Dear Mr. St. Pierre:
As you know this office is counsel to Anderson-Tuttle Properties, LLC who has
entered into a Purchase & Sale Agreement relative to the above-referenced
property.
The property is.located in an R-2 Zoning District and is currently used as two
residential units and one commercial unit. The commercial use was allowed by a
variance dated April 25, 1978, subject to the condition that the yard not be used
for parking. A copy of the variance is attached hereto. Prior to the issuance of the
variance the property was used as three residential units.
Anderson-Tuttle Properties, LLC proposes to use the premises as two residential
units, consistent with current zoning and to use a portion of the yard area for four
parking spaces to service the residential units.
Anderson-Tuttle Requests a determination whether or not the proposed use of 421
Essex Street as two residential units with parking for four vehicles in the yard area
is allowed as a matter of right.

Lola H. Ouellette, Trustee of Rilo Realty Trust, through their attorney, George
P. lrallis, One Church St. , Salem, Mass. from applicable terms of the City of Salem
Zoning Ordinance to permit the Petitioner to conduct on the first floor of a three
unit building, a dentistry and orthodontist's office. The parcel is located in an
R-2 District.
Hearing on this petition was held on April 25, 1978, pursuant to notices mailed
postpaid to the Petitioners, Board Members, Abutters, Abutt:crs to Abutters and others,
and a notice was duly published in the Salem Evening News advising. of this public
hearing.
The following Board Members were present at the meeting: Donald Eames, Douglas
Hopper, Arthur Labrecque, Jane Lundregan, William Abbott and ,lames H. Boulger, Jr.
r (James H. Boulgox, Jr. refrained from voting).
The application was submitted to obtain a variance from applicable terms of the
Zoning Ordinance with respect to use. The Petitioner, through his attorney, submitted
the following evidence: The property is situated at the corner of Essox Street and
i''arron Street and is within close proximity to a B-1 Zone where the proposed use is
permitted. The building is used as a three-unit apartment chaelling and it was pro-
posed that the use of the second and third floors unuld remain unchanged. It was
pointed out that many of the Petitioner's patients were students from the Salem
High School, which was within walking distance of the locus and that the Petitioner wou
be providing a public service and the proposed use would benefit the public interest.
It was noted that it was quite common in Salem to have a doctor's office within a resi-
dential zone and that in granting the variance the resident integrity of the area would
still be retained.
The Board, after much discussion, took the matter under advisement and decided to
table the matter witil its next regularly scheduled hearing on Kay 9, 1978 at which tin
a Petition was presented by Atty. Benjamin IV. Moulton of 39 Warren Street, Salem, signs
by several abutters and neighboring property owners stating their desire that the
petition be granted subject to the condition that the yard of the locus property not be
used as a parking area.

Petition of George Balich requesting a -
Special Permit and Variance for the property at 421 Essex Street
City of Salem Zoning Board of Appeals
A public hearing on the above petition was opened on December 20, 2006 pursuant to
Massachusetts General Law Ch. 40A, Sec. 11. The following Zoning Board members
were present: Nina Cohen, Bonnie Belair, Steven Pinto, Elizabeth Debski and Robin
Stein.
The petitioner, George Balich, sought a Special Permit to convert an existing
nonconforming mixed-use building into a residential building and a Variance from off-
street parking requirements for the property located at 421 Essex Street, Salem, in the
Business Neighborhood (B-1) zoning district.
The Board of Appeals, after careful consideration of the evidence presented at the public
hearing, and after thorough review of the Petition submitted, makes the following
findings of fact:
1. The property at 421 Essex Street is an existing nonconforming building within
the B-1 zoning district. At present it houses two residential units and a
commercial unit (dentist's office).
2. The petitioner is requesting a Special Permit to convert to residential use the
dentist's office, and also seeks a Variance from off-street parking
requirements to allow four(4) spaces to serve the resulting 3 residential units,
instead of the required five (5) spaces.
3. Petitioner's plan calls for no exterior changes to the tum of the century
property, and does not increase the number of units therein. The existing
building envelope will be retained and the structure rehabilitated for resale as
condominium units.
4. The first floor unit will be approximately 1,200 sq.ft.
5. The petitioner shall provide four(4) off-street parking spaces on the site, and
will create a new curb cut to allow access to the parking area from Warren St.

6. Petitioner will remove "No Parking—Doctor's Office street signs currently
reserving street parking spaces on Essex and Warren Streets, freeing up
parking spaces on the street.
7. One member of the public spoke in favor of the petition.
On the basis of the above findings of fact, including all evidence presented at the public
hearing, including, but not limited to, the Petition the Zoning Board of Appeals concludes
as follows:
1. The petitioner's requests to for a Special Permit and a Variance do not
constitute substantial detriment to the public good as the additional residence
at the property will not substantially impact the neighborhood.
2. The requested relief does not nullify or substantially derogate from the intent
or purpose of the zoning ordinance as the nature of the Business
Neighborhood District allows for a residential component in the Special
Permit section and by its nature allows incorporation of residential uses with
business uses.
3. A literal enforcement of the zoning ordinance would create a substantial
hardship to the petitioner by unfairly restricting the usage of their property
when multi-family uses are permitted in the district with a Special Permit.
4. In permitting such change, the Board of Appeals requires certain appropriate
conditions and safeguards as noted below.
In consideration of the above, the Salem Board of Appeals voted, five (5) in favor
(Cohen, Pinto, Debski, Stein, BeWr) and none (0) opposed, to grant the request for a
Special Permit and a Variance, subject to the following terms, conditions, and safeguards:
1. Petitioner shall comply with all city and state statutes, ordinances, codes and
regulations.
2. All construction shall be done as per the plans and dimensions submitted to and
approved by the Building Commissioner.
3. All requirements of the Salem Fire Department relative to smoke and fire safety
shall be strictly adhered to.
4. Petitioner shall obtain a building permit prior to beginning any construction.
5. A Certificate of Occupancy is to be obtained.
6. Petitioner shall appear before any City Boards and Commissions having
jurisdiction, including without limitation the Historic Commission.
7. Unless this decision expressly provides otherwise, any zoning relief granted does
not empower or authorize Petitioner to demolish or reconstruct the structures(s)
located on the subject property to an extent of more than fifty percent (50%) of its
floor area or more than fifty percent (50%) of its replacement cost at the time of
destruction. If the structure is demolished by any means to an extent of more than
fifty percent (50%) of its replacement cost or more than fifty percent (50%)of its
floor area at the time of destruction, it shall not be reconstructed except in
conformity with the provisions of the Ordinance.
