Following the recent fire, we are requesting zoning relief to allow the rebuilding of our
home consistent with structural safety, current building codes, and the property’s
existing footprint.
1. Do special conditions and circumstances especially affect the land, building, or
structure involved, generally not affecting other lands, buildings, and structures in
the same district?
Yes. The subject property is improved by a legally existing single-family home that
predates current zoning and is legally nonconforming. The structure sustained
extensive fire damage that compromised the entire roof system, including the attic
framing and support members. This level of damage is unique to this property and
does not generally affect others in the district. Additionally, the home’s placement
within the lot’s setback areas—established long before current zoning—combined with
the lot’s size and shape, imposes rebuilding constraints not commonly faced by
neighboring properties.
2. Will literal enforcement of the provisions of the Ordinance involve substantial
hardship to the applicant in attempting to put the property to productive use?
Yes. Due to the fire damage, the roof structure requires full replacement; partial repairs
are neither safe nor compliant with current building codes. The attic space is integral to
this structural rebuild and necessary to meet all applicable safety, insulation,
ventilation, and egress requirements. Strict enforcement of current setback and
dimensional requirements prevents rebuilding within the existing footprint, which would
leave the property partially unusable and impose significant practical and financial
hardship.
3. Can desirable relief be granted without substantial detriment to the public
good, and without nullifying or substantially derogating from the intent of the
district or the purpose of the ordinance?
Yes. The proposed roof replacement and attic reconstruction will restore the home
within its original footprint and maintain its character as a single-family residence. The
chosen roof design aligns with the architectural character of neighboring homes, many
of which include attic spaces, ensuring visual continuity within the neighborhood.
Elevations confirm there will be no increase in building height or bulk. The relief sought
poses no adverse impact on public welfare or neighboring properties and is fully
consistent with the district’s purpose and intent.
We respectfully request that the Board grant the necessary relief so we can restore our
home to its safe, code-compliant condition without altering its original character or use.
