Dear owner,
It has come to the building department's attention that the two-family building at 5 Phelps Street
underwent modifications to the top floor of the building at some point by finishing the space
such as adding a kitchen, bathroom, living room and a bedroom. Please note that a Zoning Board
of Appeals decision in the year 2000 denied a special permit for an addition of a third unit in this
space. It appears that the space was finished without a permit after the denial of a special permit
and is now currently being used as a third unit for a short-term rental. You are directed to cease
and desist the improper use of this property upon receipt of this notice. Permits must be applied
to disassemble the unpermitted finished space and return the building back to a flowing two-
family dwelling.
If you are aggrieved by this notice, your appeal is to the Zoning Board of Appeals.
