Petition of FAR FROM THE TREE CIDER,requesting a Special Permit per Sec. 3.0 Tabk of Principal and
Accessory Use Regulations of the Salem Zoning Ordinance,in order to allow a brewery,distillery or winery and a
tasting room located at 209 ESSEX STREET(Map 35 Lot 241) (B-5 Zoning District).
A public hearing on the above Petition was opened on March 18,2015 pursuant to M.G.L Ch. 40A, § 11. The
beating was closed on that date with the following Salem Board of Appeals members present: Ms. Curran
(Chair),Mr. Copelas,Mr. Duffy and Mr. Tsitsinos (Alternate).
The Petitioner seeks a Special Permit from the provisions of Section 3.0 Table of Principal and Accessory Use
Regulations of the Salem Zoning Ordinance.
Statements of fact:
1. In the petition date-stamped March 4, 2015, the Petitioner requested a Special Permit per Section 3.0
Table of Prinapal and Acressory Use Regulations of the Salem Zoning Ordinance, in order to allow a
brewery,distillery or winery and a tasting room.
2. Denise and Al Snape, owners of Far From the Tree Cider,presented the petition.
3. The proposed winery and tasting room would occupy a total of 1,476 square feet.
4. In addition to an existing winery located at 102 Jackson Street, the winery at 209 Essex Street would
be used to ferment, hand bottle and distribute small batches of product. The tasting room would
provide public tours of traditional cider production, cider tasting, and retail sale of cider house related
merchandise and the sale of bottles of cider for off premise consumption.
5. Nearby city parking lots will provide parking spaces for this location as allowed in accordance with the
City of Salem Zoning Ordinance for this district.
6. It is estimated that daily water usage and disposal will increase by approximately 448 gallons per week
for washing glasses and public bathroom use.
7. Proposed hours of operation are Monday through Sunday 12pm-12am.
8. The requested relief,if granted,would allow the Petitioner to operate a brewery,winery,distillery with
a tasting room.
9. At the public hearing, seven (7) members of the public spoke in opposition to the petition. Three (3)
members of the public spoke in favor of the petition.

The Salem Board of Appeals, after careful consideration of the evidence presented at the public hearing,
and after thorough review of the petition, including the application narrative and plans, makes the
following findings:
Findings
1. The proposed brewery, distillery, winery and tasting room is will have a positive impact on the social,
economic or community needs served by the proposal.
2. There are no impacts on traffic flow and safety,including parking and loading.
3. The capacity of the utilities is not affected by the project.
4. There are no impacts on the natural environment,including drainage.
5. The proposal conforms to the existing neighborhood character.
6. The potential fiscal impact,including impact on the City tax base is positive.
On the basis of the above statements of facts and findings, the Salem Board of Appeals voted four (4) in
favor (Ms. Curran, Mr. Dionne, Mr. Copelas and Mr. Tsitsinos) and none (0) in opposed, to approve the
requested Special permit to allow a brewery, distillery, winery and tasting room, subject to the following
conditions,terms,and safeguards:
Standard Conditions:
1. The Petitioner shall comply with all city and state statutes, ordinances, codes and regulations.
2. All construction shall be done as per the plans and dimensions submitted to and approved by the
Building Commissioner
3. All requirements of the Salem Fire Department relative to smoke and fire safety shall be strictly
adhered to.
4. Petitioner shall obtain a building permit prior to beginning any construction.
5. A Certificate of Occupancy shall be obtained
6. A Certificate of Inspection shall be obtained.
7. Petitioner is to obtain approval from any City Board or Commission having jurisdiction including, but
not limited to,the Planning Board..
Special Conditions:
1. Hours of operation are Monday-Wednesday 4pm-8pm,Thursday 4pm-9pm, Friday 4pm-10pm
Saturday- Sunday 12pm-10pm. During October the hours operation will be Monday—Thursday
12pm-9pm and Friday-Sunday 12pm-10pm
2. The front entrance is the entrance and egress to the building and the side door will be an egress for
emergencies only.
3. Special Permit is limited to the current applicant, Far From the Tree Cider.

Dear Mr. Durand,
On September 22, 2014, the Salem Building Department conducted a periodic inspection of
Salem Cyberspace, the tenant at 209R Essex Street. Several areas of concern were identified.
The smoke/fire separation between the building mechanical/electrical area and the tenant space,
as well as the rear exit stairway does not appear to be complete.
The Emergency Egress lighting could not be conclusively tested because not all test-switch
locations were identified.
1. It is requested that a Code Review,prepared by a registered design professional, be
submitted to this office, addressing the issues noted above.
2. Submit a report by a licensed electrician, confirming that the emergency lighting system
is code compliant,has been tested, and that it performed as designed.
Please forward the requested documentation to the Salem Building Department, 120 Washington
Street, 3`d Floor, Salem,MA 01970,by October 31", 2014.
Failure to resolve the issues cited above will be construed as non-compliance and may result in the issue of
municipal tickets and fines as well as further enforcement actions. If you feel you are aggrieved by this order,

Dear Jim:
On Wednesday August 30th, I made a visit to the site to complete a visual review and inspection of
the work completed to date with the objective of determining what work, if any, remains to be
completed and/or corrected prior to issuance of the final Certificate of Occupancy.
The following is submitted to summarize our observations, items to verify and information or action
required. The items to verify, and information or actions required are indicated in italics below the
observations noted.
Exterior:
1. Exterior stairs on south side of building leading to Stair 2 & Hall:
a. Stair treads have been replaced with new 1x6 pressure treated lumber.
b. Existing 1x4 fir decking remains on landing.
c. Railing has been replaced and is set at only 30" above the leading edge of treads or
landing.
• Provide guard railings set at a minimum of 34" above leading edge of stair treads and
42" above landing level.
• Provide hand railings on both sides of stairs.
2. Exterior stairs on south side of building leading to Stair 3 & Hall:
a. Stair treads have been replaced with new Ix6 pressure treated lumber.
b. Railing has been replaced and is set at 36" above the leading edge of treads or landing. m
c. Areaway and steps down to basement below remains open and unprotected by railings. o
• Provide metal railings around opening with top railing set at a minimum of 34" above Q
grade. °

3. Exterior exit stair located on south side of building and leading from Unit 8 on second floor:
a. Guard rail at lower landing has been located at 40" above landing level, and lower stair
railing has been set at only 24" above leading edge of treads.
• Provide guard railings set at a minimum of 34" above leading edge of stair treads and
42" above landing level.
b. Stair railing at upper ran of stairs has been set at 35" to 36" above leading edge of treads.
c. Guard rails at upper landing have been located at 42" above landing level.

d. A 4x4 PT wood post supports one comer of the upper stair run, and is unbraced over its
height of 12'. The wood post appears to bear on an 8" diameter CIP concrete pier,
however the depth, footing size and bearing conditions are unknown and could not be
verified. 4x6 PT wood braces have been installed to support outer corner of upper landing
and at center of span of upper stair run. Diagonal braces are toe-nailed and anchored with
one lag bolt. The extent of blocking and solid wood framing in exterior walls to support the
braces could not be verified. The stair stringers have been overeat by as much as 1-1/2" at
both treads and risers, thereby reducing effective depth of the stringer to less than 5" in
most locations. Connecting devices at railings and guard rails could not be verified.
• As indicated on approved Shop Drawing Submittal #9904.6.1, the owner's structural
engineer shall provide confirmation that the foundations, structural framing, bracing
and anchoring has been constructed in accordance with the structural design and
applicable Code requirements, including loads on guard rails and handrails.
Basement:
L Ceiling in main boiler room (located under Stair 1 & Hall on first floor):
a. Some large voids in the 1 hour fire rated ceiling remain to be protected with 5/8 Type X
gypsum board, e.g. above water heater and at plumbing penetrations. Several smaller gaps
also remain to be protected with fire safng insulation.
• Provide and complete the required fire separation as indicated.
b. Electrical 'unction box cover on ceiling above boiler has not been installed.
• Comp)ete installation of junction box covers.
2. Access to all basement spaces is open and unrestricted.
• Access to all areas of the basement other than the Laundry Room shall be prohibited.
Install doors where missing and provide locks on all doors. Basement spaces greater
than 50 SF in area shall not be used for storage unless smoke partitions are constructed
as indicated.
3. A laundry room has been constructed in the space directly under Unit 4 Studio Apartment with
access and egress from Stairs 2 and 3. The space is sprinklered.
• Provide exit signs and emergency lighting to two means of egress from laundry room.
4. The small boiler room located generally under Unit 3 currently does not have a fire rated
ceiling installed, however, the space is sptiukletod.
• Provide and complete the required fire separation as indicated.
Attics:
1. Wood access panels (314" wood construction)have been constructed to close off openings to
the attic areas and have been secured in place. with screws in lien of the fire.rated doors as
directed. It is our understanding that these spaces have been fully sprinklered as indicated on
the Design Build Contractor's approved engineering drawings. In addition, it is our
understanding and belief that the partitions and ceilings separating the attic areas from adjacent
apartment units have been constructed to create continuity of fire separation to the underside of
roof sheathing or structure above as indicated on the Contract Documents. However, a visual
inspection of the interior of the attic spaces could not completed to verify these assumptions.
• Access panels to attic spaces are not required to be fire rated if all attic areas are trade
inaccessible and are not to be used for storage of any kind by the tenants or landlord,
and if the above assumptions are correct. Therefore, inspect all attic areas and provide
518" Type X gypsum and/or fire safing insulation to conceal any openings or voids
remaining in the fire separation assemblies. Confirm that all structural lumber and roof
framing has been protected with a 1 hour fire rated assembly as indicated.

• It is recommended that all wood access panels be replaced with fire rated solid core
wood doors secured in place with locks to prevent tampering and access from tenants.
Please provide a minimum of 72 hours notice prior to requesting our final inspection and
preparation of an affidavit vis-a-vis Control Construction Certification. Please do not hesitate to

On Wednesday August 30th, I made a visit to the site with our mechanical consultant, Steven Forte
of Forte Engineering, to complete a visual review and inspection of the sprinkler system work
completed to date with the objective of determining which units are ready for occupancy, and to
confirm what, if any additional work or remedial work will be required in order to bring the project
to 100% completion and ready for Certificate of Occupancy.
The following is submitted to summarize our observations, items to verify and information or action
required. Please note that the items to verify, and information or actions required are indicated in

Unit 7 1. The Dining/Living space on first floor has sidewall sprinkler heads located on
the south and west walls (at 90° to each other and too close to each other). This
may cause one head not to activate in the event of a fire.
• Design Build Contractor shall provide calculations to confirm the hydraulic
flow at these heads. One head will only be required on the south wall if the
hydraulic flow calculations indicate a coverage area of 16'-0" x 18'-0". If
two sprinkler heads are required to cover this area based on the hydraulic
calculations, both heads shall be positioned on the same and longest wall
(west wall) and positioned a minimum of 8'-0"feet on center.
2. A sprinkler head is missing in the entry vestibule on first floor.
• Install one sprinkler head in this area.
3. A sprinkler head was not installed in the Bath on first floor as indicated on the
approved Design/Build Engineering Drawings. However a sprinkler head is not
required in bathrooms under 55 SF in area.
4. Suspended acoustical tile ceilings above sprinkler heads in Kitchen area and
elsewhere have not been installed.
• Ceilings above all sprinkler heads shall be installed prior to approval of a
Certificate of Occupancy.
5. The Bedroom space on second floor has sidewall sprinkler heads located on the
south and west walls (at 90° to each other and too close to each other). This may
cause one head not to activate in the event of a fire.
• Design Build Contractor shall provide calculations to confirm the hydraulic
flow at these heads. One head will only be required on the south wall if the
hydraulic flow calculations indicate a coverage area of 16'-0" x 18'-0". If
two sprinkler heads are required to cover this area based on the hydraulic
calculations, both heads shall be positioned on the same and longest wall
(west wall) and positioned a minimum of 8'-O"feet on center.
6. A sprinkler head is missing in the Walk-In Closet on the second floor.
• Install one sprinkler head in this space.

A sprinkler head is required in this space because the closet is greater than 36"
in depth and exceeds 24 square feet in area.

Basement 1. Electrical Room on northwest corner of building has only 1 sprinkler head
where 2 are required due to size and configuration of room.
• Install additional sprinkler head as required.
2. Boiler Room has only 1 sprinkler head where 2 are required due to size of
room.
• Install additional sprinkler head as required.
3. Sprinkler head at bottom of Stair 2 is not perpendicular to ceiling.
• Adjust sprinkler head as required.
4. Recessed closet with framed opening located on north wall of laundry room is
not covered with a sprinkler head. No door has been installed at this closet.

installed. Otherwise, provide a new sprinkler head in this location.
5. The two spaces located on the north wall of the basement directly under the
entry hall Units 3 & 6 and under the Unit 3 studio apartment are not adequately
covered. Sprinkler heads are missing or inadequate.
• Install additional sprinkler heads as required in all spaces including closets
and recessed areas.
6. Crawl space located under Unit 7 has only two sprinkler heads. The dimensions
of the crawl space are approximately 16'-0" by 22'-0".
• Install 2 additional sprinkler head as required, located no more than 7'-6"
from any sidewall.

7. Size of sprinkler main at service entrance is 2" not 4" as indicated on the Riser
Detail, and not 3" as indicated on the basement sprinkler layout, per approved

Action Required'.
General Items to Verify and Information or Action Required:
1. After removal of sections of GWB ceilings and walls to complete sprinkler work as described
above, complete all patching, repairs and painting of all materials and finishes as required to
exactly match the prior existing and adjacent conditions.
2. Sprinkler heads in attic areas do not appear to be "dry-type" heads. Attic areas are not heated;
and sprinkler piping is not insulated. Therefore, provide dry-type heads as indicated on
approved Shop Drawings and insulate all exposed piping, and seal all penetrations through
attic walls.
3. Design Build Contractor shall revise and resubmit the As-Built Drawings including the
calculations for hydraulic flow and pressure for all as-built conditions.
I understand that the Design/Build Contractor (DCB) will be returning to the site immediately to
complete the above described work such that when the work is 100% complete, it will comply with
the requirements of the Massachusetts State Building Code. Please give the DBC a copy of this letter
and inform him that before a final sign-off and acceptance of the sprinkler system can be approved,
we will require written confirmation from the DBC stating that the above items are 100% complete,
fully tested and ready for "final inspection." and 4 copies of the "As-Built Drawings" including
hydraulic calculations as indicated herein. Please provide a minimum of 72 hours notice prior to
requesting our final inspection and preparation of an affidavit vis-a-vis Control Construction
Certification.

d. A 4x4 PT wood post supports one corner of the upper stair run, and is unbraced over its
height of 12'. The wood post appears to bear on an 8" diameter CIP concrete pier,
however the depth, footing size and bearing conditions are unknown and could not be
verified. 4x6 PT wood braces have been installed to support outer corner of upper landing
and at center of span of upper stair run. Diagonal braces are toe-nailed and anchored with
one lag bolt. The extent of blocking and solid wood framing in exterior walls to support the
braces could not be verified. The stair stringers have been overcut by as much as 1-1/2" at
both treads and risers, thereby reducing effective depth of the stringer to less than 5" in
most locations. Connecting devices at railings and guard rails could not be verified.
• As indicated on approved Shop Drawing Submittal #9904-6.1, the owner's structural
engineer shall provide confirmation that the foundations, structural framing, bracing
and anchoring has been constructed in accordance with the structural design and
applicable Code requirements, including loads on guard rails and handrails.
Basement:
1. Ceiling in main boiler room (located under Stair 1 & Hall on first floor):
a. Some large voids in the 1 hour fire rated ceiling remain to be protected with 5/8 Type X
gypsum board, e.g. above water heater and at plumbing penetrations. Several smaller gaps
also remain to be protected with fire sating insulation.
• Provide and complete the required fire separation as indicated.
b. Electrical junction box cover on ceiling above boiler has not been installed.
• Complete installation of junction box covers.
2. Access to all basement spaces is open and unrestricted.
• Access to all areas of the basement other than the Laundry Room shall be prohibited.
Install doors where missing and provide locks on all doors. Basement spaces greater
than 50 SF in area shall not be used for storage unless smoke partitions are constructed
as indicated.
3. A laundry room has been constructed in the space directly under Unit 4 Studio Apartment with
access and egress from Stairs 2 and 3. The space is sprinklered.
• Provide exit signs and emergency lighting to two means of egress from laundry room.
4. The small boiler room located generally under Unit 3 currently does not have a fire rated
ceiling installed, however, the space is sprinklered.
• Provide and complete the required fire separation as indicated.
Attics:
1. Wood access panels (3/4" wood construction) have been constructed to close off openings to
the attic areas and have been secured in place with screws in lieu of the fire rated doors as
directed. It is our understanding that these spaces have been fully sprinklered as indicated on
the Design Build Contractor's approved engineering drawings. In addition, it is our
understanding and belief that the partitions and ceilings separating the attic areas from adjacent
apartment units have been constructed to create continuity of fire separation to the underside of
roof sheathing or structure above as indicated on the Contract Documents. However, a visual
inspection of the interior of the attic spaces could not completed to verify these assumptions.
• Access panels to attic spaces are not required to be fire rated if all attic areas are made
inaccessible and are not to be used for storage of any kind by the tenants or landlord,
and if the above assumptions are correct. Therefore, inspect all attic areas and provide
5/8" Type X gypsum and/or fire safing insulation to conceal any openings or voids
remaining in the fire separation assemblies. Confirm that all structural lumber and roof
framing has been protected with a 1 hourfire rated assembly as indicated.

It is recommended that all wood access panels be replaced with fire rated solid core
wood doors secured in place with locks to prevent tampering and access from tenants.
Please provide a minimum of 72 hours notice prior to requesting our final inspection and

Inspection of the Sprinkler System Work
Dear Jim:
During our last meeting on Friday, June 23rd you requested that we schedule our final inspection of
the sprinkler system work during the week of June 25th. You indicated that the sprinkler work was
100% complete and ready for the Fire Department's inspection, that perhaps a few sprinkler heads
remained to be installed in the basement, but for all intents and purposes, we should complete our
inspection as soon as possible. Therefine"on Wednesday June 28th, our mechanical consultant
Steven Forte of Forte Engineering completed a visual review of the work completed to date. The
following is submitted to summarize his observations.
General Observations:
1. Contrary to our expectations, about 75% of the basement sprinkler heads have not been
installed.
2. Sprinkler heads have not been installed in the townhouse Unit 7.

3. Several of our observations made after our last site visit to inspect the sprinkler work remain
outstanding and have nct been addressed by the contractor, i.e. 1) heads sre missing in some. n
locations where soffits have been dropped or added, 2) some heads remain located in excess of

confirmed.
9. Unit 1.6: The side wall head positioned above the ship's ladder is located more than 10'-0"
away from the exterior wall.
10. Unit 16 bedroom: The side wall head is located where the ceiling begins to slope down toward
the exterior walls, and may not provide complete coverage to the under the sloped ceiling areas.
I understand that the design/build sprinkler contractor will be returning to the site to complete the
remaining work on Wednesday July 5th. Please give the contractor a copy of this letter and inform
him that before a final sign-off and acceptance of the sprinkler system can be approved, we will
need confirmation from him that the above items as well as all other remaining work requited for a
complete installation must be 100% complete, fully tested and ready for the Fire Department testing
prior to our return once again for the "final inspection." We will keep track of the additional time
required to complete these field visits and inspections and invoice you accordingly.

Background: In his letter, dated July 30, 2004, Mr. Thomas St. Pierre, Building Inspector for the
City of Salem, sent a letter to State Board of Building Regulations and Standards., in reference to
the following Sections of 780 CMR, Sixth Edition (the State Building Code), 705.3, for property
located at 90 Lafayette Street. A copy of said letter is made part of this decision.
The construction type of the subject building is 2A, and the use groups contained within are Mercantile
(M), Residential (R-2), and Storage (S-2).
Relief Requested: The Appellant requested relief in the form of a variance to allow the renovation of an
existing two-story building into a six-story building with a greater percentage of openings in the side
exterior walls that is allowed by the building code.
' Appellants:
The appellants testified that they are renovating an existing two-story building into a six-story building in
an urban setting where the exterior walls of the new building will be on the lot line. On one side, there is a
driveway between the buildings with a right of way that allows both buildings to use the driveway, so the
chance the adjacent building will be to the lot line is near zero.

The appellants testified that the window openings will have additional sprinkler protection with deluge
sprinkler heads. The percentage of openings they are seeking is about 10-15 % of the exterior wall.
The appellants testified that there is a party wall agreement with the adjacent building.

The building official was present at the hearing, and testified that he does not object to the granting of the

I am in receipt of the preliminary drawings for the proposed project on 90 Lafayette

signage
DRB Recommendation
At its meeting on December 3, 2014 the DRB voted unanimously to recommend
approval of erecting new proposed signage at 209 Essex Street, Rear (LEAP for
Education), conditional upon the applicant working with DRB Member Glenn
Kennedy to produce a graphical representation of the typeface on the proposed sign
board.
Staff Comment for December 10, 2014 SRA Meeting
The applicant, as requested, did work with DRB Member Glenn Kennedy and has
produced a graphical representation of the sign (enclosed). Both Kennedy and the
applicant propose using the scheme shown in "option B."
Proposal for December 3, 2014 DRB Meeting
The applicant proposes to remove an existing two part wall sign running vertical to
the left of a window. The new proposed signage will be the same dimensions (18.4
sq/ft total) as the existing sign(s), except that the background will be a turquoise
color, with raised simple black plastic letters reading "LEAP" (first sign), and "For
Education" (second sign).
The applicant also requests to mount a 13"x6' (6.6 sq/ft.) right angle sign, which was
approved in concept by this Board earlier in 2014. The new proposed sign will read
"LEAP" running vertically.
Enclosed are the applicant's sign permit application, a map noting the location of the
business, drawings, and a photo of existing conditions.

209 Essex Street, Rear (LEAP for Education): Discussion and vote on proposed
signage
DRB Recommendation
At its meeting on December 3, 2014 the DRB voted unanimously to recommend
approval of erecting new proposed signage at 209 Essex Street, Rear (LEAP for
Education), conditional upon the applicant working with DRB Member Glenn
Kennedy to produce a graphical representation of the typeface on the proposed sign
board.
Staff Comment for December 10, 2014 SRA Meeting
The applicant, as requested, did work with DRB Member Glenn Kennedy and has
produced a graphical representation of the sign (enclosed). Both Kennedy and the
applicant propose using the scheme shown in "option B."
Proposal for December 3, 2014 DRB Meeting
The applicant proposes to remove an existing two part wall sign running vertical to
the left of a window. The new proposed signage will be the same dimensions (18.4
sq/ft total) as the existing sign(s), except that the background will be a turquoise
color, with raised simple black plastic letters reading "LEAP" (first sign), and "For
Education" (second sign).
The applicant also requests to mount a 13"x6' (6.6 sq/ft.) right angle sign, which was
approved in concept by this Board earlier in 2014. The new proposed sign will read
"LEAP" running vertically.
Enclosed are the applicant's sign permit application, a map noting the location of the
business, drawings, and a photo of existing conditions.
