170 NORTH STREET, BASEMENT UNIT, CONDEMNATION ORDER LETTER 9-10-25 l + CITY OF SALEM, MASSACHUSETTS BOARD OF HEALTH 98 WASHINGTON STREET 3'D FLOOR SALEM,MA 01970 DOMINICK PANGALLO TEL. (978)741-1800 health&salem.com DAVID GREENBAUM,RS,CHO MAYOR HEALTH AGENT September 10, 2025 Mr. Alvaro Nunes C/O Attorney Keith Sachs DDSK Law LLC 900 Cummings Center, Suite 21OU Beverly, Massachusetts 01915 RE: 170 North Street, Basement Unit Dear Owner: As a result of several recent inspections of your property located at 170 North Street, conducted by David Greenbaum, Health Agent, for the Salem Board of Health, Voula OrFanos, Building Commissioner, and representatives of the Salem Fire Department, several conditions deemed to endanger or materially impair the health or safety of the occupant were observed in the basement unit. Specifically: • There is no emergency egress window in the bedroom. • There are exposed electrical wires running throughout the basement. • There are exposed sewer pipes running through the basement unit leaking into the kitchen area. • There are no smoke or carbon monoxide detectors in the basement. • There are locked or inaccessible egress doors. • There are containers with flammable liquids stored in the basement. Additionally, the Building Commissioner has issued a cease and desist order to stop using this space and revoked the occupancy. Based upon these findings and in accordance with 105 CMR 410.630(B), the Board of Health determines that the danger to the life or health of the occupants is so immediate, condemnation is ordered immediately and the hearing requirements of 105CMR 410.800 are waived. All occupants of the residence are ordered to vacate the unit immediately. If any person refuses to leave the dwelling they may be forcibly removed by the Board of Health or by local police authorities on the request of the Board of Health. If after one year from the issuance of an order to secure compliance with the minimum standards set forth in 105 CMR410.000 has not been affected, then the Board of Health may cause the dwelling to be demolished. Any costs borne by the Board of Health are a debt to the City and shall be recoverable from the owner in an action of contract. No dwelling or portion thereof, which has been condemned and placarded as unfit for human habitation, shall again be used for human habitation until written approval is secured from, and the Board of Health removes such placard. No person shall deface or remove the placard, except the Board of Health shall remove it whenever the defect or defects upon which the condemnation and placarding action was based have been eliminated. Should you be aggrieved by this Order, you have the right to request a hearing before the Board of Health. A request for such a hearing must be received in writing in this office of the Board of Health within seven (7) days of receipt of this Order. At said hearing, you will be given the opportunity to be heard and to present witness and documentary evidence as to why this Order should be modified or withdrawn. You may be represented by an attorney. Please also be informed that you have the right to inspect and obtain copies of all relevant inspection or investigation reports, orders, and other documentary information in the possession of this Board, and that any adverse party has the right to be present at the hearing. Sincerely, A David Greenbaum Health Agent
