I understand the project has been split into four separate permits,The Derby Plaza(Lower) Level,Ground Floor,Guest Floors 2&3,and the Roof Top Area. The first permit seeking a Final Certificate for Occupancy is the Ground Floor that is the Lobby of the hotel,the Counter Restaurant and 8 Guest Rooms. Two single fixture restrooms are provided for public use on that floor and are in operation serving a total of 60 persons. The restaurant also utilizes restrooms on the Derby Plaza Level(Basement)and has 3 fixtures each serving a total of 180 persons. I have been told that these will be complete on Monday or Tuesday of next week. My observation is that this is possible as only sinks and toilet partitions have yet to be installed. The Counter Restaurant has a total of 54 indoor seats plus staff. I suggest that if a Permit of Occupancy is issued for opening this weekend the Owner should be notified that the Total Occupancy on that floor should be limited to 60 persons and increased to the full occupancy when the lower level restrooms are operational. Upon our review all other life/safety/egress requirements have been met for the floor.
