That in the spring of 1984 we were informed of an application pending before the Salem Board of Appeals by Mark and Jessica Herbert for a special permit to add an additional fourth rental unit to the property at 95-97 Federal Street and to maintain a third nonconforming unit at said property, permission for which had been conditionally granted by the Board some years earlier , subject to review whenever the property was sold. 2 . That prior to a hearing by the Board on the Herberts ' application on June 20 , 1984 , Mrs . Herbert met with many of the neighbors to discuss the proposal , repeatedly assuring them that she and her husband would occupy one unit of the building as owners and would rent . the other three . 3 . Based on the above representations , many neighbors , including the undersigned, supported the application, either in person or by letters introduced at the hearing, provided certain conditions were met. One such letter is attached. 4 . It is our memory and understanding, based on remarks made at the time of the hearing by members of the Board of Appeals that the special permit was granted on the condition that Mr. and Mrs . Herbert would solely own the property, would occupy one unit and would rent the other three. 5 . It is also our memory and understanding that another condition was that if the Herberts were to sell the property, the two nonconforming units would be subject to review at that time . 6 . It is our understanding that approximately one month after the granting of the special permit , Mr . and Mrs . Herbert filed documents at the Essex Registry of Deeds for four condominium units at the property and have , in fact, recently sold one of the units . 7 . We also understand that the Herberts have not gone through the process under the Salem City Ordinances for obtaining permission to convert what were apartments into condominiums . 8. We feel that the above represents a violation of the spirit, if not the letter , of the Special Permit and requires immediate investigation by the Board of Appeals . 9 . We are afraid that unless the Board of Appeals addresses this situation immediately, it will be much more difficult, if not impossible , to address later, after additional units are sold. 10 . The distance between structures as regulated and determined by the Zoning Ordinance 10-23-1962, is, in my opinion,a sufficient, proper,and reasonably safe distance. This opinion is based on the following; considerations : (A ) The proposed occupancy is not of a high hazard type. (B) The proposed fire detection and extinguishment equipment is adequate for this type occupancy. (C) The proposed structure is sufficient in mean,i of exit and is not of a height as to render aserious or complex evacuation problem should such need arise. (D) The proposed structure will mitigate any hazard which presently exists. The above opinion is made with the .full knowledge that the regulation of distances between structures is not germane wi.;h the authority invested in me. Door closer on boiler room door is broken off. Door catch also missing. Door from basement at top of stairso should require a proper self closing device. This door is also now sagging and does not close properly. This door may not meet requirements. of a fire door rating. First floor: Rear door(egress from room #6) is sagging. No exit sign over door. Remove the door stop from base of corridor door, this defeats the __.__•_._ .. purpose of the electromagnetic door holder. This corridor door also does not close tight. When carpeting is replaced this office shall require the flame .,spread rating to be filed at the bureau office. ' Emergency lighting appears inadequate for full coverage on 1st floor. The Main corridor fire door does not close properly. Second Floors The stairwell doors are held open by electromagnetic door holders. This condition has been allowed to exist but should be approved in writing by the building inspector. The second egress door from room Eight is blocked by a chair in the sitting room. Recommend the rear stairwell door be closed at all times. The laundry chute door is not self closing and appears inadequate. Emergency lighting appears inadequate for the rear egresses. It is recommended that the pull curtains around the beds and the drapes have the flame spread ratings applicable to this type of occupancy and same be placed on file at this office. DAVID PREMAN REQUESTING A VARIANCE FOR 95-97 FEDERAL STREET - A hearing on this petition was held on October 17, 19M with the following Board Members present. James H. Boulger, Jr., Chairman, Douglas Hopper, John Nutting, Anthony M. Feeherry and Associate Member Joseph Piemonte. Notice of the hearing was sent to abutters and others and a notice of the hearing was published in the Salem Evening News on October 3, 1979 and October 10, 1979 in accordance with Massachusetts General Laws Chapter 40A. The Petition of Mr. and Mrs. Preman requests a variance to add a third floor apartment to an existing two-family house at 95-97 Federal Street. A variance is required because the building is in an R-2 district where the proposed use is - prohibited, The Board of Appeals, after consideration of the evidence presented at the public hearing and after viewing the property makes the following findings of fact: (1) The property in question was purchased by the Petitioners approximately a year and one half ago for $67,000. Since the time of that purchase, the property has been utilized as a two-family unit. (2) The property was previously used as a nursing home; however, it had been vacant for approximately two years before being purchased by the Petitioners. (3) The home is situated in a Historic District and is in close proximity to many other will-maintained restored homes of similar if not identical size and configuration. Hearing on this petition was held on Tuesday, December 14, 1976 with members Chairman John Gray, Donald Eames, William Abbott, Jane Lundregan, Arthur LaBrecque, and Associate Member Douglas Hooper present. Atty. Walter A. Costello, Jr. , 1 Salem Green appeared for the petitioner. He stated that the building in question had been vacant since it was formerly used as a nursing home. It contain 25 rooms and 8 bathrooms. The building was used as a nursing home until about six months ago. The building is equipped with sprinklers and fire detectors. The property at present is vacant. It was stated that it would be economically unfeasible to use the building as a one or two family house. The petitioner, Health and Education Services, Inc. has an option to buy the property. The petitioner whose sole business is the North Shore �. Guidance Center, is presently at 162 Federal Street, a few houses down from the proposed relocation. HES, Inc. seeks a variance in order to continue conducting the business of a guidance center, serving the following communities, Salem, Marblehead, Peabody, Danvers, Boxford, Topsfield, and Middleton. The petitioner could purchase the property for $50,000.00, which is within its financial capabilities The petitioner, HES, Inc, said to its attorney that if it bought the property there would be no alterations to the building, as it is suitable in its present state. Several abutters appeared in support of the petition. Several of the abutters felt that the use proposed would be a better use than a boarding house or a six family house, or that type of residential use. The clinic holds office hours from 9:00 A.M. to 8:00 P.M. Monday through Thursday, and from 9:00 A.M. to 5:00 P.M. on Friday, and it would be closed on weekends. They service approximately 20. people a day, and would .employ 18 on staff. The petitioner would have approximately 5,000 square feet for parking. Two abutters appeared in opposition to the granting "o,f. the .variance requested. . The abutters opposed on the ground that the use proposed would.decrease the property value of the surrounding houses, and would not be in the interest of the public good. The Board voted to grant the variance requested. The Board felt that the size of the building, 25 rooms with 8 bathrooms, was a hardship and could not economically be used for a residence, as allowed in a two family zone. The Board found that the proposed use would be the best possible use for the surrounding neighborhood. The Board felt that this proposed use would be preferable to either a boarding house or a multi-family dwelling, and would cause less harmful effect on the neighborhood surrounding. The Board granted the petition with the following conditions: 1. That the facility be used as an Out-patient facility only. 2. That it not be used as a drop-in center. 3. M. on October 16, 1975 Inspection conducted with Emile J. Guy of the Life Safety Code inspection unit of the Dept, of Public Safety and Mr. Ruffing, administrator of the home. The following deficiencies were found to exist at the time of inspection. 1. License from the Commissioner of Public Health has expired, 2. It is recommended that a Class B door be placed at the top of the basement stairs, with a self closing davice attached. The present door is inadequate and uses a plain spring for a door closer. 3. Fire Alarm batteries located in the basement are all reading completely discharged. 4. Several holes located in the ceiling of the laundry room shall be repaired. 5. Recommend the kitchen egress door through the laundry room be changed to a class B door, with a self closing device attached. 6. Recommend the regular kitchen door be made a solid Class B door, with a self closing device attached. 7.. The Fire extinguishing system provided for the kitchen range, shall be connected to the fire alarm system. 8. The egress from the basement out through the garage does not meet code requirements because it leads out through the garage which has an overhead door for egress and the inner door had a slide bolt in closed position on the door. 9. It is recommended that the refrigerators located in the supply room be provided with individual electrical receptacles. The present receptacle (a duplex type) has no cover on same. 10. No record has been filed nor tag affixed to the sprinkler system to show when last tested. 11. Sprinkler system shall require the addition of an inspectors test gauge at the tap most point for use of fire dept. inspectors. 12. Front stair doors at the second floor shall have electromagnetic devices removed# and be kept closed at all times. 13. Second floor front stair way, door towards the rear of *the structure should be changed to open in the direction of the egress stairway. 14. It is recommended that the glass transom located over the front stairway at the second floor be removed and replaced. with fire resistive materials. 15. Extinguisher located in second floor lounge is overdue for recharge: 16. The third floor shall be vacated immediately as it does not meet requirements for occupancy. 17. The fire alarm system has still not been put back into service since the alarm of July 1, 1975• 18. The fire alarm system still does not comply with the requirement for a connection of same,to the City of Salem Fire Alarm office. 19.
