The City's Zoning Ordinance does not give the Zoning Board of Appeals the power to grant a use variance. Please review the following sections of the Zoning Ordinance that would allow you to request relief for the same proposal without requesting an ADU. Let me know whether you would like to replace the requested Special Permits from 3.2.8 and 3.3.5 to the following: 1. A Special Permit per Section 3.3.2 of the Zoning Ordinance—To request a change from a two-family building to a three-family building in the R1 Zoning District. 2. A Special Permit per Section 3.3.3 of the Zoning Ordinance—To allow the extension of the existing roof and staircase within the property's rear, side, and front setbacks. Logistically, I need consent to advertise these revised reliefs by Noon tomorrow. An updated Statement of Grounds should be submitted to the City by Noon on October 8.
