Our licensed electrician installed the combination illuminated exit sign and emergency lights at the south exit of the meeting house. He also installed the emergency light and illuminated exit sign at the north exit door. These are wired into the building electrical supply according to code. Enclosed are photographs of the installation. The one.emergency light head in the west hallway of the. narthex that was not operating during your inspection has been replaced and is functional. At the conclusion of our inspection Reverend Barz-Snell advised us that you as the Standing Chair and your Committee were the responsible agency with-in the Church for the remaining outstanding violations as per this Department's April 19, 2012, Violation Notice pertaining to the Church area and separate August 9,2012—Violation Notice relating to the second floor. It was noted at completion of our re-inspection and stated forthwith that all violations noted in our letter ofAugust 9, 2012 are complete and in compliance. This Building Department compliance places The Henne Penny Nursery School located on the Second Floor in good standing. Regarding the outstanding violations stated in our April 19, 2012 letter and April 26, 2012 site meeting with the Reverend and the Church's Architects, as of September 25, 2012 outstanding violations still exist with this office. The only noted correction was the installation of"lighted"exit signage was above the egress door inside the Church at the Essex Street end of the building. As at that time the Certificate of Occupancy associated with the Building Permit was issued, and at the meeting with your Architect's it was noted that were no or limited life safety equipment: lighted exit, signs, emergency lighting, horn strobes in the existing Church Building. It was agreed that "lighted"exits sign and emergency Lighting, along with any other required LIFE SAFETY equipment would be installed prior to Church services opening after the Easter holiday. The Petitioner requested variances from the following sections of 521 CMR: 25.1,regarding the lack of entrances; 29.2.3, regarding the change in level to the organ loft, mezzanine and pulpit; and 30.1, regarding the lack of accessible toilet rooms at the mezzanine level. In accordance with M.G.L. c. 30A, §§ 10 and 11; 801 CMR 1.02 et. seq.; and 521 CMR 4.00,the Board convened a hearing on June 6, 2011 where all interested parties were provided with an opportunity to testify and present evidence to the Board. Patrick Guthrie and Arthur Vogt,Menders Torrey& Spencer, Inc.; Steve Palmer, Representative for First Church in Salem; Jeff Barz-Snell, Minister; and Richard Lheureux,Representative for First Church in Salem, all appeared on behalf of the Petitioner. All but Vogt were sworn in by the Chairman. Applicable Laws The Board established jurisdiction pursuant to 521 CMR 3.3.2, which states that, "[i]f the work performed, including the exempted work, amounts to 30%or more of the full and fair cash value (see 521 CMR 5.00)of the building the entire building is required to comply with 521 CMR." Under the requirements of 521 CMR 25.1, "[a]ll public entrance(s) of a building or tenancy in a building shall be accessible. Public entrances are any entrances that are not solely service entrances, loading entrances, or entrances restricted to employee use only." Pursuant to the requirements of 521 CMR 30.1, "[e]ach public toilet room provided on a site or in a building shall comply with 521 CMR...a. In each adult public toilet room, at least one water closet and one sink in each location shall be accessible to persons in wheelchairs, or a separate accessible unisex toilet room shall be provided at each location. Adult water closets shall comply with the provisions of 521 CMR 30.1 through 30.13...." Exhibits Exhibit 1: Board Packet, AAB1-30, including all correspondence and plans submitted. Facts The variance hearing was held on June 6, 2011 and based on the credited testimony of the witness, and the documents submitted, the Board finds the following facts: 1) The church was originally built in 1836 and consists of a single story, with an organ loft, and a basement level consisting of a performance hall with a stage (to be removed in future phase). The 1927 attached two story parish house consists of the basement space, consisting of storage and mechanical space; the first floor being used as parish administration space; and the second floor being used for religious education. The building is a total of 19,000 square feet with 8,200 square feet at the first floor, 4,400 square feet at the second floor, and the basement occupiable space consisting of 6,400 square feet. (Exhibit 1). 2) The proposed project will be an estimated $940,000.00;with the assessed value of the existing building being $1,449,200.00. The project will consist of a 1,200 square foot addition which will create access to all floors via a new elevator and entrance into the church, along with the other following modifications: expansion of the existing sprinkler system; retrofit of a secondary egress stairs; removal and relocation of existing stair; upgrades to all existing door hardware to comply with 521 CMR; creation of an accessible unisex toilet room; and accessibility modifications to the existing first floor toilet rooms and community kitchen. The work at the exterior will also consist of the following: creation of a new accessible pathway from Essex Street; new accessible parking spaces created within the church parking lot; and the removal of two existing fire escapes, to be replaced with windows. (Exhibit 1). 3) There are currently six (6) entrances into the existing building (See Plan A101, AAB 23). Of the existing six entrances, Entrance 1 will be the primary accessible daily entrance to the building, which is accessed directly from the adjacent parking lot; Entrance 2 will also be a primary daily accessible entrance directly adjacent to the vehicular drop-off. With the proposed construction of the addition, Entrances 1 and 2 will be the primary entrances into the building and will create an accessible route to all levels of the church. (Exhibit 1 and Testimony of Guthrie). 4) Entrance 3 opens onto a stair landing at an intermediate level between floors. This historic entrance also has a 12 inch wide threshold at the doorway. (Exhibit 1 and Testimony of Guthrie). 5) Entrance 4 is currently inaccessible and is located at the historic fagade of the church. All interior spaces adjacent to this entry are fully accessible via other routes from fully accessible entrances. The cost of creating access at this entrance is estimated at approximately $148,000.00 to create a 40 foot ramp, which would also block the existing drop-off area. (Exhibit 1). 6). Entrance 5 is an inaccessible entrance that enters into a stair landing at an intermediate level between floors. This historic entrance also has a 12 inch wide threshold at the doorway. (Exhibit 1). All interior spaces adjacent to this entry are fully access via other routes from fully accessible entries. This entrance is primarily an egress door from an egress stairway. Guthrie stated that Entrance 6 is shown on Plan A 10 1 (AAB23) and that space adjacent to Stair 2 is currently located directly adjacent to the minister's office which will remain in this location and is accessible from the interior. Bars-Snell stated that this entrance was more of an employee only entrance that was occasionally used, but added that he often meets with parishioners in the common areas within the church. (Exhibit 1 and Testimony of Guthrie and Barz-Snell). 8) The Organ Loft is reached via two sets of stairs from the Narthex: The seating within the Organ Loft represents less than 10% of the total seating at the Meetinghouse. The use of the loft is also generally limited to the holiday use by the choir, in contrast to their usual performance space at the front of the Meetinghouse. The Petitioners noted that the installation of a vertical wheelchair lift or LULA elevator would be an excessive cost without substantial benefit to persons with disabilities. Guthrie noted that the organist is a paid employee of the church and reiterated that the choir only used the loft on holidays. He added that because of the way that the balcony sits over the sanctuary, the balcony line extends into the sanctuary space, requiring that a lift would be installed within the sanctuary. Guthrie also clarified that there is.tiered seating within the sanctuary;which.is divided by-the built-in-organ bench,resulting in no clear path of travel between the two sides of the loft. (Exhibit 1 and Testimony of Guthrie). 9) The Mezzanine is located at the mid-level between the narthex and the basement and is reached via stairs at Entrance 3 and 5 from the Narthex and basement levels. The Mezzanine is only used for storage,but does also have two toilet rooms that are available to the parishioners. Guthrie added that the new elevator will create access to the lower floor level and the first floor, but there will be no intermediate access to the mezzanine level. He also noted that the toilet rooms at this level are 4 inches higher than the mezzanine level floor. Guthrie added that the existing toilet room at the first floor would be expanded to create an accessible unisex toilet room. The Petitioners noted that the next phase of the renovation will include the addition of accessible toilet rooms at the basement level as well. (Exhibit 1 and Testimony of Guthrie). 10)The Pulpit is 6 feet above the sanctuary level floor at the front of the Meetinghouse and is accessed via two sets of narrow stairs that flank each end of the pulpit. The Petitioners noted that the accessible space at the altar has the same liturgical importance and is used in equal measure to the pulpit. Barz- Snell noted that he did lead services from the pulpit for part of the time, but that a lot of the service is conducted from the accessible altar. The pulpit is also historic to the church, built in the 1870's. Barz- Snell noted that although the pulpit is occasionally used by parishioners during the service for readings, the church often uses a lectern at the floor level. (Exhibit 1 and Testimony of Barz-Snell). Analysis The Board established jurisdiction pursuant to 521 CMR 3.3.2, which states that, "[i]f the work performed, including the exempted work, amounts to 30%or more of the full and fair cash value (see 521 CMR 5.00) of the building the entire building is required to comply with 521 CMR." The next variance request was in regards to 521 CMR 29.2.3, regarding the change in level from the altar to the Pulpit. A letter of opposition was submitted by the Standing Committee ofthc First Church In Salem, Unitarian. Peter Copelas and William 1lenning, who are both affiliated with the First Church also spoke in opposition to the request 9. Councilor At Large, Steven Pinto, spoke in favor of the request. 10. David Williams (342 Essex Street) requested that if the Board chooses to grant the petitioner's request, that they place limitations on the special permit. 11. Ward 3 Councilor, Jean Pelletier, spoke in favor of the request saying the church is exempt from the parking regulations and is a much larger use that the use proposed. The Board of Appeal, after careful consideration of the evidence presented at the public hearing, and after thorough review of the plans and petition submitted, makes the following findings: I. The proposed change in nonconforming use would not be substantially more detrimental than the existing nonconforming use to the neighborhood. On time basis of the above Findings of fact and all evidence presented at the public hearing including, but not limited to, the Plans, Docunments and testimony, the Zoning Board of Appeals concludes: 1 . A special permit for a change in nonconlornling use is granted to allow the first floor space which formerly housed a photography studio to house professional offices. 2. The Petitioner requested variances from the following sections of 521 CMR: 25.1,regarding the lack of entrances; 29.2.3, regarding the change in level to the organ loft,mezzanine and pulpit; and 30.t,regarding the lack of accessible toilet rooms at the mezzanine level. In accordance with M.G.L. c. 30A, §§ 10 and 11; 801 CMR 1.02 et. seq.; and 521 CMR 4.00,the Board convened a hearing on June 6, 2011 where all interested parties were provided with an opportunity to testify and present evidence to the Board. Patrick Guthrie and Arthur Vogt,Menders Torrey& Spencer, Inc.; Steve Palmer, Representative for First Church in Salem; JeffBarz-Snell,Minister; and Richard Lheureux,Representative for First Church in Salem, all appeared on behalf of the Petitioner. All but Vogt were sworn in by the Chairman. Applicable Laws The Board established jurisdiction pursuant to 521 CMR 3.3.2,which states that, "[i]f the work performed, including the exempted work, amounts to 30%or more of the full and fair cash value(see 521 CMR 5.00) of the building the entire building is required to comply with 521 CMR-" Under the requirements of 521 CMR 25.1, "[a]ll public entrance(s) of a building or tenancy in a building shall be accessible. Public entrances are any entrances that are not solely service entrances, loading entrances, or entrances restricted to employee use only." Pursuant to the requirements of 521 CMR 30.1, "[e]ach public toilet room provided on a site or in a building shall comply with 521 CMR...a. In each adult public toilet room, at least one water closet and one sink in each location shall be accessible to persons in wheelchairs, or a separate accessible unisex toilet room shall be provided at each location. Facts The variance hearing was held on June 6, 2011 and based on the credited testimony of the witness, and the documents submitted, the Board finds the following facts: 1) The church was originally built in 1836 and consists of a single story,with an organ loft, and a basement level consisting of a performance hall with a stage (to be removed in future phase). The 1927 attached two story parish house consists of therbasement space, consisting of storage and mechanical space; the first floor being used as parish administration space; and the second floor being used for religious education. The building is a total of 19,000 square feet with 8,200 square feet at the first floor, 4,400 square feet at the second floor, and the basement occupiable space consisting of 6,400 square feet. (Exhibit ly. _ 2) The proposed project will be an estimated$940,000.00,with the assessed value of the existing building being$1,449,200.00. The project will consist of a 1,200 square foot addition which will create access to all floors via a new elevator and entrance into the church, along with the other following modifications: expansion of the existing sprinkler system; retrofit of a secondary egress stairs; removal and relocation of existing stair; upgrades to all existing door hardware to comply with 521 CMR; creation of an accessible unisex toilet room; and accessibility modifications to the existing first floor toilet rooms and community kitchen. The work at the exterior will also consist of the following: creation of a new accessible pathway from Essex Street; new accessible parking spaces created within the church parking lot; and the removal of two existing fire escapes, to be replaced with windows. (Exhibit 1). 3) There are currently six (6) entrances into the existing building(See Plan Al01, AAB 23). Of the existing six entrances,Entrance 1 will be the primary accessible daily entrance to the building, which is accessed directly from the adjacent parking lot; Entrance 2 will also be a primary daily accessible entrance directly adjacent to the vehicular drop-off. With the proposed construction of the addition, Entrances 1 and 2 will be the primary entrances into the building and will create an accessible route to all levels of the church. (Exhibit 1 and Testimony of Guthrie). 4) Entrance 3 opens onto a stair landing at an intermediate level between floors. This historic entrance also has a 12 inch wide threshold at the doorway. (Exhibit 1 and Testimony of Guthrie). 5) Entrance 4 is currently inaccessible and is located at the historic fagade of the church. All interior spaces adjacent to this entry are fully accessible via other routes from fully accessible entrances. The cost of creating access at this entrance is estimated at approximately$148,000.00 to create a 40 foot ramp, which would also block the existing drop-off area. (Exhibit 1). 6) Entrance 5 is an inaccessible entrance that enters into a stair landing at an intermediate level between floors. This historic entrance also has a 12 inch wide threshold at the doorway. (Exhibit 1). All interior spaces adjacent to this entry are fully access via other routes from fully accessible entries. This entrance is primarily an egress door from an egress stairway. Guthrie stated that Entrance 6 is shown on Plan Al01 (AAB23) and that space adjacent to Stair 2 is currently located directly adjacent to the minister's office which will remain in this location and is accessible from the interior. Bars-Snell stated that this entrance was more of an employee only entrance that was occasionally used,but added that he often meets with parishioners in the common areas within the church. (Exhibit 1 and Testimony of Guthrie and Barz-Snell). 8) The Organ Loft is reached via two sets of stairs from the Narthex. The seating within the Organ Loft represents less than 10% of the total seating at the Meetinghouse. The use of the loft is also generally limited to the holiday use by the choir, in contrast to their usual performance space at the front of the Meetinghouse. The Petitioners noted that.the installation of a vertical wheelchair lift or LULA elevator would be an excessive cost without substantial benefit to persons with disabilities. Guthrie noted that the organist is a paid employee of the church and reiterated that the choir only used the loft on holidays. He added that because of the way that the balcony sits over the sanctuary,the balcony line extends into the sanctuary space,requiring that a lift would be installed within the sanctuary. Guthrie also clarified that there is tiered seating within the sanctuary, which is divided by the built-in organ bench, resulting in no clear path of travel between the two sides of the loft. (Exhibit 1 and Testimony of Guthrie). 9) The Mezzanine is located at the mid-level between the narthex and the basement and is reached via stairs at Entrance 3 and 5 from the Narthex and basement levels. The Mezzanine is only used for storage, but does also have two toilet rooms that are available to the parishioners. Guthrie added that the new elevator will create access to the lower floor level and the first floor, but there will be no intermediate access to the mezzanine level. He also noted that the toilet rooms at this level are 4 inches higher than the mezzanine level floor. Guthrie added that the existing toilet room at the first floor would be expanded to create an accessible unisex toilet room. The Petitioners noted that the next phase of the renovation will include the addition of accessible toilet rooms at the basement level as well. (Exhibit 1 and Testimony of Guthrie). 10)The Pulpit is 6 feet above the sanctuary level floor at the front of the Meetinghouse and is accessed via two sets of narrow stairs that flank each end of the pulpit. The Petitioners noted that the accessible space at the altar has the same liturgical importance and is used in equal measure to the pulpit. Barz- Snell noted that he did lead services from the pulpit for part of the time,but that a lot of the service is conducted from the accessible altar. The pulpit is also historic to the church, built in the 1870's. Barz- Snell noted that although the pulpit is occasionally used by parishioners during the service for readings, the church often uses a lectern at the floor level. (Exhibit I and Testimony of Barz-Snell). Analysis The Board established jurisdiction pursuant to 521 CMR 3.3.2, which states that, "[i]f the work performed, including the exempted work, amounts to 30% or more of the full and fair cash value (see 521 CMR 5.00)of the building the entire building is required to comply with 521 CMR." Since the proposed project will cost $940,000.00 and the assessed value of the building is$1,449,200.00,the entire building is required to comply in full with all applicable sections of 521 CMR. The first variance that the Petitioners sought was in regards to the six (6) entrances into the existing building (See Plan A101, AAB 23). Of the existing six entrances, Entrance 1 will be the primary accessible daily entrance to the building, which is accessed directly from the adjacent parking lot; Entrance 2 will also be a primary daily accessible entrance directly adjacent to the vehicular drop-off. With the proposed construction of the addition,Entrances 1 and 2 will be the primary entrances into the building and will create an accessible route to all levels of the church. Entrance 3 opens onto a stair landing at an intermediate level between floors. This historic entrance also has a 12 inch wide threshold at the doorway. The cost of creating access at this entrance is estimated at approximately $148,000.00 to create a 40 foot ramp, which would also block the existing drop-off area. Entrance 5 is an inaccessible entrance that enters into a stair landing at an intermediate level between floors. This historic entrance also has a 12 inch wide threshold at the doorway. Entrance 6 is an inaccessible doorway from egress stairway. All interior spaces adjacent to this entry are fully access via other routes from fully accessible entries. This entrance is primarily an egress door from an egress stairway. Guthrie stated that Entrance 6 is shown on Plan A101 (AAB23) and that space adjacent to Stair 2 is currently located directly adjacent to the minister's office which will remain in this location and is accessible from the interior. Barz- Snell stated that this entrance was more of an employee only entrance that was occasionally used, but added that he often meets with parishioners in the common areas within the church. Based on this information,the Board voted to grant the variances requested for Entrances 3, 4, 5 and 6. . The next variance sought by the Petitioners was in regards to 521 CMR 29.2.3, regarding the change in level between the sanctuary and the Organ Loft. The Organ Loft is reached via two sets of stairs from the Narthex. The seating within the Organ Loft represents less than 10% of the total seating at the Meetinghouse. The use of the loft is also generally limited to the holiday use by the choir, in contrast to their usual performance space at the front of the Meetinghouse. The Petitioners noted that the installation of a vertical wheelchair lift or LULA elevator would be an excessive cost without substantial benefit to persons with disabilities. Guthrie noted that the organist is a paid employee of the church and reiterated that the choir only used the loft on holidays. He added that because of the way that the balcony sits over the sanctuary, the balcony line extends into the sanctuary space, requiring that a lift would be installed within the sanctuary. Guthrie also clarified that there is tiered seating within the sanctuary, which is divided by the built-in organ bench, resulting in no clear path of travel between the two sides of the loft. Based on this information,the Board voted to grant the variance for the lack of access to the Organ Loft. The Petitioners also sought a variance for 521 CMR 29.2.3 regarding the lack of access to the Mezzanine. The Mezzanine is located at the mid-level between the narthex and the basement and is reached via stairs at Entrance 3 and 5 from the Narthex and basement levels. The Mezzanine is only used for storage,but does also have two toilet rooms that are available to the parishioners. Guthrie added that the new elevator will create access to the lower floor level and the first floor, but there will be no intermediate access to the mezzanine level.
