APPENDIX II(14) Legal Remedies for Tenants of Residential Housing The following Is a brief summary of some of the legal remedies tenants may use In order to get housing code violations corrected: 1. Rent Withholdinp(Massachusetts General laws Chapter 239,section 8A): If Code Violations Are Not Being Corrected you may be entitled to hold back your rent payments.You can do this without being evicted if. A- You can prove that your dwelling unit or common areas contain code violations which are serious enough to endanger or materially impair your health or safety and that your landlord knew about the violations before you were behind in- your rent. B. You did not cause the violations and they can be repaired while you continue to live in the building. C. You are prepared to pay any portion of the rent iiim court if a judge orders you to pay it.(For this,it is best to put the rent money aside in a safe place.) 2. RMair and D A,a(Massachusetts General laws,Chapter 111,section 127L):The law sometimes allows you to use your rent money to make the repairs yourself.If your local code enforcement agency certifies that there are code violations which endanger or materially impair your health,safety,or wolf-being,and your landlord has received written notice of the violations. you may be able to use this remedy.If the owner fails to begin necessary repairs(or to enter into a written contract to have thedr made)within five days afar notice or to complete repairs within 14 days after notice, you can use up to four months'rent in;an9 year to make the repairs. 3. On the same day, he promptly visited the Building Department of the City of Salem to obtain information concerning the status of said property with regard to licensing and conformity with current city and state building requirements. Commencing with his initial visit to the Building Department, and in subsequent meetings with various representatives of the City of Salem, Mr. Howe at all times advised of his position as prospective purchaser of said premises and of his need to obtain an accurate assessment as to the costs that would be involved to continue the premises as a boarding house, upon which financial information he further advised he would base his decision on whether or not to complete the purchase of the premises. In response to his initial visit on April 15th, Mr. Howe was advised that the rooming house license on the subject premises had been allowed to expire by interim owners Frederick D. and Karen J. Small. Mr. Howe was further provided with a copy of letter dated August 20, 1985, from you to Dr. Charles Donovan (the then current owner of the subject premises) , in which various deficiencies in the subject premises were enumerated. Mr. Howe was then advised that the Building Department and Fire Department would object to the reissue of the boarding house license until such time as the deficiencies specified in your letter of August 20th were corrected. In response thereto, in the immediate weeks following, Mr. Howe met separately with Norman P. Lapointe, Fire Inspector of the Salem Fire Department, and Mr. Maurice Martineau of the Building Department, to inspect the subject premises. Based on the initial comments made by both gentlemen, Mr. Howe then retained the services of an architect, and Mr. Howe and Mr. Martineau met to go through the subject premises a second time, this time accompanied by the architect, to have Mr. Martineau advise the architect as to what internal changes in the subject premises would be acceptable solutions to the deficiencies noted in your letter of August 20th, the most substantial of which being the absence of a second acceptable means of egress from the third to the second floor. At all times herein, Mr. Martineau was held out to Mr. Howe as being a competent and knowledgeable official having authority to represent the Building Department and the City of Salem with regard to the matters under consideration. Based on Mr. Martineau's specific instructions and with Mr. Martineau's approval, Mr. Howe then commissioned the architect to draw the plans and specifications for said second means of egress ; in full accord with Mr. Martineau's on-site directions. Although the Salem Fire Department has no legal standing within the City's organizational structure to formally approve or ° 2 disapprove such construction, it is noted for the record that Mr. Lapointe found the proposed solution to the creation of the second means of egress acceptable. Hence the plans drawn up by Mr. Howe's architect were in accord with the recommendations of both the Salem Fire Department and the Salem Building Department. Acting in reliance upon the recommendations of Messrs . Martineau and Lapointe, the architectural plans drawn in response thereto, and the contractor' s estimates as to the cost of executing the architectural plans, and acting in further reliance upon the representations made by Messrs. Martineau and Lapointe that both the Salem Building Department and the Salem Fire Department would not object to the reissue of the boarding house license if the deficiencies noted in your letter of August 20th were corrected, Mr. Howe then proceeded to expend substantial effort and moneys to complete the purchase of the subject premises. It was there that the matter was in progress and rested when you called a meeting at your office on June 15, 1988, at which I and Loring Fluke, representing the Warren Five Cents Savings Bank, the current owner of the subject premises, were among those present. During the course of said meeting you advised that Dr. Charles Donovan, the former owner of the subject premises, had made demand of the City of Salem, that the tenants in said premises be evicted for safety considerations due to the deficiencies cited in your August 20th letter. You further advised that, as a result of Dr. Donovan's demand, you had no alternative but to give a direct order to the Warren Five Cents Savings Bank to send eviction notices to all of the tenants on the subject premises. You further persisted in your demand that all of the tenants be evicted notwithstanding my noting the callousness of your order and the needless suffering and mental anguish that the same would cause in light of the following facts which I then called to your attention: (a) that Mr. Howe was proceeding with the purchase of the subject premises, (b) that Mr. Howe had the financial backing both to purchase and undertake extensive renovation of the subject premises, (c) that Mr. Howe was prepared to promptly correct all of the deficiencies listed in your August 20th letter upon his obtaining title to the premises in accord with meetings held with Messrs. Martineau and Lapointe, and (d) that Mr. Howe was prepared and contemplated spending upwards of $80,000, .00 on the subject premises in the first year of ownership. As evidence of Mr. Howe's good faith with regard to the matter, I had brought along with me to the meeting the architect' s plans which had been drawn in accord with the recommendations of Messrs. Martineau and Lapointe which plans, it is to be noted, you repeatedly refused to examine. Last but not least, I placed you on notice that your eviction order would serve as a substantial if not fatal impediment to Mr. Howe's purchase of the property and also placed you on notice that if Mr. Howe did not purchase the property, 3 there was no one else to correct the deficiencies on the premises, the end result of which would 'be the eviction of the tenants. Your response to all of the above was to express your lack of concern as to all of the items enumerated herein and to persist in your demand that the Warren Five immediately send out eviction notices. It is to be noted herein that your conduct at said June 15th meeting was capricious and arbitrary and undertaken by you in knowledgeable violation of the law in that (a) you undertook to issue the order without a current inspection of the subject premises and (b) you gave the order orally when you were otherwise required by law to give the same in writing. Beyond the issue of the law, your conduct at said June 15th meeting in persisting in the issuance of your unlawful order when you were otherwise fully informed that steps had been and were being taken to correct the situation was a moral outrage in needlessly inflicting emotional distress upon the tenants inhabiting the subject premises. In addition, you willfully and knowledgeably continued in the issuance of your unlawful order even after it had been made explicitly clear to you that the issuance thereof would serve to hinder, if not stop, the repairs planned for the subject premises. As a result of the unlawful actions taken by you on June 15th, Mr. Howe had to undergo considerable additional expense and travail in order to persist in his obtaining title to the subject premises. Notwithstanding the additional obstacles which you willfully and knowledgeably placed in his path, the sale was proceeding to conclusion when, in early July, immediately prior to his obtaining title, I asked that he seek reconfirmation from the Fire Department and the Building Department concerning their earlier agreement that both Departments would have no objection to the re-issuance of the boarding house license if all of the deficiencies listed in your August 20th letter were corrected. It was at this time that you personally chose to add new, additional and open ended demands as a pre-condition to the Building Department withdrawing its objections to the re-issuance of the boarding house license. Mr. Howe immediately responded to your additional demands by letter dated July 6, 1988, addressed to your attention, wherein it was made clear both to you and the City of Salem that your new demands constituted an extraordinary and unfair economic burden which could not be met and further constituted a violation of the agreement previously reached between Mr. Howe and Messrs . Martineau and Lapointe upon which understanding Mr. Howe had based his actions in moving to complete the purchase the subject premises. In a final effort to resolve this situation, a meeting was 4 held at Mayor Salvo's office on July 11th and which the mayor, you, Mr. Howe and, I were among the participants. At said meeting, all of the above circumstances were again reviewed and I called both to your and the mayor's attention the potential civil liability that the City of Salem now had not only to Mr. Howe but also to the tenants of the subject premises as a result of the manner in which this matter had been and was being handled by the City and its representatives. At said meeting, I also made demand that the City of Salem live up to its prior agreement with Mr. Howe, to wit, that satisfaction of the deficiencies listed in your August 20th letter would result in both the Fire Department and Building Department withdrawing their objections to the re- issue of the boarding house license. The foregoing was agreed to by you on behalf of the Building Department conditioned upon your review of the architect's plans which you had previously refused to review when offered to you on June 15th. Subsequently, you met with Mr. Howe on the subject premises at which point you (a) made new and additional demands for changes in the subject premises, in particular with regard to replacement of all of the interior doors, and (b) disapproved of the architect's plans for a new interior staircase drawn in accord with the instructions given by Messrs . Martineau and Lapointe, instead making new demands that the plans be redrawn with the new stairway being repositioned in such a manner that it would take up such space as to significantly reduce the potential income from the subject premises. It is further to be noted that you willfully made the demand for the repositioning of the new staircase with full and clear knowledge that the loss in income generated by Mr. Howe's compliance with said demand would make Mr. Howe' s purchase of the subject premises economically unfeasible. It is at this point that the matter now stands. As a result of your latest set of additional demands, in breach of the prior understandings and agreements reached between Mr. Howe and the City of Salem, the purchase and restoration of the subject premises as a boarding house is no longer economically feasible, and Mr. Howe must consequently terminate his plans to purchase the subject premises. The Warren -Five Cents Savings Bank has been advised by this office of the situation and Mr. Howe's resulting inability to proceed with the purchase of the premises. The Warren Five, in turn, has advised Mr. Howe that he has until Monday, July 25, 1988, to confirm that he is proceeding with the purchase of the premises, absent which Mr. Howe's deposit moneys will be declared forfeit and the premises again placed on the auction bloc. In light of the current burdens which you are unlawfully seeking to place upon him with regard to the purchase of the premises, Mr. Howe is unable to give the confirmation that the Warren Five is requesting. There will be no extensions or additional courtesies granted by the Warren Five to Mr. Howe. All of Mr. Howe's rights to purchase the premises will expire on Monday, subsequent to which Mr. Howe will have no alternative but 5 to proceed to press his claims against you and the City of Salem. Subsequent to the issuance of your August 20, 1985 letter to Dr. Donovan there is no evidence indicating that either you or anyone else acting on behalf of the Building Department took affirmative action with regard to compelling Dr. Donovan to correct the deficiencies listed in said correspondence. Said correspondence stated that you would notify the appropriate licensing authority and initiate appropriate legal action if corrective action were not taken by Dr. Donovan within thirty days. There is no evidence indicating that either you or anyone else acting on behalf of the Building Department took such action against Dr. Donovan upon his failure to take corrective action. On the contrary, the indications are that you knowingly and willfully failed to take any action against Dr. Donovan as a result of his failure to take corrective action, all to the financial benefit of Dr. Donovan. The indications further are that you knowingly and willfully failed to take any action against any of the subsequent owners of the subject premises as a result of their similar failure to take corrective action. However, when Dr. Donovan, the original miscreant, made demand of you that you close down the subject premises and evict all of the tenants because of his, Dr. Donovan's, failure to comply with the terms of your letter of August 20th, you immediately reversed your position and became an avenging angel hell bent on closing down the subject premises. Commencing with the meeting called by you on June 15th, you have .been unswerving and singularly dedicated in your attempts to close the subject premises. While giving lip service to the purported safety of the tenants, you have likewise been unswerving in your dedication to imposing one impediment after another in the way of Mr. Howe's purchase of the subject premises, notwithstanding your full and complete knowledge that Mr. Howe is the only individual both financially capable and willing to correct the deficiencies outlined in your letter of August 20. For thirty-four months after the issuance of your letter of August 20, 1985, you took no concrete affirmative action to obtain compliance with the terms thereof. Upon instigation by Dr. Donovan, however, you immediately instigated a campaign of harassment against Mr. Howe's purchase of the subject premises. Commencing with the meeting called by you on June 15, in violation of application local and state law and in violation of Mr. Howe's rights to due process of law, you ordered the eviction of all of the tenants from the subject premises notwithstanding full and complete knowledge that such action would seriously impede if not destroy Mr: Howe's ability to purchase the premises and make the necessary repairs thereto. When Mr. Howe overcame the obstacles raised by you at said June 15th meeting, you then knowingly and willfully violated the terms of the agreements previously reached between Mr. Howe and the Building Department 6 as represented by Mr. Martineau to raise new and, from your viewpoint, hopefully fatal barriers to Mr. Howe's purchase of the subject premises. When Mr. Howe was successful in appealing such misconduct on your part to the mayor, you then again knowingly and willfully breached the terms of the agreements previously reached between Mr. Howe and the Building Department by revoking approval of the architect' s plans and making demand for new plans positioning the new staircase in such a manner as to reduce the income potential of the subject premises to such a level that the purchase and renovation thereof by Mr. Howe is no longer economically feasible. In short, since Dr. Donovan has made demand that you do so, you have done everything in your power, in violation of ordinance and statute and in breach of prior agreements reached between the City of Salem and Mr. Howe, to thwart Mr. Howe's purchase of the subject premises. In addition, your actions have been accompanied by an attitude that is highly objectionable. Your condescending comments concerning Mr. Howe, directed towards me during our meeting on June 15 and again directed towards me and Mr. Howe during our meeting of July 11, to the effect that you knew what was best for Mr. Howe in establishing additional impediments to his purchase of said premises and that you only had his interests at heart in the creation of said obstacles, are personally offensive to Mr. Howe and professionally unacceptable by this office. Mr. Howe is a mature, competent, educated and experienced adult, well versed in the management and purchase of real estate. Your patronizing comments to the contrary were and are highly insulting, as well as being indicative of your mentality and motivation in dealing with Mr. Howe in this matter. Further, I would suggest that you have sought to cover and conceal your actions with regard to this matter in a tissue of lies and falsehoods. When we met with Mayor Salvo on July 11th, you advised the mayor that Mr. Howe had previously falsely held himself out to be the owner of the subject premises in an earlier meeting with you. Said statement on your part is false and is known by you to be false. There can have been no earlier misrepresentation on Mr. Howe's part or earlier misinterpretation on your part as to Mr. Howe's standing in this matter as the meeting of July 11th was the first time that Mr. Howe met with you concerning the same. At the July 11th meeting you also advised that your motivation in seeking the eviction of the tenants was based on a newspaper advertisement of rooms for rent. Said statement on your part is likewise false and is known by you to be false. At our meeting of June 15th you made it clear that your sole motivation in seeking the eviction of the tenants was the demand made of you and other city officials by Dr. Donovan At the July 11th meeting you also had the unmitigated nerve 7 to disclaim .all responsibility for the issuance of the eviction notices, stating that it was the Warren Five Cents Savings Bank that had undertaken such action on its own initiative to protect its position, and that you had only raised the possibility of the same with the bank. Said statement on your part was a bold faced lie and is unequivocably known by you to be a lie. I would remind you that this writer was present on June 15th when you again and again ignored this writer's arguments and objections, and instead repeatedly ordered the Warren Five to immediately issue the eviction notices. The question now is, who benefits from the course of action you have chosen to follow? Is it the tenants? Certainly not. You have put them through the tortures of the damned in compelling the Warren Five to issue .mass eviction notices, and you have done everything possible to thwart the purchase of the subject premises by the one person both willing and financially able to correct the deficiencies noted in your letter of August 20th, the one person willing and desirous of maintaining the subject premises as a board house -- Alan T. Howe. Is it the City of Salem? Likewise, certainly not. I would suggest that, by your willful, arbitrary, capricious and unlawful misconduct in this matter, you have rendered the City of Salem financially liable not only to Mr. Howe but also to the tenants of the subject premises. With regard to the latter, as I detailed during the course of our July 11th meeting, I would suggest that the City of Salem has now become liable to the tenants not only for the cost of moving them to other locations and (indefinitely into the future) the cost differential between their old and new accommodations but has also become legally responsible for securing and placing them in new lodgings as well as for exemplary damages. Your pious protestations of public safety aside, I would further respectfully suggest to you that the public, the courts, and juries, have far greater intelligence than you give them credit for, and that, in light of the easily provable facts of the situation, all will quickly pierce the sanctimonious trappings with which you have sought to clothed your actions. The question then remains, who benefits from the course of action you have chosen to follow? There is only one -- Dr. Charles Donovan -- and I will leave it to you to explain to a jury why you have chosen to favor his interests over those of Mr. Howe, the City of Salem, and the tenants of the subject premises. Mr. Howe has not, by this letter or by any other action taken with regard to the City of Salem, asked that he be exempted from the application of any ordinance of the City of Salem or statute of the Commonwealth of Massachusetts. All that Mr. Howe has requested is that the law be equally applied and that he be held to a standard no higher than that to which others in the community are held. 8 A review of other boarding houses in Salem, conducted over the past week, has confirmed that Mr. Howe is not being treated equally under the law by you or the City of Salem. On the contrary, both you and the City of Salem are attempting to hold him to a standard that even Caesar's wife would not be able to meet. Said investigation has made it obvious to the point of certainty that a much higher and discriminatory standard is being applied to Mr. Howe's purchase of the subject premises, all in violation of due process of law. What I would suggest has likewise become fully apparent from your actions is that, for reasons other than those allowed by law, you have personally determined that Mr. Howe should snot become the owner of the subject premises and that, in furtherance of your determination in this matter, you have chosen to do everything in your power, both within and without the law, to thwart Mr. Howe's purchase of the premises. As a result of your misconduct in this matter, demand for relief is hereby made against you, individually, and the City of Salem for real damages in the amount of $500,000.00 and exemplary damages in the additional amount of $500,000.00. The foregoing damages are separate, apart, and in addition to those being demanded of Dr. Donovan. However, you you have aligned your actions and those of the City of Salem so closely to Dr. Donovan's interest, I believe it appropriate that Mr. Howe's causes of action against the three parties be filed jointly in a single action. Failure to resolve this matter to Mr. Howe's satisfaction within six months of the receipt of this letter shall result in suit being commenced against you, individually, and the City of Salem without further notice. In addition to the above, it is the intent of this office to ask for complete investigations of this matter by the appropriate Federal and state agencies having jurisdiction over civil rights matters. This property lacks a fire alarm system appropriate for the use and occupancy of this byilding. Battery-powered smoke detectors are inappropriate for use within a lodging house and/or medical office. A system of interconnected smoke and heat detectors with a battery-backup and zoned panel are re- quired. Such system shall be installed by a licensed elec- trician with permits from both the Fire Prevention Bureau and the Salem Electrical Department. 2. The heating system and domestic water heater must be enclosed within and approved boiler room, with walls and door rated in accordance with the Massachusetts State Building Code. 3. Stairways shall be enclosed as to provide a clear means of egress from the building. Doors and walls forming such enclosure shall be rated as per the Building Code. 4. . The storage of paints and related materials shall be within an approved storage cabinet. 5. The gas stove shall be disconnected and removed from the corridor, as this is obstructing the means of egress from . the building. 6. Two separate means of egress shall be provided from each floor within the building. The fire escape on the front of the building is not an acceptable means of egress, as it does not meet the requirements of the Building Code. 7. Glass transoms over interior doors shall be removed and replaced with material which meets with the requrements of the Building Code with respect to fire rating. 8. An unregistered motor vehicle, a green 1966 Continental sedan, shall be removed from the property, as this constitutes a fire hazard. ' This vehicle has been unregistered since the Fall of 1982. 9. A means for the disposal of trash, rubber tires, and debris is needed. Uncovered trash barrels, discarded automobile tires, and other debris are being stored under a wooden porch in the rear of the building. A metal trash shed, suitable for several rubbish containers should be provided. 10. Fire extinguishers, of the proper size and class, shall be distributed throughout the building as directed by the Fire Prevention Bureau. Howe of 10 Chestnut Street, Salem, who has an option to purchase the premises known as and numbered 331 Essex Street in Salem ("premises") . This letter will serve to ratify and confirm the understanding reached between you, in your capacity as Inspector of Buildings, and Mr. Howe, as prospective purchaser of 331 Essex, during your tour of the premises this afternoon. Reference is made to your letter of August 20, 1985 , addressed to Dr. Charles Donovan, the then current owner of the premises, detailing various deficiencies in the premises. Since that date, the boarding house license on the premises has been allowed to lapse. Mr. Howe is desirous of obtaining a reissuance of said license. You, in your capacity as Inspector of Buildings for the City of Salem, however, have interposed objection to the reissuance of said license absent a correction of the deficiencies listed in your letter of August 20th. This letter is to codify in writing the understanding reached today by which Mr. Howe has committed himself to promptly correcting various deficiencies in the premises. Upon Mr. Howe's execution of the commitments he has made herein, you have agreed to withdraw your objection to the reissuance of the boarding house license. This letter further details the manner, jointly agreed upon, in which Mr. Howe is to correct the deficiencies in question. Mr. Howe has agreed to correct the deficiencies, numbered 1 through 5 in your letter of August 20th, which have not previously been corrected. It is understood as to deficiency number 1, relating to enclosure of the boiler room, that Mr. Howe has the "September" 1 option, for lack of a better word, with regard thereto, in light of the pending change in the state building code. Deficiency number 2 will be corrected by Mr. Howe by his having replaced or remodeled all of the interior doors and transoms leading into the first, second and third floor corridors of the premises. The new or remodeled doors are to meet a 1 hour rated standard. All doors to the tenants' rooms are to have self-closing locks. Deficiency number 2 will further be corrected by Mr. Howe by his having installed a 1 hour rated fire door in each of the first and second floor halls , approximately midway, in the passageways running from the front to the rear of the building. Deficiency number 3 will be corrected by Mr. Howe by his having constructed an exterior staircase at the rear of the premises. The egress onto the staircase will be from the third floor. At Mr. Howe's option, the egress will be from Room 6 or Room 7 of the premises. The exterior unit will consist of an exterior landing of approved dimension, followed by a staircase having a minimum stair tread width of 22" . If the premises are within the Salem Fire District the staircase will be made of metal. If the premises are not within the Salem Fire District, the staircase may, at Mr. Howe's option, be made of wood. In either instance, all exterior glass within 10' of the exterior staircase will be modified to meet a 1 hour rated standard. It is my understanding that the deficiencies numbered 4 and 5 in your letter of August 20th have previously been corrected. This letter will serve to ratify and confirm that Mr. Howe has and hereby agrees to have the above deficiencies corrected in the manner specified herein within 30 days of his assuming title and possession of the premises, strikes, delays by materialmen and acts of God excepted. It is understood by both you and Mr. Howe that the correction of deficiency number 3 cannot be commenced by Mr. Howe until he receives permission from the Salem Historic District Commission to construct the exterior staircase in question. Mr. Howe agrees to promptly apply to (and diligently pursue) the Commission for permission to construct the exterior staircase (presently, or, if he lacks current standing to do so, upon his obtaining title to the premises) . You, in turn, as Inspector of Buildings, agree to certify to the Commission that the exterior staircase is necessary for reasons of safety. In the event that the Commission has not yet granted permission to construct the exterior staircase on the date that Mr. Howe assumes title and possession to the premises, Mr. Howe will have 30 days from the date said permission is granted to construct the exterior staircase, strikes, delays by materialmen and acts of God excepted. Notice of the hearing was sent to abutters and others and notices of the hearing were properly published in the Salem Evening News in accordance with the provisions of Massachusetts General Laws, Chapter 40A. The petitioner, represented by Attorney John Serafini, is requesting a Variance and/or Special Permit to convert a rooming house at 331 Essex Street to six (6) residential units. The property is located in an R-2 District. The provision of the Salem Zoning Ordinance which is applicable to this request for a Special Permit is Section V B 10, which provides as follows: Notwithstanding anything to the contrary appearing in this Ordinance, the Board of Appeal may, in accordance with Section VIII F and IX D, grant Special Permits for alterations and reconstruction of nonconforming structures, and for changes, enlargement, extension or expansion of.nonconforming lots, land, structures, and uses, provided, however, that such change, extension, enlargement or expansion shall not be substantially more detrimental than the existing nonconforming use to the neighborhood. In more general terms, this Board is, when reviewing Special Permit requests, guided by the rule that a Special Permit request may be granted upon a finding by the Board that the grant of the Special Permit will promote the public health, safety, convenience and welfare of the City's inhabitants. The Board of Appeal, after careful consideration of the evidence presented at the hearing, and after viewing plans of the property, makes the following findings of fact; 1. Several neighbors and abutters spoke in favor of granting the Special Permit, and stated that they favored the granting of a Special Permit for four (4) units. 2. The petitioner, after several neighborhood meetings, agreed to request the Special Permit for only four (4) units. 3. The petitioner plans to restore the historic exterior of the property and to provide green space. 4. Adequate on-site parking is shown on the petitioner's plans. On the basis of the above findings of fact, and on the evidence presented at the hearing, the Board of Appeal concludes as follows: 1. Special conditions exist which especially affect the subject property but do not generally affect the district; AMENDED DECISION ON THE PETITION OF FREDERICK D. I am ever mindfull of our agreement to bring this property into compliance with the applicable code.At this date some 'conditions' may be said to be incomplete and indeed some 'conditions' are incomplete,nevertheless. I believe that I am in substantial compliance with applicable code. The major aspect of the mandated compliance was the building of an interior staircase in order to provide a second means of egress from the third floor.After the stairs were built, you informed me that the staircase was too narrow as were two exit doors.In each instance the minimum width of 36 inches had not been met.How the builder failed to meet this standard has never been adequately explained to me. Widening the door and staircase has been delayed longer than than I wished. It has been more costly and time consuming because the builder has not seen fit to correct these errors without substantial additional cost to me. Further, a leaky roof has delayed the installation of drywall and emergency lights. The correction of the staircase and exit ways is in progress. A new first floor exit door is nearly completed making it possible to begin to enlarge the staircase.The emergency lights in the stairwell are scheduled for competion this week. Staircase correction and drywall installation are targeted for completion August 31th. The recent fire in Lynn has heightened everyone's concerns for fire prevention. We have fire rated doors in everyroom as well as firedoors in the hallways. When sprinklers are installed, we will be in better condition than most lodging houses which I have seen . Most of them contain doors inferior to those that I replaced. We know that the City of Salem does not wish to have a tragedy similar to Beverly or Lynn. Despite all the statements by public officials , even with sprinklers a Salem rooming house might sustain loss of life. In both Beverly and Lynn, any amateur knows that a fire of such intensity has to be set with a powerful accelerant. If one is going to torch a building and he places that accelerant in the stairwells, some one is bound to perish. My recent experience with the police, fire and health departments tells me that there is no way a property owner can receive help in reducing the chance of a fire, if he tries to remove from his property persons who might endanger the public safety. Recently, after receiving numerous complaints about the use of fireworks from a room in my building, I complained to the police,, fire and health departments. They told me there was nothing they could do unless they actually saw the person doing it. The police suggested I file a complaint with the Salem District Court. Now fireworks are a fire_tLazard. Over the July 4 weekend, the papers carried a story of a house ablaze by fireworks that fell into the bushes subsequently setting the house on fire.None of the agencies mentioned interviewed the alleged fireworks user. That act may have deterred his use. I will allow that Inspector LaPointe would have gone by had the person been at home in the daytime. Freebasing cocaine is a firehazard. There is no quick way to rid a building of a freebaser. We had an incident of forced entry into our building. Two women entered to confront a tenant with a personal matter. The police took the report but did nothing to question the alleged persons who entered the building. Rooming houses are set on fire by persons with a grudge to settle with one of the occupants. I know that even if a rooming house operator is vigilant that he can little support from city agencies in dealing with what he perceives to be threats to the security . of his property. If Salem wishes to avoid a tragedy similar to Lynn's , it will have to develop legislation both in the City Council s well as the legislature which will allow the means .to take quick and effective action against those persons likely to set a building on fire. As a rooming house owner,I am conscious of the threat of fire. Our building contains twelve renting units. There are three deckers in Salem with probably more occupants , whose front and rear doors are not secure and are ripe for the kind of grudge arson seen in Beverly and Lynn. As I lost three young cousins to such a fire in Boston thirty years ago , I cannot help but believe that the attention focused on rooming houses overlooks a greater number of buildings with a greater potential for. the loss of human life. I do not say this so that you will focus your atention elswhere and leave me alone. But rather , if we are sincere in our desire to prevent the loss of human life in a fire in Salem then , we should address the some of the concerns that I have raised in this letter.
