A hearing on this petition was held on Tuasday, June 6, 1978, with the following
members of the Board present: Jane Lundregan, Donald Eames, Douglas Hopper and James
Bouls r. Notices were sent to abutters and others in accordance with Pass. General
Laws, Chapter 808. The notice of hearing was duly published in the Salem Evening News
advising the public of said hearing.
The Petitioner was represented by Atty. George P. Vallis, One Church Street, Salem,
Pass. The Developer for the site in question is George Aulson who is the owner of
he fire station building on the adjacent property. He would like to build a three
level structure for commercial, office and residential use which is to be located behind
the fire station building, ,known as parcel RC-1D. A variance is needed from the parking
requirements since the proposed use for the building cannot meet the parking require^.ents
The Board voted unanimously to grant the variance requested with the condition that
the landlord shall provide adequate off street parking spaces for the tenants since
r such space cannot be otherwise provided for on the property in question.

The Board found that the granting of the variance would not be detrimental to the
surrounding neighborhood, would not derogate from the Salem Zoning By-"law and would be
the best use for the property in question.

parcel is not now, and never has-been, recognized�as a valid street address.
This parcel has no frontage on Salem Green; in fact, at its closest point,
it is over 130 feet away from Salem Green.
The only address officially recognized by the City, is 33 Federal Street. In
addition to Federal Street, the property has frontageWon-North-Walkway, a
public way which was officially accepted at a special meeting of the City
Council on July 24, 1978. The building's entry fronts on this walkway. The
unauthorized assignation of the Salem Green address resulted in the formaliz-
ation with the City's Code of Ordinances of the traditional address assigning
procedure. This ordiance states that the Board of Assessors has sole
authority to assign street addresses in the city.
Salem Green is an unaccepted pedestrian walkway running from Church Street
between the Lyceum Restaurant and One Salem Green, behind the Lyceum and 81
Washington Street, to the walkway at the rear of City Hall . At no time has
the name Salem Green been used to designate the walkway on which this parcel
fronts.

There have been no tests of the plumbing, drainage and venting
systems of said premises located at thirty-three (-33)--Federal Street

until it.. has been inspected, tested, and approved., as prescribed in
this Code, it shall be uncovered for inspection. after notice to
uncover the work has been issued to the responsible person by the
Inspector of Plumbing.

It shall be the duty of the holder of the permit to give notice
to the Inspector when plumbing work is ready for test and/or inspection,
and such holder of a permit shall make sure that the work will stand
the test prescribed, and that the roughing-in has been completed as far
as practicable before giving the notification. If the Inspector finds
that the work will not pass the test and/or requirements of the Code,
necessary corrections shall be made and the work shall be resubmitted
for test and/or inspection.
4. 11 . 3. Page 25 Final Test and Inspection
When the work in a. building is sufficiently advanced that the
water may be turned on to any or all of the fixtures, the plumber doing
such work, shall, witin five days, notify the Inspector of Plum-bing.
The inspector of Plumbing shall , within two working days, after the
recie_r..t of such notice, proceed with the plumber or his workman and
examine the work with the water turned on to the fixtures. If found

satisfactory and fully completed, a certificate will be issued. to this
effect if desired. Should the examination disclose any defects, the plumber
shall be required to remedy same, without delay, and again notify the
Inspector of Plumbing, as before. Should a licensed plumber holding a'
permit card for work in a, building, turn the water on and to such and
and neglect to send the notification as required, or neglects to remedy
any defects that may have been found and pointed out to him by. the Inspector
of Plumbing, ,for a period of over five days, he shall not be granted any
further permits until he shall have complied with these rules, or until
action is taken by the Inspector of Plumbing as provided for in Chapter
142 of the General Laws.
I will not sign any occupancy permit in regards to aforesaid, premises
belonging to Mr. George Aulson, nor will I in any future time sign any
occupancy permit until mechanical contractors comply with the
Massachusetts State Plumbing Code.

The Redevelopment Authority has approved the plans submitted by Mr.
George Aulson for the development of a commercial and residential building
to be built adjacent to the Old Fire House. Inherent in the approval is the
understanding that window wells located on the east wall of the building may
encroach on the public walkway. Because this encroachment is not significant,
and because an alternate design may be inferior, the Authority's approval of
the design constitutes permission to locate the window wells in the walkway,
as shown on the plan.
