Shortly thereafter we converted the first floor apartments into two separate office spaces, one in the front and one in the rear. We were advised at the time that no zoning relief was required as we were going from one conforming use to another in the B-5 Zoning District. We now propose to revert to the prior use of the first floor for two residential apartments. As such the building would return to a five (5) unit apartment building which is a permitted use in the B-5 District. When we discussed this matter, you raised the issue of whether zoning relief was necessary due to the density regulations or parking requirements. Having now carefully reviewed both, I respectfully suggest that no zoning relief is required. With respect to density, Table III of the Salem Zoning Ordinance provides identical density regulations on residential uses and combined nonresidential use. In fact the third column of the Table is entitled "Residential Uses or Combined Residential and Nonresidential Uses - Existing Building". Clearly the by-law makes no distinction between the two so there is no change which would trigger the necessity for zoning relief. Under subsection (1) nonresidential uses have no off-street parking requirement. "New" residential dwellings are governed by 7.3(h)(2)a. "Rehabilitated" buildings are governed by 7.3(h)(2)b. which provides that parking may be provided either on-site or "a combination of on-site parking and/or parking at municipal or other parking facilities in the vicinity of the proposed use." we would appear to be a "rehabilitated building". As you are aware, residential tenants (unlike business tenants or even business owners) are entitled to residential parking stickers which would appear to satisfy this requirement. In fact, that would seem to be the clear intent of providing parking stickers to residents. It may also be that the municipal lot is within 1000 feet, but I don't feel that is necessary to determine. Based on my review of the Salem Zoning Ordinance and discussing this matter with other local zoning "experts" it would appear that we could revert to the former use without any zoning relief.
