Thank you for taking the time to meet with me last week. As you know, I
represent Mr. and Mrs. James Bailey relating to litigation concerning a fire at 392 Essex
Street. Shortly after the fire, an investigator for Mr. and Mrs. Bailey's insurer reviewed
your filed and made copies of documents in your file. Enclosed is a letter dated March 3,
1994 and signed by Mr. Leo E. Tremblay, Inspector of Buildings. When I reviewed your
file, this letter from Mr. Tremblay was not in the file.
When your schedule permits, I request that you telephone me so that we can
discuss the March 1994 letter. I thank you for your anticipated cooperation.

received alleging that the third floor apartment at 392 Essex Street
has only one means of egress. On Tuesday March I , 1994 I meet with
you at 392 Essex Street and my inspection of the property finds that
two means of egress do exist, and are Legal grandfathered means of
egress.

enter any dwelling.
(D) The occupants of each dwelling.dwelling unit,and rooming unit shall be responsible for the proper placement of her or his garbage and
rubbish in the receptacles required in 105 CMR 410.600(C)or at the point of collection by the owner.
410.60E Collection of Garbage and Rubbish
The owner of any dwelling that contains three or more dwelling units,the owner of any rooming house.and the occupant of any other dwelling
place shall be responsible for the final colelection or ultimate disposal or incineration of carbage and rubbish by means of:
(A) The regular municipal collection system;or
(B) Any other collection system approved by the Board of Health;or
(C) When otherwise lawful.a garbage grinder which grinds garbage into the kitchen sink drain finely enough to ensure its free passage,and is
otherwise maintained sat as not to create a safety or health hazard;or
(D) When otherwise lawful,a garbage or rubbish incinerator located within the dwelling which is properly installed and which is maintained so as
not to create a safety or health hazed;or
(E) Aoy other method of disposal which dues not endanger any person and which is approved in writing by the Board of Health

Dear Mr,Murphy:
This letter was written ut response to your inquiry as to whether the third floor of 392 Essex St., in Salem
had two means of egress.
On Tucsday, January 19, 1999, 1 met with the Salem Building Commissiotur, Peter Strout,and inspected
the said property. The third floor consisted of 6 dwelling units,each having I door exiting into an L shaped
corridor; these doors were not of fire rated construction. At each end of the corridor there were open
stairways leading to the exterior on the first floor. At the middle of the corridor there was a door splitting
the corridor in half,this door was not of fire rated construction. Also,there were no exit signs at the time
of the inspection
The building was certified as a lodging louse in 1974- The Building code in force at that time of
perm t�g was theme Bwere O CA Basic Building Code of 1970(the code). Upon reviewing the code the following

Exitways, states:
There shall not be less than two (2) approved independent exirweip serving every floor area

618.6, Stair Exitway Doors,requires that: "All doorway opening protectiecs, including the frames and
hardware, shall be approved self-closing swinging doors complym with article 9. Article 9, Section
917 , Fire Doors, requires stairway doors to be at least 1 % inch solid core wood doors for all
residential construction.

Additionally,The Sixth Edition of the Massachusetts State Building Code(780 CMR),the current code in

In any existing building or structure not provided with exit facilities as herein prescribed for new
buildings and in which rhe exits are deemed hazardous or dangerous to life and limb, the
building offraral shall declare such building dangerous and unsafe in accordance with the
provisions of 780 CMR 121.0.
In accordance with 780 CMR Section 1004.2.1 the following section was not provided for, and in my
opinion hazardous to life and limb:
Section 1006.4 Remote Location,which states:
Wherever more than one exit is required from any room, space or floor oja Building, such exits
shall be placed as remote from each other as practicable, and shall be arranged and constructed
to provide direct access in separate directions from any point in the area served so as to
minimize the possibility that both exits will be blocked by any one
condition. fire or other emergency
In this ease there was only ate means of egress from within each dwelling unit.
In conclusion,the BOCA Basic Building Code of 1970 required one of the stairways to be enclosed with
approved materials and door construction. In addition,all means of egress were required to be marked with
approved "EXIT' signs. The current building code, 780 CMR, required the said building to have two
means of egress to provide direct access in separate directions from any point in the area served. None of
these were provided for on the third floor of 392 Essex Stroet,Salem at the time of the inspection.

410.600: Storane of Rubbish and GgrbAgg.
(A) Garbage or mixed garbage and rubbish shall be stored in watertight receptacles with tight-fitting covers.Said receptacles and covers shall be
of metal or other durable,rodent-proof material.Rubbish shall be stored in receptacles of metal or other durable,rodent-proof material.
Garbage and rubbish shall be put out for collection no earlier than the day of collection.
(B) Plastic bags shall be used to store garbage or mixed rubbish and garbage only if used as a liner in watertight receptacles with tight-filing
covers as required in 105 CMR 410.600(A)provided that the plastic bags may be put out for collection except in those places where such p
practice is prohibited by local rule or ordinance,or except in those cases where the Department of Public Health determines that such practice
constitutes a health problem For purposes of the preceding sentence,in making its determination,the Department shall consider,among other
other evidence of strewn garbage,tom garbage bags,or evidence of rodents.
(C) The owner of any dwelling that contains three or more dwelling units,the owner of any rooming house.and the occupant of any other
dwelling place shall be responsible for providing as many receptacles for the storage of garbage and rubbish as are sufficient to contain the
accumulation before final collection or ultimate disposal,and shall so locate them to be convenient to the tenant that no objectionable odors
enter any dwelling.
(D) The occupants of each dwelling,dwelling unit,and rooming unit shall be responsible for the proper placement of her or his garbage and
rubbish in the receptacles required in 105 CMR 410.600(C)or at the point of collection by the owner.
410.601:Collection of Garbage and Rubbish
The owner of any dwelling that contains three or more dwelling units,the owner of any rooming house,and the occupant of any other dwelling
place shall be responsible for the final colelection or ultimate disposal or incineration of garbage and rubbish by means of:
(A) The regular municipal collection system;or
(B) Any other collection system approved by the Board of Health;or
(C) When otherwise lawful,a garbage grinder which grinds garbage into the kitchen sink drain finely enough to ensure its free passage,and is
otherwise maintained so as not to create a safety or health hazard;or
(D) When otherwise lawful,a garbage or rubbish incinerator located within the dwelling which is properly installed and which is maintained so as
not to create a safety or health hazard;or
(E) Any other method of disposal which does not endanger any person and which is approved in writing by the Board of Health
(see 105 CMR 410.840)

(D) Common Areas: In any dwelling,the owner shall be responsible for maintaining in a clean and sanitary condition free of garbage,rubbish,
other filth or mases of sickness that part of the dwelling which is used in common by the occupants and which is not occupied or controlled by
me occupant exclusively.
(i)The owner of any dwelling abutting a private passageway or right-of-way owned or wed in common with other dwellings or which the
owner or occupants under her or his control have the right to use or are in fact using shall be responsible for maintaining in a clean and
sanitary condition free from garbage,rubbish,other filth or cause of sickness that pan of the passageway or right-of-way which abuts her or
his property and which s/he or the occupants under her or his control have the right to use,are in fact using,or which s/he owns.
Board of Health Regulation#7 Section 3 10: Containers or Bundles of Household and Ordinary Commercial Waste.Garden and Lawn Waste: These shall
be placed at the outer edge of the sidewalk appurtenant to the premises of the owner not later than 7:00 a.m.on the day of collection and not before 6:00
p.m.on the day preceding the day of collection,and shall be removed from the sidewalk on the same day as emptied.No commercial establishment shall
place or cause to be placed more than four barrels or other containers of ordinary commercial wastes or any extraordinary commercial or industrial wastes or
tree waste upon any sidewalk or way for disposal
You are hereby Ordered to make a good faith effort to correct these violations within 24(twenty four)hours of receipt of this notice.
Failure on your part to comply within the specified time will result in a complaint being sought against you in Salem District Court.
Should you be aggrieved by this order,you have the right to request a hearing before the Board of Health. A request for said hearing must be received in

Dear Mr. St. Pierre:
Based on conversations with the owner, James Bailey and yourself, I understand that the owner has
received final approvals from the Salem Fire Department and the Salem Electrical Inspector
regarding the fire protection (sprinkler) system and fire alarm system based on successful testing
and inspection of the systems and components.
On Wednesday August 30th, I made a visit to the site with our mechanical consultant Steven Forte of
Forte Engineering to complete a visual review and inspection of the work completed to date with the
objective of determining which units are ready for occupancy, and to confirm what, if any
additional work or remedial work will be required in order to bring the project to 100% completion
and ready for Certificate of Occupancy.
It is my understanding that the owner has requested approval of a Temporary Certificate of
Occupancy, and that it can be issued by your office based on receipt of written confirmation from
me that certain units are ready for occupancy, but with the stipulation that any outstanding or
remedial work so identified must be completed within 30 days of the date of issuance of a
Temporary Certificate of Occupancy.
This letter shall serve therefore, to confirm that the following apartment units have been inspected
and that to the best of my knowledge, information and belief, the work associated with the sprinkler a
and fire alarm systems within each of the following apartment units as well as the common areas, o

Dear Mr. St. Pierre:
Based on conversations with the owner, James Bailey and yourself, I understand that the owner has
received final approvals from the Salem Fire Department and the Salem Electrical Inspector
regarding the fire protection (sprinkler) system and fire alarm system based on successful testing
and inspection of the systems and components.
On Wednesday August 30th, I made a visit to the site with our mechanical consultant Steven Forte of
Forte Engineering to complete a visual review and inspection of the work completed to date with the
objective of determining which units are ready for occupancy, and to confirm what, if any
additional work or remedial work will be required in order to bring the project to 100% completion
and ready for Certificate of Occupancy.
It is my understanding that the owner has requested approval of a Temporary Certificate of
Occupancy, and that it can be issued by your office based on receipt of written confirmation from
me that certain units are ready for occupancy, but with the stipulation that any outstanding or
remedial work so identified must be completed within 30 days of the date of issuance of a m
Temporary Certificate of Occupancy.
This letter shall serve therefore, to confirm that the following apartment units have been inspected
and that to the best of my knowledge, information and belief, the work associated with the sprinkler a
and fire alarm systems within each of the following apartment units as well as the common areas, o

The writer inspected the site. Mr. Bailey& Mr. Slocum accompanied.
1. The third floor lintel along the D-line had its end, at location D-2, obscured by fire damage.
Drawing S-2 required this damage to be removed to expose the lintel's end condition; this had
been done. The lintel should be replaced with a timber or glulam of equal size and with a least 2"
of bearing at each end. Mr. Slocum said this would be done.
2. Mr. Slocum pointed out a damaged and deflected timber girder in the first floor framing near
the boiler room and parellel to the 2-line. The writer recommended that a cca-treated 4"x4" sill be
placed on grout on the concrete foundation and a 4"x4"@16"o.c. wall be placed continously
under the length of the girder. W. Bailey& W. Slocum agreed to this.
3. The writer reconfirmed, as he had at a 27 April meeting, that submittals for the specified timber
connectors and any proposed material substitutions were required and subject to the Engineer's
approval and that there timely procurement could control construction schedule. None have yet
been received. Mr. Slocum said they would be submitted the next day. The writer agreed to pick
them up at the jobsite, if required. Also, the writer explained that if non-specified connectors were
obtained or locally-made it would tale additional engineering time & expense to evaluate them.
4.One of Mr. Slocum's men pointed out that some third-floor joists, between the B & C-lines,
showed fresh wood where they were pulling slightly out of the 1-line wall timber. This indicates
that the wall had moved outward recently. Mr. Slocum was to stabilize the wall.
5. The writer discussed, as stated on the drawings, that all means and methods of construction and
stability of the structure during construction until all structural pieces are in place are the sole
responsibility of the Contractor. Too, that proper fit of the structural pieces to achieve the
finished building as shown on the contact drawings was the sole responsibility of the Contractor.
The writer's belief is that Mr. Slocum is the Contractor because he has the ability and experience
to achieve these goals.
6. Mr. Slocum said, as at the 27 April meeting, that his framing contractor wished to have a
drawing with every piece of the roof framing shown. The writer stated that the drawings show
every roof main member and requires these to be infilled with 2"x12"@16"o.c. which is believed
clear and is know to be an accepted and standard way of depicting structural framing. Also,the
roof is architecturally detailed in surfaces and the writer will meet with Mr. Slocum and his framer
if desired.

Pursuant to our telephone conversation on July 8th, and consistent with the points I have
reviewed with the Owner and Contractor on many occasions during the past several weeks, I am
writing to confirm the following relative to the Submittals, Shop Drawings and other
requirements of projects subject to Construction Control.
With commencement of construction activities last week, I would like to clarify that as of this
writing, we have not received, nor have we reviewed, the required Submittals as specified in the
Contract Documents. The Contract Documents include both the Project Manual and the
Drawings dated 23 April 1999. Although it is my understanding that you are in the process of
assembling the required Submittals and Shop Drawings for the structural framing and framing
connectors, it is at your sole risk and responsibility that you proceed with any work that requires
the Architect's or Structural Engineer's review and approval of Submittals or Shop Drawings.
For the record, the Project Manual includes the following language regarding the Construction LL
Control requirements:
Construction Control: The Massachusetts State Building Code, Article 116.0 - Registered a
Architectural and Engineering Services - Construction Control provisions and requirements m
apply to this Project. The Architect and Structural Engineer are required to perform the ^m

3. Be present at intervals appropriate to the stage of construction to become, generally
familiar with the progress and quality of the Work and to determine, in general, if the
Work is being performed in a manner consistent with the Contract Documents.
Notify the Architect and authorities having jurisdiction at least thirty-six hours in
advance of concealing any work.
In addition, with regard to procedures, controls and the responsibilities of the Contractor, I would
like to emphasize the following points that are included in the Project Manual:
1. General Contractor shall verify all dimensions, grades, and locations before proceeding with
the work. Report discrepancies immediately to the Architect, for review and approval prior
to commencing with the Work.
2. Contractor shall notify the Owner who shall notify the Architect of any irregularities or
discrepancies discovered during demolition which may effect the current design and/or
layout of the new Work, prior to commencing with the Work.
3. Remove existing materials, systems and improvements as indicated or as required to
complete the Work, not scheduled or indicated for re-use, including but not limited to the
following:
• Remove all fire damaged materials.
• Remove all wood finish flooring.
• Remove all ceilings, strapping, furring and suspended framing members.
• Remove all partitions not indicated to remain.
• Remove all heating, plumbing and electrical materials, systems, equipment and
components. All abandoned electrical & telephone conduits and wires, plumbing lines
and mechanical equipment (including all anchorages and attachment devices) must be
removed and properly disposed.
• Remove all concrete masonry infill in existing openings of brick foundation walls where
basement windows are indicated to be installed.
• Remove existing floors and walls where new openings are indicated.
• Remove all wood tested or observed to exhibit effects of decay or damage from water or
fungal growth as determined by the structural engineer.
• Remove all other materials whether specifically indicated or not, as required to complete
the Work as indicated on the Drawings.
4. Shoring & Bracing: It is the Contractor's responsibility to determine the means, methods
and techniques necessary to provide suitable shoring and bracing to support all
concentrated and uniform loads imposed on the existing walls, partitions and other
structural elements scheduled for removal as indicated on the Drawings. Provide solid
timber and/or steel wide flange sections for shoring and bracing, with solid blocking as
required. Maintain shoring and bracing in place until structural elements are re-braced and
supported by the permanent and completed installation. Repair and replace all materials
and finishes damaged during shoring and bracing.
5. Contractor: Exercise proper precaution to verify all existing conditions and layout of the
Work. Contractor to notify Architect of any discrepancies immediately, and prior to
commencing with the Work.

• Contractor is responsible for any error resulting from failure to exercise such
precaution. Such error will not be considered subsequently as a basis for extra
compensation.
• Contractor is to lay out Work and be responsible for all lines, measurements of the
building, and other Work executed under the Contract.
• Contractor shall complete all cutting and patching as required to complete the Work as
described in the Construction Documents. Do not cut or patch any Work in a manner
that would result in the failure of the Work to perform as intended, decreased energy
performance, increased maintenance, decreased operational life, or decreased safety. Do
not cut structural Work without written approval from the Architect. Provide temporary
shoring and bracing as necessary to support and protect the existing structure and
materials during construction. Use materials identical to materials to be cut and patched.
Provide finished Work which will result in equal or better than existing performance
characteristics.
• Should the contractor find discrepancies in or omissions from the drawings and
specifications, or should he be in doubt as to their meaning, he shall at once notify the
Architect and Architect prior to proceeding with the Work. The Architect has final
authority with regard to the interpretation of the design intent as indicated or implied by
the Contract Documents.
We look forward to receiving the required Submittals and Shop Drawings in the very near future.
Please submit five original copies of all Submittals and Shop Drawings, and allow five business
days for our review and processing. After the Structural Engineer and ourselves have completed
our review, we will return two copies to you, one for your files and one for your subcontractor or
suppliers. Don't hesitate to contact me at (978) 745-3330 if you have any questions.
Finally, we will be making periodic visits to the site to generally become familiar with the
progress and quality of the Work, and will provide written Field Reports to record our
observations, with copies to all parties.

Dew Mr. Murphy:
This letter was written in response to your inquiry as to whether the third floor of 392 Essex St., in Salem
had two means of egress.
On Tuesday, January 19, 1999, I met with the Salem Building Commissioner, Peter Strout, and inspected
the said property. The third floor consisted of 6 dwelling units, each having I door exiting into an L shaped
corridor; these doors were not of fire rated construction. At each end of the corridor there were open
stairways leading to the exterior on the first floor. At the middle of the corridor there was a door splitting
the corridor in half, this door was not of fire rated construction. Also, there were no exit signs at the time
of the inspection
The building was certified as a lodging house in 1974. The Building code in force at that time of
permitting was the BOC A Pacir Rlril,rling Code oft 970 (the codel. Upon reviewing the code the following
violations were found:
1. There was no enclosed independent stairway as required by Section 611.0. Section 611.0, Number of
Exitways, states:
There shall not be less than two (2) approved independent exitways serving every floor area
above and below the first or grade floor, at least one (1) of which shall be an interior enclosed
stairway...
2. There were no doors enclosing either stairway as required by Section 618.6, and Section 917. Section
618.6, Stair Exitway Doors, requires that: "All doorway opening protectives, including the frames and
hardware, shall be approved self-closing swinging doors complying with article 9. Article 9, Section
917 , Fire Doors, requires stairway doors to be at least 1 % inch solid core wood doors for all
residential construction.

3. There were no exit signs visible at the time of the inspection as required by Section 625.0. Section
625.0, Exit Signs and Lights, requires all means of egress to be indicated with approved metal "EXIT"
signs.
Additionally, The Sixth Edition of the Massachusetts State Building Code (780 CMR), the current code in
force, indicates in Section 1004.2.1 Exit Order/Hazardous Means of Egress,that:
In any existing building or structure not provided with exit facilities as herein prescribed for new
buildings and in which the exits are deemed hazardous. or dangerous to life and limb, the
building official shall declare such building dangerous and unsafe in accordance with the
provisions of 780 CMR 121.0.
In accordance with 780 CMR Section 1004.2.1 the following section was not provided for, and in my
Opinioni.azarucas to He and lir.°.';,:
Section 1006.4 Remote Location, which states:
Wherever more than one exit is required from any room, space or floor of a building, such exits
shall be placed as remote from each other as practicable, and shall be arranged and constructed
to provide direct access in separate directions from any point in the area served so as to
minimize the possibility that both exits will be blocked by any one fire or other emergency
condition.
In this case there was only one means of egress from within each dwelling unit.
In conclusion, the BOCA Basic Building Code of 1970 required one of the stairways to be enclosed with
approved materials and door construction. In addition, all means of egress were required to be marked with
approved "EXIT" signs. The current building code, 780 CMR, required the said building to have two
means of egress to provide direct access in separate directions from any point in the area served. None of
these were provided for on the third floor of 392 Essex Street, Salem at the time of the inspection.

Dear Attorney Landolphi:
As requested, I am pleased to provide the following update of our progress to date with completion
of design services for the reconstruction and repairs to 392 Essex Street in Salem.
As you know, we have inspected the building's conditions following the fire and clean-up
operations with the structural engineer, the owner, and the owner's contractors with the objective of
defining the scope of the project, the timetable and the estimated construction costs for completion
of the repairs and reconstruction work. With regard to the status of our architectural services, we arc
currently in the early phases of the developing the design and approvals process.
Our first priority will be to complete the drawings necessary to make the building wealhertight by
reconstructing the roof and damaged exterior walls, windows and doors. Once we have completed
the desigu services associated with the weathertight shell scope of work, we will confirm the scope of
interior renovations necessary to bring the building into compliance with applicable codes and
standards.

The building is a three story wood frame structure with a two story addition off the rear et. It was
built in 1850/1851 in the imposing Italianate style as a single family residence, clearly intended to
reflect the prominence of its owner, a successful printer-publisher. The gross floor area of the LL
building will be confirmed very shortly upon completion of our existing conditions documentation, o
and is expected to range between 10,000 and 11,000 square feet in area.
The building housed a total of 19 rental units ranging in size from studio apartments to two
bedroom units. Although we are still in the early stages of the design process, and no final decisions m
have been made as of yet, the nature and scope of the renovations required to rebuild the portions o
of the building damaged by fire is expected to yield a reduction in the number of apartment units m
from the pre-fire total of 19, to a post construction total of approximately 16 units. This will be
accomplished by reducing the number of studio apartments, thereby increasing the percentage of g
one and two bedroom apartments. It is my expectation that as a result of the improvements to be t
made to the building, that the monthly rental rates and gross income will increase. It is also my
understanding that the rental income is anticipated to range from between $550 and $750 per month
per apartment unit, yielding an anticipated total projected monthly income of approximately $9500. £

With regard to the estimated timetable and construction costs for completion of this project, my
experience as an architect specializing in historic building renovations tells me that a realistic budget
for completion of the work as described will likely fall in the range of$400,000 to $450,000, and
that the project should be able to he completed within 9 months. I would like to point out however,
that since the first and second floors of the rear el were not effected by the fire and remain
structurally intact, and since the rear two story addition remains completely undamaged in any way
by fire or water, it is very likely that a portion of the building can be completed and ready for
occupancy within 6 months.

Design/Build Sprinkler Contractor has adjusted the deflector
at sidewall sprinkler head such that the deflector is positioned
parallel with the ceiling plane above.
We will provide you with a copy of our Field Report that outlines our observations and findings
regarding the remedial repairs and additional work required to complete the project within the next
30 days. Our Field Report will be sent to you under separate cover immediately upon its
completion. If you have any questions in the interim, please do not hesitate to contact me.

As we discussed on 9/20/00 I have requested your letter of compliance as required in a letter
dated September 6,2000 from Pierce Architects. It is stated in the aforementioned correspondence from
Pierce on page 5 "Please give the DBC(Design/Build Contractor)a copy of this letter and inform him
that before a final sign-off and acceptance of the sprinkler system can be approved,fully tested and ready
for"final inspection."and 4 copies of the"As-Built Drawings"including hydraulic calculations as
indicated herein."
I have called Pierce Architects for this final inspection as the work has been completed.
However,Pierce Architects requires that you supply me with this"letter of compliance"as stated on page

To Whom It May Concern:
The Salem Historical Commission has reviewed the plans dated April 23, 1999 for the
reconstruction of the fire damaged house at 392 Essex Street and finds that the work proposed is
substantially similar in exterior design to the building prior to the fire and therefore is excluded
from the review by the Commission as provided in the Salem Historical Commission Ordinance
Section 5.6.4.
