Bathroom 1: - There is still evidence of water leakage in the first-floor bathroom's ceiling above the sink. - The window sash still does not close completely. The inspector was informed by the occupants that they screwed the window sash closed to keep out cold air. - The window can lock, but that is because its sash is screwed shut, allowing the locking mechanism to reach the sash. Dining Room: - The right-side door amongst the double doors leading to the rear porch still does not lock. Dwelling Unit: - The smoke and carbon monoxide detectors are not operational. According to the occupants, when they put batteries into the smoke and carbon monoxide detectors they would beep incessantly. The City of Salem Fire Department has been notified. Kitchen: - The dishwashing machine's door still cannot stay closed under its own power. The floor tiles in front of the refrigerator are still loose, and a small portion of the subfloor is still exposed. NOTE: The inspector has been made aware by the property owner and the dwelling unit's occupants that there has been difficulty arranging time for the property owner's contractors to have access to the dwelling unit to conduct work. It is up to the property owner and the occupants to come to an agreement on the days and times work will be conducted at the dwelling unit. Any arrangements for how the work is conducted must also be discussed and agreed on between the property owner and the occupants. Regarding when and how work is conducted, the Salem Board of Health reminds both parties they have the right to seek relief in housing court. Failure of both parties to come to an agreement on when and how work is conducted in the dwelling unit to bring it into compliance will result in the Salem Board of Health filing in housing court to have both parties speak and come to a legally binding agreement before a court appointed magistrate. Both parties have fourteen (14) days from the property owner's receipt of this order, based on a returned certified mail card, to come to an agreement on when and how the violations of 105 CMR 410.000 found in the dwelling unit will be corrected. All other violations noted in the inspection report of October 16, 2025, have been corrected. Thank you for your cooperation in this matter.
