After meeting with the tenant, Manette Hansen, on the property listed above, I contacted the Board of Health on 12-11-06 to request a home inspection. Ms. Hansen listed a number of issues I felt needed to be inspected(no heat,plumbing, and electrical problems). On 12-12-06,John Gehan from the Board of Health did an inspection-copy attached. One area Mr. Gehan stated they could not inspect was the electrical concerns and recommended I contact the city electrical department. Both you and Mark Rochon explained to me how you were unable to go onto private property without the landlord's permission. You then informed me that Ms. Hansen could have a private licensed electrician evaluate her concerns and then forward that information to you,the Building Inspector,Fire Prevention, and the Board of Health. Attached are two evaluations Ms. Hansen obtained. One electrician,Donald E. Cushing,was very general. The other, Franco DeSimone,went into great detail listing a number of safety issues. I would also like to note Ms. Hansen has complained about no heat since she moved in March of 2006. When Mr. Gehan was doing his inspection,the heat was on. Ms. Hansen does not have access to a thermostat; it appears the landlord regulates it. Ms. Hansen also had a plumber come out today to evaluate the heating situation-attached is his note. Lighting shall also be provided to illuminate the exit discharge.Means of egress lighting in occupancies in Use Group R-2,other than lighting within a dwelling unit,shall be wired on a circuit independent of circuits within any dwelling unit. The disconnecting means and ovacument protection device shall not be located within a dwelling unit or such that access to such devices must be obtained by going through a dwelling unit. 1024.2 Intensity of illumination: The intensity of floor lighting sball not be less than one footcandle(11 lux)except as provided for in 780 CMR 1024.3. A maximum of one exit access shall be permitted to pass through a kitchen, storeroom, restroom, closet or similm space provided that passage through such space is not the only means of access to an exit. An exit access shall not pass through a room subject to loclang. Means of egress from dwelling units,rooting units, guestmoms and dormitory units shalt not lead through other such units,or through toilet rooms or bathrooms. It is not feasible for the Owner to remedy the pre-existing condition where the second means of egress for the second and third floor Units is through the primary Unit. To do so would represent an unreasonable hardsbip. She reports, shortly after moving in,the heat was not working. She notified the landlord,Raymond L. Young. He did not respond, so she contacted the Board of Health. She said they did not follow through either. She continued addressing this issue with the landlord and informing him of electrical and plumbing problems too. Ms. Hansen decided to go to Small Claims in October. She started paperwork,but did not have Mr. Young served. Before taking this step, she thought she would first try withholding the rent. A copy of her December I,2006 letter is attached. She then received a letter dated December 2,2006 from Mr. Young. In the last paragraph he addresses a plumber coming. He also mentions how he wants proof her rent is in an escort account. Ms. Hansen then sent another letter dated December 5,2006 in response to Mr. Young's. She also sent along a copy of her money order-copy attached, On December 7,2006,the Salem Housing Authority sent Ms. Hansen a letter stating her landlord was not renewing her lease-copy attached. She feels this is retaliation for her withholding the rent. Lastly,Ms. Hansen received a letter postmarked December 13,2006,but dated December 2, 2006 from Mr. Young. He states he in not renewing her lease because he is moving his parents into his home. Again, M.S. Hansen feels he is retaliating. On December 13th, Ms.Hansen did follow through on the Capias and had Mr. Young served-copy attached, Ms. Hansen would like to know what kind of legal.assistance she could receive. However, in reference to your letter I just received dated June 9, 2006, I found the contents to be retaliatory, discriminatory and most dishonest! • Fire Alarms were not working when black smoke filled the apartment and halls due to an aged and way-below-code dangerous electric wiring system that blew my nearly-new microwave due to power surges. You know that I have never called the fire department although I should have! You had already threatened to evict me if I ever called anyone to come here for any __problem_or.reason_(your quote on several occasions), which is not legal for you to do and I do not appreciate threats, even from "a hot-headed Italian." (again, your quote) • The Fire department responded only to a call from Gem Plumbing Contractors concerning gas odor from an old, dangerous, improperly working gas stove in my apartment, as they are required by law to do. The new stove replacing the old one is a much safer contribution and I am sure your parents would have been more severely distressed by a house fire here, caused by either faulty hazardous electric wiring or a gas leak from faulty equipment. One of my P.C.A.'s is still concerned about the smell of gas in several places in the back of your house. All this is documented by Gem Plumbing Contractors and Salem Fire Department. • Windows - improvement, however there are still nine (9) windows unable to be opened in the sunroom. • Lighting Safety— exterior lights in the rear of house where my entrance is to my apartment may be operational, but I have no known access to their operation, and as they are always turned off at all times, I have not found that they have yet contributed to my safety, which, again has caused me several more falls, as I am disabled and cannot see in the dark. Page I of 3 • The issue we discussed of better lighting for safety, going from your driveway and into the back yard towards my doorway entrance now needs to be addressed as I fell in the darkness twice this past week: once falling into a large lawn mower that I could not see and landed on in pain. • I also fell down the bottom five steps in the hallway staircase when my heel caught in one of the holes in the stair treads. These tears and holes are a threat to the safety of anyone going up or down the stairs. • Problems with the electric lighting in the basement, bathroom and kitchen; especially the kitchen as the lights flicker and several appliances blown. • Kitchen sink garbage disposal not working properly since newly installed. • I would appreciate a safety grab bar installed as a reasonable accommodation for safety, at my doctor's request, as I would be less apt to fall or slip in my shower/tub. • The light in the front hall has not gone on for over a week which keeps the whole hall downstairs in darkness when entering or leaving at night which is unsafe. • I shall expect you to completely respect and honor my adamant request that you address all issues and concerns relating to my tenancy to me. The friends and/or people employed to assist me as P.C.A.'s, etc., would be violating their professional confidentiality commitment if forced to discuss or answer any questioning that personally relates to me and/or my tenancy or privacy. This practice on your part has created anxiety and concern on the part of my employees to date. • If, as you and your representative have stated, there has been little or no upkeep, maintenance and/or cleaning of Apartment 2R, 87 Federal Street., for at least the past seven (7) years, there is, understandably, some catching up that needs to be done, especially in an older house. After stating verbally and in my lease, that the apartment would be cleaned and up to "code" of minimum standards for health and safety and habitability before I moved in, it was necessary for me to spend over $500.00 out of pocket to cleaning companies in order to make the apartment minimally habitable and clean. There is also still more to do in that regard. Tear holes were in the carpet when I first inspected the apartment in January and was noted by your representative, Mr. Thompson, my P.C.A., as well as by the St. Pierre Movers before they brought any items in . They were concerned for their own safety and had to be extra cautious. Also documented by other tenants in the building were the tears and holes and filth previous to my move. • Kitchen sink garbage disposal has again been reported to you as not being operational.. • Bathroom sink is still totally stopped up and smells of mold and mildew as it did when we discussed this issue before I moved in. The tub is still nearly as bad. No wall electric outlet in the bathroom is still a concern. As for the lease issues: • The lease states, as did you verbally, in front of three (3) other witnesses that you would have the apartment clean(ed) before I moved in and when you did not comply, it cost me over $500.00 to hire help to get it cleaned enough to be habitable before the movers came the next day, as scheduled. This cleaning effort was necessary in great part due to the filth left behind by the recent former tenant and her five (5) pet cats. The cat hair and claws all over the apartment did not seem to affect your health adversely at all, at the time, as well as so many years of grime and filth to wade through. - -- - - • -My dog-is-a legal-service-companion animal; my-cat-is-my-one pet.. As-your - — -- - agent representative, Mr. Thompson was always aware of my cat and assured me that "she would be fine, no problem," especially as the tenant before me had had so many. I am surprised that your mother is not aware of your "severe allergy" to cats, as she has had cats until recently and is most fond of them. Also when others were doing repairs/maintenance in my unit, you were right in here with them most all of the time. • Any "personal items" are much less "dangerous" or prolific than those of any other tenants here, and stating otherwise is discriminatory. • You have several times promised the return of the money that belongs to me and others in need, in front of witnesses" also stating that "it is in the mail", to us. The withholding of our money is as theft, as well as illegal, under Section Eight regulations. As it has been held by you over two months now, I am requesting a reasonable amount of interest on that money as well. • As I also previously have stated in writing in a letter dated May 315`, 2006, you may deduct my portion of my June rent from the total amount that you owe me. You may not just keep my money for added fees and rent that are not included on my lease, per regulations of Section Eight as well. Page 2 of 3 • Before and since I moved in, you have met four (4) of my P.C.A. workers, and you know that Section Eight partially covers my expense ($1,200.00) for a "two bedroom" apartment only because of my qualifications for P.C.A care, including nights, ongoing. My P.C.A. workers are with me as much as possible, but they do not reside with me; they have their our residences to go home to. I must say that I wonder and I am concerned at your stating that you believe to have knowledge about what goes on in my private residence "24 hours a day, seven days a week" especially as you are often not at home yourself. That seems to be a gross invasion of my privacyjand stalking is illegal. • You did not mention my ongoing problem of having no heat in my unit these past 3 '/z months of unseasonably cold and damp and rainy weather. As you, only, control the thermostat and the heat, or lack thereof I would consider it only fair that you compensate my extreme difficulty and health hazard from the above, financially to me, as I am sure it was a savings of much greater than $50.00 a month to keep my apartment from getting any available heat since I moved in. • I have also spent hundreds of dollars on rugs for my unit, as you requested at my expense, for you to have "more quiet". • If Mr. Thompson is, in fact, your agent/representative, then his assuring me in front of others of an on-the-property parking space should have been adhered to and still should be, especially as I am disabled. To haul in an old car and change that agreement the morning I came to sign the lease and had - - - — -- to move in-was and-is;-most unethical. --- - -- - • Again, as I have requested, "all communications with me" means just that- and your further abuse and interrogations of my friends and threatening 1?.1vA. workers the other day in front of witnesses, was totally unacceptable. As you may know by now, I am not an easy quitter and these above concerns and problems notwithstanding, I am still most hopeful and anxious to work them out to our mutual satisfaction. Lighting shall also be provided to illuminate the exit discharge.Means of egress lighting in occupancies in Use Group R-2, other than lighting within a dwelling unit, shall be wired on a circuit independent of circuits within any dwelling unit. The disconnecting means and overcurrent protection device shall not be located within a dwelling unit or such that access to such devices must be obtained by going through a dwelling unit. 1024.2 Intensity of illumination: The intensity of floor lighting shall not be less than one footcandle(11 lux)except as provided for in 780 CMR 1024.3.
