Notices were sent to abutters and others in accordance with Mass. General Laws, Chapter 808. The notice of hearing was duly published in the Salem Evening News advising the public of said hearing. The Petitioner was -represented by Atty. George P. Vallis, One Church Street, Salem, Mss. The Petitioner is requesting a variance on the front, side and rear lot lines in order to construct a single three level structure for multi-family use and a parking stall as an accessory building. All are permitted uses in the urban renewal B-5 District. The proposed structure will contain eight condominium units and there is no way that 'the building can be constructed on the site without obtaining the variances requested. The parking stall will be constructed right on the boundary line. The building shall be designed for the best possible use of the parcel and the aesthetic use of the property. the Board voted to grant the variance requested as shoWn on e site plan dated I th May 23, 1978: front yard, from IS ft. to 0 ft. ; easterly sideyard,ftom30 ft. to 0 ft. ; and rear yard, from 30 ft. to IS ft. Said variances shall be granted with the stipu- lation that the parking shed shall not encroach over the abutting property line of the New England Telephone Company property. The Board voted that to deny the petition requested uould cause substantial hardship to the Petitioner and that much study and work has -One into the development of the best possible use of the land. With particular regard to the firestopping requirement, it is basic- ally governed by local codes and the discretion of the local build= ing inspector. Our installation instructions call for firestopping , as a normal component when penetrating a floor level or going up through an attic level. The reason that firestop installation is called for on the top of a framed opening going into an attic is to prevent the entry of any potentially combustible insulation into the opening in the ceiling.. At locations other than an attic , the firestop location is called for on the bottom side of the framed opening since insulation entry would normally not be a problem. More to the point, from a fireplace safety standpoint, - the location of the firestop is immaterial with regard to the temperature of ad- jacent combustible materials. The location of the firestop is only of consequence in relationship to the requirements for firestopping capability in building construction as, governed by local codes. As long as you have maintained the required 211 clearance of the flue pipe from combustibles, the manner in which you have installed the firestopping on top of the extended plywood flooring should be satisfactory and in compliance with normal installation practices. Again , from the standpoint of safety of the fireplace system and the temperatures of adjacent combustible materials, the firestop can be safely installed on either the top side or bottom side. of the ceiling through which it passes . This office has investigated the placement of the heat pump in question and has found that due to the Zoning District it is located in it does not constitute a zoning violation. However, based on my conversation with Ms. McClune and my knowledge of the sound that this equipment can transmit, it may be a source of "noise polution" and a complaint should be filed with the City Health Agent.
