Our office received a complaint regarding your property located at 362 Essex Street. The complaint was
investigated on Tuesday,August 21, 2012. Said property was found to be in violation of Massachusetts
State Building Code requirements.
The most concerning off these violations that has been received and noted during the inspections were life safety
and egress issues in the unit that fronts Essex Street. Additionally fire separation violations at the door locations on
the first and second floor levels that appear to go to the adjoining unit were noted.
1- 362 Essex Street, Unit "A"—Exit and Exit Access Doorways, Section 1015& Number of Exits
and Continuity, Section 1021- Unit presently has only one means of egress out of the unit in
violation of the aforementioned 780 CMR. The situation needs to be addresses immediately, and
the Building Department notified of the solution.
You are hereby ordered to contact this office immediately upon receipt of this letter and begin to rectify these conditions
within 7 days of receipt of this notice including applying for required permits; failure to respond to this notification will
be construed as non- compliance,with issuance of Municipal tickets or further actions. You have the right to appeal this
order to the State Board of Building Regulations at One Ashburton Place,Boston,Ma.

Dear Sir/ Madam :
The Massachusetts Department of Public Health State Sanitary Code, Chapter II, "Minimum Standards
of Fitness for Human Habitation," Section 410.354 Metering of Electrictiy and Gas and Section 410.254
Light in Passageway, Hallways and Stairs states:
(A) The owner shall provide the electricity and gas used in each dwelling unit unless
(I) Such gas or electricity is metered through a meter which serves only the dwelling unit
and
(2)The owner shall install and maintain wiring and piping so that any such electricity or
gas used in the dwelling unit is metered through meters which serve only such
dwelling unit and
(3) The rental agreement provides for payinent by the occupant.
(B) If the owner is required by this code or rental agreement to pay for the electricity or gas
used in a dwelling unit,then such electricity or gas may be metered through meters which
serve more than one dwelling unit.
(C) In a dwelling containing only three or fewer dwelling units,the light fixtures used to
illuminate a common hallway may be wired to the electricity service serving a dwelling unit
on the same floor provided that it the occupant of such dwe:ling unit is responsible for
paying for the electric service to such dwelling unit,then the rental agreement shall
state that the occupant is responsible for paying for light in the common hallway and the
owner shall notify the occupants of the other dwelling units.
Cross metering has been reported by the occupant of 362 Essex Street(Rear). This occupant(s) pay
the electric bill for that unit.
You are hereby ordered to present certification to this office within 14 days that a licensed electrician has
determined that no cross metering exists or that any cross metering has been remedied.

DECISION ON THE PETITION OF ARTHUR F. WONSON FOR A SPECIAL PERMIT
TO CONVERT THE PROPERTY AT 362 ESSEX STREET TO TWO CONDOMINIUM UNITS

A hearing on this Petition was held on January 20, 1982, with the f�Yl�otSii
. Board Members present: Douglas Hopper, Chairman; Messrs. Hackerr;tLPO.emonte,
Martineau and Feeherry. Notice of the hearing was sent to abutters and others
and notices of the hearing were properly published in the SalemIr�feingP:A`eLtak,NAS&
in accordance with Massachusetts General Laws ,Chapter 40A. -.
This proposed condominium conversion is covered : by the terms of the City
of Salem's condominium conversion ordinance. The Special Permit that has been
requested may therefore be granted only upon a finding by the Board of Appeal
. that (1) the grant of the Special Permit will not adversely impact upon the city's
existing stock of rental units for low and moderate income families and elderly
people on fixed incomes, (2) that the grant of the Special Permit is not contrary
to the City's Master Plan, and (3) the grant of the Special Permit will not have
an adverse effect on the neighborhood.
The Board of Appeal, after considering the evidence at the hearing, and
after viewing the property makes the following findings of fact:
1. The property in question is suited for conversion into two condominium
units.
2. The proposed conversion of this property to two condominium units in no
way conflicts with the Master Plan of the City of Salem.
3. The proposed conversion of this property into two condominium units
was not opposed by abutters or neighbors.
4. The property is vacant of residential tenants. Thus, no hardship is caused
by the proposed condominium conversion to any residential tenants.
On the basis of the above findings of fact and on the evidence presented
at the public hearing, the Board of Appeal , by a unanimous vote concluded that the
proposed condominium conversion is in harmony with the condominium conversion
ordinance of the City of Salem. Accordingly, the Board voted in favor of granting
the requested Special Permit in accordance withthe following terms and conditions:
1. The conversion shall be in accordance with the plans submitted
to this Board.
2. Not less than three parking spaces shall be provided.at the site.
3. Certificates of occupancy shall be obtained prior to..the sale of these units.
4. Because the building was vacant of residential tenants at the time this
petition was filed, the Petitioner will not be required to allow six months to elapse
before commencing work in furtherance of the condominium conversion. The Petitioner
may commence such work 20 days after the date of"the filing of this ec�ision.
