Section 508.3 - R-3 residential units must have a rated separation from the B Business
occupancies below according to Section 508.3.3. Table 508.4 prescribes a 1 hr fire rated floor
assembly between the 2nd Flr residential and the 1 st floor Business occupancies given that this
will be a Fully Sprinklered building. There is an existing 1 hr rated Floor/Ceiling assembly in
place composed of plaster ceiling, wood joists, wood sub-floor and finished wood floor.
Restaurant ceiling has also been given an extra layer of 5/8" Type X F.C. gypsum board for
added safety. An extra layer of gypsum board has been added to both sides of the wall
separating the church from the restaurant. 1st Floor Business and S-1 Storage occupancies do
not need separation.
Chapter 7 Fire & Smoke Protection
Section 707.3.3 Interior Exit Stair Enclosures - Rating shall not be less than 1 hr (based on
being less than 4 stories.
Section 716.5 Fire doors must conform to fire protection rating called for in Table 716.5
Doors into 1 hr fire stair enclusures shall be 1 hr rated and have self closing devices.
Exit doors to outside do not need to be fire rated.
Section 1015.1 Exception: R-3 Residential Unit can have one (1) Means of Egress if it has an
Automatic Sprinkler System and if the length of travel is 75 feet or less (See Section 1014.3).
Table 1015.1 B Business Occupancy can have one (1) Means of Egress if the Occupant Load
is 49 occupants or less.
IEBC 2009
301.1.2 Work Area compliance method- Must comply with applicable requirements in
Chapters 5-13
Alteration Level 2 - 1 st Flr Commercial Kitchen/Restaurant will receive new preparation and
serving equipment. 2nd Flr space shall be re-partitioned to create (2) 1-Family living units.
Code Compliant Fire Alarm System must be completed with modification of residential units.
Conclusions:
Church at 1st Flr needs to keep Maximum Occupancy to 49 persons or less as there is no op-
portunity to create a 2nd means of egress. Church shall use basement as Pastor's office as an
Accessory space of the Church. Additional basement rooms must not be used for child care, but,
only Storage as there is additional diffuculty in egress from those spaces.
Restaurant could be allowed to operate if upstairs is unoccupied prior to installation of
Automatic Sprinkler System.
