On September 13, 1988, a public hearing was held in Boston before members of the State Board of Building Regulations and Standards who acted as the State Building Code Appeals Board in which a majority of the said Appeals Board found in its opinion the enforcement of the Massachusetts State Building Code would do manifest injustice to the appellant and the relief requested would not conflict with the general objectives of the State Building Code and any of its enabling legislation. There were present at the said hearing: Robert D Farley, 16 Park St, Danvers Annie C Harris, Salem Historic Commission, Salem William Monroe, One Salem Green, Salem STATE BUILDING CODE APPEALS BOARD Docket #88-96 and 88.97 Date: March 2, 1989 Docket Number: 88-96 and 88-97 Date of Hearing: September 13, 1988 The Appellant testified that he represented the owner of public library building located in Salem where the local inspector required compliance with Section 437.2 and 607.2.1 of the Building Code. The Appellant testified that two separate stairways are involved in this appeal, both being in the same building. The first stairway is a new exit stairway which penetrates the ceiling between the first and second floor. It is the position of the Appellant that this stairway should be defined by the Building Code as a floor opening not so long as it penetrates one floor and this compliance with Section 437.2.3 of the Building Code is not required. The Appellant believes that the referenced Building Code section is printed in error and should not require smoke control. However, the Appellant provides the Board with the current Section 437.2 and alleges that he does comply with the section as presently written. On Section 607.2, the front stairway in the building is a required exitway stairway which does not exit directly to grade or to an area of refuge. This stairway is the focal point of this historic building and felt by the Appellant to be necessary to the renovation of the library. In addition, the stairway is provided with a sprinkler system and will be enclosed at the 2nd and 3d floors. The Appellant indicates that by moving the children section of this library in this current renovation, there will be no large groups of children on the upper floors. The current stairway as well as the proposed stairway exits into a lobby and through this lobby directly outside. The Appellant provided support from the local historic commission and from the libriarian who provided the local perspective and his opinion that the open stairway allows for better security for library patrons. The Appellant indicated that he felt that this historic stairway should be perserved and that the measures taken with these renovations made the building itself safer and partictularly made the stairway safer. No testimony was received from the local inspector who did provide documentation that he had correctly interpreted the Building Code. Following testimony, the Board found that the stairway in question does not become an atrium and is therefore not subject to the requirements of Section 437.2 of the Building Code dealing with smoke control. On Section 607.2.1 of the Building Code, the stairway`is clearly an exitway access and must exit directly to grade. In this case, the stairway exits into a center lobby which does lead directly to grade. The historic nature and the age of the building as will as the fact that the lobby is very short and in clear view of the front door, causes the Board to waive the requirements of Section 607.2 and 611.3. I have determined the plan, as drawn, would not comply to the following sections due to the choice of materials shown and the lack of the appropriate fire rating of these materials. 1 . Section 619.5 which states in part that the materials used by consistent with the materials permitted in Table 214. 2. Table 214 that requires stairways be enclosed by two (2) hour rated materials in type 3-B construction. 3. Section 909.3.1 which states that stair enclosures be constructed of component materials to afford the required fire resistance ratings. In view of the fact that a glass and copper clad enclosure could not satisfy these requirements I would suggest that you seek alternatives. Specifically, you have asked the following: In light of conflicting instructions, is the determination of the Building Inspector final, and may we therefore proceed w;.th our oriun,-! pnDpPr design as 'approved initially by him? Or, given this determination .of noncompliance of glass, must we now appear anew as petitioners to the Historical Com- mission for some alternative approval? And, should it be necessary for us to appear. anew as petitioners to the Historical Commission for some alternative approval on this item, are then any and/or ' all other approvals voted at Commission hearing on January 4 , 1989 and continuance on January 18 , 1989 subject to being reopened by the Commission? - 2 - First, Chapter 143 , Section 3 of the General Laws vests with the Building Inspector authority to issue or refuse building permits . Without going into Chaper 143 in detail, the bottom line is that the Building Code as interpreted by the Building Inspector governs the composition of building materials . Secondly, in my opinion, there is no legal compulsion to again appear before the Historical Commission. General Laws Chapter 40c §11 provides that the Commission must make a determination on an application within 60 days of the filing of the same. In the instant case, the original application was -filed on November 27, 1989 and a final determination was voted by the Commission on January 18, . 1989, well within the statutory time frame. However, for the reasons stated in the . prev .ou.s paragraph, when there is a conflict between the Building inspector and other municipal authorities relative to building materials and permits, the Building Inspector controls . As 60 days has expired since submission of the original application and the Building Inspector has determined that the glass construction voted by the Commission is not appropriate, the copper construction as originally petitioned has been approved by virtue of the operation of general laws chapter 40c §11. However, from a public relations standpoint, it would be better to reappear before the Commission to obtain approval of the copper design or an acceptable alternative if the same will not interfere with the Library's bidding process timetable. Lastly, as I stated above, there is no ' compulsion for . the Library Trustees to appear anew as petioners. However, if the trustees reappear before the 'Historical Commission, that appearance would be solely limited to the, issue .of the book stack roof rear egress appurtenance. Repair roof over Reference Room at 370 Essex Street,Main Branch Library, by removing the railings and storing them, strip the existing tar and gravel roof to the base coat, inspect roof deck and replace any rotted wood. Install new fiberglass base sheet with roofing nails and metal caps. Install (3) more layers of fiberglass felt paper hot-mopped with asphalt between each layer and on top of final layer. Install new 16 oz. copper flashing at all roof edges with two layers of membrane asphalt cemented. Reflash back wall with 16 oz. copper counter, flashing ,will be membrane as above. Fabricate (9) 16 oz. copper flashings for new posts(railings), install same, Reinstall old railing on new posts,resolder where necessary. Clean up all old and left over new materials and remove from site. 2. Repair roof at East Branch Library, 502 Essex St. by stripping a section approximately 400 sq. ft. to base sheet, install new roof sections as detailed above, all requireknew flashings to be 16 oz. copper. Repair leak around the stairway as detailed above,all required new flashings to be 16 oz. copper. Repair (2) sections at the front of the building, work to be as detailed above, all required new flashings to be 16 oz. copper. 3. Repair heating distribution system at the Main Branch Library, 370 Essex Street by cutting the main steam line,furnishing and installing a motorized zone valve, repiping the main line so that the Ist floor front section of the library will be on a separate zone, independent from the stack area and basement, include all required pipe cutting, threading, electrical comiections and thermostats, include cutting of holes in floors, walls and ceilings and patching same, unit to be complete and operating. Contractor will carry Workmen's Compensation, personal injury and `property damage insurance and will supply proof of having same. .Contractor will be responsible for obtaining all necessary permits. The egress to the rear, which would serve as a secondary means of exit from the stack room, appears to have been eliminated during some past remodeling. The lower level window should be made into an emergency exit, with proper alarm locks provided for security. 7t should also be noted at this time, that the entire layout of the stack room is not computable with fire safety standards +in this room, with its excessive fire load, appears to make an ideal flue for the rapid rise and spread of fire. Application has been made for a Building Permit for the Salem Public Library, 370 Essex Street this date. Conditions of said approval are as follows: 1. The installation of the sprinkler system shall be in accordance with the provisions of NFiPA Standard #13 and Article 12 of the Massachusetts State Building Code. Sprinkler system drawings shall be submitted as shop drawings for approval at a later date. 2. The installation of the standpipe system system shall be in accordance with the provisions of NFiPA Standard #14 and Section 1211.0 of the Massachusetts State Building Code. The standpipe system shall be of Class III design, with 2-1/2 inch National Standard Hose Threads, and 1-1/2 inch Iron Pipe Hose Threads. 3. The criteria for determining the need for a fire pump is explained in Article 1211.7 of the Massachusetts State Building Code. Such determination shall be made based upon flow data obtained prior to construction. Installation of the fire pump shall be in accordance with the provisions of NFiPA Standard #20. 4. The installation of the fire alarm system shall be in accordance with the provisions of .527 CMR 24.00, NFiPA Standard #72E, and Article 12 of the Massachusetts State Building Code. The zoning of such system shall incorporate provision for flow and tamper from each floor in addition to detectors and manual pull Page 2 stations. It is recommended by both the Fire Prevention Bureau and the Salem City Electrician that the fire alarm panel be upgraded to accomodate the additional components being added to the system. 5. Duct detection for control of the HVAC system and dampers shall be incorporated into the fire alarm and HVAC systems. Plan for such shall be presented to and approved by the Fire Prevention Bureau. 6. The developer shall agree to maintain consistency in fire alarm system components throughout the development. 7. A Knox Rapid Entry System (Knox Box) shall be installed on the outside of the building at the entrance leading to the fire alarm system annunciator. 8. A heat detector (190 degree fixed temperature) shall be located at the top of the elevator shaft. 9. Carpeting shall conform to the requirements of Article 920.7.2 of the Massachusetts State Building Code. 10. Fire Extinguishers shall be located in accordance with the requirements of NFiPA Standard #10 11. Permits shall be obtained for the following: (a) Installation of the sprinkler and standpipe system.
