Massachusetts Building Code Analysis based on Massachusetts Amendments to the International
Building Code 2009 Eight Edition effective 2/4/11 and the IEBC 2009.
Chapter 34—Existing Structures
101.4.2 Buildings previously occupied. The legal occupancy of any building existing on the date
of adoption of this code shall be permitted to continue without change, except as is specifically
covered in this code,the International Fire Code, or the International Property Maintenance Code,
or as is deemed necessary by the code official for the general safety and welfare of the occupants
and the public.
Chapter 4: Classification of Work
401.3 Occupancy and use. When determining the appropriate application of the referenced
sections of this code,the occupancy and use of a building shall be determined in accordance with
Chapter 3 of the International Building Code.
Existing Use Group=B,Business
Proposed Use Group=B,Business
The work for this permit is in the category of Repairs and Alteration-Level 1.
Chapter 4:Repairs
401.1 Scope. Repairs as described in Section 402 shall comply with the requirements of this
Chapter.
401.2 Conformance. The work shall not make the building less conforming than it was before the
repair was undertaken.
The proposed repairs and alterations do not make the building less conforming.
Chapter 5: Alterations-Level 1
f 501.1 Scope. Level 1 alterations as described in Section 403 shall comply with the requirements
of this chapter.
501.2 Conformance. An existing building or portion thereof shall not be altered such that the
building becomes less safe than its current condition.
Exception: Where the current level of safety or sanitation is proposed to be reduced, the portion
altered shall conform to the requirements of the International Building Code.
The proposed work does not make the building less conforming.
Chapter 8: Change of Occupancy
801.2 Partial change of occupancy group. Where a portion of an existing building is changed to a
new occupancy group, Section 812 shall apply.
The proposed new use of Suite 208 does not result in a change of occupancy.
Fire Protection
804.1 Fire protection requirements of Section 812 shall apply where a building or portion thereof
undergo a change of occupancy classification.
The proposed new use of Suite 208 does not result in a change of occupancy therefore fire
protection requirements are not applicable.
Change of Occupancy Classification
812.1 The occupancy classification of an existing building may be changed, provided that the
building meets all of the requirements of Chapter 7 applied throughout the building for the new
occupancy group and complies with the requirements of Sections 802 through 812.
The occupancy classification of the building is not changing. It is now a mixed use building with
Group R-2 being the more restrictive.
812.1.2 Change of occupancy group with separation. A portion of an existing building that is
changed to a new occupancy group that is separated from the remainder of the building with fire
barriers having a fire-resistance rating as required in the International Building Code for the
separate occupancy shall comply with all the requirements of Chapter 7 for the new occupancy
group and with the requirements of this chapter.
Per Table 508.4,there is no required separation between occupancies B and B.
