OBSERVATIONS:
1. Two plywood panels on Essex Street have been removed on
the ground floor to expose existing building to
determine the proper location for the granite panels.
2 . Power service to building is underway and the
transformer location has been selected. The transformer
shall be located at the rear of Endicott Center North.
3 . A temporary AC unit was on site and is scheduled to be
installed the week of 17 May 1992 . The location
selected by the contractor will be adjacent to the
intersection of the two story structure and the Endicott
building.
4 . Samples for the spandrel glass were approved and the
glass has been installed on the ground floor on the
Endicott Building.
5. Shop drawings and samples for the stucco facade have
been approved and fabrication is underway.
6 . The granite sample was approved and fabrication shall be
underway as soon as all the plywood is removed from the
ground floor.

1. The granite header over the windows shall be installed
as detailed.
2 . The granite pilaster returns at the windows shall vary
in depth due to the irregularities of the window
locations.
3 . The color of the banding above the windows on the ground
floor shall match the granite sample.
4. Masonry work shall begin the week of 15 May 1992 at the
lobby entry on Washington Street.
ITEMS TO VERIFY:
1. The color for the stucco band above the second floor
windows needs to be selected. Sample colors from the
stucco manufacturer are required.
2 . The decision needs to be made regarding the removal of
the protective plywood on the fifth and sixth floor
dormers.

OBSERVATIONS:
1. Exterior brick work at Lobby Area on Washington Street has
been completed.
2 . The vaults under the sidewalk on Essex Street for the
Massachusetts Electric Company transformers are installed.
3 . The primary conduit from the Mass Electric vault which will
feed the pad mounted transformer in the rear of the building
have been installed to a distance of 12 feet from the vault
wall in the basement.
4 . The concrete pad for the transformer in the rear of the
building has been placed and the conduit from the pad to the
building has been installed.
5. The 5 dormers on the North face of the building are underway
- and with some modification they will be ready for
caulking. The second dormer in from the right needs panel
adjustment at the lower portion of the face of the dormer,
the panel needs to be pushed in closer to the building
sheathing.

6. At the bottom of the dormer where the dormer face meets the
roof there is an area of exposed metal that needs to be
covered.
7 . The first low window on the bootery roof adjacent to the
sloping slate roof requires a piece of counter flashing.
8 . The roof supporting the scaffolding is experiencing damage to
the slate and some of the flashing.

1 . The roof dormers were complete ant the cornice at the roof
mansard was installed at West facade and portions of the South
facade.
2 . The preformed synthetic cement belt course and the column
capitals and bases were installed on the East and West facade.
3 . Granite installation was 85% complete at the South facade and
the East facade was underway.
4 . The granite color of the South facade is a mixture of warm and
cool tones.
5. The granite installer grouted the joint at the granite and
metal window intersection on the South facade of the building.
DIRECTIVES :
1. The grout must be removed at the joints where the granite
returns into the metal windows. The joint must be caulked
with sealant.
2 . The granite manufacturer should inspect the color of the
granite and respond to the color gradation.

Dear Roger:
This letter will summarize items you expressed concern alvout `'=
during our meeting at the subject building on May 21, 1991.
We verified and notified you by phone that the upper levels,
floors 2 thru 6 are designed for office occupancy with regards to
Live Load requirements of the Massachusetts State Building Code.
Any occupancy having less stringent load requirements would also
be acceptable..- i.e. residential or classroom loading.
The cracks 'that' have occurred ,in the floor slabs of the upper
levels are related to shrinkage stresses and are not the result of
any deficiencies in the' supporting members.
The new foundations have been installed in accordance with the
permit drawings prepared by this office.
The rusting of steel members that has occurred is superficial only
and has no affect on the strength of the steel.
The exterior walls have been designed.to be tied back in
accordance with the details on drawings prepared by this office.
Due to the termination of services, we never completed site
observations of the upper .levels to verify if tie backs were
properly installed.
We have not reviewed any reports from other consultants regarding
the building structure and cannot offer any comments at this time.
We would be pleased to provide further -services regarding the
structure at Endicott Place.

As the result of an inspection of the Endicott Center property at #100
Washington Street this date, the following was noted:
1. The fire alarm system appears to be working with the exception of
the zone for the sprinkler system which is not in service. The
fire alarm system is to be monitored by American Alarm and
Communication, Inc., a central station monitoring company from
Arlington. A test of the system was conducted, indicating that
the internal system was operating satisfactorily, but no signal
was received by the central station provider. This problem was
being investigated by the property manager at the time of the
inspection. _ Q
2. The sprinkler system is not fully completed and is thus not in
service. The water supply to the system is shut at the main �\
valve. The use of a fire department in the event of a fire in
this building would prove futile. Full sprinkler protection of p�
this property, as required by law, cannot be achieved without l\�
serious work being performed on the system.

An electrical inspection was made on October 9 , 1990 by my assist-
ant John Giardi at the above address .
The moisture problems in the cellar area has caused corrosive dam-
age to the electric service at this location . It is the recommendation
of the inspector that an in-depth inspection be made by a licensed e-
lectrician .
As you know, the electrical permit for this service was temporary
for only 90 days , the 90 days has been exceeded . No action has been
taken to fully repair and secure this building properly .
This condition is in direct violation of the Massachusetts Electric
Code , it allows its electrical equipment to be exposed to atmosphere con-
ditions (.high moisture) . This could cause failure of electrical protec-
tion devices .
If corrective steps are not taken within the next thirty days , I
will have no choice but to terminate the electric service in the in-
terest of public safety.

Dear Mr.Roth:
The following is to reaffirm the concerns of the City of Salem
Inspection Department that were expressed at our October 16, 1990 meeting
which was held in my office at One Salem Green.
1 , The water in the basement pit not only poses a problem in itself,
but is also affecting the electric system. _
2. The fact that the electric system is temporary and that the ninety
(90) days allowed for temporary systems has long expired.
3. The Fire Marshal 's concern that there is not full sprinkler protection
of the property as required by law.
4. The concern 's of the Plumbing Inspector regarding unplugged pipes
that are adding to the water problem and also allowing sewer gas to
enter the building.
5. The Building Department is concerned with the senerflex wall system
on the exterior of the building (manufacturer's specifications state
it should not remain unprotected for more that three (3) months) , we
are also concerned with the fact it is unattached to the building in
places.
The top three sections of the staging are not secured to the building.
The severe cracking of the new concrete floors. In -addition, the staging permit
and the building permit have expired and the bond terminates at the end of
November.

As per our arrangement, the staging will be removed and some method of
protecting the senerflex system from being a hazard to the public safety will be
provided no later than Friday, November 16, 1990.
The electric system will be addressed or terminated by Friday, November
16, 1990. All other concerns of the various City Departments will be addressed
no later than November 16, 1990.
Should this timetable not be met, I will have no recourse but to declare the
property a hazard to the public safety and welfare and enforce the General Laws of
the Commonwealth of Massachusetts, specifically CMR 780, Section 123, Unsafe
Structures
I must advise you that violations of the State Building Code are punishable
by a fine of not more than One Thousand dollars ($1 ,000) a day or imprisonment
for not more than one year, or both,for each violation, each day during which any
portion of a violation continues constitutes a separate offense.
This office, as well as all other offices involved, is available to
assist in any way we can to help resolve this matter.
Please send confirmation of our meeting scheduled for Monday, November
19, 1990 at 2:00 p.m. , in my office at One Salem Green.

• I represent Endicott Center Realty Trust, the owners
of the building at 234 Essex Street, Salem, Massachusetts.
( formerly known as the Kerr Building) The owner has
recently received a commitment to finance completion of the
building, however there are some issues regarding zoning
that must be resolved.
I have enclosed for your review a copy of the 1987
decision of the Board of Appeals grantingVariances for 234
Essex Street as well as for the adjacent building at 90
Washington Street. I have also enclosed copies of
contemporaneous separate decisions of the Planning Board
for each of 234 Essex Street and 90 Washington Street.
The decisions of the two Boards clearly indicate that
the former owners intended to develop each building as a
distinct component of a larger project. The Board of
Appeals decision clearly separates the variances that
relate to each property. Further, the Planning Board
actually issued separate decisions for each property. The
original plan was to add 'two stories to the building at 234
Esser Street and to use the building for commercial
purposes , With respect to 90 Washington Street, the intent
was to raze the existing building and construct a 6 story
building to house 69 residential units . As part of the
latter phase, the plans provided for the construction of a
facility consisting of 69 parking spaces .
As you know, the two floors were added to the building
at 234 Essex Street in accordance with the variances for

that property, but the building was never put into
service. No action was taken to exercise the rights with
respect to 90 Washington Street.
The present owner' now plans to construct 31 apartment
units in the building at 234 Essex Street, a use which is
allowed in the B75 Zoning district. The plan complies with
all of the requirements of the Zoning Ordinance, including
that for parking. My clients recently approached the
Building Inspector to discuss the issuance of a building
' permit, however, the inspector expressed some concern
relating to the variances granted for 90 Washington Street.
It is my opinion that the variances for the two
properties are distinct, that the rights granted with
respect to 234 Essex ,Street were properly exercised and
that the variances relating to 90 Washington Street were
abandoned. Accordingly, there should be no impediment to
the issuance of a building permit at 234 Essex Street, for
users permitted by the Zoning Ordinance.
! I would appreciate if if you could review this matter
at your earliest convenience and. advise me of the best
course of action to satisfy the concerns of the Building
Lnspector.

The Board of Appeal, after careful consideration of the evidence presented, and
after viewing the, plans, makes the following findings of facti
1 . The building is located, in the B-5 area;

2. Petitioners plans provide for sixty-nine (69) parking spaces in
surface and underground, parking;
3. It is impractical to maintain the entire existing structure and
provide on site parking due to the close proximity at the train
tunnel which runs under Washington Street;
4 . Construction as shown on the plans will retain and add to the
current retail activity and stimulate small businessess;
5. This project will provide for new business to locate in Salem and
the-efore create jobs;
6. This project will substantially increase the tax revenue on the
property; and
7. There was community support and petitions presented in favor.
On the basis of the above findings of fact, and on the evidence presented at
the hearing, the Board of Appeal concludes, as follows:
1 . Special conditions exist which especially affect this building but
do not affect the district generally;
2. Literal enforcement of the Ordinance would involve substantial
hardship to the petitioner;
3. The relief reqeusted can be granted without substantial detriment to
the public good and, without nullifying or substantially derogating
from the intent of 'the district or the purpose ofithe Ordinance.
Therefore, the .Zoning Board of Appeal voted unanimously, 5-0,� to grant the
Variance requested under the following terms and conditionsi
1 . Petitioner must include in the Condominium Documents the provisions
for the Condominium Association to purchase from the City of Salem
a minimum of thirty-five (35.) parking spaces at any municipal facility
2. Petitioners are to work closely with the Salem City Planner so that 1
he will approve the final plans for the street scape at the rear and
the side of the building other than Washington and Essex Sts. side;

3. Mall area as indicated by plans are to be opened to the public so as
to assure access from Washington St. to the public parking lot;
4. The City will not, now or ever, be responsible for rubbish and
trash removal;

5. If the City chooses to put a second tier for parking on the
Sewall Street parking lot, the developer will work with the City
Planner to arrange an agreement for the developer to help defray
the cost to the City of Salem;
6. Petitioner will provide sixty-nine (69) on site parking spaces
in accordance with the plans submitted to the Board;
7 . Petitioner will provide in the Condominium Documents for the parking
spaces to be non-severable from residential unit ownership;
8. Petitioner will comply with requirements of the Salem Fire Department;
9. Petitioner will obtain and comply with the requirements of all
building permits;
10. Construction shall be in accordance with the plans submitted to
the Board; and
11 . The building shall be numbered in accordance with regulations.

The Petitioner is presently the owner of the land and

Petitioner requested . and obtained from the Board of Appeal

(decision filed July 8 , 1986 and extended for six (6) months in
July, 1987 ) a variance from the minimum parking requirements in a
B-5 district .
For reasons beyond the control of Petitioner , the prior
owners of the parcel were unable to convey title until December ,
1986 . Due to the delay, resulting changes in financing, and
updated construction cost estimates , Petitioner determined that
rehabilitation of the "Foodland Building" was not feasible , such
that a new structure had to be designed for that portion of the
site . The !
previous plan submitted to the Board was based upon
• maintenance of the existing structure and as a result provision
of on-site parking under the existing structure was not possible
due to design problems and cost . 'The proposed plan, on the other
hand, is based upon renovation of the Kerr Building (with riew
construction of two additional floors ) , and demolition and
construction of a new building on the "Foodland" site.
Demolition of the "Foodland" portion of the existing structure
and construction of a new building reduces the design problems
and costs of on-site parking so that the new building can provide

for on-site parking.'
Since the new plan results in two buildings and financing
and condominium plans are based upon two buildings , the parcel is
divided into two 'lots and density and parking variances are
requested for each building as follows:

A. KERR BUILDING VARIANCES
• I . Maximum Lot Coverage (Table III Item 4 )
The proposed building plan is a combination of renovation
and new construction of two additional stories . The building
covers 91% of the lot ( 10 , 624 SF building footprint on 11 , 613 SF
lot) .
The ordinance allows 100% lot coverage for existing
buildings but only 50% lot coverage for new construction of

non-residential ,uses . Since the ordinance is silent as to which
is applicable in the instance of renovation of an existing
building with new construction of two additional floors , a

variance is required.
2 . Minimum Width of Side Yard (Table III Item 5)
The existing building abuts the lot lines and thus a
variance from the five ( 5) foot side yard regulation is required.
(Although no side yard is required for existing building, since

the ordinance is silent as to new construction of additional
floors , a variance is , requested) .
3 . Floor Area Ratio (Table III Item 10)
The floor area of the building is 45 , 688 SF and the lot area
is 11, 613 SF resulting in a ratio of 4 to 1 . Since a ratio of 3
to 1 is called for by the ordinance a variance is required.
(Again, although a ratio of 6 to 1 is provided for existing
buildings , this variance is requested because of new construction
of two additional floors .
The Kerr Building will not contain residential dwelling
units so that parking spaces are not required.

B . NEW BUILDING VARIANCES
1 . Minimum Lot Area per Dwelling Unit (Table III Item 2)
The new structure will contain 69 residential dwelling units
and thus require a lot 'containing 34 , 500 SF. ( 500 SF per
dwelling unit) . Since the lot contains 17 , 580 SF, a variance is
necessary.
(Note : The ground floor of the proposed structure will cover
5 , 974 SF on the 17 , 580 SF lot which meets the 50% lot coverage
requirement of Table III , Item 4 ) .
2 . , Minimum Width of Side Yard (Table III Item 5)
The new structure will abut side lines and thus a, variance
is required, from the 5 ' requirement for new construction.
3 . Maximum Height of Building (Table III Items 6 & 7 )
The new structure will be 81 feet high and consist of 8
stories and thus .variances are necessary for each of these height
regulations .
4 . Floor Area Ratio (Table III Item 10)
The structure will contain 94 , 685 SF of floor area
(excluding 21 , 500 SF of subsurface automobile parking) on a lot
area of 17 , 580 SF resulting in a ratio of 5 . 4 to 1 and thus
exceeding the 3 to 1 ratio required by the ordinance so that a
variance is necessary.
5 . Parking (Section VIZ C)
The building will contain 69 on-site parking spaces (surface
and subsurface) to accomodate 69 residential units . Since the
ordinance requires 1 . 5 spaces per unit (103 . 5 spaces) a variance
is required.

Due to the configuration of the multiple lots of this
• parcel , the pro!Cimity of buildings to the lot lines , the nature
of the existing buildings and proximity to the B & M train
tunnel , special conditions and circumstances exist which affect
the land and buildings so that literal enforcement of the
ordinance provisions would involve substantial financial hardship
to the Petitioner. The relief requested may be granted without
detriment to the public good and in keeping with the intent and
purpose of the ordinance and the City Master Plan in that the
development provides housing and commercial space which will
promote economic vitality and activity in the B-5 downtown
district .

Dear Mr . Munroe:
In regard to'Eidicott�Centel;please be advised that the Salem
Redevelopment Ailthority.,has-approved the temporary use of plywood
to cover the exposed columns on the building located on the corner
of Essex and Washington Street .
The plywood is a temporary measure and will be replaced with
granite slabs, as called for in the approved plans, once the
granite material has been cut and delivered. The owners of the
building are estimating an April delivery date.

Dear Mr. Baxter:
Based on the plan review held at this office on October 21, 1991 regarding
the proposed food establishment at 234 Essex Street, the Health Department
issues the following comments in accordance with the State Sanitary Code,
Chapter X "Minimum Sanitation Standards for Food Establishments", 105
CMR 590.000:
- Walls, floors and ceilings in food preparation, food storage warewashing
areas, and all walk-in refrigerators, dressing rooms, toilet rooms shall
be constructed of smooth non-absorbent easily cleanable surfaces. An
example is stainless steel, "glassboard" or equivalent material.
- All equipment and utensils to be constructed of stainless steel or an
equivalent smooth easily cleanable material. ' Equipment to be installed
with adequate space surrounding it to allow for regular, effective
cleaning.
- Accessible wall-hung handwashing sink(s) with liquid soap and paper towel
dispensers to be installed in each food preparation and warewashing area.
Sinks used for food preparation or for warewashing shall not be used for
washing of hands or for any other purpose. ,
- In new establishments'at least one (1) service sink or curbed cleaning
facility with a floor drain shall be provided and used for the cleaning
of mops or similar cleaning tools and for the disposal of mopwater.
Handwashing or warewashing facilities or food preparation sinks shall
not be used for this purpose under any circumstances.

— The installation of exposed horizontal utility service lines and pipes on the.
floor is prohibited. Exposed utility service lines and pipes shall be install—
ed in a. way that does not obstruct or prevent cleaning of the walls , floors and
ceilings.
All construction must meet the code, requirements set forth by the Building,
Fire , and Electrical Departments as well as the Health Department.
— Any changes of this proposed food establishment requires Board of Health
approval.
The Health Department appreciates your cooperation in this matter.
