43 Rear Walter Street Statement of GroundsProject: Lowe, Sonia & Tyler 43R Walter Street Salem, MA 01970 STATEMENT OF GROUNDS (for Special Permit) We request a Special Permit for the reconstruction of a rear deck at 43R Walter St., Salem, MA 01970. Additionally, we request permission to modify the current stair layout down to the yard, which will also act as a landing for an enclosed 3 -season porch under the new rear deck. We understand the existing rear yard set back is 28.8’ where 30’ is required, and that by adding the new staircase the proposed rear yard set back will be reduced to 25’. The new deck footprint, when factoring stair dimensions, is slightly deeper than the existing in order to provide adequate clearances around the bulkhead at ground level. The current bulkhead entrance is deteriorating and unsafe for the homeowners to use, and the current stairs within the bulkhead are extremely steep and not to code. The deck above the bulkhead is also unsafe due to improper stair framing and steps that have pulled away from the deck structure. Therefore, it is our feeling that the additional 3’ of lot coverage is necessary to provide a safe basement egress for the homeowners. The design elements of the deck, stairs, and enclosed 3-season porch will match an existing exterior addition including cedar impression shingles, composite decking, aluminum rail systems, and stained wood framing. All these materials were previously approved by the Town of Salem, MA during construction of the existing exterior addition in 2024, and deemed keeping in character with the neighborhood aesthetics.
