Dear Mr. Greenbaum:
On behalf of our client, Prolerized New England Company, LLC(PNE), a Potentially Responsible Party for the
referenced disposal site, we are providing notification that we are submitting an Immediate Response Action
(IRA) Plan for the referenced Massachusetts Contingency Plan (MCP) disposal site on or about July 16,
2024. RTN 3-50191 was assigned in response to verbal notification made to the Massachusetts Department
of Environmental Protection (MassDEP) on May 16, 2024 of a condition which, in accordance with the MCP
(310 CMR 40.0321(2)(b)), "could pose an Imminent Hazard (IH)to human health"; specifically, the detection
of polychlorinated biphenyls(PCBs) in 3 of 24 samples of surficial material at concentrations exceeding 10
milligrams per kilogram (mg/kg).
It is noted that in accordance with the MCP(310 CMR 40.0321(4)), it may be demonstrated by a
preponderance of the evidence that the release does not pose an IH in conformance with the Imminent
Hazard Evaluation (IHE) process described in the MCP (310 CMR 40.0426). In accordance with that
provision, an IHE was conducted based on the analysis results for samples of surficial material collected at
the disposal site and concluded that an IH does not exist. Therefore, implementation of an IRA is not required
pursuant to the MCP. However, out of an abundance of caution, PNE has elected to post signage at the
perimeter of the disposal site advising trespassers not to enter the properties, and is conducting that action as
an IRA.
