A hearing on this petition was held on Tuesday, June 6, 1978, ivritft the following
members of the Board present: Jane Lundregan, Donald Eames, Douglas Hopper and James
Boula0er. Notices were sent to abutters and others in accordance with Mass. General
Laws, Chapter 808. The notice of hearing was duly published in the Salem Evening News
advising the public of said hearing.
The Petitioner was -represented by Atty. George P. Vallis, One Church Street, Salem,
Mss. The Petitioner is requesting a variance on the front, side and rear lot lines in
order to construct a single three level structure for multi-family use and a parking
stall as an accessory building. All are permitted uses in the urban renewal B-5
District.
The proposed structure will contain eight condominium units and there is no way
that 'the building can be constructed on the site without obtaining the variances requested.
The parking stall will be constructed right on the boundary line. The building shall
be designed for the best possible use of the parcel and the aesthetic use of the property.

New England Telephone Company property.
The Board voted that to deny the petition requested uould cause substantial
hardship to the Petitioner and that much study and work has -One into the development of
the best possible use of the land. The Board found that the granting of the variance
would not derogate from the intent of the Salem Zoning By-la,.

Dear Mr. Rostanzo:
This will confirm our telephone conversation regarding .the fire-
place installations at the New Salem condominiums onFederalStreet
in Salem, Nla.
With particular regard to the firestopping requirement, it is basic-
ally governed by local codes and the discretion of the local build=
ing inspector. Our installation instructions call for firestopping ,
as a normal component when penetrating a floor level or going up
through an attic level.
The reason that firestop installation is called for on the top of a
framed opening going into an attic is to prevent the entry of any
potentially combustible insulation into the opening in the ceiling..
At locations other than an attic , the firestop location is called
for on the bottom side of the framed opening since insulation entry
would normally not be a problem.
More to the point, from a fireplace safety standpoint, - the location
of the firestop is immaterial with regard to the temperature of ad-
jacent combustible materials. The location of the firestop is only
of consequence in relationship to the requirements for firestopping
capability in building construction as, governed by local codes.
As long as you have maintained the required 211 clearance of the
flue pipe from combustibles, the manner in which you have installed
the firestopping on top of the extended plywood flooring should be
satisfactory and in compliance with normal installation practices.
Again , from the standpoint of safety of the fireplace system and the
temperatures of adjacent combustible materials, the firestop can be
safely installed on either the top side or bottom side. of the ceiling
through which it passes .

Dear Councillor Harvey:
The day following your call regarding placement of heat pumps I
received a call from a Ms. Marilyn McClune of 30 - 9 Federal Street
regarding the same subject and I am forwarding a copy of this letter
to her.
This office has investigated the placement of the heat pump in
question and has found that due to the Zoning District it is located
in it does not constitute a zoning violation. However, based on my
conversation with Ms. McClune and my knowledge of the sound that this
equipment can transmit, it may be a source of "noise polution" and a
complaint should be filed with the City Health Agent.
I would further suggest that in the complaint reference be made to
Chapter 161 , Noise Control, of the City of Salem, Code of Ordinances, of
which I am enclosing a copy for your review, as an additional alleged
violation.

It shall be unlav,-ful for any person to make, continue, or

(1) Endangers or injures the safety or health of humans `
or animals, or
(2) Annoys or disturbs a reasonable person of normal sen- fr`ti

(3) Endangers or injures personal or real property, which
noise shall be termed a "noise disturbance" for the
purposes of this chapter.
Noncommercial public speaking and public assembly activi-
ties conducted on any public space or public right-of-way shally* >

(4) Loadivg and unloading, manufacturing activities. Load-
ing, unloading or other handling of boxes, crates, con-
tainers or building materials or similar objects and

hours of 11:00 p.m. and 7:00 a.m. the following day in
such a manner as to cause a noise disturbance across =;
a residential real property boundary.
(5) Construction. Operating or permitting the operation of
any tools or equipment used in construction, drilling,
or demolition work between the hours of 6:00 p.m. and '
7:00 a.m, the following day on weekdays or at any
time on Sundays/weekends or holidays, such that the
sound therefrom creates a noise disturbance across a
residential real property- boundary, except for emer-
gency work of public service utilities or by special vari-
ance issued by the building inspector pursuant to the Salem

bance across a real property boundary or on a publics

permit 41577-95 . As of this date we have not received a
call for an inspection of work having been completed. If,
work pertaining to permit 41577-95 has been completed,
please call for a final inspection. If work is still
ongoing please notify us of such, so we can continue to
monitor the work.
If this office does not hear from you within fifteen
( 15 ) days , your permit will be revoked and work will not
be certified per State Building Code .
