Dear Mr. Correnti:
The Salem Planning Board issued a Site Plan Review, Planned Unit Development (PUD) Special
Permit and Wetlands and Flood Hazard District Special Permit decision to Kennedy
Development Group on January 13, 2011. The decision contains Special Condition 3, which
restricts deliveries to Walmait to the hours between 6 a.m. and 12 a.m. However, the City
Ordinance only permits loading/deliveries from 7 a.m. to 11 p.m. (Sec. 22.2 (4)).The Planning
Board does not have the authority to permit loading/deliveries outside of these hours. Please be
advised that, despite the Planning Board's decision, all the retail establishments included in the
Kennedy Development Group PUD project will be required to comply with the City Ordinance
and must limit delivery hours to 7 a.m. to I I p.m.

As mentioned late yesterday afternoon, please find enclosed a copy of my
correspondence to the Architectural Access Board along with copies of their
recent order and fine notice hearing. Peter Strout will be in touch with you to
set up and inspection of the facility as soon as possible. Any access issues must
be addressed forthwith or Goldeneye must seek appropriate relief from the
Access Board.
Zoning CertiFcate
Please advise your clients to seek appropriate relief for a special permit from the
Board of Appeals for the marine/ferry terminal use. The building inspector is
unable to sign off on compliance under the present zoning ordinance. Goldeneye
will have the support of the administration for the appropriate marine use. We
would not expect to see an application for entertainment uses on the parking lot
(ie. Salem's version of Harborlights).
As mentioned, at the Mayor's request, I am beginning the drafting/adoption of a
Waterfront Overlay District for the area in question. As everyone knows, this is
required for the ultimate new Salem Wharf Project. Ferry terminal use will
certainly be included in same.
Also, it is disturbing to read of the apparent sham musical boats being sold to
individuals with no boats showing up. I assume there is some sort of contractual
arrangement with your client. I hope your clients address this problem
immediately.

A hearing on this Petition was held on May 12; 198LA-;with the -fbuok€t g
Board Members present: Douglas Hopper, Chairman, Messrs. Hacker, Piemonte and
Feeherry. Notices of the hearing were sent to abutters and others and notices
of the hearing were properly published in the Salem Evening News in accordance
with Massachusetts General Laws Chapter 40A.
The Petitioner requests a variance for the property at 63 Federal Street
to use the site for professional offices in addition to not. more than four
residential units. A variance is required because the building is in a R-3
district where the proposed use of the property for professional offices is
prohibited without a variance.
The Board of Appeal, after consideration of the evidence presented at
the public hearing and after viewing the property, makes the following
findings of fact:
(1) The proposed use of the property will upgrade the site without
an adverse effect on the area.
(2) The area has over the last several years become a favored
location for professional offices. This use of the older
properties in the area has had a markedly positive effect in
upgrading the appearance of the street.
(3) The proposed variance received the support of several
persons in the area and no opposition to the proposed use
was raised by anyone.
On the basis of the above findings of .fact, and the evidence presented
at the public hearing, the Board of Appeal concludes as follows:
(1) The property in question is unique because of its size and
location. The building's proximity to local courts and the
Registry of Deeds is particularly convenient for local
attorneys. In addition, because of its size and structure,
it cannot be used economically as only a multi—family dwelling.
(2) The conditions described above especially affect the structure
in question but do not generally affect the zoning district in
which the building is located.

(3) The conditions described above which affect the land in question,
but not the zoning district generally cause the following special
hardship: unless the variance is granted, the property cannot
be utilized for its highest and best use.
(4) The desired variance may be granted without substantial detriment
to the public good because the proposed use is in keeping with
the general area.
Therefore, the Board of Zoning Appeal unanimously voted in favor of
granting the requested relief, the Board grants a variance to the Petitioner
on the following terms and conditions:
(1) The property may be used for professional offices in conjunction
with not more than four residential units.
(2) Six parking spaces shall be maintained at the site as shown on a
plan submitted to the Board.
(3) Prior to use of this property for professional offices the
Petitioner shall be required to obtain a certificate of use
and occupancy from the Building .lnspector.
