We propose to rebuild an existing deck and add an enclosed sunroom below, at ground level. The existing lot is already non-confirming.

The Undersigned hereby petitions the Board of Appeals to vary the terms of the Salem Zoning Ordinance and allow the project to be
constructed as per the plans submitted, as the enforcement of said Zoning By-Laws would involve practical difficulty or unnecessary
hardship to the Undersigned and relief may be granted without substantially derogating from the intent and purpose of the Zoning
Ordinance.
Statement of Hardship (for Variances):
We request a variance to rebuild an existing deck on an already non-conforming lot, 43R Walter Street, Salem, MA. The existing deck
and stairs are unsafe in their current condition and would not pass a safety inspection due to incorrect framing, rotting materials, and
stairs that do not connect to the current deck platform appropriately nor do they reach the yard below. In order to maximize the use of
outdoor space on all levels, the clients request the permission to enclose the underside of the new deck and create access from the first
floor. The new enclosed area would not extend beyond the footprint of the deck above, thus not impeding any further on the open yard.
