The release was reported to the MassDEP and subsequently assigned Release Tracking Number(RTN)3-2383.Historic response actions conducted at the Site have included removal of former leaking gasoline USTs, excavation and disposal of contaminated soils, several rounds of groundwater sampling, air sparging (AS) with soil vapor extraction (SVE), and subsurface investigations to define the extent of the release. ■ In 2002,the submittal of a Method 1 Risk Characterization and Class A-3 Response Action Outcome (RAO) Report closed the Site with the MassDEP;stipulated by the implementation of an Activity and Use Limitation(AUL)which prevents the disturbance of subsurface soils greater than 3 feet below the ground surface affected by the gasoline release with a soil management plan(SMP). ■ The Disposal Site is defined as the Property Boundary(i.e.,the AUL Boundary)as show on Figure 3. ■ During 2017—2019,the site was redeveloped as a Valvoline Instant Oil Change(VIOC)facility which involved further excavation of soil and reassessment of site conditions following the natural attenuation of petroleum hydrocarbons. Recent assessment activities indicate soil and groundwater conditions at a significant portion of the site have attenuated and are now approaching background levels or below the applicable MCP Method 1 Standards for Soil and Groundwater. ■ Based upon the findings of a Method 1 Risk Characterization for residual contaminants on Site, a condition of"No Significant Risk" of harm to health, public welfare, and the environment has been achieved for both current and future conditions.No further response actions are required to achieve a condition of No Significant Risk for any current or future foreseeable Site uses.This determination is not predicated on any activity and/or use limitation(AUL),grant of environmental restriction(GER), operation of one or more Active Exposure Pathway Mitigation Measures, or other restriction on potential future activities and/or uses at the release location.It is CSE's professional opinion that the requirements for a Permanent Solution with No Conditions specified in 310 CMR 40.1000 have been met for RTN 3-2383. ■ Based upon a review of the MassDEP online Waste Site/Reportable Release Lookup database no other releases have been reported within the Disposal Site Boundaries with the exception of secondary RTN 3-18399 and 3-19609 which have since been closed. ■ Based on the conclusions of this PSNC,an Activity and Use Limitation(AUL)is no longer necessary to maintain a level of No Significant Risk at this disposal site. ■ On February 28, 2019, Mr. Michael McLaughlin,_Executive Vice President of Henley Salem, LLC recorded A Termination of the Notice of AUL (originally recorded on October 1, 2002) with the Southern Essex County Registry of Deeds in accordance with 310 CMR 40.1083(1)(e).
