Dear Sirs and Madam: .
With reference to the application of Richard and Sandra Pohl seeking
a Special Permit to establish an office for the practice of Psychiatry at
335 Essex Street I urge that the application be denied.
The residence lies in an R-2 district. If R-2 zoning is to have in-
tegrity that can be relied upon by neighbors and abutters, businesses must
be restricted to areas outside residential districts. While the practice of
medicine may be a more desirable business than perhaps a gas station, it will
still create many of the characteristics of a business that are not in keep-
ing with a residential district.
Furthermore, I would like the Board to take note of the proximity of
the proposed offices to the Chestnut Street Historic District. Any major
change in the usage of 335 Essex Street will certainly impinge upon the his-
torical values of the abutting.historical properties. I refer specifically
to any proposed business parking in what is now the back yard of 335 Essex
Street. I also would like the Board to consider that Essex Street is bounded
-not only by the Chestnut Street Historic District but also by the Federal
Street Historic District. It is not improbable that Essex Street will be in-
corporated into an Historic District in the near future. Major structural and/
or usage changes now, in violation of present zoning regulations, may preclude
restoring historical values in the future.
Again, I urge denial of this Special Permit. I also request this letter
to be read into the minutes of the public hearing.

DECISION ON PETITION SUBMITTED BY RICHARD AND SANDRA POHL CONCERNING PROPERLY
LOCATED AT 335 ESSEX STREET (R-2 DISTRICT)
A hearing on this petition was held on September 26, 1978 with members 'Jane
T. Lundregan, Douglas Hopper, Arthur Labrecque and James Boulger present. Notices
were sent postpaid to abutters and others and duly published in the Salem Evening
News on September 11 and 18, 1978 in accordance with Mass. General Laws, Chapter
808.
Atty. Donald Koleman, 328 Essex St. , Salem, Mass. represented the Petitioners
before the Board.
The Petitioners are requesting a Special Permit under Section V,B,1, page 25
of the Salem Zoning Ordinance in order to use one room of their home, located at
335 Essex St. to counsel. people on a psychiatric basis. Said room would not con-
stitute more: than 25% of the gross floor area. There will be no employees at all,
and there will be no changes to the building. The Petitioner has one available parking
space in front of the residence and has rented two parking spaces across the street.
The Board voted to grant the Special Permit requested. The Board noted that said
Special Permit use is permitted and provided for in Section V,B,l of the Salem Zoning
Ordinance and found that the granting of said Permit would not be detrimental to the
surrounding neighborhood. There is adequate parking and the use of said room will not
generate any traffic increases.
