The lot area is approximately 25, 075+/- SF and has a triangular configuration with approximately 209-feet fronting on Essex Street. Presently, there are two buildings that exist on the site. The large white building is presently used as an apartment building with no on-site parking. The other building is used as a commercial business: • automobile repair garage. My client intends to remove the garage building, construct a new 12-unit condominium building, and convert the existing apartment house into 6 residential condominium units. As we discussed at our meeting, several questions have arisen, which will ultimately change the shape of the proposed development. They are as follows: 1. Can the two property lines (that start at Essex Street and intersect each other at a point in the rear) be considered side property lines? Therefore, is the side-yard setback distance 10-feet from these two side property lines? 2. Where these two side property lines meet at a point, can this point of intersection be considered the rear property line (point)? Therefore, is the rear-yard setback distance measured 30-feet radially from this rear point? 3. Can the garage be demolished and a new.residential condominium be constructed, (therefore, changing the use) without a variance to Zoning By-Laws? 4. Can the proposed development have two buildings on one lot without a variance to Zoning By-Laws? 5.
