Dear Property Owner:
This office has received complaints regarding a rodent infestation on your property located at Heritage Drive in the City
of Salem,Massachusetts.
An on-site inspection was conducted on June 21,2022,by David Greenbaum,Health Agent and Elizabeth Gagakis,
Senior Sanitarian,for the Board of Health. At the time of the inspection,it was noted that there are numerous active
rodent burrows around the property line bordering properties on Proctor Street and Hillside Ave. The stone wall that
encompasses your property has evidence of a severe rodent infestation that is causing rodent activity on neighboring
properties and in the neighborhood at large. Additionally,the dumpsters on this property were found open with trash
blowing out of them and some have no drain plug. Dumpsters must be kept closed when not in use and proper fitting drain
plugs must be installed.
In accordance with Mass General Laws,Chapter III,Section 122 and 123 the Board of Health determines that these
conditions create a public health nuisance.You are ordered to retain the services of a licensed pest control operator
and suppress any rodent population on this property,including in the stone wall at that borders Proctor Street and
Hillside Ave,within fourteen(14)days of receipt of this order. Exterminations must continue until the rodent
population is suppressed and all invoices for extermination must be forwarded to this department upon completion
of the extermination. Additionally,you must take all action necessary to prevent this nuisance from occurring in the
future.
Should you be aggrieved by this order,you have the right to request a hearing before the Board of Health. A request for
said hearing must be received in writing in the office of the Board of Health within 7 Days of receipt of this order. At said
hearing,you will be given an opportunity to be heard and to present witness and documentary evidence as to why this order
should be modified or withdrawn. You may be represented by an attorney. Please also be informed that you have the right
to inspect and obtain copies of all relevant inspection or investigation reports,orders,and other documentary information in
the possession of this Board,and that any adverse party has the right to be present at the hearing.

To Whom it May Concern:
During a recent rodent investigation on your property located on Heritage Drive, Salem,
MA, David Greenbaum, Health Agent for the Salem Board of Health, observed that the
dumpsters on your property are visible from a public way or located in a residentially zoned
area or within 50 feet of a residentially zoned area: This is a violation of City Ordinance 24-
23. Additionally, several dumpsters were found open with trash spilling out and the
dumpsters are missing drain plugs.
Therefore, in accordance with City Ordinance 24-23, Dumpsters, Screening, all
dumpsters visible from a public way or located in a residentially zoned area or within
50 feet of a residentially zoned area shall be enclosed or screened, you are hereby
ordered to keep the dumpsters closed when not in use, install drain plugs on all
dumpsters and provide this department,within 60 days of receipt of this order, a plan
indicating how you will enclose or screen your dumpsters so as to comply with this
City ordinance.
Should you be aggrieved by this Order, you have the right to request a hearing before the
Board of Health.A request for such a hearing must be received in writing in this office of the
Board of Health within seven (7)days of receipt of this Order. At said hearing, you will be
given the opportunity to be heard and to present witness and documentary evidence as to
why this Order should be modified or withdrawn. You may be represented. by an attorney.
