Dear Mr. Monroe:
Gulf of Maine Research Center is under contract with Attorney
Donald Koleman of 328 Essex Street in Salem to assist in the
disposal of kerosene contaminated soil currently stockpiled within
the building located at 405 Essex Street in Salem and known as
Cooper' s Garage (hereinafter the "Site" ) .
The removal of four underground storage tanks from beneath the
floor of the Site-building has left a sizable opening in the
concrete slab floor. The soil from the tank pit is contaminated
with what appears to be kerosene. Approximately 60 cubic yards of
soil has been stockpiled within the building Attorney Koleman wishes
to gain permission from the appropriate Salem health and safety
officials to temporarily store the contaminated soil in covered and
lined roll-off dumpsters on Essex Street until arrangements can be
made for disposal.
GULF OF MAINE RESEARCH CENTER INC.
Our field screening of the soil indicates that the level of
kerosene contamination of the soil is not great enough to require
the soil to be classified as hazardous waste. While our field
screening is subject to verification by laboratory analysis, it is
currently the opinion of Gulf of Maine Research Center that the soil
does not represent an imminent threat to human health or safety.
We propose to line the dumpsters with two layers of 6 mil
polyethylene and after filling, cover them with plastic tarpolans.
It is the opinion of Gulf of Maine Research Center that these
actions will be sufficient to preclude rainwater from washing
through the dumpsters and leaching contaminants onto Essex Street.
We understand that street and sidewalk permits will be required
by the Salem Building Department and the Salem City Engineer' s
Office. We also understand that a $1,000. street bond will be
required as well as approvals from the Salem Police Department
Traffic Office.

Dear Mr. St. Pierre:
This letter is sent to you in your capacity as the officer responsible for the administration and
enforcement of the Salem Zoning Ordinance. The purpose of this letter is to request a
determination in writing from you in your official capacity as to whether or not my company,
ASAP Drains, Inc., may use the premises at 405A Essex St., Salem, Massachusetts for the
business operations of the company.
The utilization of the premises would include normal office space use Monday to Friday,
7:30 a.m. to 5:00 p.m. It would also include the storage of trucks for everyday dispatch and
for dispatching of trucks for water jetting, camera work and drain cleaning. In addition, the
garage area would be used as a shop for maintaining the vehicles and equipment of the drain
cleaning business. It is anticipated that employee vehicles would be parked inside the
building while on the premises.
It is my understanding that you have received an affidavit from the present owner of the
premises regarding the past and existing uses of the premises. As I have entered into a
purchase and sale agreement on the premises, I would appreciate an answer as soon as
possible. It is my intention to rely on your determination in proceeding or not proceeding
with the purchase of the premises.

Affidavit made this 10"'day of July 2003 by Donald Koleman president of
Competition Motors Ltd a duly formed Massachusetts corporation having a usual place of
business in Massachusetts at 405A Essex Street, Salcm, Essex County and Donald
Koleman as trustee of Cooper's Realty Trust, the owner and purchaser of the teal estate
known as Cooper's Garage located at Salem in 1985 from Raymond W. and Lorraine St.
Pierre formerly of Salem now of Martha's Vineyard. Prior to the purchase,Cooper's
Garage was used as a general automotive repair garage,diesel engine rebuilding facility,
automotive electrical repair and rebuilding center, retail gasoline pumping station and
service center accompanied by a business and operations office above the first floor
consisting of approximately 1200 square feet. Up until the purchase of the facility from
the St. Pierre's the facility was in full operation and utilization. Following the purchase of
the premises in 1985 by Cooper's Realty Trust, Competition Motors Ltd rented the
premises for the storage of classic and vintage automobiles, service work, and an office
for operations. Shortly thereafter the premises were rented to O'Brien's Ambulance
Service for the storage,repair and location of ambulances assigned to the city of Salem
under contract. The second floor was used as a business and dispatch office center for
ambulances and EMTs. At that time gasoline was still being dispensed from the pumps
located on the sidewalk as a retail business.
In the summer of 1988 Cooper's Realty Trust determined it was no longer
feasible under the new statute relating to the sale of gasoline to continue the storage and
sale of gasoline. Accordingly the tanks were removed and the building painted and
upgraded. After the use by O'Brien's Ambulance Service,Competition Motors Ltd
became the sole tenant of Cooper's Garage at 405A Essex Street and maintained a full
service automotive restoration business, storage facility for automobiles, trucks,machine
shop,vehicle dispatch,and business operations office. This business was conducted by
Competition Motors Ltd until the spring or early summer of the year 2000 at which time
the main operation moved to Portsmouth New Hampshire where it is now located.
Cooper's Garage became a secondary location of Competition Motors,which has,

however continued to store automobiles, automotive parts and accessories,equipment
and machinery used in conjunction with the operation of Competition Motors. The
facility continues to be used for temporary storage of motor vehicles,machinery and
equipment.
Competition Motors Ltd,as sole tenant from the late spring/early summer of 2000
up to the present has continued to pay the electricity, heating fuel oil,real estate taxes and
water and sewer charges evidencing the exclusive occupation by Competition Motors of
Cooper's Garage at 405A Essex Street Salem MA.As the owner of Competition Motors I
and other employees continuously have had access to the building for the purpose of
moving automobiles, trucks and automotive parts and machinery in and out of the
premises.
This affidavit made this 10'h day of July 2003 under the pains and penalties of
perjury.
