Dear Annie;
I have reviewed your letter regarding the removal of
trees at the above referenced property. I have also
reviewed the decision of the Board of Appeal and the
conditions on that decision .
Landscaping, hottopping and fencing do not require
permits from any city department other than the height of
the fence and the proximity of hottop to property lines .
The intent of the Zoning Board of-Appeal may have been to
regulate these activies when they referred to "exterior
work" , however, that expression, as far as this department
is concerned, would imply building work only.
This department is always prepared to support the
Commission in any way we can but in this matter I would
find it difficult to present a case .

above referenced property. While the Board takes no position at
this time regarding the information you provided us in your letter,
the Board is always concerned with possible violations of conditions
placed on our decisions.
Under MGL Chapter 40A, the Zoning Board of Appeal can only react
to petitions and appeals made in writing to us on proper forms. Any
perceived violation must be first reported, in writing, to the Zoning
Enforcement Officer William Munroe, who then has fourteen (14) to

Dear Chairman Bencal :
On June 19 , 1991, the Board of Appeal approved a variance for
393 Essex Street which confirmed the use of the property as
professional offices, medical or dental clinic on the first floor
with upper stories to be maintained as three residential dwelling
units . The Salem Historical Commission has recently received
numerous complaints concerning work that has since been completed
at this property. Of particular concern has been the loss of trees
and other landscaping to make way for an asphalt parking lot which
nearly completely blankets the land.
393 Essex Street is believed to have been built circa 1740 .
Architecture in Salem by Bryant F. Tolles, Jr. offers the following
information: "This two and one-half story, wood-frame and
clapboard house is one of Salem' s most outstanding large gambrel-
roof Georgian Colonial dwellings . . . .During the Revolution the house
was owned by Rev. Thomas Barnard, the pastor of the Old North
Church, who played a significant role in the "Leslie' s Retreat"
episode of 1775 at the North Bridge in Salem. . . .William P. Andrews
bought the property in 1816, and the Andrews family owned it for
almost a century. " Early photos show a handsome fence which is now
gone.
This exterior work of the removal of trees and extensive
asphalting has caused substantial detriment to the public good by
transforming a property, located in an R-2 district, which
essentially still appeared a fine Georgian Colonial residence into
what now appears as an inappropriate building reuse. While the
Commission had no objection to the use of the first floor as
professional offices, we had expected that the property would
continue to retain the character and feeling of a residence. The
work completed since the Board of Appeals decision in no way helps
retain that character and feeling.
In addition, the Salem Historical Commission believes that
this work is in violation of the Decision of the Board of Appeal in
that the Variance was subject to the condition that "approval of
the Salem Historic Commission be obtained if any exterior work ( is )
to (be) done" .
To remedy this situation, the Commission believes that the
property owner should be required to present a landscape design for
approval by the Salem Historical Commission, as required by the
Board of Appeal, which would include appropriate trees , planting,
fencing and partial removal of asphalt paving.

residential dwelling units on the upper stories has been in existance since
1964.
5. The daytime use of the first floor professional offices is beneficial to the
neighborhood in that it does not require overnight parking.
6. There have been numerous doctor's offices along Essex Street and Highland
Avenue between this property and the Salem Hospital.

Therefore, the Zoning Board of Appeal voted unanimously, 5-0, to grant the

Please be advised that I have examined various documentation
relative to the use of the above-described premises as a combination
dwelling and professional office. I have examined various affidavits,
copies of city directories and a recent tax assessment.
Based on my review of the documentation, it is my opinion that
this dwelling was a lawful combination dwelling and professional office
prior to the adoption of the City' s Zoning Ordinance in 1965. It is my
opinion that this dwelling should be afforded the protection of Section
VIII(E) of the aforementioned ordinance relative to non-conforming uses
and this dwelling' s current use as a combination dwelling and
professional office is permissible..

Please be advised that I represent Dr . Frederick P.
Keach who is preparing to sell his dental practice and the
building where he has been conducting his dental practice at
393 Essex Street in Salem.
Dr . Keach purchased the building in 1960 and has been
conducting a dental practice on the first floor of the building
since that time . Prior to the purchase by Dr . Keach there were
three radiologists ; Doctors Savage , Dillon and Wells , conducting
their medical practice from the first floor of that same address .
Dr . Keach applied for , and received , a building permit to im-
prove the third floor of the building for residential use . At
the present time , the first floor is used for treatment rooms ,
office space and a reception area by Dr . Keach and his patients .
The Assessors of the City of Salem carry the property in two
categories : one being business use and the second , residential
use , and have done so since 1964 .
I am enclosing with this letter an Affidavit from Dr .
Keach along with an Affidavit of Dr . William F. White , Sr . ,
who was in practice with Dr . Keach at this address in 1960 . I
also enclose a copy of the Deed into Dr . Keach , along with a
typewritten transcript from the Assessor ' s office in the City
of Salem indicating how the Assessor ' s records reflect this
property .
Dr . Keach , in selling this property , has indicated to
the purchaser that he has no dispute with the City of Salem
over the present use of the building . The purchaser would like
to gain whatever assurances are possible so that he may go
ahead with his purchase knowing that he may conduct his dental

In 1961 I was practicing dentistry in Salem and became
an office tenant of Dr . Keach after he purchased the property
at 393 Essex Street in Salem.
I remained Dr . Keach ' s tenant for several years until
I purchased other property in the area and moved my practice .
I have memory that prior to Dr . Keach ' s purchase of 393 Essex
Street , it was owned by three radiologists , Louis D. Savage ,
Raymond A. Dillon and Edward P . Wells ,- who conducted a medical
practice at that location for several years prior to my moving
there .
All medical and dental practices were conducted on the
first floor and there were residential apartments on the second
and third floors .

I have been the owner of this property since May 26 ,
1961 when I purchased the property from Louis D. Savage ,
Raymond A. Dillon and Edward P. Wells . Doctors Savage ,
Dillon and Wells conducted a medical practice at this address
for some time prior to my purchase of the property .
In 1961 I moved my dental practice from 219 Essex Street
in Salem to its present location of 393 Essex Street in Salem.
This building is of wood construction and contains three
floors . My dental practice , waiting rooms , treatment rooms
and filing area occupy the first floor . The second and third
floors are used for residential purposes . Sometime in the
year 1964 I applied for , and received , a building permit to
renovate the third floor for residential purposes .
I have been taxed by the Assessors of the City of Salem
for both commercial and residential use for as long as I
have owned the building .
At no time during my ownership have I ever been informed
of any violation of any ordinance accepted by the City of
Salem.
