The Undersigned hereby petitions the Board of Appeals to vary the terms of the Salem Zoning Ordinance and allow the project to be
constructed as per the plans submitted, as the enforcement of said Zoning By-Laws would involve practical difficulty or unnecessary
hardship to the Undersigned and relief may be granted without substantially derogating from the intent and purpose of the Zoning
Ordinance.
Statement of Hardship (for Variances):
This statement is submitted in support of our request for three zoning variances associated with a
proposed project to add a second dwelling unit within the existing basement footprint of the

structure. The project does not involve any expansion of the building's current footprint. A copy of
both the existing conditions and proposed plan is attached to this application for reference.
1. Parking Space Variance (Section 5.1.8)
Due to the lot’s size and existing building placement, providing three off-street parking spaces is
not feasible without significant alteration to the structure or elimination of usable open space.
The two provided spaces are sufficient for the intended use and align with neighborhood
conditions. The hardship is a result of pre-existing lot constraints, not actions of the current
owner. This variance will not negatively impact traffic, parking availability, or surrounding
properties.
2. Parking Surface Setback Variance (Section 5.1.6)
The current driveway/parking area encroaches into the required 2-foot setback. We are not
proposing any expansion—only to retain the existing condition as shown on the attached site
plans. Requiring compliance would necessitate the removal or relocation of usable parking,
creating unnecessary hardship. This condition is long-standing, functional, and poses no adverse
impact on adjacent lots.
3. Accessory Building Size Variance (Section 3.2.4)
We propose a 150-square-foot accessory structure—30 square feet larger than permitted. The
slightly increased size is necessary due to a lack of interior storage in the home and will be used
to securely store typical household and maintenance equipment. The structure is appropriately
located and scaled and does not infringe on neighbors or the character of the lot. The hardship
arises from practical needs, not self-created conditions.
