MEMO OF OPTIONS REGARDING SMOKING REGULATION MEMORANDUM Date: 11/23199 To: Board of Health Members From: Joanne Scottj Re: Options regarding Smoking Regulation DELIBERATIONS OF PROPOSED REGULATION PROHIBITING SMOKING IN DINING AREAS OF RESTAURANTS & RESTRICTING SMOKING IN BAR AREAS OPTION 9: DO NOT REGULATE SMOKING AT ALL Advantages: Owners have choice regarding smoking restrictions. Customers have choice to patronize establishment or not. Easy enforcement. Disadvantages: Children may be exposed to second hand smoke. Employees exposed to second hand smoke. OPTION 2: REGULATE SMOKING WHEN KITCHEN IS OPEN Advantages: Owners maintain some choice Owners do not need to renovate. Customers have smoke free dining everywhere. Size of establishment is not a factor. No variance procedures needed. Disadvantages: Employees may be exposed to second hand smoke. Non-smoking "after hours" customers may be exposed. OPTION 3: PROHIBIT SMOKING IN DINING AREA, RESTRICT SMOKING IN BAR. AREA,ALLOW SMOKING IN BARS WHERE ONLY INCIDENTAL FOOD IS SERVED Advantages: Owner may accommodate all customers. Customers have smoke free dining. Disadvantages: Owners must make renovations. Owners of small establishments may not be able to separate smoking and dining area. Difficulty in defining "bar'... if it is where only incidental food is to be served, the effects of alcohol may be increased. Variance proceedings, to allow very small establishments ( perhaps under a certain sq. footage) to have smoking without bar barriers, may be extensive. Barriers may cause exiting problems. OPTION 4: PROHIBIT SMOKING IN ALL ESTABLISHMENTS Advantages: No exposure to second hand smoke for customers or employees. Equal enforcement of regulation regarding all establishments. Ease of enforcement. Disadvantages: No choice for smoking customers.
